The bidder should have adequate in house testing facilities for conducting acceptance with the relevant IS specification and bidder should possess enhanced fabrication shop and full- fledged work shop for manufacturing / repairing/overhauling of the locomotive’s precise components. 5. The Manufacturer/supplier has to submit equipment construction record and engine building record at the time of delivery of machine. 6. All the parts catalogue of diesel engine, transmission & chassis, operation and maintenance manuals, shop manuals for complete equipment must be supplied in two sets along with the equipment. 7. One set of standard tools for the subject per locomotive must be supplied along with the equipment free of cost. The mandatory tools list is attached herewith under Clause (D). 8. The consumable spares / items for 2000 Hrs. of operation of each locomotive must be supplied along with the locomotive free of cost. The list of the spare parts is separately attached under Clause (D). 9. The bidder will have to submit recommended parts list for transmission, pneumatic system, and engine parts for 4000Hrs. of operation of locomotive. 10. Commissioning of the equipment and operating training to operators of GSECL at site should be provided by the party free of cost. 11. Inspection of the locomotive shall be carried out at manufacturer’s works before dispatch. 12. The party will have to provide Services of Service Engineer as & when required free of cost throughout service life of the machine. 13. Your offer should be submitted with all relevant documents in support of above qualifying requirements; otherwise offer is liable to be rejected.

(A) PRE QUALIFYING CRITERIA AND GENERAL CONDITIONS:

1. The bidder should be standing in market since more than Ten years and should have effective service network with force of expert well conversant Service Engineers in Gujarat state, so that in emergency cases Service Engineer should be easily accessible to attend emergency in short period.

2. The manufacturer/supplier should have supplied Diesel Hydraulic Shunting Twin power pack locomotive having capacity range of 800 HP or above to any Govt. /public sector/private sectors at least Ten numbers with in a period of last Two years, the documentary evidence/order copy is necessary for verification. The satisfactory performance report of locomotives from users for a period of minimum two years should be submitted along with the offer.

3. The manufacturer/supplier has to confirm that spare parts of the offered model will be available for more than 15 years.

4. The bidder should have adequate in house testing facilities for conducting acceptance with the relevant IS specification and bidder should possess enhanced fabrication shop and full-fledged work shop for manufacturing / repairing/overhauling of the locomotive’s precise components.

5. The Manufacturer/supplier has to submit equipment construction record and engine building record at the time of delivery of machine.

6. All the parts catalogue of diesel engine, transmission & chassis, operation and maintenance manuals, shop manuals for complete equipment must be supplied in two sets along with the equipment.

7. One set of standard tools for the subject per locomotive must be supplied along with the equipment free of cost. The mandatory tools list is attached herewith under Clause (D).

8. The consumable spares / items for 2000 Hrs. of operation of each locomotive must be supplied along with the locomotive free of cost. The list of the spare parts is separately attached under Clause (D).

9. The bidder will have to submit recommended parts list for transmission, pneumatic system, and engine parts for 4000Hrs. of operation of locomotive.

10. Commissioning of the equipment and operating training to operators of GSECL at site should be provided by the party free of cost.

11. Inspection of the locomotive shall be carried out at manufacturer’s works before dispatch.

12. The party will have to provide Services of Service Engineer as & when required free of cost throughout service life of the machine.

13. Your offer should be submitted with all relevant documents in support of above qualifying requirements; otherwise offer is liable to be rejected.

14. The Bidder will have to submit the test certificates of main/sub-assemblies i.e. engine,

Transmission. WAFD, Reservoir Tank, suspension springs, air compressor and material certificates of gears, pinions, axles, propeller shaft, couplers, gear boxes and main frames etc. during pre-dispatch inspection of the locomotive. The complete locomotive should be approved by RDSO of India.

15. Vendor registration is not mandatory for tendered item of this tender.

16. GUARANTEE / WARRANTEE:

The supplied locomotives and its spare parts should be covered GUARANTEE/ WARRANTEE against faulty material and workmanship for the period of 12 (Twelve) Months or 4000 Hrs of operation whichever is earlier from the date of commissioning at site.

(C) General Specifications:

1. MAIN FRAME: Mainframe should comprise of heavy deck plate on two thick longitudinal members running full length of the locomotive between two buffer beams. Cross section stretchers and reinforcements should be provided at bogie center pivots, power unit mountings and other important points. The complete frame should be of welded construction to give good torsional stability and resistance to impact and bending respectively. Provision should be given for lifting of complete locomotive with its super structure and equipment and also for lifting the body of the locomotive by means of high lift jacks. The front and rear guard should have pocket type construction from heavy plates. Heavy plate buffer beams and robust coupler pockets should be provided at each end.

2. BOGIE The main frame should be supported on two numbers of two axle bogies. The bogie frame should be of welded construction from heavy steel plates and having single stage suspension consisting of coil springs designed to ensure satisfactory riding of the locomotive up to the maximum specified operating speeds.

3. WHEELS Wheels should be of rolled steel solid type. The tread flange contour should be as per

Indian Railway standards and suitable for shunting application. The provision should be made on wheel hub for its easy extraction from axle by oil injection pump.

4. AXLES Axles should be of high grade steel forgings, heat treated appropriately, ultrasonically tested and finish machined all over which seats the driving gear, wheels, axle journals and bearings areas finished by grinding and should be designed to withstand heavy impact load and bending stresses.

5. AXLE BOXES Grease lubricated heavy duty roller bearings should be located in robust cast steel housings with renewable wear resistant steel liners bearing against similar liners on bogie horns. The axle boxes should be designed to withstand the heavy jerks.

6. SUSPENSION The suspension arrangement should be coil springs type mounted on each axle box. The springs should be designed to ensure satisfactory riding of the locomotive.

7. COUPLING ARRANGEMENT The coupling arrangement should be designed for shunting application and handling of coal wagons and oil tankers of Indian Railway.

8. OPERATOR CABIN The operator’s cabin shall be of steel fabricated construction and shall ensure good visibility to the maximum extent possible and enabling driving of the locomotive in either direction of travel without having to turn the locomotive. The Front, rear look out window and entrance door shall be fixed plate glass type sets in sun and heat resisting synthetic rubber section and should be large enough for all round visibility with provision to drive in monsoon also. Heavy duty sliding window shall be provided on cabin side walls. The necessary insulation and ventilation to the driver’s cabin shall be provided to suit the site condition. Operator cabin fan should also be provided. Upholstered adjustable seats shall be provided in the cabin for the operator.

9. ENGINE COMPARTMENT The engine compartment and equipment compartment shall have hood type structure with running board on either side and should be thoroughly braced and firmly secured to the frame. The engine and equipment compartments should be equipped with large removable service hatches on roof and doors to provide adequate access for repair and maintenance of the equipment. The sides doors should have robust construction secured by lose pin

hinges so that they can be easily removed. The machine should have walkway of adequate width with Non-skid steel plates fixed on the deck plate around the hood compartment

10. HAND RAIL & FOOT STEPS Suitable hand rails should be provided along the sides of the hood, across ends and near

footsteps to ensure safety of operating personnel. The Footsteps should be fabricated from non-skid plates and should be provided at four corners of the frame and near entrance doors where necessary.

11. COMPRESSOR The locomotive should be equipped with TRC1000B air compressors and engine mounted

Air compressors having adequate capacity with an unloader, intake filters and air reservoirs of ample capacity to meet the requirements of brake system, Horns, controls, wind screen wipers etc.

12. BRAKE The locomotive should be equipped with air brake system with suitably designed brake rigging. All wheels of the Locomotives should be braked and the brake shoes shall be of Ferrodo. Additionally, the locomotive should be equipped with Air brake system for trailing load. The location of the brake valve should be either side of desk board in corner of operator cabin and in front of operator’s sheet Slack adjusters should have designed for adjustment of brakes to take care of the wear on brake block and to maintain effective braking on the locomotive.

13. PARKING BRAKE The locomotive should be equipped with suitable parking brake operated from the cab for holding the vehicle on gradients during parking.

14. WIND-SCREEN WIPERS Heavy duty pneumatically operated wind-screen wipers should have provided for front and rear look-out fixed windows.

15. WARNING HORNS The machine should have Pneumatic horns operatable from either side of the control desk.

16. FUEL TANK Fuel Tank should have fabricated from heavy gauge steel with ample baffles as provision against surge. The locomotive should be equipped with interconnected two fuel tank situated at both end in front of engine The tank should facilitated with the mechanical as well as gauge glass and shall have provision of Filling points.

17. BATTERY HOUSING The batteries should be housed in a fabricated steel box, suitably located for inspection and topping up together with adequate ventilation and drainage.

18. FIRE EXTINGUISHER A fire extinguisher of dry powder CO2 cartridge type should be provided in the driver’s cabin.

19. POWER PACK AND CONTROLS i) DIESEL ENGINE The locomotive should be fitted with two nos. Cummins make diesel engine model NTA 855L (Big Cam) ii) FINAL DRIVE UNITS. The final axle drives should be heavy duty having robust construction, and should design for long and trouble free shunting applications. The drive should incorporate helical / spur pair and a spiral bevel pair. The pinion, Gears should be designed for heavy duty application. High quality alloy steel ultrasonically sound forging should be used for gears to ensure long and trouble-free service. Helical/spur gears shall have case carburized, hardened and ground, bevel gears should case carburized, hardened and lapped. The final drives should be coupled to the transmission by means of cardan shafts having adequate strength.

iii) COOLING Cooling equipment should be of adequate capacity, designed for the most adverse ambient temperature prevailing in tropical places is fitted.

20. CONTROL EQUIPMENT & INSTRUMENTS

Adequate control including gauges, instruments and safety devise should be provided for safe and satisfactory operation. The equipment should so arranged on the desk that it will be within easy reach and sight of the driver from both driving positions. The locomotive should be equipped with following controls, gauges and safety devices.

21. ELECTRICAL EQUIPMENT

The locomotive should be equipped with 24 Volt DC electric systems complete with batteries; alternator, starter motor, Head lights on either, cabin lights, engine compartment lights and should have provision of 24Volt plugs inside the engine compartment. The Electrical equipment consists of:

(E) General Terms and Conditions and Notes:

Conditions mentioned here under shall override similar conditions mentioned in ‘General Commercial Terms and condition Or else where

1. You shall have to accept GSECL's Standard Payment Terms i.e. 80% against TRC within 30 days and balance against S.R. Note within 45 days from the date of receipt of materials at site in good condition. No advance will be paid by the GSECL. Payment will be effected through RTGS/NEFT system of Banks. Hence you are requested to furnish details as: 1) Account Number 2) Type of Account 3) Bank Name 4) Branch Name and address 5) ContactnumberofBranch6) IFSC No.

2. Pl. mentioned clearly all taxes till destination in detail with scope.

3. You shall have to agree for penalty if the supply is made outside the agreed delivery as per GSECL's rules which are applicable to our Customers. Any delay that may take place in supply and/or erection, testing and commissioning activities beyond contractual cut ‘off date/stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate of 1/2% of the contract price/order price per week or part thereof subject to a maximum of 10% of the total contract value/order value (i.e. End Cost including taxes & duties).

4. Delivery Period: We require the materials within 16 Months please offer your minimum delivery period for supply.

5. Your offer should be valid for a minimum period of 120 days from the date of opening of the Bid.

6. Excise Duty: Clause No.18 of Commercial terms and condition is revised as under: The Ex-works Prices are exclusive of Excise Duty, which will be paid extra, as applicable, on a given excisable goods, within the original contractual delivery period. The current rate of Central Excise Duty (CENVAT) is 12.5%.

If there is any increase or decrease in statutory Rate of CENVAT, you will accordingly charge Central Excise Duty, at increased or decreased CENVAT Rate and the GSECL will reimburse the Tax accordingly.

However, you shall have to submit a Self-Declared Certificate, by your Authorized Signatory, certifying that you have not claimed Refund of any Central Excise Duty, charged to GSECL or shall not claim any such Refund, on a future date, from the concerned Central Excise Authorities and if, any Refund, in respect of such Central Excise Duty, is claimed, it will be immediately passed on to the GSECL, without GSECL making any specific Claim, for the same, either from the Department or from you.

7. Please refer clauses of commercial terms for submission of EMD/SD/PBG and note the following: For submission of EMD/SD/PBG the GSECL will accept the bank guarantees, if the guarantees are issued by following banks a) All Nationalize banks including the public Sector Bank, ie, IDBI Ltd.

The Bank Guarantee covering execution of the contract will be returned only on successful Execution of contract and on receipt of the bank guarantee towards warrantee/guarantee where ever applicable.

I. EMD: Party have to pay EMD Rs. 2,90,390.00 @1% of estimate value. The EMD is

payable by Demand Draft in favour of the Gujarat State Electricity Corporation Limited

on any Scheduled / Nationalized Banks payable at Vadodara. or it should be partially

(50%) by DD in favour of Gujarat State Electricity Corporation Ltd on any Scheduled

Bank in Vadodara and balance 50% by Bank Guarantee from any Scheduled /

Nationalized Banks listed above (Format given in this tender document). Cheques are

not acceptable.

Small, cottage & tiny Industrial units registered under Small Scale Industries of Gujarat State & holding subsequent registration with CSPO/NSIC/DGS&D registration will, however, be considered for exemption from payment of EMD subject to furnishing of the authenticated notary certified copy of the certificate of Registration with Small Scale Industries/NSIC. The SSI/NSIC certificate should indicate the manufacture of items offered under this tender. Provisional SSI/NSIC Registration Certificates are NOT allowed.

II. Security Deposit Clause No:12 (Commercial terms/conditions): Successful Bidder has to submit security deposit 10% of the order value ( End Cost value) before placement of order. Detailed order will be placed only after submission and verification of security deposit. Other contains remain same.

III. As per GUVNL circular No. GUVNL/Tech/2040, Dtd.03.10.2013, the exemption in

payment of EMD and relaxation in payment of Performance Guarantee towards execution period (Security Deposit) and towards Guarantee/warrantee period shall be given to Small, Cottage & Tiny industrial Units registered under Small Scale Industries of Gujarat State and holding subsequent registration with CSPO/NSIC/DGS&D registration certificates for the ITEMS under the tender.

The relaxation will be subject to furnishing of the authenticated notary certified copy of the certificate of Registration with Small Scale Industries/NSIC. Accordingly, Performance Guarantee Clause No. 46, is modified as under. “The successful bidder shall have to submit the performance guarantee in the form of Bank Guarantee to cover the entire execution and Guarantee period wherever applicable for the items to be purchased, as tabulated hereunder. The Performance Bank Guarantee covering the execution of the contract will be returned ONLY on successful execution of the contract and on receipt of the Bank Guarantee towards Warrantee, whereas the Bank Guarantee towards warranty will be retained till completion of the Guarantee period. These Bank Guarantees shall be applicable for all the bidders irrespective whether they are SSI/NSIC units.” The above Performance Guarantee, to be submitted by successful tenderer towards execution period, is for the satisfactory execution of the contract. Whereas the Performance guarantee, to be submitted by successful tenderer, towards guarantee/warrantee is for satisfactory performance of the materials which should be validity for period as per clause No.16 of Guarantee / Warrantee of Pre-Qualification Criteria. However, in case of expiry of PG before the said period the same should be got extended / renewed till the completion of said period by the Tenderer at least one month before the expiry of the validity failing which GSECL will be at liberty to encash the same, without entering into further correspondence, formalities, etc. in the matter.

Bidders with Small, Cottage and tiny Industrial units of Gujarat State, shall have to submit performance bank guarantee amount / BG towards execution of supply within 30 (thirty days) from the date of order. The Performance Guarantee towards execution submitted should cover the complete execution period specified in the order with a 3 month extra validity period. The bank guarantee towards execution of contract shall be kept live till the submission of bank guarantee towards equipment warranty. Performance bank guarantee towards equipment warranty (amount / BG) shall have to be submitted prior to the last stage of supply.

For all the cases the, Performance Guarantee amount will have to be paid either in the form of Bank Guarantees / Demand Draft. The Performance Guarantee submitted should be for the full period which covers complete execution period (including acceptance of materials) & for full Guarantee Period. Further performance Guarantee should have clear onetime validity for the full period. However, in case of expiry of BG before the required completion of Guarantee Period, the same should be got extended / renewed, at least one month before it’s expiry, till the completion of execution / Guarantee Period, by the bidder. Performance Bank Guarantee 10% of the order value (End cost) shall be submitted before completion of last stage of supply & before expiring of Security deposit BG.

8. Party has to pay Tender Fee Rs.7500/- (Rupees Seven thousand Five hundred ) (Non Refundable) by way of Demand Draft in favour of Gujarat State Electricity Corporation Ltd, payable at Vadodara.

9. GUARANTEE / WARRANTEE: The supplied locomotives and its spare parts should covered GUARANTEE/ WARRANTEE against faulty material and workmanship for the period of 12 (Twelve) Months or 4000 Hrs of operation whichever is earlier from the date of commissioning at site.

10. GSECL reserves the rights to accept / reject and reduce / enhance quantities of spares without assigning any reason and same will be binding to all bidders.

11. REPEAT/ADDITIONAL ORDERS: The GSECL reserves the right to place repeat orders / additional orders on the successful tendered up to 50% of the original quantity of the A/T at the same prices terms and conditions stipulated in the original contract within 3 to 4 months from the date of receipt of order. In special circumstances the GSECL will reserve the right to place repeat order / additional order up to 100% quantity mutually agreed upon.

12. Please submit latest order copy of indented items supplied to GSECL and other Govt. /Semi.Govt. Organizations/PSU/Power Generating companies etc. Along with your offer.

13. GSECL reserves the right to terminate the Contract (i.e. Purchase order) at any time, without assigning any reasons, whatsoever, by giving a notice period of ONE month from the date of Notice of termination of the Contract. Suppliers will not be entitled for any compensations / damages / losses, whatsoever, on account of such termination of the Contract.

14. Pre dispatch Inspection Clause applicable for this Tender as per clause No. 55 of Commercial Terms and condition and as per Prequalifying and General condition criteria Point no. 11.

15. You shall have to submit the technical leaflet & literature/catalogues along with the Technical Bid.

16. You should submit Material Test Certificate along with supply.

17. Statutory Variation:

Any statutory increase or decrease in the above taxes/duties, if it takes place within the original contractual delivery date will be to the GSECL’s accounts, subject to the claim being supported by documentary evidence. However, if any decrease in the above takes place after the contractual delivery date the advantage will be passed on to the GSECL

18. Purchase Agreement: - The supplier shall have to enter into a `Purchase Agreement’’ with GSECL. This purchase Agreement has to be executed on Non-Judicial stamp paper of Rs.100/- duly notarized. The cost of Non judicial stamp & Notary charges will be borne by supplier. Format for the Agreement is attached herewith. Being a proprietary firm, the proprietor himself should execute & sign the agreement and his full residential address must be available in the record document. Statutory evidence (Aadhar Card / Voter card) of the person signing the agreement should accompany the agreement. Upon submission of Performance Bank Guarantee towards execution of contract against LOI and signing of Agreement, GSECL shall issue a detailed A/T / Purchase order incorporating various terms and conditions.

19. ARBITRATION: [A]: Arbitration clause for supply orders/tenders:- “All questions, disputes or differences whatsoever which may at any time arise between the parties to this agreement touching the agreement or subject matter thereof, arising out or in relation there to and whether as to construction or otherwise shall be referred to the decision of the Sole Arbitrator, appointed by the Chairman and MD, GSECL, for that purpose, who shall be a retired High Court Judge or retired District and Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties. Reference to the arbitrator shall be governed by the provisions of the Arbitration & Conciliation Act, 1996 as amended from time to time and the rules made there under. The Arbitration proceedings shall be conducted at HO GSECL, Vadodara or at such places as the Sole Arbitrator may be determined. The award of Sole Arbitrator shall be final and binding upon the parties.”

[B]: Arbitration clause for indivisible: combined supply and works orders/tenders:

“ All questions, disputes or differences, whatsoever, which may at any time arise between the parties to this contract in connection with the contract or any mater arising out of or in relation thereto, shall be referred to the Gujarat Public Works Contract Dispute Arbitration Tribunal Act,1992”.In case ,where divisible orders for supply and works are placed instead of indivisible supply and works order, the arbitration clause for such divisible supply order shall be as per [A] above and for divisible work order, the Arbitration clause shall be as per [B] above.

20. JURISDICTION: All questions, disputes or differences arising under out of or in connection with the Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender / Acceptance of tender is issued, is situated.

21. The undersigned reserves the right to reject any or all the quotations without assigning any reasons.
