Detailed specifications of the generator to be installed are furnished hereunder. Sealed tenders / quotations to be dropped in the tender box provided in the office of Telangana Grameena Bank Head Office, Hyderabad, on before 15.07.2016, 3:00

Item :

Supplying, installation, running and maintenance of diesel operated DIESEL GENSET of capacity not less than 75 KVA capacities with all the accessories. The scope of supply includes the following:

1. Co-ordination with EB (State Electricity Board). 2. Electrical Inspectorate approval. 3. The DG set should comply with the central pollution control board norms. 4. Provision of Generator panel board, MCCB. 5. Cables connected from Generator to change over panel Board.

Quoted rate should include for lubricants, repairs, Genset power panel, operator salaries, cost of generator panel boards, connecting wires, anti-vibration springs/mountings, silencers, all types of running lubricants. The cost of special type of foundations (if necessary) shall have to be borne by the vendor / supplier only. Electrical start with sound proof canopy facility of approved make or reputed make should be provided. WATT-HOUR meter has to be fixed and should be ENSURED in working condition all the times. The vendor should visit the branch/Place before quoting the rate to know the actual site conditions.

THE COST OF THE DIESEL SHALL BE REIMBURSED BY THE DEPT BASED ON ACTUAL CONSUMPTION OR THEORETICAL CONSUMPTION WHICHEVER IS LESS. QUOTED RATE SHOULD EXCLUDE THE COST OF DIESEL CONSUMED FOR OPERATION.

ELIGIBILITY CRITERIA

The eligibility criteria of contractors are as under:-

1. The applicants should have given on hire

Three nos of capacity 30 KVA and above

or

Two nos of capacity 62.5 KVA and above

or

One no of capacity 100 KVA and above

of the DIESEL GENERATOR sets of respective capacities for at least 1 year

min (in the last 3 years) to Govt. Departments / PSUs / Banks / Reputed

Corporate Offices/ IT, Pharma & Chemical Industries.

2. Average annual financial turnover during the last 3 years ending 31st

march 2016 should be minimum Rs. 5.0 Lakhs. Contractor should

provide copy of audited annual Report (Balance Sheet and Profit &

Loss Account) of last 3 years.

3. The applicant should submit the work completion certificates. Work

orders will not be accepted.

4. Original invoice of the new generator is to be submitted for verification.

5. Should have ESI, PF registration and Labour license for the state of

Telangana.

6. Tenders not meeting the eligibility criteria will be rejected

7. The decision of the tender opening committee in this regard will be final

and no further communication will be made from bank’s side

DETAILS OF WORK AND TERMS & CONDITIONS FOR DG SET HIRING AT

RACPC & REGIONAL OFFICE-2, HYDERABAD

Scope of work:

1. Generator power is required only in the absence of EB power (Partly or fully).

2. Generator services should be provided as and when required by bank (including holidays).

3. Operator services must be available during working hours.

4. Minor electrical works of lighting and power within the premises of Telangana Grameena Bank Hyderabad, RACPC & REGIONAL OFFICE-2, Hyderabad should

be taken up by operator.

5. The Lubricants, spares, fittings and repairs, replacement of any damaged parts and maintenance shall be the responsibility of the Generator supplier.

6. In the event of shifting of one or more offices or floors by the Bank on a future date, revised monthly hiring charges of the Generator shall be calculated proportionately based on the revised load. Vendor will have liberty to replace with the suitable capacity of new generator for such revised loads.

7. In the event of any breakdown of the Generator, supplier should provide alternate Generator within reasonable period, not exceeding one day.

8. The rate quoted in the quotation is valid for Five years.

9. The quoted rate should be inclusive of all taxes, deductions at source if any, shall be made in the monthly payments.

10. All approvals from Electrical Inspectorate and Central pollution control board to be obtained by the supplier of Diesel Genset

11. A log-book of the Generator has to be maintained all the time indicating the hours of working, fuel consumed, etc.

12. Suitable area for erection or installation of the generator shall be earmarked in our premises.

13. Generator services will not be accepted if found unsatisfactory and contract will be terminated with immediate notice from bank.

14. All the employees should be covered with P.F./minimum wages, as per labour laws. All the rules and regulations as per the extant guidelines of labour department are to be followed.

GENERAL CONDITIONS. 1. (a)The contractor shall ensure that no person of doubtful character is in any

way associated with the contractor. The contractor shall employ only qualified representatives with proper and adequate authorization to deal with the RACPC & REGIONAL OFFICE-2, Hyderabad whose name shall have to be communicated in writing to the RACPC & REGIONAL OFFICE-2, Hyderabad and approved by him to supervise the service contract work. Any written order or instructions given to the representative shall be deemed to have been given to the contractor.

(b) The contractor shall apply in writing for the issue of security passes and shall submit a list of personnel concerned and shall satisfy the banks authorities who shall at their discretion have their right to recommend for issue of passes to control admission of contractor, his agents, his staff and workmen. The cost of photographs if required for the pass will be borne by the contractor. Passes shall be deposited with the premises authorities on demand and in any case immediately after completion and or termination of the contract. The contractor, his staff and workmen shall observe all the extant rules formulated by the banks authorities i.e. prohibition of smoking in fire prone areas. Non-adherence to the rules laid down by the authorities shall make the contractor/his representative liable for expulsion from the site without assigning any reason whatsoever and the contractor shall have no claim in this regard. The employees of contractor will also be liable to be frisked by the banks security staff and any resistance in this regard would render the contract to be terminated solely at the bank’s discretion.

2. The watch and ward of the plant equipment and control connected with the above shall be responsibility of the contractor.

3. The contractor shall on request of bank’s authority forthwith remove from the work: Any person employed thereon by him who in opinion of the bank had committed misconducts himself or misbehaved or is doubtful character. Such person shall not again be employed on the works without the prior permission of the bank’s authorities.

4. The contractor shall adhere while execution of the contract to the relevant safety standards/codes of safety of ISI for various works. In the absence of such codes of practices, the contractor shall adhere to such safety measures as directed by the bank’s authorities.

5. The whole of the work included in the contract shall be executed by the contractor who shall not directly or indirectly transfer, assign or sub-let the contract to any part thereof no undertaking shall relieve the contractor from the full responsibility of the contractor.

6. The contractor should submit an amount equal to two times, the quoted monthly contract value in the form of Demand Draft in favor of Telangana Grameena Bank, head office towards the security deposit against the contract

by the contractor after award of the work within fifteen days. The amount of security deposit shall be refunded within sixty days of the termination of the contract and proper handing over the complete installation to the bank’s authorities.

7. Monthly bill shall be payable within 2 weeks from the date of submission of bills enclosed with a certificate from the bank’s engineer, that the work had been completed.

8. The contract can be terminated by Telangana Grameena Bank only by giving

three months notice. The contractor shall not remove from site any equipment, tools and material brought for the purpose of work without permission of bank’s authorities.

9. No spares shall be moved out of the premises without permission of the bank’s authorities.

10. Fair wages shall be paid by the contractor to the staff laborers as per the State/Central Government Labour Law in force and as may be amended from time to time during validity of this contract during this is alive. The Bank reserves the right to pursue relevant records of the contractors in order to satisfy that the requirements under the applicable labour laws are being fulfilled.

11. The labour/ workers employed by the contractor shall be recovered by proper insurance cover at his/their own cost to take care of the risk involved in working in the multi-storied buildings.

12. Law shall also subject to the provision and obligations impose the employment of all the laborers and the State/Central Government may amend as from time to time.

13. If the Bank happens to suffer any loss or to face any action or inaction on the part of the contractor(s) or his / their laborers/employees, the contractor (s) without demur and on demand by the bank shall indemnify the bank, at his/their own risk and cost.

14. The contractor before taking the operation and maintenance contract shall satisfy themselves that the entire installation is in order.

15. The contractor is agreeable to recover Rs.200/- () per shift (8 hours) per person in case of absence from duties.

16. The courts of Hyderabad district of Telangana alone shall have jurisdiction in respect of any dispute relation to his agreement.

18. Any minor repairs are to be attended within two hours failing which the total cost of the repair will be deducted from the contractor.

19. Any major repairs are to be attended within 24 hours failing which the total cost of the repair not exceeding Rs.10, 000/- will be deduced from the contractor’s bill.

20. The contractor should possess valid labour license code for Service tax, Provident Fund and ESI. The contractor shall pay the Minimum Wages as per Statutory Regulations/Rules as in vogue.(Copy of the ORDER from Chief Labour Commissioner enclosed).

21. The contractor shall also comply with the provision of the following. 1. Minimum Wages Act 2. Payment of wages Act 3. Payment of Bonus Act 4. Workmen compensation Act 5. Equal Remuneration Act 6. Insurance cover to the workmen/ staff 7. Employees provident fund scheme. 8. ESI Act and Rules there under.

THE PAYMENT WILL BE REGULATED AS PAYABLE TO SKILLED LABOR AS PER LATEST NOTIFICATION ISSUED BY REGIONAL LABOUR COMMISSINOR (E).

TERMS AND CONDITIONS:

Sealed tenders in two bid system for HIRING OF BRAND NEW 75 KVA (3- phase) GENERATOR WITH ACOUSTIC ENCLOSURE AND OPERATOR FOR RACPC & REGIONAL OFFICE-2, HYDERABAD are invited from the Manufactures / approved dealers of reputed brands only. General conditions are as under

1. In case any contractor who is not manufacturer / approved dealer of reputed brands / without prior experience but still quotes for the work job, the tender will not be considered even after the tenders are opened and the firm stands L1.

2. The contractors should quote in figures as well as in the words the rates, and amount tenders by them. The amount for each item should be worked out and the requisite totals given. Rates quoted by the contractor in figures and words shall be accurately filled in so that there is no discrepancy in the rates figures and words. However, if a discrepancy is found, the rates which correspond with the amount in words shall be taken as correct. If the contractor does not work out the amount of an item or does not correspondent with the rate written either in figure or in words then the rates quoted by the contractor in words shall be taken as correct. Where the rates quoted by the contractor in figures and in words tally but the amount is not worked out correctly, then the rates quoted by the contractor will be taken as correct and not the amount.

3. The tender document must be filled in English and all the entries must be made by the hand and Written in ink. If any of the documents are missing or un-signed, the tender shall be considered invalid.

4. The acceptance of a tender will rest with the Competent Authority, who does not bind himself to accept the lowest tender and reserves to himself the authority to reject any or all of the tenders received, without assigning any reasons. All tenders in which any of the prescribed conditions are not fulfilled, or are incomplete in any respect are liable to be rejected.

5. All compensation or other sums of money payable by the Contractor to Clients under the terms of this contract may be deducted from the security deposit, or from any sum that may be or may become due to the Contractor on any account whatsoever and in the event of the Security Deposit being reduced by reasons of any such deductions, the Contractor shall within 10 days of being asked to do make good in cash or by cheque any sum which have been deducted from his security deposit.

6. Tender containing any condition leading to unknown/indefinite liability, are liable to be summarily rejected. If at all any rebate(s) is/are to be offered the tenderer shall first quote his rates strictly on the terms and conditions stipulated in tender document and then show separately rebate(s) offered specifying the conditions for such rebate(s). Failure to follow this procedure will render the tender liable to summarily rejection.

7. Canvassing in connection with tenders is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable to rejection.

8. The tenderer should quote their (own) rates for undertaking the work.

9. All taxes including Sales Tax, Vat, excise, Octroi, service tax or any other statutory obligation / tax on material or on finished works like work’s contract tax, turn over tax etc. in respect of this contract, as applicable, shall be payable by contractor including transportation and TA / DA of the workers at site and the Bank will not entertain any claim whatsoever in this respect.

10. Income Tax will be recovered @ 2% plus surcharge or as applicable as per Government Rules.

11. Service Tax will be recovered at the applicable rate. Contractor should have Service Tax Registration Number

12. The EMD amount of the lowest bidder will be retained as security deposit during the contract period.

13. Time is the essence of the contract. The work should be completed in TWO(2) months from the date of the work order issued to the contractor to commence the work, failing which penalty will be strictly imposed.

14. Tenders for works shall remain open for acceptance for a period of 30 days from the date of opening of tenders. If the tenderer withdraws his tender before the expiry of the said period or makes any modifications in terms and condition of the tender which are not acceptable to the Bank, then the bank without prejudice to any other right or remedy is at liberty to forfeit the earnest money.

15. The tenderer, apart from being a competent contractor must co-ordinate himself with the agencies of appropriate class for all allied works.

16. The tenderer should visit the site to ascertain the working conditions and local authority regulations/restrictions if any and other information required for the proper execution of the work.

17. The quantities of various items given in the schedule of quantities are approximate. The quantities of work may vary at time of allotment / execution of work. Bank reserves the right to omit / delete any item(s) of work from the schedule at the time of allotment / before. Contractor will be paid for the actual work done at the site duly verified by the concerned official of the bank.

18. The unit price shall be deemed to be fixed price. In case of extra items, a record of labour charges paid shall be maintained and shall be presented regularly to the Employer’s for checking. The settlement will be made based on figures arrived at jointly and taking unit price given in the contract assigned to the successful Tenderer. In case of extra items where similar or comparable items are quoted in the tender, extra rates shall be based on tender rates.

19. No employee of the Bank is allowed to work as a contractor for a period of 2 years of his/her retirement from Bank Services without previous permission of the Bank. This contract is liable to be cancelled, if either the contractor or any of his employees is any time to be such a person who had not obtained the permission of Bank as aforesaid before submission of the tender or engagement in the contractor’s service.

20. All the rates shall be filed up in figures as well as in words. The rates and amount against each items of work shall be filled up only in the tender document issued to the contractor.

21. The contractors cannot have any claim for reduction or increase in the quantities of work while in the execution in the branch. Scheduled quantities indicated above are tentative.

22. Deduction at source for income tax shall be done from bill amounts of the work done.

23. The contractors are advised to consult the Bank’s Engineer or visit the site for more details.

24. Work should be completed within the prescribed period

25. Conditional tenders are liable for rejection.

26. The quoted rate should be inclusive of materials, labour, fixtures, transportation, installation, all taxes, wastages, Octroi, machinery, temporary works such as scaffolding, cleaning, overheads, profit, statutory expenses, incidental charges and all related expenses to complete the work.

27. Duly filled in complete tender documents bearing signature of contractor on all pages of complete tender documents(otherwise liable to be rejected) shall be submitted in sealed cover addressed to General Manager (Admn & IT), TELANGANA GRAMEENA BANK HEAD OFFICE : HYDERABAD # 2-1-520, 2nd Floor, Vijaya Sri Sai Celestia, Street No.9, Shankermuth Road, Nallakunta, Hyderabad, Telangana .500044

28. on or before the last date & Time stipulated above. The name of the work should be clearly super scribed on the sealed cover. No paper/sheet/drawing should be altered in or detached from the tender documents issued to the contractor. The tenders shall be liable for rejection, if any one of the above said requirements has not been complied with.

28. The Bank will not be bound to accept the lowest tender and reserves the right to accept or reject any or all the tenders without assigning any reason whatsoever.

29. The contractor should fulfill the labour regulation guidelines stipulated by the governments.

30. No advance payment will be granted for the works proposed.

GENERAL DIRECTIONS AND TERMS & CONDITIONS OF CONTRACT FOR HIRING OF BRAND NEW 75 KVA (3 - phase) GENERATOR WITH ACOUSTIC ENCLOSURE AND OPERATOR FOR RACPC & REGIONAL OFFICE-2,

HYDERABAD. 1. ‘TGB’ means Telangana Grameena Bank, and its successors

2. The contractors, legal heirs, legal representatives etc, represented by the Contractor for the purpose of the subject Contract.

2. PRICES:

1. The rates mentioned for the Contract shall be for completing the job and is inclusive of handling and labor charges etc.(All inclusive price)

3. The Security Deposit (EMD) will be refunded to the Contractor on successful completion of the Contract, which shall be interest free. TGB shall be empowered to adjust from out of Security deposit any dues to TGB from the Contractor or his workmen.

4. PAYMENT TERMS:

1. Full payment will be made within 30 days after the job is completed each month through RTGS.

2. The Contractor shall submit the bill for the work done once in a month. 3. Payment will be arranged by TGB Regional Office against certification

and the recommendations by the RO. 4. Support documents for remittance of Operator salary, PF & ESI for the

every month should be attached with the Bill for the subsequent month to enable TGB to arrange payment/

5. However, the 1st bill shall be submitted in the 2nd month along with the above documents pertaining to the 1st month.

5. EXECUTION OF CONTRACT:

1. The work shall commence immediately. The work shall generally be carried out during all the shift timings on all 365 days. Written permission of RACPC & Regional Office-2, Hyderabad has to be obtained for working before and beyond these shifts.

2. The work is to be carried out with due diligence and all work executed is to be done in a profession manner.

6. DEDUCTIONS AND RECOVERIES:

1. In the event of contractor having carried out unsatisfactory work of carelessly, recoveries shall be made from the Contractor’s bills and in case bill amounts insufficient recoveries shall be made from the Security Deposit, as Assessed by RM Regional Office-2, Hyderabad. The decision of General Manager (Admn & IT) shall be final and binding on both the parties in case of any dispute in this regard.

2. TGB shall have the right to recover the actual expenditure incurred to make good the: a) Poor quality of services

b) Damage caused to the neighboring works, surrounding equipment, etc.

c) Damage caused by him and / or persons employed by him either during the course of work or otherwise. From any sums due or may become die or from Security Deposit in the event of Contractor’s failure to do so.

3. In every case, in which by virtue of the provisions of section-12, sub:-Section (1) of the workmen’s Compensation Act, 1923, TGB is obliged to pay compensation to workmen employed by the Contractor in execution of the work and under Section-12, sub-section (2) of the said Act, TGB shall be at liberty to recover such amount or any part thereof and by deducting it from the Security Deposit or from any sum due from TGB to the Contractor(s) whether under the Contract otherwise.

4. TGB shall not be bound to contest any claim made against it Under section 12, sub-section (1) of the said Act, except on the written request of the Contractor(s) and upon his / their giving to TGB full Security for all costs for which TGB might become inconsequence of contesting such claim.

5. The Contractor shall indemnify TGB from all liability what so ever under the Employee’s compensation Act or otherwise under any other Act, as applicable, in respect of any injury suffered on the Labour employed by the Contractor or resulting in the death of his workmen,

7. COMPENSATION:

The Contractor shall have to pay compensation if he or his workers causes / cause loss or damage to any of TGB property in any manner as determined by TGB. Failure on the part of the Contractor to make good the loss suffered by TGB. TGB is entitled to recover such amount from his running bills of the Contractor or can forfeit Security Deposit amount or appropriate action including legal action will be taken to recover the compensation in the event of the Contractor’s failure to pay compensation within the stipulated time limit on demanded.

8. SECURITY:

1. TGB area is under security arrangement, the entry / exit into / from the factory premises will be regulated by pass, issued by Security Department to the Contractor and his workmen, which shall be countersigned by Chief Security Officer of TGB. In the premises/plant security checks will be carried out. The Contractor shall take notice of the above Security restrictions.

2. The Contractor shall abide by the rules and regulations and other security checks existing and to be imposed by TGB from time to time.

3. The Contractor and his staff should follow the security regulations of TGB in force and as amended from time to time. Either the Contractor or his workmen are liable for suitable action including summary termination and / or penal and / or legal action for breach of these security regulations and TGB’ decision shall be final and binding on the Contractor.

4. The Contractor shall be held personally responsible for conduct or his work-men and shall be liable for consequential action in case of any guilt or offence.

5. The Contractor and his work men shall also come under the purview of the laws of the State Union and Defenses Rules and liable to be dealt with suitably in the event of infringement of any of these rules.

6. The Contractor shall employ a supervisor at his cost to supervise the workmen employed by him for proper execution of the contract.

9. COMPLIANCE WITH ENACTMENTS:

9.1 The Contractor shall comply with the provisions of the following Acts and Rules:- (i) The Contractor shall obtain License under the CL (R & A) Act and shall

comfy with the contract Labour (Regulation & Abolition) Act, 1970 or any amendment thereof and all legislation and rules of the state or other local authority framed from time to time. The Statutory obligations with regard to wages, welfare and safety measures, maintenance of all required registers etc., will be deemed to be part of the Contract. In case of engagement of Contract Labour by the Contractor, the Contractor shall pay wages no less than those fixed by the RCL (central) from time to time for similar hobs including payment of basic wage, Leave wage, Holiday wage, etc. and shall meet other statutory obligations in respect of his workmen.

(ii) The provisions of the Minimum Wages Act, 1948 and payment of Wages Act, 1936 of amendments thereof and the rules made there under.

iii. Industrial Disputes Act.

iii. Employees Compensation Act, 1923 as amended or any other law for the time being in force.

(v) Contractor or shall comply with statutory requirement in relation to the provisions of the EPF & MP Act, 1952 & Employee’s State Insurance Act 1948 and get the code number under Employees Provident Fund from PF office and for ESI code number from ESI authorities. The payment will be released only after submission of the code number and a copy of the coverage intimation & subsequent payments also will be released only on submission of challans and 12 A monthly return copy in proof of remittance of provident fund for previous month, and incase of ESI, proof of remittance of ESI contribution.

(vi) The contractor should have registered with ESI & PF authorities and comply with the provisions of ESI & PF Act, in respect of workmen employed by him including maintenance of necessary registers.

(vii) Equal Remuneration Act etc.

viii) The Contractor shall provide necessary insurance coverage for the workmen / staff employed by him, as may be necessary.

10.0 SAFETY: 1. The Contractor shall ensure adherence of all safety regulations and

Wearing of safety appliance by his workmen while at work as per factories Act & CL (R & A) Act provisions. He has to contact safety engineer TGB before starting the work and obtain safety work permit.

2. Contractor should supply all the persons involved in work with proper safety appliances like safety shoes, helmets, aprons etc.

3. The contractor shall be solely responsible for any type of injury/accident to the persons engaged by him.

11. WEEKLY HOLIDAYS AND PAID HOLIDAYS:

1. Every workmen employed by the contractor shall allow in each week, a day’s rest and statutory holidays with wages as required under the relevant laws.

12. REGISTERS:

1. The contractor should maintain all registers as per the Contract Labour (Regulation and Abolition) Act, 1970 and Rules made under and produce them for inspection as and when required by TGB Appropriate statutory authority like PF, ESIC & Labour Enforcement Authorities.

13.0 LIQUDATED DAMAGES;

13.1 The time completion of work as specified shall be strictly observed by the contractor. If the contractor fails to comply with the time schedule, he shall be liable to pay liquidated damages at 1% (One percent) or such amount as CM (Estate) may decide on the contract amount of the work for every week, the work remains uncommented or unfinished provided the total liquidated damages shall not exceed 10% (ten percent) of the Contract amount. In case the default continues beyond 11 weeks, it tantamount to breach of contract and the contract is liable to be terminated summarily. 13.2 Failure on the part of the Contractor to carry out the jobs as per Contract in time, TGB, apart from levy in liquidated damages, is entitled to make alternate arrangements for carrying out such jobs at the cost and by it from the Contractor’s Bills / Security Deposit.

14.0 PENALITY: In case of non-performance or delay in the performance or for reasons at Clause 15.1 (a) & (b) hereof, the Contractor is liable for penalty the quantum of which would be decided by the General Manager (Admn &IT) whose decision in this regard would be final and binding.

15.0 TERMINATION OF THE CONTRACT;

15.1 TGB may put an end to the agreement at any time by giving Three(3) -month notice in writing in case of un satisfactory services. However, TGB reserves its right to terminate the Contractor without giving any notice for the following reasons attributable to the Contractor. (a) The bad workmanship of the work; (b) Damage t other works in progress/surrounding fixtures, accessories and equipment. (c) Slow progress of work; or (d) Any other reason as he thinks fit.

15.2 The Contractor can also exercise his option to terminate the contract by giving three month’s notice.

16.0 DISPUTES:

In the event of any differences or dispute arising out of interpretation of this contract the same shall be referred by either party to the Sole Arbitrator of the General Manager (Admn &IT) or any other official nominated by him, whose decision shall be final and binding on both the parties. To all such proceedings, of the provisions of Indian Arbitration & Conciliation Act 1996 shall apply.

17.0 SUITS:

All Suits or any other matter arising out of this contract other than those mentioned at clause 16 shall be within the jurisdiction of Hyderabad Courts only.

18.0 All conditions and rules stated above shall be binding and applicable unless Stated otherwise elsewhere in the work order.
