patents continue to be recognized as a viable proxy for innovation. Rosabeth Moss Kanter, Harvard Business School Ernest L. Arbuckle professor, sums up this sentiment in her statement, “The ability to own a discovery and reap rewards from the investment in that unique invention or concept encourages innovation. Why invest, if predators could easily steal the ideas and make it their own? The patent system is the innovator’s friend.”

Thomson Reuters similarly realizes the importance of accepting patents as such a measure, as evidenced in its annual Top 100 Global innovators program (top100innovators.com) and in this annual State of innovation report.

To understand the impact of the patent-innovation connection, it is important to look at how the patent system is changing and the effect of these changes on innovation. The global patent system, the protection engine enabling the commercialization of innovation, has remained relatively constant over the past year with modest developments.

in Europe, the launch of the Unitary Patent (UP) and the Unified Patent court were introduced and are certain to have a long-term, positive impact on innovation and patenting across the 25 member countries, representing some 500 million people, participating in this movement. Touted advantages of the UP include cost savings for designating and maintaining patent protection in the 25 participating jurisdictions and expedited decision making regarding validity and infringement claims.

in the U.S., noteworthy changes include the official launch of the first-to-file movement (which took effect in September 2013 as part of the America invents Act) and legislation to decrease costly litigation primarily originating from non-practicing entities, NPEs (as part of the innovation Act). The latter movement addresses the concern that suits brought by these NPEs have increased from 29% to 62% of all infringement suits in the two year period from July 2011 – July 2013.1 The concern is that the explosion in litigation could have a dampening effect on innovation and divert could-be R&d dollars to costly litigation.

in Asia, there were modest changes in patenting across the continent. As china continues to transition from a production economy to an innovation one, it is guided by its latest National Patent Strategy with the aggressive goal of filing two million patents each year and doubling the number of overseas patent application filings by chinese applicants by 2015;2 india is grappling with new generics and pharmaceutical legislation; and South Korea is feeling the effects of increased litigation, with 334 suits filed against South Korean companies in 2013, twice the number of just three years earlier.

despite the ever-evolving landscape, the confidence in patents as a benchmark for innovation remains strong. “Patents produce higher and more certain investment returns from innovation, effectively ensuring and magnifying the first-mover advantage and helping to justify sustained investments in research and development,” said Bruce Nolop, chief financial officer, Pitney Bowes inc.4

The findings from this year’s State of innovation report confirm that the post recessionary down-slump has officially rounded the corner and that innovation investment is on the rise. in all categories except Biotechnology, the Thomson Reuters analysts identified increases in activity, with most being in the double digits.

For the fifth consecutive year, the computing & Peripherals technology area takes the lead with the most overall innovation of all sectors analyzed. This time it leads with more than 300,000 unique inventions, more than twice as many as the next nearest category: Telecommunications.

The three technology areas with the greatest year-over-year increases are Automotive, domestic Appliances and Petroleum, each of which jumped by 35% over prior year figures. in Automotive, the subsector area with the largest increase in activity is Seats, Seatbelts and Airbags, which is up 40% over the prior year’s activity, followed closely by the Safety subsector, which jumped 39%. These figures underscore the shift in focus to making vehicles as safe as possible, potentially a result of the recalls affecting the auto industry.

Toyota takes the title as the world’s front runner in overall Alternative Powered Vehicles innovation. it surpassed its nearest competitor, Honda, by some 300%, while simultaneously bumping its own output over the prior period by 52%. All subsectors within the Automotive technology area had increases in activity, whereas only 7 of the 12 showed positive gains in the prior period.

Every subsector within domestic Appliances saw increases between 28% and 40% over the prior year. This is the most consistent technology area, as it was also amongst the top three fastest growing sectors in the prior analysis and its distribution of innovation activity is balanced across subsectors.

in the Petroleum space, the subsector for Petroleum& Gas Exploration, drilling, Production & Processing is up 43% over prior year, whereas the prior year’s comparison was up only 9%. This is the first time that Petroleum has made it into the top three most active areas list. Some of this innovation is related to hydraulic fracturing, which is quickly becoming a source of alternative fuel amidst environmental concerns over oil and gas.

The largest jump in year-over-year innovation activity is in Aerospace, within the Structures & Systems subsector, which skyrocketed 192% over the prior period, where it had experienced a decline of over 50% from the previous analysis. in the category of Space Vehicles & Satellite Technologies, Boeing takes the overall global lead with the most innovations.

The only area to show a year-over-year decline is Biotechnology, which dropped 3% from the prior year. All subsectors decreased year-over-year except for Genetically Modified crops which was up 8%, but still with a smaller increase than the prior period, which had jumped by 13%. The biggest loser in Biotechnology was drug discovery related innovation, which fell by 25%; even oncology-related innovation declined by 2%, despite the increase in diagnoses in this area.

Analysts continue to see more activity from emerging markets, specifically from china and Russia. As an example, the University of People’s Friendship, in Russia, took a spot in the top 10 in Food, Tobacco and Beverage Fermentation, Medical devices and Pharmaceuticals.

The future looks promising for global innovation investments and commercialization based on figures in this year’s analysis.

The following is a bulleted list of some of the highlights from this year’s analysis:

• All categories within Telecommunications saw increased innovation activity over the prior period, with the largest jump happening within digital information Transmission Systems, which grew by 45% over the prior year (compared to 10% growth for the prior period)

• Semiconductors also experienced growth across all subsectors, as compared to only one subsector showing an incline in the prior period. The biggest gainer was discrete devices, up 30%

• in the Pharmaceutical technology area, the biggest jump in innovation activity was in the category of Steroids, which was up 31%, as compared to a decline of 5% for the prior period

• Russia is a more active leader in sectors of innovation than has been witnessed in the past. For example, the University of People’s Friendship, in Russia, took a spot in the top 10 in Pharmaceuticals, Medical devices, and Food, Tobacco and Beverage Fermentation

• The Petroleum& Gas Exploration, drilling, Production & Processing is up 43% over prior year, whereas the 2012 comparison to prior data was up only 9%

• Medical devices continues to be a winner, with all categories showing growth, led by Medical Aids, Oral Administration, which was up 38% year over year

• The subsector with the most new entrants in the Top 10 lists is Beverage Fermentation, with 25 new organizations making the leader boards by region. There was a 70% increase in innovation related to meat, year over year, and a 16% decrease in innovation related to tobacco, year over year (whereas prior period had > 130% increase in tobacco innovation)

• L’Oreal continues to be the global front-runner in cosmetic-related innovation, with more than twice as many make-up related innovations year-over-year as compared to closest competitor, which is KAO corporation from Japan

• 2013 seems to be the year for Human Hygiene—there was a 40% increase in such inventions (under exact category name) and increases across all of the cosmetics categories, which include makeup, hair, skin, antiperspirant and perfume (a sector which had significant declines over the prior year period in last report we issued)

• computer Peripherals saw major leaps as well, when during the prior period it encountered significant declines—for instance, the Other Peripherals category jumped by 39% year-over-year, however showed a 33% decline for the prior period. Every subsector in this area had increases

• Biotechnology innovation seems to be an area where not as much patenting is happening in these direct categories. All subsectors decreased year-over-year except for Genetically Modified crops which was up 8%, but still with a smaller increase than the prior period, which had jumped by 13%. The biggest loser in Biotechnology was drug discovery related innovation, which fell by 25%. Even oncology treatment innovation declined by 2%, despite the increase in diagnoses in this area

• Automotive sector sped into high gear over last year, with an overall 35% jump in activity over prior year. Toyota remains the clear front runner in the Alternative Powered Vehicles subsector, surpassing the nearest competitor, Honda, by 300%, and increasing its own ouput over the prior period by 52%. Every category in Automotive had increases, whereas for the prior period covered only 7 of the 12 subsectors rose (42% declined). The biggest leader was in the category of Seats, Seatbelts & Airbags, which was up 40%, followed by Safety which was up 39%

• The single largest jump in subsector category innovation came from Structures & Systems, within Aerospace, which skyrocketed 192% over the prior period, where it experienced a decline of over 50% from the prior period. in the category of Space Vehicles & Satellite Technologies, Boeing took the overall global lead with the most innovations
