In exercise of powers conferred under Rule 29(3) read with Rule 3 of Haryana SchoolRules-2003 Education Department, Haryana permission is hereby granted to establish a newproposed school on the terms and conditions mentioned below:-
The Proposed School shall have the required infrastructure regarding land and Building i.e.number & size of class rooms with varanda and other rooms for Head ofInstitution/Office, Library, Laboratory, Stairs, Ramp and Toilets etc. as per Rule 30.The Management of the school shall have to apply for permanent recognition within thestipulated time in the prescribed form-II with documents as per rule 31.The Management shall not make admission beyond Class-III before the sanction of itsrecognition or in its anticipation.The letter of permission is based on the undertaking given by the applicant as per detailsgiven overleaf. Any violation of the undertaking automatically nullifies the permission.This permission is further subject to 'No Objection certificate' from the 'CompetentAuthority' regarding the land use of the proposed site.
This is only a formal permission to establish a New School or Start Classes and does not enableyour school to get recognition automatically for which physical verification of infrastructure andrecords in this respect shall be made by District Inspection Committee.* The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Ruels 2011 and amendments it any thereafter. The Managing shall be liable fordisciplinary action in case of violation of any provisions of the rules.

With reference to your application and subsequent correspondence with the school/inspection
in this regard, I convey the grant for provisional recognition to Indus Public School, Distt. Hisar for class
1 st to 8th with effect from 01.04.2016 run by Managing Committee, Sindhu Education Foundation, LGF 23,
Raidoot Marq, Chanakya Puri, New Delhi.
The above sanction is subject to fulfillment of following conditions:-1.The grant for recognition is Class not extendable and does not in any way imply an y obligation torecognize/affiliate beyond Class VIII.2. The school shall by the provisions of Right of Children to Free and Compulsory 1Wucation Act, 2009
and the Haryana State Right of Children to Free and Compulsory Iducation Rules 2011.3.The school shall admit in class I, to the extent of the Strength of that class. Children belonging to
weaker section and disadvantaged group in the neighborhood and provide free and compulsoryelementary education till its completion:
Provided, that in case of pre primary classes also, this norm shall be followed.
4.For the children referred to in paragraph 3, the school shall be reimbursed as per sub section (2) ofsection 12. To receive such reimbursements school shall provide a separate bank account.5. The school shall not collect any capitation fee and subject the child or his or her parents or guardians
to any screening procedure.6.The school shall not deny admission to any child for lack of age proof. If such admission is sought
subsequent to the extended period specified for admission, the same shall not be denied and thechild shall not be discriminated on the ground of religion, caste or race, place of birth or an y of them.
The school shall ensure that :-no child admitted shall be held back in any class or expelled from school till the completionof elementary education in a school;no child shall be subjected to physical punishment or mental harassment;no child is required to pass any hoard examination till the completion of elementaryeducation.every child completing elementary education shall be awarded a certificate as laid down underrule 22;inclusion of students with disabilities /special needs as per provision of the Act;the teachers are recruited with minimum qualifications as laid under section 23(1) of the Act.Provided further that the current teachers who, at the commencement of this Act do notposses minimum qualifications shall acquire such minimum qualification within a period of 5years;the teacher performs its duties specified under section 24(1) of the Act; andthe teachers shall not engage himself or herself fir private teaching activities.
The school shall follow the syllabus on the basis of curriculum laid down by academic authority.The school shall enroll students proportionate to the facilities available in the school as prescribed 19.

13.The accounts should be audited and certified by a Chartered .Accountant and proper accountsstatement should be prepared as per rules.. \ copy each of the statements of accounts should be sent tothe District Elementary Education Officers every year.14.The recognition code Number allotted to your school is 3222LHSR/8th/BOSE/2016. This mayplease be noted and quoted for any correspondence with this office.
15.The school furnishes such reports asnd information as may be required by the Director ofEducation/District dementary I.ducation Officer from time to time and complies with such

Whereas an FIR No. 461 dated 22.07.2014 was registered under section 341, 354-B,
506 IPC read with provisions of Section 10 of POCSO Act, 2012 at police station Fatehabad
against appellant i.e. Sh. Jagram, S.S. Master GMS Majra (Fatehabad), now posted at GHS
Chikanwas (Hisar). Criminal case was initiated against him at Hon'ble Court of Addl. Sessions
Judge Fatehabad and was acquitted on 23.09.2014 giving benefits of doubts. The period from
22.07.2014 to 08.03.2015 of SI). Jagram NA as treated as leave of kind due by the competent
Disciplinary Authority vide order dated 21.09.2015.
The concerned S.S. Master preferred an appeal attaching his attendance at District
Elementary Education Officer Fatehabad and requested to decide the matter afresh. He has
been heard in person on 08.01.2016. After due consideration of all the facts and circumstances,
I am of the considered view that the custody period i.e. 22.07.2014 to 23.09.2014 be kept as
leave of kind due but since concerned master attended the office of District Elementary
Education Officer Fatehabad w.e.f. 24.09.2014 therefore, the rest of the period i.e. from
24.09.2014 to 08.03.2015 be treated as duty period for all intents and purposes.

Whereas an FIR was registered under section 302, 452, 148/149 IPC against Sh. Madan
Lal i.e. the appellant, Science Master GHS Alika (Sirsa) now ESHM GSSS Jatwar (Ambala).
He remained under judicial custody and remained on suspension from 16.01.2004 to
12.09.2006. He was charge sheeted under Rule 7 vide order No. 14/38-2004 HRM-II dated
04.03.2006. He was acquitted granting benefit of doubts. On acquittal his suspension period
16.01.2004 to 29.03.2006 was allowed as Leave of Kind due by the Disciplinary Authority vide
order dated 24.08.2007.
He preferred an appeal against this order and requested to treat this suspension period
as duty period. After considering the facts and contents of judgment dated 01.05.2006, I am of
the considered view that the appeal of the appellant deserves to be accepted under Rule 7.3
read with 7.5 of Punjab Civil Rules Vol.1 Part 1. Resultantly the appeal is allowed and the
suspension period is ordered to be treated as duty period but the pay of this suspension period
is restricted to subsistence allowance already paid.

Whereas by way of filing CWP No. 11136 of 2016, titled as Rajbir Singh &
others versus State of Haryana & others, the Petitioners have approached Hon'ble
Punjab & Haryana High Court at Chandigarh for issuance of a writ in the nature of
mandamus directing the respondents for stepping up their pay with their junior
Respondent No. 6 i.e. Vasdev, Science Master, Govt. High School, Naya Bans
(Rohtak) and Respondent No. 7 i.e. Ram Kishan son of Ram Phal, S.S. Master,
GSSS Nigana (Rohtak) and thereafter grant all consequential benefits. The said
writ petition came for hearing before Hon'ble Mat on 30-05-2016 and Hon'bie
Court pleased to dispose of the same. The operative part of this judgment is
reproduced here for ready reference:
"Learned counsel for the petitioners submits that at this stage, he
would be satisfied if the present writ petition is disposed of with a
direction to respondent No.4 to take a decision on the legal notice
dated 12.04.2018 (Annexure P-5), issued on behalf of the petitioner&
/ And the prayer made by learned counsel for the petitioners to
be reasonable.Accordingly, at this stage, without commenting on the merits of
the case, the writ petition is disposed of with a direction to respondent
No.4 to take a decision on the legal notice dated 12.042016
(Annexure P-5), issued on behalf of the petitioners, by passing a
speaking order and after affording opportunity of hearing to the
petitioners, prefers*, within four months from the date of receipt of a
certified copy of this order.
Needless to add that the decision so taken be communicated to
the petitioners and if the decision is not to the satisfaction of the
petitioners, they would be at liberty to challenge the same, in
accordance with law."
In pursuance of judgment dated 30-05-2016, all relevant record related to
legal notice dated 12-04-2016 has been examined in the light of seniority of the
petitioners. The pay fixations of Sh. Vasdev Science Master (i.e. Respondent No.6)
& Ram Kishan Social Studies Master (i.e. Respondent No. 7) have also been
considered. Through Writ Petition, the petitioners have submitted that the
Respondent No. 6 & 7 are junior to them and they have been getting more pay than
petitioners. After due consideration of service record of private respondents, it
has been found that they have been allowed benefit of 1 st ACP pay scale on
completion of 10 years continuous service including adhoc service as this benefit
was granted to them in view of judgment dated 09-12-2008 passed by Hon'ble
Punjab & Haryana High Court Chandigarh in CWP No.20664 of 2008; "Surender
Kumar Sharma vs. State of Haryana and others". After considering the relevant
record and legal notice (supra), following facts came Into existence:
I) That the petitioner number 20 & 29 i.e. Smt. Rajwanti and Sh. Ram Kumar
respectively, have been working as Sanskrit teacher in Classical &
Vernacular Cadre which is a feeder cadre of Master cadre, therefore, they
cannot be senior to Private Respondents who are serving in Master Cadre.
ii) That as per provisional seniority of the Master Cadre as on 01-01-2012, the
private Respondents stand at Serial No. 4990 & 4997 respectively whereas
the number of the petitioners are 7889.1,9064,7710,7715,7831, 8256,
7891, 8399, 8843,7622 18159, 9066,7861,7586, 7627, 8107, 9123,
9023, 9189, 9025, 9042, 7909, 8432, 8219, 7721, 9043, 8488, 8575,
9394 and 8489 respectively. Therefore, the none of petitioners Is senior to
Private Respondents' No. 6 & 7, therefore the petitioners are entitled to
mislead Hon'ble Court by submitting wrong facts.
III) That it is an admitted fact that the petitioners and private Respondents
were engaged on adhoc basis and their services were regularized w.e.f. 01-
10-2003. The petitioners have rightly been granted 1 st ACP pay scale on
completion of 10 years regular satisfactory service but the private
Respondents' No. 6 & 7 differs from them on ground that they were allowed
seniority with effect from the date; they were engaged on adhoc basis by
this Hon'ble Court. Their seniority was fixed accordingly but subject to
decision of Hon'ble Supreme Court of India in SLP i.e. "State of Haryana
and others vs. Vijay Singh and others" but no such seniority is granted to
petitioners. Moreover, it is relevant to state that the private Respondents
have been granted benefit of 1st ACP pay scale under the provision of
"Note" to Rule-7 of ACP Rules, 2008 which states as under:
"Note.— For the purpose of these rules, — `regular satisfactory service'
means continuous service counting towards seniority under Haryana
Government, including continuous smite In Punjab Government before re-
organization, commencing from the date on which the Government servant
Joined his service after being recruited through the prescribed procedure or
rules etc. for regular recruitment, in the cadre In which he Is working at the
time of being considered his eligibility for grant of ACP pay band and grade
pay under these rules and further fulfilling all the requirements prescribed
for determining the suitability of grantofACPpaystructure."
iv) it is also relevant to state that the seniority of respondents' no. 6 & 7 came
under consideration again before Hon'bie High Court Chandigarh in CWP
No. 5478 of 2013, titled as Rajesh & another versus State of Haryana &
others. While its judgment dated 06-10-2015, the Hon'bie High Court
observed as under:
"It is not disputed before me that the Special Leave Petition; "State
of Haryana and others vs. Surender Kumar and others" was dismissed by
the Apex Court on. 19.11.2010 and since the dismissal was on the ground of
delay alone, the question of law was kept open to be decided in another
case. In a later judgment while deciding the other bunch of SLPs filed by
the State in "State of Haryana and others vs. Vijay Singh and
others",(2012)8 SCC 633, the Apex Court set aside the order of this Court
by holding as under:-
"30. None of the aforesaid judgments can be read as laying
down a proposition of law that a person who is appointed on
purely ad hoc basis for a fixed period by an authority other
than the one who is competent to make regular appointment

to the service and such appointment is not made by the
specified recruiting agency is entitled to have his ad hoc
service counted for the purpose of fixation of seniority.
Therefore, the respondents, who were appointed as Masters
in different subjects, Physical Training Instructor and Hindi
Teacher on purely ad hoc basis without following the
procedure prescribed under the 1955 Rules are not entitled
to have their seniority fixed on the basis of total length of
service. As a corollary to this, we hold that the direction given
by the High Court for re-fixation of the respondents' seniority
by counting the ad hoc service cannot be approved."
In view of the uncontroverted position, as above, the impugned
seniority lists which were made on the basis of orders passed by this Court
In Vijay Singh's case(supra) which stands overruled by the Apex Court in
"State of Haryana and others vs. Vijay Singh and others, (2012)8 SCC 633
they are liable to be set aside.
Resultantly. while setting aside the Impugned seniority lists
(Annexures P-2 and P-3). a direction is given to the State of Haryana to
reframe the seniority of the petitioners as per the law determined by the
Apex Court In "State of Haryana and others vs. Vijay Singh and others,
(2012)8 SCC 633.
The needful be done within six months from the receipt of a certified
copy of this order."
In pursuance of this order of Hon'bie Court, necessary action has
been initiated. Necessary show cause is being Issued under the principles
of natural justice prior reducing pay of private respondents. Needful is
being done accordingiy.
v) That the petitioners have no locus standi to claim pay at par with their
senior as on 01-01-2012. They have never been denied their substantive
right in pay and seniority which Is admissible to them under financial &
service rules. Since, Respondents' No. 6 & 7 are senior to petitioners with
4990 & 4997 respectively in Master Cadre, therefore, there is no merit in the
legal notice (dated 12-04-2016).
After considering all the contents on file and perusing judgment
(supra) of Hon'bie Court, the petitioners have been granted opportunity of
personal hearing on 30-6-2016. They submitted their seniority on the basis
of provisional seniority list as on 01-01-2016 but in this regard, it is stated
that the objections have been demanded from field offices against this
seniority list, therefore, this seniority cannot be declared final unless and
until all objections have been got satisfied. In conclusion, undersigned is of
a considered view that the petitioners have no locus standi to claim more pay
than their entitlement under statutory financial rules. The petitioners have
been paid salary as per their substantive right as per rules/ instructions
issued by the Finance Department, Haryana. Without any fact of seniority,
there is no merit In the claim of the petitioners, resultantly; the claim of the
petitioners through legal notice dated 12-04-2016 deserves to be declined.
I pass order accordingly.
