I. APPLICATION

A. Basic Information:

B. Background Information: On November 9, 2006, Mark Development LLCobtained approval (File No. 2005/SUB-213) to subdivide a 37.08-acre lot into 125residential lots with areas ranging between 5,000 square feet and 9,101 squarefeet, one remainder lot of 17.341 acres, and a roadway lot of varying widths.Subsequently, in 2008 Mark Development declared bankruptcy and the propertywas sold to Presidio Oahu Land, LLC (Presidio).

On April 18, 2013, the SHHCH entered into an interim loan agreement with theHawaii Housing Finance and Development Corporation (HHFDC) to acquire 70of the 125 lots in the Keola Pokai Bay subdivision in Waianae. The SHHCHpurchased the 70 vacant lots in May of 2013 from Presidio and has startedconstruction on eight of the 70 dwelling units.

C. Proposal: The Applicant proposes to develop a single-family dwelling on each ofthe 70 residential lots it acquired. The Project will consist of 35 two-story,three-bedroom, two-bath dwellings and 35 one-story, four-bedroom, two-bathdwellings. All structures will comply with the R-5 Residential Districtdevelopment standards, including parking. There will be two different modeltypes; variety in building designs will be provided by utilizing three roof styles andreverse floor plan designs (see Exhibits F-i through E-17).

All of the units will be affordable and sold to households earning less than 80percent of the Area Median Income (AMI). The Applicant will offer 12 units(17 percent) to households with incomes below 50 percent of the AMI and theremaining 58 units (83 percent) will be available to households with incomebelow 80 percent of the AMI.

The self-help housing Project is comprised of two phases. In the first phase, theApplicant provides financial and loan counseling, and a homeownership course.During the second phase (construction) the Applicant provides technicalassistance and, under the direction of a construction supervisor, the familieslearn skills to build the houses. Through the team self-help housing method,each family contributes 32 hours of labor per week and help each other buildtheir homes as a team.

D. Affordability Reguirements: To meet the 201 H affordability requirements, aminimum of 10 percent of the units must be affordable to households earninglessthan 80 percentoftheAMl; theApplicantwill offer 100 percentofthedwellings to those households.

The dwellings will be affordable in perpetuity. The HHFDC will review allapplications to confirm that the families meet the 80 percent or less AMIrequirement. Subsequent to the home purchase, the lender (the United StatesDepartment of Agriculture Rural Development) will recertify that the homeownersmeet the 80 percent eligibility requirement on an annual basis.

E. Financing: The Applicant states that the estimated construction cost for theProject is $8.72 million. Construction of all dwelling units is anticipated to becompleted by October of 2020.

II. FINDINGS OF FACT

On the basis of the evidence presented, the Director has found:

A. Description of Site and Surrounding Uses: Dwelling use is permitted in the R-5Residential District and all lots conform to the lot area and dimensions of the R-5Residential District subdivision standards. The total Project area is 13.16 acres,which equates to a density of 5.3 units per acre.

Surrounding land uses include residential uses to the north and west and anindustrial subdivision to the south. Further south, adjacent to Farrington Highwayis the Waianae Wastewater Treatment Plant. To the east is a steep mountainousarea.

B. Chapter 343. Hawaii Revised Statutes (HRS): Although the Applicant receivedfunds from the HHFDC to acquire the unimproved lots, the Project is not subjectto the environmental assessment requirements of Chapter 343, HRS. In a letterdated January 18, 2018 to SHHCH, the HHFDC determined that the use of Statefunds to acquire the lots did not require an environmental assessment. TheHHFDC stated that “[p]ursuantto section 343-5(b) HRS and section 11-200-6,Hawaii Administrative Rules, one of the two administrative categories of actionwhich requires the preparation of an environmental assessment is ‘the use ofstate or county funds, other than funds to be used for feasibility or planningstudies for possible future programs or projects which the agency has notapproved, adopted or funded, or funds to be used for the acquisition ofunimproved real property; provided that the agency shall considerenvironmental factors and available alternatives in its feasibility of planningstudies’ [emphasis added].”

C. Waianae Sustainable Communities Plan (WSCP): The following are guidelinesand policies relating to the Project within the WSCP:

• The Vision of Waianae’s Future — “Is that our mo’omo’o (children includingthose yet unborn) will be able to have their essential needs met.”

• Elements of the Vision — Restrict coastal urban, suburban, or resortdevelopment makai of Farrington Highway, and improve transportationsystems within the District.

• Residential Land Use — Residential building heights should generally notexceed two stories or 30 feet in height to protect important naturalfeatures.

Rural Residential — Lands Makai of the Community Growth Boundaryshould generally be in the range of five to eight units per acre.

The proposed Project addresses the need for affordable housing in the WaianaeDistrict. It is located within the Community Growth Boundary and designatedRural Residential. The Project is consistent with the WSCP provided the Projectretains its affordable housing status for the minimum time period required perHHFDC (shared appreciation and buy-back provisions).

D. Flood District: For this parcel, the Federal Emergency Management AgencyFlood Insurance Rate Map Community Panel Number 15003C0192J, effectiveNovember 5, 2014, indicates that the Project site is within Flood Zone D, areasundetermined, but possible (see ExhibitD).

E. Infrastructure and Roadways: All utility plans have been approved by therespective State and City agencies as part of the subdivision approval process.All infrastructure, including the roadways, was constructed in accordance with thesubdivision approval (File No. 2005/SUB-213) and have been dedicated to theCity.

F. Fire: Fire protection is provided byWaianae Fire Station No. 26, located at85-645 Farrington Highway.

G. Police: The Project site is within the Honolulu Police Department’sKapoleilWaianae Patrol District 8, which serves the Leeward Coast and the EwaPlain. The main police station in this area is the Waianae Substation, located at85-939 Farrington Highway.

H. Schools: The Project site is located within the Department of Education (DOE)Leeward District, Waianae Complex Area, which includes Leihoku, Maili and•Makaha Elementary Schools, and Waianae Elementary, Middle, and High

Schools. According to the Applicant, families expected to occupy the dwellingswill be from the Waianae Complex area.

Public Parks and Recreational Facilities: Public parks in the vicinity of theProject primarily consist of shoreline resources such as Lualualei Beach Park,Maili Beach Park, and Pokai Bay Beach Park. As part of the subdivisionapproval process, the former developer complied with private park requirementswith the payment of park dedication fees for all 125 residential lots. The fees willbe used to improve public parks.

Ill. REQUESTED EXEMPTIONS AND ANALYSIS

Section 201 H-38, HRS, Housing Development, exemption from statutes, ordinances,charter provisions, and rules, allows eligible 201 H projects to seek exemptions of anygovernmental agency relating to planning, zoning, and construction standards that donot negatively affect the health and safety of the general public in exchange forproviding affordable housing.

The Applicant has paid $21,840, as of the date of this report, for building permits foreight dwellings that are either constructed, or under construction. The following Tablesummarizes the permit and plan review fees, Ewa highway impact fees, and generalexcise tax exemptions that are being requested:

A. Permit and Plan Review Fees: The Department of Planning and Permitting(DPP) does not object to the proposed exemption. The exemption of buildingpermit and review fees do not adversely impact health and safety, but do helpreduce the cost of producing affordable housing.

B. Ewa Highway Impact Fee: Ordinance 02-52 was enacted to provide additionalresources for roadway and traffic improvements for the Ewa Region. There is no

exception to the fees related to Ordinance 02-52, however, the Ewa Region islimited to the Ewa Development Plan Area, Village Park, and Royal Kunia, anddoes not include Waianae. Therefore, an exemption request is not applicable.

C. General Excise Tax: The request for exemption from the State General ExciseTax for construction costs cannot be granted by the City Council through theHRS Chapter 201 H procedure. The request must be submitted to, and certifiedby the HHFDC, pursuant to their administrative rules. Therefore, this exemptionrequest is not applicable.

IV. CONCLUSION

The Applicant has submitted all required documentation, and the Project is consistentwith the provisions of Section 201 H-38, HRS.

A. The Project will comply with all R-5 Residential District development standards.

B. Existing utilities and roadways already comply with all applicable constructionstandards.

C. Detailed plans will be submitted and reviewed for compliance prior to thebeginning of construction.

The proposed affordable housing Project satisfies the eligibility criteria specified inChapter 201H, HRS and the City’s application requirements.

V. RECOMMENDATION

A. Proposed Exemptions: Pursuant to the above, the Director of the DPPrecommends approval of the affordable housing Project from the RevisedOrdinances of Honolulu Chapter 18, Articles 6.1 and 6.2, to allow an exemptionfor Building Permit Plan Review fees and Building and Construction Permit feesestimated at $191,100, which includes the reimbursement of $21,840 for BuildingPermit Plan Review fees and Building and Construction Permit fees that theApplicant has already paid; and

B. Development Agreement: To ensure the efficient implementation and monitoringof the Project, the Director of the DPP further recommends that the City Councilrequire the Applicant to meet the conditions as specified in the DraftDevelopment Agreement, described herein, and incorporated into the DraftResolution as Attachment 1.

RESOLUTION

AUTHORIZING EXEMPTIONS FROM CERTAIN REQUIREMENTS RELATING TOTHE POKAI BAY SELF-HELP HOUSING AFFORDABLE HOUSING PROJECT ATWAIANAE, OAHU, HAWAII, TAX MAP KEYS 8-6-027: 001 THROUGH 004, 049THROUGH 054, AND 064 THROUGH 123.

WHEREAS, the Self-Help Housing Corporation of Hawaii (SHHCH), a Hawaiinonprofit corporation, proposes to develop an affordable housing project on 70subdivided lots (about 13.16 acres of land) located in the Waianae area of Oahu,identified as Parcels 1 through 4,49 through 54, and 64 through 123 of Tax Map PlatNo. (1) 8-6-027, which is owned by the SHHCH, to be known as the Pokai BaySelf-Help Housing Project (the “Project”); and

WHEREAS, the Project will consist of 70 one- and two-story single-familydwelling units; and

WHEREAS, the Project is eligible to receive consideration under the City’sprogram regulating implementation of Section 201 H-38, Hawaii Revised Statutes(HRS), which requires that at least 50 percent of a project’s total units must be availableto households earning at or below 80 percent of the area median income (AMO; and

WHEREAS, the City Council is empowered and authorized to approve theProject which may include exemptions from statutes, ordinances, charter provisions andrules of any government agency relating to planning, zoning, construction standards forsubdivision, development and improvement of land and the construction of units thereonpursuant to 201H-38, HRS; and

WHEREAS, the City Council has reviewed the preliminary plans dated May 2018(“Pokai Bay Subdivision”), January2013 (Model 1246), and July2015 (Model 1120),prepared for the Project by L and M Architects, and submitted to the Council by theDepartment of Planning and Permitting (“DPP”) on ___________ by DepartmentalCommunication (2018); and

WHEREAS, thehousing project is consistent with the purpose and intent of HRSChapter 2W H, and meets minimum requirements of health and safety; and

WHEREAS, the development of the proposed housing project does notcontravene any safety standards, tariffs, or rates and fees approved by the PublicUtilities Commission for public utilities or of the various boards of water supply,authorized under HRS Chapter 54; now therefore,

RESOLUTION

BE IT RESOLVED by the City Council of the City and County of Honolulu, that itapproves the Project, which approval includes exemptions from certain fees required forthe Project, as follows:

Revised Ordinances of Honolulu Chapter 18, Articles 6.1 and 6.2 to allowexemption from Building Permit Plan Review fees and Building and ConstructionPermit fees estimated at $191,100, which includes the reimbursement of $21,840for Building Permit Plan Review fees and Building and Construction Permit feesthat the Applicant has already paid.

BE IT FURTHER RESOLVED that if the SHHCH fails to complete construction ofthe Project, the exemptions granted for this Project shall be void; and

BE IT FURTHER RESOLVED that the exemptions granted for this Project arenot transferable to any other real property; and

BE IT FURTHER RESOLVED that the final plans and specifications for theProject shall be deemed approved if those plans and specifications do not substantiallydeviate from the Plans submitted to the City Council; provided that minor modificationsto the design character or specifications of the building, and/or landscaping, may beapproved by the DPP, if such modifications are consistent with the prevailingneighborhood character; and

BE IT FURTHER RESOLVED that no aótion may be prosecuted or maintainedagainst the City and County of Honolulu, its officials or employees, on account ofactions taken by them in reviewing or approving the plans and specifications, or ingranting the exemptions listed herein; and

BE IT FURTHER RESOLVED that the City and County of Honolulu, Director ofthe DPP and the SHHCH are authorized to execute and record the DevelopmentAgreement substantially in the form attached hereto as Attachment 1 and made a parthereof, pursuant to the terms, conditions, and provisions approved as to form andlegality by the Corporation Counsel as being necessary, advisable, or desirable for thepurpose of carrying out this resolution; and

BE IT FURTHER RESOLVED that the Director of the DPP is hereby authorizedto execute any incidental or related documents to carry out the transactions, abovedescribed, as long as said documents do not increase either directly or indirectly thefinancial obligations of the City; and

3. DEFINITIONS

A. “City” means the Citj’and County of Honolulu.

B. ~“City Council” means the City Council of the City and County ofHonolulu.

C. “Department of Planning and Permitting” and “DPP” means theDepartment of Planning and Permitting of the City and County ofHonolulu.

D. “Developer” means the Self-Help Housing Corporation of Hawaii.

E. “Preliminary Plans” means the preliminary plans datedFebruary 16, 2018, and outline specifications dated

December 19, 2017, prepared for the Project by the Developer, submittedto the City Council on _____________

4. RECITALS

A. The Developer requested the bity Council tq exercise the authoritystated in Section 201 H-38, Hawäh Revised Statutes (“HRST’), grantedto the City under the provisions of Section46-15.1, HRS, by exemptingthe Project from certain planning, toning, construction standards ofsubdivisions, development and improvement of land, and theconstruction of units thereon,in order to accommodate development ofthe Project by the Developer on the Prpjedt Land as more particularlydescribed in the Preliminary Plans

B The City Council approved the Preliminary Plans, which include therequested exemptions by its adoption of Resolution No

5 DEVELOPER’S AGREEMENTS

The Developer agrees with the City as follows

A The Project will consist of 35 single-story, four-bedroom units of _______

square feet, and 35 two-story, three-bedroom units of _______ square feetThe dwelling units will be located on lots ranging in size from ______ to_______ squàre~feet, and all units will have heights ranging from _______ to_______~féet.~ Each existing and planned unit will have two parking stalls.The Developer will provide 12 units (17 percent) as for-sale units affordableto households with income below 50 percent of the median income and theremaining 58 units (83 percent) will be for-sale units affordable tohouseholds with income below 80 percent of the median income.

(1) Construction of the Project shall commence within 12 monthsafter approval of Resolution No. _________

(2) To the extent economically feasible, utilization of e.nergy andwater conservation fixtures, such as low-pressure sodiumlamps, solar water heating or heat pumps, low-flush toilets andlow-flow plumbing fixtures. Developer’s design developmentplans shall be as approved by the City’s Department of Planningand Permitting.

B. To furnish a performance and payment bond provided by the generalcontractor, which assures that the Project will be completed andcompleted lien free.

C. To submit the following reports to the Citysubject to verification asreasonably requested by the City:

(1) A quarterly status report on the progress of the construction ofthe Project, commencing at the start of construction andcontinuing on the first day of each calendar quarter (January,April, July, October), thereafter, until construction of the Projectis completed;

(2) A final report to the City summarizing the work completed withinninety (90) daysafter thecompletion of the Project’simprovements.

D. To notify the City within 24 hours or as promptly as practicable if anylender shall declare the Developer to be in default.

6 CITY EXEMPTIONS

The City agrees with the developer that the exemptions granted in ResolutionNo _________________ shall apply to the Project

7. CONDITION OF THE RESOLUTION

A. Ifoonstruction of the Project does not commence within 12 monthsfrom the date of the Resolution, the exemptions granted by theResolution shall be void.

B. If the Developer fails to complete construction of the Project, theexemptions granted by the resolution shall be void.

C. The exemptions granted in the Resolution are not transferable to anyother land or property.

8. CITY’S RELATIONSHIP TO THE DEVELOPER AND PROJECT

This Agreement shall not be construed as creating a partnership, joint ventureor other agency relationship between the City and the Developer. The City isnot the developer of the Project and shall not be deemed to have assumedany liability whatsoever with respect to the development, construction,ownership, management and operation of the Project.

The Developer shall indemnify and hold the City harmless from any claim ordemand made by any person or entity pertaining to the Project for death,personal injury, and property damage, including attorney’s reasonable fees.

9. CITY’S RIGHTS AND REMEDIES

The City, including the City Council, reservesall rights and remedies availableto it in law or in equity if the Developer shall fail to perform any of theDeveloper’s obligations in this Agreement and shall fail to correct such defaultwithin thirty (30) days after written notice of the default from the City or suchlonger time as may be reasonably necessary to effect such cure in the eventthat such cure cannot be reasonably accomplished within said thirty (30) dayperiod as long as the Developer shall diligently proceed with such cure

10. MISCELLANEOUS TERMS

A Amendment The provisions of this instrument may be amended onlyby each party executing a subsequent written instrument which stateseach amended provision

B. Binding Effect. Upän its execution by each party, this instrument shallbecome binding and enforceable according to its provisions If morethan one party is obligated to perform an act by any provisions statedin this instrument, those parties shall be jointly and severally liable andobligated for the performance of those acts. The rights and obligationsof each party named in this instrument shall bind and inure to thebenefit of each party, respectively, and the respective heirs, personalrëpresentativês, successors, and assigns of each party.

C. Applicable Law. The provisions of this instrument shall be interpretedin accordance with the law of the State of Hawaii as that law isconstrued and amended from time to time.

D. Authorization. Each party warrants to each other party that theindividuals executing this instrument are authorized to do so.

E. Consent. Subsequent Agreement. If a subsequent consent requiredof any party by the provisions of this instrument is requested by a

party, it shall not be unreasonably withheld by the party to whom therequest is made.

F. Construction. Each party named in this instrument acknowledges andagrees that: (i) each party is of equal bargaining strength; (H) eachparty has actively participated in the negotiation and preparation of thisinstrument; (Hi) each party has consulted with their respective legalcounsel and other professional advisors as each party has deemedappropriate; (iv) each party and the party’s legal counsel and advisorshave reviewed this instrument; and (v) each party: has agreed to bebound by the terms stated in this instrument following its review andobtaining advice.

S. Counterparts. This instrument may be executed by the parties incounterparts. The counterparts executed by the parties named in thisinstrument and properly acknowledged, if necessary taken together,shall constitute a single instrument.

H Dates If any dates stated in this instrument fall on a Saturday, or legalholiday, such date shallbe the next following business day.

Defined Terms. Certain terms where they initially are used in thisinstrument are set off by quotation marks enclosed in parentheses and aresubsequently capitalized Those designated terms shall have the samemeaning throughout this instrument, unless otherwise specifically stated orclearly inappropriate in the context.

J. Force Maieure;: If any party is prevented from performing itsobligations stated in this instrument by any event not within thereasonable control of that party, including, but not limited to any act ofGod, public enemy, or war, fire, an act or failure to act of a governmententity (except on the part of the City), unavailability of materials, oractions by or against labor unions, it shall not be in default in theperformance Of its obligations stated in this instrument.

PROVIDED, HOWEVER, any party delayed by such an event shallreqLøstar]èxtension of time to perform its obligations stated in thisinstrUmeht by notifying the party to which it is obligated within ten daysfollowing the event. If the notified party agrees that the event was thecause of the delay, the time to perform the obligations stated in thisinstrument shall be extended by the number of days of delay causedby the event. If the required notice is not given by the delayed party,no time extension shall be granted.

K. Gender; Number. In this instrument, the use of any gender shallinclude all genders and the use of any number if reference to nouns

and pronouns shall include the singular or plural, as the contextdictates.

L. Integration. This instrument contains all of the provisions of theagreement between the parties pertaining to the subject matter statedin this instrument. Each party acknowledges that no person or entitymade any oral or written representation on which this party has reliedas a basis to enter into the agreement stated in this instrument which isnot included as a provision in it.

M. Memorandum. If required by the provisions of this instrument orrequested by any party, a memorandum of thisinstrument shall beexecuted by the parties, the signatures properly acknowledged by aNotary Public, and recorded in the Bureau of Conveyances/LandCourt, State of Hawaii.

N. No Drafter. No party shall be deemed to have drafted this instrument.No provision stated in this instrUment shal[be construed against anyparty as its drafter.

0 Notice Any notice required or permitted by the provisions of thisinstrument to be given by a party to any party, shall be written andeither shall be delivered personally or mailed postage pre-paid bycertified mail, return receipt requested, to each other party at theaddress and to the person designated by each party, stated below Noother method of notice shall be effective.

R. Severability. If any provision stated in this instrument subsequently isdetermined to be invalid, illegal, or unenforceable, that determinationshall not affect the validity, legality, or enforceability of the remainingprovisions stated in this instrument Unless that effect is madeimpossible by the absence of the omitted provisibn.

S. Survival. Any representation and warranty stated in this instrumentmade by a party shall survive the termination of the agreement statedin this instrument, unless otherwise specifically stated
