1. M/s. North Delhi Power Ltd. (NDPL) filed the Petition for True-up for F.Y. 2009-10 with

the Commission on 31.05.2010 and 02.06.2010, which had certain deficiencies.

Accordingly, a deficiency memo was issued to the Licensee on 09.06.2010 directing

the Licensee to file a complete True-up Petition showing ‘variation on account of

uncontrollable items like energy sales and Power Purchase Cost’ as per the MYT

Regulations/Electricity Act, 2003. The Licensee, in response to the deficiency memo,

have removed the deficiencies and submitted the Revised Petition on 30.06.2010

which was listed for admission on 08.10.2010.

2. Petition is admitted.

1. The North Delhi Power Limited (NDPL) filed ARR petition for determination of Tariff for

FY 2011-12 and review of FY 2010-11 with the Commission on 22.03.2011. The said

petition was scrutinized and found generally in order as per the Delhi Electricity

Regulatory Commission Comprehensive (Conduct of Business) Regulations, 2001.

However, certain deficiencies in respect of the information/details furnished were

identified and conveyed to the licensee on 18.04.2011.

2. The Commission admits the petition.

3. The Commission directs that the petitioner/Licensee shall remove the deficiencies

and also place on record the requisite information/details within 7 days of issue of this

order.

Analyses of purported surplus of Rs.3577 Crore during FY 2010-11

(as per draft tariff order 2010-11)

The basis on which the so called ‘surplus of Rs.3577 Cr.’ was arrived at in

the last year draft tariff order has been analysed and the findings are as

under:

Assumptions regarding Assessment of Surplus i) For the year 2010-11, a large quantum of additional capacity with

benefits for the National Capital Territory of Delhi was expected to be

commissioned during the financial year, primarily from projects which

were targeted to be commissioned prior to the Commonwealth

Games.

ii) The projection had considered a total power availability of 4526 MW

during the FY 2010-11. Out of this 1935 MW alone was on account of

new power stations which were expected to be commissioned during

FY 2010-11, thereby leading to an estimated additional energy of

about 20811 MUs. This additional power was estimated considering the

dates of commissioning of new power plants as per information

available from the website of the Central Electricity Authority (CEA)

and other sources, although delays in commissioning appeared

inevitable even at that time. A substantial part of this additional

energy was expected to be surplus after meeting the requirements of

Delhi utilities.

iii) It was assumed that the surplus power will be sold at an average rate

of Rs.5.75 per KWh against the average rate of about Rs. 3.25/KWh at

which power was expected to be purchased by the distribution utilities.

iv) The sale of surplus power at a profit was expected to result in a net

surplus of Rs. 3,577 Cr. with the three private distribution utilities.

In this context, it is appropriate to clarify the factual position based on

information available in the Commission at the present time.

i) As expected, there have been delays in commissioning of the new

power plants as detailed below:

a. In case of DVC power plants, the Consultant considered the PPAs

signed between DVC and Delhi utilities for supply of power, going upto

Hence as against the initial estimate of over 21,000 units being surplus, actual

surplus units were only about 5800. Even these surplus units could not generate any

monetary surplus for the reasons given below:

iii) The Central Electricity Regulatory Commission had in January, 2010 proposed

change in the scheme of Unscheduled Interchange (UI). The revised Indian

Electricity Grid Code, proposed to be implemented from the April 1, 2010

(draft of which was available months earlier) also stipulated that the

operating frequency benchmark would be raised to 49.5 Hz from the then

existing level of 49.2 Hz. Thus, the penal rate of Rs.12.22 / Kwh would be

applicable for overdrawals below 49.5 Hz. and it was expected that the

utilities in the country would refrain from overdrawing at a frequency below

49.5 Hz.

iv) As expected, there was a significant reduction in the overdrawals by the

distribution utilities on account of the penal rates applicable for overdrawals

below 49.5 Hz. following the introduction of the new regime of Unscheduled

Interchange (UI) vide CERC Order dated 28th April, 2010 (effective 3rd May,

2010). This resulted in drastic reduction in the average UI rates as well as the

rates for power sold on the power exchanges. The month-wise average

rates for UI and the rates on the power exchanges during the period

preceding the new Order of CERC and in the months following this Order is

given in Table 3 below:-

v) It would be seen from the above that the assumption regarding the premium

at which the surplus power would be sold did not remain valid and the

entire projected surplus did not materialise. Neither was the surplus power

assumed in the calculation of the surplus available nor there was a premium

on the sale of surplus power.

vi) The future implication of the new regime would be that even after the

commissioning of the new generating capacity from 2011-12 onwards, it

may not be possible to generate a surplus from a sale of surplus power

because there is now hardly any differential between the rates of power

purchase and the rates at which the surplus power can be sold. In fact,

there are times when the rates for sale of surplus power are lower than the

incremental rates for power purchase.

It would thus be seen that the assumptions on which the surplus of Rs. 3,577

Cr. was based no longer hold good.

Enhanced Cost of Power Purchase

Another factor which has a bearing on the tariff determination is the cost of

power purchase incurred by the distribution utilities. When compared with

the assumptions made while fixing the tariff for FY 2009-10, there has been a

significant increase in the cost of power purchase which is partly attributable

to the directions issued by this Commission vide letter No. F.

17(47)/Engg./DERC/2009-10/C.F. No. 2147/2956, dated 21.10.2009, wherein

the Commission had directed the distribution utilities to limit the load

shedding in their respective areas of supply to less than 1% of the total

demand, failing which they would be penalised @Rs.2.50/Kwh for every unit

of load shed.

Based on the audited accounts of the DISCOMs, the Commission, in its

advice dated 15.12.2010 to the GNCTD under Section 86(2)(iv) of the

Electricity Act, 2003, had observed that there has been a very considerable

increase in power purchase costs incurred by the distribution licensees during

FY 2009-10 and FY 2010-11. The power purchase cost which normally does

not exceed 80% of the revenue from retail sale of electricity has increased

much beyond this level. Table-4 of the advice which summarizes the

percentage of power purchase cost vs. total revenue billed is reproduced

below:-

The utilities are, therefore, not generating revenue even to make

payments for the purchase of power, leave alone other expenses. Thus, the

purported surplus of Rs. 3577 crore never materialized and the net result of

operation during 10-11 was a net shortfall in revenue vs. operating cost.

It may also be noted that Government of NCT of Delhi had

requisitioned the services of SBI Capital Markets Ltd. to examine the audited

accounts of the distribution utilities for FY 2007-08, 2008-09 and 2009-10 and

provide a financial analysis of the same in the light of claims made by the

distribution utilities regarding their poor financial health.

The Report concludes that the financial analysis contained in the

Report amply proves that the distribution utilities had not been able to pass

on the increase/decrease in operating expenses (primarily power purchase

costs) to the consumers in the same year. The liquidity position was

precarious which is evident from the low current ratio and acid test ratio.

Despite making book profits during 2009-10, the NOPAT (net operating profit

after taxes) and EVA (economic value addition) were negative due to

adjustments relating to review gaps to bring the EVA closer to cash flows.
