Declaration of Non-Display Information Usage

This declaration is required for all receivers of Oslo Børs real-time and/or delayed data feed, whether the information is received from Oslo Børs directly or indirectly via a vendor. Each member of the User Group in receipt of information from Oslo Børs is required to complete this declaration.

User Group is defined as “the User (the natural or legal person being the co-contractor of Oslo Børs regarding the Agreement) and its subsidiaries (a company in which the User owns directly or indirectly more than 50% of the issued share capital and over which it exercises effective control), including the User, and any holding company of the User and any subsidiary of such holding company.”

If you are receiving a real-time and/or delayed data feed but not using the information for non-display purposes, please complete section 1, 2 and 4.

This declaration will, when applicable, be added as a schedule to the Agreement for Non-Display Information Usage.

New Original Works means information that is created in whole or in part from the original received Information and that cannot be (1) readily reverse-engineered to recreate the original Information or (2) used to create other data that is a reasonable facsimile for the original Information. New Original Works does not include the processing of the real-time Information by software (e.g. Microsoft Excel) which is subject solely to the permanent access of a particular user and which, in connection with the displayed real-time information, merely enables individual calculations and/or the individualized display of information.

Other Internal Non-Display Usage

Internal non-display use of Information for purposes not covered by any of the above listed categories, including but not limited to risk management, compliance, order management, execution management, surveillance programs, quantitative analysis and portfolio management, as well as creation of indices and/or New Original Works that is not distributed externally. Customers holding a licence under the Automated Trading Application category are exempted the fee for Other Internal Non-Display Usage.

Section 4: Acceptance

The company confirms that it is/is not using real time and/or delayed information as stated in this declaration.

The company agrees to pay the applicable licence fees for Non-Display Information Usage as specified in the current Information Services Fee Schedule, available on the Oslo Børs website, as updated from time to time.

The company undertakes to promptly inform Oslo Børs by e-mail to sales@oslobors.no of any changes to the information declared above.
