on Union Square, in beautiful San Francisco, CA.

“Knowledge is Power” is the theme this year. Second Vice-President Linda Lynch has put together another excellent line up of seminars that will bring you up-to-date on many of the ever-changing, timely issues pertinent to our civil defense practices. In addition to obtaining your MCLE credits, the Annual Meeting is a wonderful time to network and socialize with old friends and also a time to meet new friends and business associates.

The Annual Meeting will start out with the always popular “Year in Review,” which will summarize the important 2012 appellate decisions. We also have a panel of experts who will analyze the California Supreme Court decision in Howell v. Hamilton Meats from a practical standpoint and will provide practice pointers ranging from discovery tools to verdict forms. Additionally, the Secondary Medicare Payor Act remains a “constantly changing playing field.” Our panel will provide you with a current update to help you to effectively handle these issues in your practice. The ADA Amendment Act and new government regulations have expanded the definition of the term “disability,” and a panel will address the strategies for defending disability discrimination claims after these changes. Another panel will provide tips on the use of §998 Offers and help you negotiate the potential traps and pitfalls of this cost shifting statute.

We are also offering sessions on cutting edge topics that will address such subjects as defending your case, not only in court, but in the social media that is now a pervasive part of our lives. For public entity practitioners, learn how to defend bullying and hazing cases, another developing area of potential legal liability. There are Construction Defect and Medical Malpractice panels for these specialty areas, as well. Lastly, both young lawyers and seasoned lawyers can benefit from the panels on “Rainmaking,” legal ethics and substance abuse.

After a long day of seminars, please join us in the Grand Ballroom for the President’s Reception. This is always an elegant event and it is excellent way to kick off the holiday season with friends, fine food and holiday beverages.

On Friday, our CDC Legislative Advocate, Mike Belote, should have much to report about on legislation and budget issues impacting the judiciary, especially in this election year. Mike Schonbuch will give an engaging presentation on jury selection, followed by inspirational speaker, Dr. Martha Kanter. We are honored to have Attorney General Kamala Harris as our Guest Speaker this year. She has been described as one of California’s “fastest rising political stars,”

and we look forward her dynamic and entertaining presentation.

My term as President will end at the Annual Meeting. It has been an honor to serve as your President this year. Greg Pike will be installed as President for 2013, and under his leadership, he and your Board of Directors will keep the ADC one of the preeminent defense organizations supporting defense practitioners.

This seminar will review the current state of the Centers for Medicare and Medicaid Services “Alerts” and Town hall meetings, the new “Fixed Percentage Option” of calculating recovery amounts and the new “Self Calculation Option”, the Medicare Secondary Payer Recovery Contractor process of identifying and collecting on claims including MSPRC’s new portal for both plaintiffs and defense to upload information, and cases involving the act running through the Federal Court system. The ADA Amendment Act (ADAAA) and accompanying U.S. Equal Employment Opportunity Commission’s recently enacted regulations made significant changes to the definition of the term “disability.” It is now easier than ever for an employee to be found to have a disability that an employer may have to accommodate. The panel will discuss how courts are analyzing and applying the ADAAA and whether the expanded definition has spurred more requests for accommodation and an increase in discrimination claims. Over the last few years, the courts have dramatically altered the landscape of insurance litigation. Whether the issue is what constitutes an “accident” (e.g., Delgado v. Interinsurance Exchange and its progeny), the contours of the “genuine dispute” doctrine (e.g., Wilson v. 21st Century, Howard v. American National), or the potential liability of an insurer for failing to settle in the absence of a settlement demand (Du v. Allstate), the stakes for insurers have never been higher – and that doesn’t even count the repercussions of the Supreme Court’s recent “all-sums-with-stacking” rule (State of California v. Dr. Kanter, as the U.S. Under Secretary of Education, is charged with planning and policy responsibilities to implement the nation’s goal for the U.S. to have “the best educated, most competitive work force in the world by 2020.” Dr. Kanter previously served as the chancellor of the Foothill-De Anza Community College District, one of the largest community college districts in the nation, serving more than 45,000 students, and in a variety of other jobs in post secondary education.

Under Secretary Kanter holds a doctorate in organization and leadership from the University of San Francisco. She received her master’s degree in education with a concentration in clinical psychology and public practice from Harvard University, and a bachelor’s degree in sociology from Brandeis University. This award was established in 1999 to honor the memory of Nathan Holt, a claims representative with the California State Automobile Association, who was a longtime, ardent supporter of the ADCNCN and its ideals. The award is presented at the ADCNCN Annual Meeting Luncheon to acknowledge a non-member who has contributed significantly to the relationship between defense counsel and their clients and who has also helped to further the goals of the Association of Defense Counsel of Northern California and Nevada.
