Tentative Selection of Jerrold N. Poslusny, Jr.

In December 2014, a merit selection committee was appointed by the Judicial Council of the Third Circuit to recommend candidates for a future vacancy on the United States Bankruptcy Court for the District of New Jer-sey. A public notice of the position vacancy was widely circulated to publicize the vacancy, applications were received, and interviews of applicants were conducted. Following its deliberations, the committee submitted a report and recommendations to the Judicial Council for the Third Circuit. After considering the recommendations of the selection committee, the Judicial Council conducted interviews with the leading candidates and then made its recommendations for the bankruptcy judgeship vacancy to the appointing authority, the United States Court of Appeals for the Third Circuit. Having considered the Judicial Council's recommendations, the United States Court of Appeals has found Jerrold N. Poslusny, Jr., of Sherman, Silverstein, Kohl, Rose & Podolsky, P.A. of Moorestown, NJ to be most qualified and is, at present, considering his appointment to the bankruptcy judgeship. This notice is intended to solicit written comments concerning the qualifications of Jerrold N. Poslusny, Jr. for this position. The Civil Procedural Rules Committee is planning to propose to the Supreme Court of Pennsylvania the rein-statement and amendment of Pa.R.C.P. No. 230.2 governing termination of inactive cases, for the reasons set forth in the accompanying explanatory report. Pursuant to Pa.R.J.A. No. 103(a)(1), the proposal is being pub-lished in the Pennsylvania Bulletin for comments, suggestions, or objections prior to submission to the Supreme Court. Any reports, notes, or comments in the proposal have been inserted by the Committee for the convenience of those using the rules. They will neither constitute a part of the rules nor will be officially adopted by the Supreme Court. Additions to the text of the proposal are bolded and underlined; deletions to the text are bolded and bracketed. The Judges have completed the MARCH 2015 civil jury term. One civil case reached verdict during the March civil term and the summary is as follows: Sheila K. Mayes and Stacey Mayes, husband and wife, v. Timothy R. Shope, M.D., Milton S. Hershey Medical Center, and Penn State Milton S. Hershey Medical Center (2011 CV 8598 MM) In February 2008, Plaintiff Sheila Mayes underwent a laparoscopic gastric bypass procedure which was per-formed by Defendant Timothy R. Shope. Initially, Ms. Mayes did well post-procedure. However, by late sum-mer or early fall 2008, Ms, Mayes began to experience significant abdominal pain, primarily after eating. Ms. Mayes reported her symptoms to Dr. Shope, who initially believed her pain was caused by gallstones. Accord-ingly, Dr. Shope performed surgery to remove Ms. Mayes' gallbladder on December 10, 2008. Not long after the surgery, Ms. Mayes began experiencing similar pains as she had been prior. She again reported her symptoms to Dr. Shope, who believed her pain was now caused by a pancreatic problem and/or an ulcer and ordered a study called MR cholangiogram. The results were normal. Ms. Mayes pain continued and on February 3, 2009, Dr. Shope performed an upper GI endoscopy. Ms. Mayes' pain continued and on April 3, 2009, she was admitted to the emergency room at a hospital close to her home. At that time, an x-ray revealed a partial small bowel ob-struction, but was told by hospital staff that further medical action was not necessary. On September 3, 2009, Ms. Mayes was again admitted to the emergency room at her local hospital where she was diagnosed with an internal hernia and small bowel obstruction. She then underwent two (2) surgeries in an attempt to salvage her damaged small bowel, however it was irreversible and she required resection of her entire small intestine. Thereafter, Ms. Mayes was transferred to the University of Pittsburgh Medical Center where it was determined that she was an acceptable candidate for a small bowel transplant procedure and was placed on the transplant list. Ms. Mayes underwent small bowel transplant surgery in February 2010. Issues for trial included whether or not Dr. Shope deviated from the accepted standard of care by failing to diagnose and correct an internal hernia and damages. Plaintiffs sought compensatory damages, past medical expenses, future medical expenses, future wages, and miscellaneous damages. Both parties presented medical experts who disagreed as to whether Dr. Shope negligently failed to diagnose the internal hernia. Plaintiffs de-manded $4,000,000.
