, Whereas, the Finance Department vide communication No. ET /Estt/154/2012 dated 11.08.2015 referred ninety three (93) posts (OM=49, RBA=21, SC=09, ST=10, OSC=Ol & ALC=03) of Sub-Inspector (Divisional Cadre Kashmir) of the J&K Excise and State Taxes (Subordinate) Service to J&K Services Selection Board for selection of suitable candidates; and

2. Whereas, the Jammu & Kashmir Services Selection Board vide No. SSB/Secy /Selj2019 /148-54 dated 08.01.2019 forwarded select list of ninety three (93) candidates for the post of Sub-Inspector, Divisional Cadre Kashmir indicating therein that the recommendations in favour of eight (08) candidates is withheld for want of certain clarifications; and

3. Whereas, the Finance Department vide Government Order No. 42-FD of 2019 dated 22.01.2019 issued appointment orders in favour of eighty five (85) Sub-Inspectors of Divisional Cadre Kashmir. The Jammu & Kashmir Services Selection Board vide No. SSB/Secy /Selj2019 /750-52 dated 24.01.2019 and No. SSB/Secy /Selj18/2019 /1855-57 dated 12.03.2019 later released recommendations in' favour of seven (07) candidates and the Finance Department vide Government Order No. 94-FD of 2019 dated 07.02.2019 and G.O.No 342-FD of 24.04.2019 issued appointment orders in their favour; and

4. Whereas, the State Taxes Commissioner/Excise Commissioner vide 302-II-Adm/8181/CST dated 12.02.2019 and No.EC/Adm/144/5020 dated 06.03.2019 later communicated that thirty six (36) appointees did not join in the department; and

5. Whereas, Finance Department vide Notice dated 27.03.2019 offered one final opportunity to these thirty six (36) appointees who did not join within the stipulated time to report to the concerned HoDs and also furnish reasonable justification for cause of delay within ten (10) days of issuance of the notice. As per the communication No. EC/ Adm/appt-sub-Insp/Ss dated 15.05.2019 and No. 1302-Adm/97-98/CST dated 16.04.2019 received from Commissioner, State Taxes, J&K, Jammu and Excise Commissioner, J&K only one (01) candidate has joined in the State Taxes Department; and

6. Whereas, the Finance Department vide Government Order No. j6q ... F{) oa ~/1dated J.,o '06 ';"o!q cancelled the appointments of the following thirty five (35) candidates:

9. The appointment of the above said candidates shall be subject to fulfillment of the following conditions:-

A) The appointment including pay, service etc shall be governed in terms of J&K Special Recruitment Rules, 2015 [SRO-202 dated 30-06-2015].

B) The appointee shall be allowed to join only on production of the following certificates in original:-

1. Academic/Technical Qualification Certificates. 2. Matriculation/Date of Birth Certificate. 3. Health Certificate issued by Chief Medical Officer. 4. Permanent Resident Certificate issued by the Competent Authority. 5. Certificates from the District Industries Centre (DIC) and District Employment &

Counseling Centre to the effect that no loan under the self-employment scheme has been taken by the appointee.

6. Reserved Category Certificate (in case of candidates belonging to reserved category).

C) The appointment of the candidate as Sub-Inspector shall further be subject to the following conditions:-

i. The appointee shall give an undertaking duly attested by the First Class Magistrate in the shape of an affidavit to the effect that in case adverse report about his/her character and antecedents is received from Inspector General of Police, (ClD), J&K to whom a reference shall be made by the concerned HoD, the candidate shall have no right to claim his/her appointment as Sub Inspector and his/her appointment as such shall be deemed to have been cancelled ab-initio.

ii. If on verification, the certificate(s) produced by the appointee are proved to be fake or forged, the appointment shall be cancelled ab-initio.

iii. The salary of the appointee shall not be drawn and disbursed to him/her unless the satisfactory reports in respect of (i) and (ii) above are received in his favour.

iv. The appointee shall be on probation for a period of 05 years and shall undergo and qualify the Departmental Examination (Excise and Taxation Part-I Examination) within the period of probation.

v. The inter-se-seniority of the appointee shall be strictly as per his merit in the select list.
