This ECAD Tech Memo is associated with CSX’s design refinements to Project B9’s proposed signal network that require additional right-of-way (ROW) acquisition, beyond what was identified during the Phase I, at the following two locations: 1. “Signal 12” – Located east of Archer Avenue (See Exhibit 1) Signal 12’s construction footprint is proposed to extend beyond the existing ROW and the previous Environmental Survey Request (ESR) boundary on the west side by an area of 15 ft. (perpendicular to the tracks) by 50 ft. This ECAD Tech Memo is associated with CSX’s design refinements to Project B9’s proposed signal network that require additional right-of-way (ROW) acquisition, beyond what was identified during the Phase I, at the following two locations:

1. “Signal 12” – Located east of Archer Avenue (See Exhibit 1)

A Special Waste Assessment (SWA) was performed for the entire Project B9 area, including the additional areas of proposed ROW required to accommodate the signal system refinements previously described. The SWA recommended a Preliminary Environmental Site Assessment (PESA) be performed for Project B9. A PESA was originally completed for the B9/EW1 project limits by Hanson Professional Services, Inc. (Hanson) in November of 2009. Patrick completed a new PESA for the B9/EW1 Project in 2014 due to the length of time that had passed since the Hanson PESA was completed (more than 3 years). A new PESA (for only the limits of Project B9) was performed as part of this Tech Memo to determine the existence of recognized environmental conditions (per ASTM Practice E 1527-13), as well as to determine risk findings (per Section 5.2 of the CREATE Procedures) for the project or certain areas of the project. In addition to the signal system refinements and expanded project limits, the Phase II design for Project B9 is proposing work that was not anticipated in the original Phase I or any of the subsequent ECAD Tech Memos. The additional proposed project scope includes:

1. Track work on the bridge carrying CSX tracks over Archer Avenue The track work on the Archer Avenue bridge will be confined to the top of the bridge deck and will not impact areas outside of the existing ROW or environmental survey request (ESR) boundary.

2. Superstructure replacement of the bridge carrying CSX tracks over the Ingredion (formerly known as Corn Products) lead (south of 64th Street) The superstructure replacement work over the Ingredion lead track will consist of replacement of the beams and deck. The existing bridge abutments will be reused, but modifications to the backwalls and wingwalls are anticipated. The bridge is not historic. The work will not impact areas outside of the existing ROW or ESR boundary.

B9/EW1 ESRF Addenda A thru G Documentation of the environmental analysis for each of the ECAD environmental categories related to Addenda A thru G is documented in the project ECAD dated July 2010 prepared by Hanson, ECAD Tech Memo dated January 2013 prepared by Patrick, ECAD Tech Memo dated June 2014 prepared by Patrick, and ECAD Tech Memo dated November 2014 prepared by Patrick. Patrick analyzed the environmental resources for potential impacts resulting from the implementation of the revised B9 project footprint. The following is a summary of Patrick’s analysis to supplement the approved ECAD (dated July 2010) analysis, approved Technical Memorandum (dated January 28, 2013), approved Technical Memorandum (dated June 30, 2014), and approved Technical Memorandum (dated November 3, 2014).

I. Social/Economic: The refined scope work does not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014

Technical Memoranda for I.1-Relocations, I.2-Changes in Travel Patterns, I.3-Economic Impacts, I.4-Changes in Land Use & Economic Development, I.5-Community Cohesion, I.6-Public Facilities and Services, I.7-Title VI and Other Protected Groups, I.8-Environmental Justice, and I.9-Bicycle and Pedestrian Facilities. The additional minor ROW acquisition required for the 87th Street Signals will impact land owned by a privately owned business, Micron Metal Finishing. The Micron Metal Finishing property that will be acquired is immediately adjacent to the west side of CSX’s existing ROW. The 20 ft. by 50 ft. portion of the property is unused and not adjacent to any building structures. The ROW acquisition will not impact Micron Metal Finishing’s current operations. Micron Metal Finishing is not a disadvantaged, minority or woman owned business. The other newly proposed minor ROW acquisitions are from property owned by Commonwealth Edison (ComEd). The ComEd properties, along the east side of the 87th Street Signals (8640 Beloit Avenue) and Signal 12 (6401 S Archer Avenue) are used for ComEd’s infrastructure to support its aerial utilities.

II. Agricultural: The currently proposed work does not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

III. Cultural: There are no proposed changes to III.1-Archaelogical Sites, III.2-Historic Bridges, and III.3-Historic Districts and Buildings as documented in the previously approved July 2010 ECAD and January 2013, June 2014, and November 2014 ECAD Tech Memoranda.

IV. Air Quality: The currently proposed work does not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

V. Noise & Vibration: The proposed design modifications do not change the analysis or

results documented in the July 2010 ECAD or the January 2013, June 2014, November 2014 Technical Memoranda for this resource.

VI. Energy: The proposed design modifications do not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

VII. Natural Resources: There are no anticipated changes to item VII as documented in the previously approved July 2010 ECAD, January 2013, June 2014, and November 2014 ECAD Tech Memoranda for this resource.

VIII. Water Quality/Resources: The proposed design modifications do not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

IX. Flood Plains: The proposed design modifications do not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

X. Wetlands: The proposed design modifications do not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

XI. Special Waste: In order to comply with IDOT’s policy on the validity or “shelf-life” of special waste assessments, an updated PESA was performed by Patrick since the most recent PESA for Project B9 completed by Patrick in June 2014 is older than 3 years and the fact that the project footprint was increased slightly in the area of the signal system refinements.

The PESA was performed to determine the existence of recognized environmental conditions (per ASTM Practice E 1527-05) and to determine risk findings (per Section 5.2 of the CREATE Procedures) for the specified project areas. The PESA performed by Patrick extends along approximately 4 miles of railway through Summit, Bedford Park, and Bridgeview, Illinois. The PESA analysis includes the entire limits of the B9 project, including the current proposed scope of work. The PESA completed by Patrick is attached as Exhibit A. Two locations from the 2014 PESA were not included in this PESA: one was located within Project EW1 and not Project B9; and one which was northeast of the intersection with the CN tracks at the northwest corner of the Project B9 area, where the planned work has already been completed. The conclusions of the PESA are that within the project limits one location contains a number of risk findings. The location is for noise walls and siding extension along the IHB/B&OCT line. The findings at the proposed project location were determined to be “Low Risk” and a detailed explanation of each low risk finding is provided in the PESA. This assessment revealed that there are no recognized environmental conditions in connection with the Site and therefore a Preliminary Site Assessment (PSI) is not required.

XII. Special Lands: The proposed design modifications do not change the analysis or results

documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for XII.1-4(f), XII.2-6(f), and XII.3-Open Space Lands Acquisition and Development (OSLAD) Act Lands.

XIII. Other Issues: The proposed design modifications do not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for this resource.

XIV. Permits Required: The proposed design modifications do not change the analysis or results documented in the July 2010 ECAD or the January 2013, June 2014, and November 2014 Technical Memoranda for required permits.

Environmental Commitments The following two environmental commitments included in the original approved ECAD are still in effect:

1. Noise and Vibration – The noise and vibration analysis for this proposed project will need to

be reassessed if: a) the project is revised in a manner in which impacts of the project may change due to the project revisions (e.g., a new track alignment is moved closer to a receptor), or b.) the CREATE Program’s train model is updated due to projects being removed of added to the CREATE Program. The following maintenance procedures will be accomplished by the rail industry to mitigate vibration impacts through minimizing vibration sources: regularly scheduled rail grinding; wheel truing programs; vehicle reconditioning programs; and use of wheel-flat detectors.

2. Permits – Procurement and compliance with all federal, state, and local, permits (NPDES, etc.), required for this proposed improvement, will be the responsibility of the individual railroad(s), or their consultants or contractors, as applicable.

The following three environmental commitments included in the January 2013 ECAD Tech Memo are still in effect. Minor updates/clarification are indicated in italicized text.

1. Air Quality – The Belt Railway Company of Chicago will ensure completion of yard

improvements including replacement of all Clearing Yard switching engines to effect a reduction in NOx emissions for the build condition. IDOT, in coordination with FHWA, has determined that the replacement of the Clearing Yard switching engines should be completed before construction of the B9/EW1 project is completed.

2. Noise and Vibration - It has been determined that a feasible and reasonable noise wall is desired by the community at the following location:

a. City of Chicago (Wall R26) – along the BRC Tracks (75th Street), from Central Park

Avenue to St. Louis Avenue and along the CN tracks (Central Park Avenue) from 75th Street to 195 feet south: This noise wall would be located on Chicago Department of Transportation (CDOT) right-of-way.

It is recommended that this noise wall be implemented as part of the EW1 Project. The final decision on implementing all noise mitigation measures will be made upon the completion of the project design and public involvement process. During final design, the City of Chicago (including the alderman) will be afforded the opportunity to provide input on noise wall design. Additionally, BRC and the City of Chicago will coordinate during final design to develop an agreement that addresses ownership and maintenance of the recommended noise wall. FHWA and IDOT will have the opportunity to review this agreement as part of the PS&E review and prior to its execution.

3. Wetlands - Prior to the project being awarded for construction, 1.52 acres of wetland credits

must be purchased from an approved wetland bank as mitigation for the wetland impacts due to the project. The impacts to the existing wetlands are proposed to be mitigated by the purchase of credits from the Sauk Trail Wetland General Bank. See the Wetland Report and Coordination in Exhibit G [of the January 2013 Tech Memo] for further information.

The following two environmental commitments included in the June 2014 ECAD Tech Memo are still in effect. Minor updates/clarifications are noted in italicized text.

1. Noise and Vibration - It has been determined that a feasible and reasonable noise wall is

desired by the community at the following location:

a. Village of Bridgeview (Wall R12) – along the CSX tracks, from 79th Street to 75th Street. This wall will be Option 3 – a wrapped wall that requires some property acquisition; all 50 impacted residences would be benefited.

Based on the preliminary design, it is recommended that this noise wall be implemented as part of the B9 Project. The final decision on implementing all noise mitigation measures will be made upon the completion of the project design and public involvement process. During final design, IDOT and CSX will coordinate with the Village of Bridgeview, as needed, on the final noise wall location and design details. The issues to be coordinated may include, but may not be limited to, the analysis of existing and proposed drainage conditions

in the area of the proposed noise barrier, as well as finalizing the approach for property acquisition, ownership and maintenance of the proposed noise barrier. Should the Village and CSX develop an agreement that addresses ownership and maintenance of the recommended noise wall, FHWA and IDOT will have the opportunity to review this agreement as part of the PS&E review and prior to its execution. The acquisition of private property will be completed in accordance with the federal Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 and the IDOT Land Acquisition Manual.

2. Prior to approval of the Phase II plans, specifications, and estimates (PS&E), IDOT and CSX will work with the Village of Bridgeview to develop and implement any agreements governing land acquisition, ownership and maintenance of the proposed noise barrier.

The following environmental commitment included in the November 2014 ECAD Tech Memo is still in effect:

1. If excavated soils require off-site disposal, soil sampling is required to meet the requirements of an off-site disposal facility and in accordance with Illinois Administrative Code (IAC) Title 35 Part 1100 Clean Construction or Demolition Debris (CCDD) Fill Operations and Uncontaminated Soil Fill Operations (if considering soil disposal in an uncontaminated soil disposal facility) or in accordance with a Subtitle D landfill facility. If excavation is planned deeper than two feet in the area covered by the November 2014 ECAD Tech Memo, a PSI is recommended.

As a result of the proposed design refinements and scope of work added during the Phase II design to Project B9 included in this ECAD Tech Memo, there is one new environmental commitment for the B9 project:

1. Asbestos-containing material (ACM) and lead-based paint (LBP) surveys on all components

of the Ingredion lead track bridge that will be disturbed by Project B9 are to be completed prior to the replacement of the beams and deck.
