1 The tenders shall be disqualified / Rejected due to following

reasons:

1.1 Tenders/Bids submitted in forms other than CPRI prescribed

forms.

1.2 Tenders submitted without tender document fee (non-

refundable), tender processing fee (non-refundable) and Earnest

Money Deposit (EMD) (refer Sl no. 13.6 for more details).

1.3 Tampering OR deviations made to the terms and conditions. 1.4 The tenders / Bids submitted in the language other than

prescribed by the tenderer.

2 The tender/Bid documents are non-transferable. The bid can only be

submitted in the name of the bidder in whose name the bid

document has been issued.

मिविदा /बोली दस्तािेज अितंरणीय हैं । बोली केिल बोली लगािे िाले के िाि पर जिा की जा सकती है, जसके िाि पर बोली दस्तािेज जारी कया गया है।

3 At any time prior to the bid closing date, CPRI may for any reason,

whether at its own initiative or in response to clarifications

requested by the prospective bidder(s), modify the bidding

document by amendment(s) through Addendum / corrigendum . All

prospective bidders who have received the bidding documents will

be notified of the amendments by appropriate mode of

communication.

बोली सिापि मतमथ से पहले कसी भी सिय, सीपीआरआई कसी भी कारण िश, अपिे खुद के पहल पर अथिा भािी बोलीदाता द्वारा अिरुोमधत स्पष्टीकरणि के जिाब िें, अिशेुष / शुविपत्र के िाध्यि से संशोधि द्वारा बोली दस्तािेज को संशोमधत कर सकता है । संपकि के उमचत िाध्यि द्वारा बोली लगािे िाले सभी भािी बोलीदाताव ं को संशोधिि के बारे िें सूमचत कया जाएगा।

4 Generally no request for extension of Bid Closing Date will be

entertained. However, in case of any changes in the specifications,

inadequate response or for any other reasons, CPRI may at its

discretion, extend the bid closing date and/or time.

सािान्द्यत: बोली सिापि मतमथ को बढािे के अिरुोध पर विचार िहीं कया जाएगा। तथावप, विमिदेशि िें कसी भी पररितिि के िािले िें, अपयािप्त प्रमत क्रया या कसी अन्द्य कारणि से, सीपीआरआई अपिे वििेक पर बोली सिापि मतमथ और / या सिय बढा सकता है ।

5 Prospective bidders are advised to ensure that their bids are

complete in all respects and conform to CPRI’s terms, conditions

and bid evaluation criteria of the tender. Bids not complying with

CPRI’s requirement may be rejected without seeking any

clarification.

भािी बोलीदाताव ं को यह सुमि ित करिे की सलाह दी जाती है क उिकी बोमलयाँ सभी प्रकार से पणूि हि तथा सीपीआरआई के मिबधंि, शतों तथा मिविदा के बोली िूल्यांकि िािदंड के अिरुूप हो । सीपीआरआई की आिश्यकता का अिपुालि ि करिे िाले बोमलयि को वबिा कसी स्पष्टीकरण के अस्िीकार कर दया जा सकता है ।

6 Other than e-tenders , the Bids received after Bid Closing Date &

Time will be treated as “Late Bids”. In case of tenders where Bid

Security has been called for, the late bids shall be returned to the

bidders on request OR in all other cases, the late bids will be

destroyed by CPRI within 180 days.

ई-मिविदा के अलािा, बोली सिापि मतमथ और सिय के बाद प्राप्त बोमलयि को "विलंब बोमलयाँ" िािी जाएंगी।मिविदाव ंके िािले िें जहां बोली सुरक्षा िाँगी गई है, विलंब बोमलयि को बोलीदाताव ंके अिरुोध पर िापस कर दया जाएगा या अन्द्य सभी िािलि िें, विलंब बोमलयि को सीपीआरआई द्वारा िष्ट कर दया जाएगा।

7 CPRI reserves the right to accept / reject or prefer any offer either

in full or in part or annul the bidding process and reject all bids at

any time prior to award of PO / contract without thereby incurring

any liability to the affected bidder (s) or any obligation to inform the

affected bidder(s) of the ground for CPRI`s action. CPRI also

reserves the right to split the order between two or more successful

bidders.

सीपीआरआई स्िीकार / अस्िीकार करिे अथिा या कसी भी प्रस्ताि को पणूि या आमंशक रूप से पसंद करिे या बोली प्र क्रया को रद्द करिे तथा क्रय आदेश / ठेका प्रदाि करिे से पहले कसी भी सिय सभी बोमलयि को अस्िीकार करिे का अमधकार रखता है, जसके चलते प्रभावित बोलीदाताव ंकी वर सीपीआरआई कोई उत्तरदामयत्ि िही उठाएगा अथिा सीपीआरआई की कारििाई के कारण प्रभावित बोलीदाताव ंको सूमचत करिे की कोई भी जम्िेदारी िही है । सीपीआरआई दो या दो से अमधक सफल बोलीदाता के बीच आदेश को विभा जत करिे का अमधकार भी रखता है।

8 The bidder shall have to be an Entity Registered in India in

accordance with law and shall follow Indian laws, regulations and

standards.

बोलीदाता काििूी तौर पर भारत िें पजंीकृत एक संस्था होिी चा हए तथा भारतीय काििू, मियिि और िािकि का पालि करिा चा हए ।

9 Any bidder from a country which shares a land border with India

will be eligible to bid in any procurement whether goods, services

only if the bidder is registered with the competent authority under

rule No. 144(xi) of GFR 2017. a copy of the registration certificate

is to be submitted failing which the bid will be rejected.

कोई भी देश का बोलीदाता जो भारत के साथ सीिा साझा करता हो , िह कसी भी खरीद िें चाहे सािाि, सेिाव ं िें बोली लगािे के मलए पात्र होगा, जब बोलीदाता िे GFR 2017 के मियि स.ं 144 )xi) के तहत सक्षि प्रामधकारी के साथ पजंीकृत कया हो । पजंीकरण प्रिाण पत्र की एक प्रमत प्रस्तुत करें अन्द्यथा उसकी बोली रद्द कर दी जाएगी ।

10 The foreign bidders can only participate through their Indian

subsidiary office established in India.

Indian subsidiaries of foreign bidders shall further meet the

qualifying criteria in terms of capability, competency, Financial

position, past performance etc., as prescribed in the tender.

विदेशी बोलीदाता केिल भारत िें स्थावपत अपिे भारतीय सहायक कायािलय के िाध्यि से भाग ले सकते हैं । विदेशी बोलीदाताव ं की भारतीय सहायक कंपिी मिविदा िें यथा मिधािररत क्षिता, योग्यता, वित्तीय स्थमत, वपछले प्रदशिि आ द के िािले िें योग्यता िािदंडि को परूा करिा होगा ।

11 The bids shall be in Indian National Rupees (INR) only in respect of

local content. बोली केिल स्थािीय सािग्री के संबधं िें भारतीय राष्ट्रीय रुपए )INR) िें होगी।

12 Bidder’s offer must conform in all respects with the applicable

specifications, drawings and terms and conditions of the tender. Any

deviation from the tender specifications or terms and conditions

must be clearly and explicitly stated. In order to be considered

responsive, bidder’s offer must specifically include the following

statement:

We certify that our offer complies with all Notice Inviting Tender

(NIT) requirements and Specifications except for the following:

List of exceptions OR If none, state “None”.

Marking and Sealing of Bids :

Manual / Limited Tender :

The original offer in bidders own original letterhead duly signed by

authorized signatory and stamped should be marked as ORIGINAL

and the copies as DUPLICATE. All the copies of offer should be

put in a sealed envelope bearing the following details on the left

hand top corner:

i) CPRI’s Tender No.

ii) Bid closing date

iii) Brief Description of materials

iv) Bidder’s Name, official address with Phone Nos. & Email

address.

13.1 TWO BID SYSTEM: bidders shall prepare the technical

commercial bids in triplicate separately and shall put these in two

separate envelopes marked as “Techno- commercial bid” ie

“Unprice Bid” and “Price Bid”. Both the envelopes containing the

“Unprice Bid” and “Price Bid” should be super scribed with Bid

Closing Date., TENDER no, bidder`s name and brief description of

materials, and sealed and then put inside another envelope super

scribing the TENDER no., Bid Closing Date, bidder`s name and

brief description of materials. The “Unprice Bid” shall contain all

techno-commercial details except the prices which shall be kept

blank. The “Price Bid” must contain the price schedule and the

bidder’s commercial terms and conditions. The bid bond /Bid

security in original should be submitted along with the techno-

commercial security in original should be submitted along with the

techno-commercial bid.

NOTE:

Bidder’s Name, Address, Phone Nos., and Email address as

described above should be indicated on the inner envelope to enable

CPRI to return the late bid to the bidder, if necessary.

13.1 दो बोली प्रणाली : बोलीदाता तकिीकी और िा ण तयक बोमलयि को अलग से तीि प्रमतयि िें तैयार करेंगे तथा इन्द्हें दो अलग-अलग मलफाफि िें "तकिीकी बोली" यािी "कीित र हत बोली" और " कीित स हत बोली" के रूप िें मच ित कया जाए। " कीित र हत बोली" और "कीित स हत बोली" िाले दोिि मलफाफे के ऊपर बोली सिापि मतमथ के साथ मिविदा संख्या, बोलीदाता का िाि और सािमग्रयि का सं क्षप्त वििरण मलखा जािा चा हए तथा बदं कर उसे फर एक और मलफाफा िें डाल कर उसके ऊपर मिविदा सं , बोली सिापि मतमथ, बोलीदाता का िाि और सािग्री का स ंक्षप्त वििरण मलखा जािा चा हए । "कीित र हत बोली" िें कीित जसे खाली रखा जाएगा को छोड़कर, सभी तकिीकी-िा ण तयक वििरण दया जािा चा हए । “कीित स हत बोली” िें िूल्य सूची और बोलीदाता के िा ण तयक मिबधंि और शतें शामिल होिी चा हए। िूल बॉन्द्ड / बोली सुरक्षा को तकिीकी-िा ण तयक बोली के साथ प्रस्तुत कया जािा चा हए।

िोट : जसैा क ऊपर बताया गया है, बोलीदाता का िाि, पता, फोि िबंर और ईिेल पता आतंररक मलफाफे पर दशािया जािा चा हए ता क य द आिश्यक हो, तो सीपीआरआई विलंब बोली को बोलीदाता को िापस कर सकें ।

13.2 The Bid Security /EMD payments as indicated in the

tender document can be effected as follows :

DD/BG/FDR etc., payments shall have to be submitted in Original

along with the techno-commercial bid documents on OR before

tender closing date and time.

13.2 मिविदा दस्तािेज िें बताए अिसुार बोली सुरक्षा / बयािा जिा रामश भुगताि को मिम्ि प्रकार से प्रभावित कया जा सकता है: डीडी / बीजी / एफडीआर आ द, भुगताि मिविदा सिापि मतमथ और सिय से पहले तकिीकी-व्यािसामयक बोली दस्तािेजि के साथ िलू िें प्रस्तुत कया जािा होगा ।

13.3 E –Tenders :

Bidder shall submit the PRICE bid & techno commercial

bid online only.

The Bid Security /EMD payments as indicated in the tender

document can be effected as follows :

a) through e- payment gateway for online payments. b) DD/BG/FDR etc., payments shall have to be submitted in

Original along with the techno-commercial bid documents

on OR before tender closing date and time.

13.4 Pre qualification documents if any as prescribed in tender

shall be submitted along with techno-commercial bid documents

and hard copies of technical catalogues, literatures, pamphlets and

related documents, etc., except the PRICE bid shall also be

submitted along with techno-commercial bid documents.

Note: The prospective bidders shall have to refer the Appendix -

III For guidelines, information and instructions regarding e-tender

portal for participating in e tender.

13.6 Earnest Money Deposit / Bid Security :

13.6.1 Validity of EMD: The Bid Security shall remain valid for

a period of 45 ( Forty-Five) days beyond the final bid validity

period.

13.6.2 Bid Validity: Minimum 180 days (six months) from the

date of tender opening.

departments, Central Public Sector undertakings, Central

autonomous bodies and other state owned public organisations and

Startups recognized by DIPP, MSE units themselves ( not their

dealer/distributor ) registered with District Industry Center or

Khadi and Village Industries Commission or Khadi and Village

Industries Board or Coir Board or National Small Industries

Corporation(NSIC) or Directorate of Handicrafts and Handloom or

any other body specified by Ministry of MSME. However, the valid

registration certificate issued by such authorities indicating the

category of goods and services for which they are registered must be

submitted.

Note: This policy is meant for procurement of only goods produced

and services rendered by MSEs and not for any trading activities by

them.

13.6.3 छूट : कें रीय सरकार विभाग, कें रीय साििजमिक के्षत्र के उपक्रि, कें रीय स्िायत्त मिकाय और अन्द्य रातय के स्िामित्ि िाले साििजमिक संगठि और डीआईपीपी द्वारा िान्द्यता प्राप्त स्टाटिअप, एिएसई इकाइयां स्िय ं)उिके डीलर / वितरक िहीं( जला उद्योग कें र या खादी और ग्रािोद्योग आयोग या खादी और ग्रािोद्योग बोडि के साथ पजंीकृत या कॉयर बोडि या राष्ट्रीय लघ ुउद्योग मिगि )एिएसआईसी( या हस्तमशल्प और हथकरघा मिदेशालय या एिएसएिई िंत्रालय द्वारा मि दिष्ट कोई अन्द्य मिकाय के मलए बायािा जिा रामश की छूट दी गई है । हालां क, ऐसे अमधकाररयि द्वारा जारी कया गया िधै पजंीकरण प्रिाण पत्र िाल और सेिाव ंकी श्रणेी को दशािता है जसके मलए िे पजंीकृत हैं उन्द्हें प्रस्ततु कया जािा चा हए।

13.6.4 Return/Refund of EMD:

For unsuccessful bidders: EMD will be refunded / Returned after

the finalization of the tender without any interest with in 30 days of

placement of Purchase Order on successful bidder.

13.6.5 For successful bidders: EMD shall be refunded / Returned

refunded on submission of Performance Security Deposit.

13.6.6 Forfeiture of EMD: A bidder’s Bid Security will be

forfeited if the bidder withdraws or amends its/his tender or impairs

or derogates from the tender in any respect within the period of

validity of the tender or if the successful bidder fails to furnish the

required Performance Security within the specified period.

The supplier shall ensure supply of spares, materials and

technological support for the entire life of the

equipment/goods/facility.

Arbitration proceedings shall be instituted in India only and all

disputes shall be settled as per applicable Indian Laws (Refer Sl No.

30.2).

Statutory laws/regulations including the labour and environmental

laws shall be strictly complied with during supply, storage, erection,

commissioning and operation process. A regular compliance report

shall be submitted to CPRI as and where applicable.

18 Country of origin of the equipment/material shall be provided in the

bid. बोली िें उपकरण / सािग्री का उद्गि देश का उल्लेख करें।

The bidder shall have to be an entity registered in India in

accordance with law and follow Indian laws, regulations and

standards.

बोलीदाता काििू के अिसुार भारत िें पजंीकृत इकाई होिी चा हए और भारतीय काििूि, विमियिि और िािकि का पालि करिा चा हए।

The manufacturers/ supplier shall list out the products and

components producing Toxic E-Waste and other waste as may be

specified. It shall have an Extended Producers Responsibility (EPR)

so that after the completion of the lifecycle, the materials are safely

recycled/ disposed of by the manufacturer/ Supplier

Section –II : Opening of Bids खंड-II: बोमलयि का खुलिा

21 Bid Opening:

21.1 Limited /Manual Tenders :

Bidder or their authorized representative (only one person per

bidder) will be allowed to be present at the time of opening of the

Bids.

21.2 E-Tenders:

Bidders presence is not required at CPRI since tenders will be

opened On-line and the content of bids can be viewed by the bidder

online.

21.3 Two Bid System: (applicable for manual/limited and e-

tender) Only techno-commercial bids (Technical) will be opened in

the first instance on the bid opening date and time after completion

of scrutiny and evaluation by the technical committee wrt the

tendered specification.

Thereafter in the 2nd

instance the commercial bids of only the

qualified techno-commercial offers will be opened on an announced

date and time.

In case of any unscheduled holiday on the bid opening date, the

Bids will be opened on the next working day. Accordingly, Bid

Closing Date /time will get extended up to the next working day.

Any vague and indefinite expressions such as “Subject to prior

sale”, “Prices ruling at the time of dispatch”, “Subject to availability

of materials” etc. will not be considered.

After tender opening CPRI may at its discretion ask the bidder/s

for clarifications of its bids. The request for clarification and

response shall be in writing /electronic mail, The reply of the bidder

should be restricted only to the clarifications sought. However

change in Price or Substance of the Bid is not accepted.

21.3 दो बोली प्रणाली: )िैिअुल / सीमित और ई-टेंडर के मलए लागू( केिल तकिीकी-िा ण तयक बोमलयां )तकिीकी(, प्रस्तुत विमिदेश के संबधं िें तकिीकी समिमत द्वारा जांच और िूल्यांकि के परूा होिे के बाद बोली खोलिे की तारीख और सिय पर पहले उदाहरण िें खोली जाएंगी। इसके बाद दसूरे उदाहरण िें केिल अहि तकिीकी-िा ण तयक प्रस्तािि की िा ण तयक बोमलयां एक घोवषत तारीख और सिय पर खोली जाएंगी। बोली खोलिे की तारीख पर कसी भी अमिधािररत छुट्टी के िािले िें, अगले कायि दिस पर बोमलयां खोली जाएंगी। तदिसुार, बोली सिापि तारीख / सिय अगले कायि दिस तक बढा दया जाएगा। कसी भी अस्पष्ट और अमि ित अमभव्यवक्त जसेै क "पिूि वबक्री के अधीि", "प्रेषण के सिय िलू्य मिधािरण", "सािग्री की उपलब्धता के अधीि" आ द पर विचार िहीं कया जाएगा। मिविदा खोलिे के बाद सीपीआरआई अपिे वििेक से बोलीदाताव ं से अपिी बोली के स्पष्टीकरण िांग सकता है। स्पष्टीकरण और प्रमत क्रया के मलए अिरुोध मल खत / इलेक्ोंॉमिक िेल िें कया जाएगा। बोलीदाता का जिाब केिल िांगे गए स्पष्टीकरण तक ही सीमित कया जािा चा हए। यद्यवप, “बोली के िूल्य या पदाथि िें पररितिि को स्िीकार िहीं कया जाता है।

Section –III: Public Procurement Preferences खंड-I I I : साििजमिक खरीद

22 Public Procurement (Preference to Make –In-India): CPRI is an autonomous body under MOP,

GOI and follows the Govt Of India Order pertaining

to the Public Procurement (Preference to Make –In-

India) Order 2017 – Revision order No. P-45021/2/2017-

PP (BE-II) dated: 4th

June 2020 : whereas the policy of the

Government of India to encourage ‘Make in India’ and promote

manufacturing and production of goods and services in India.

Required documents from the bidders :

- Bidder shal l indicate %age of the Local content and provide Self cert ificate for

goods and service of values up to 10

crores.

- And for goods and services of value in excess of Rs 10 Crores a cer t ificate from

statutary auditor / cost auditor in case of a

company and from a practicing cost

accountant or a practicing CA for suppliers

other than companies.

Exemption: The above preference is exempted for goods and

services of value less than 5Lakhs.

However CPRI shall verify /scrutinize the documents

submitted for avail ing preference as per PPP order .

Note:- Self declarations/ auditor’s/ accountant’s certificates

submitted by the manufacturer/ supplier may be verified randomly

by the committee constituted as per MoP Order 28-07-2020. In case

of false documents/ misrepresentation of the facts requisite action

against such manufacturer/ supplier will be taken based on the

recommendation of the Committee.

23 Product reservation and preferential / mandatory purchase from

certain sources as per GFR 2017 will be applicable for promotion

of locally manufactured goods OR services.

जीएफआर 2017 के अिसुार कुछ स्रोति से उत्पाद आरक्षण और अमधिान्द्य / अमििायि खरीद स्थािीय स्तर पर मिमिित िस्तुव ंया सेिाव ंके प्रचार के मलए लागू होगी।

Section IV : Technical Bid and Price Bid खंड IV : तकिीकी बोली और

24 Price Bid:

Bidders should offer firm prices with applicable GST for delivery

as indicated in the tender . (As per Price bid formats “Section IV L

& Section IV NL”)

Basic price: including Mandatory spares, Transit insurance, and

packing & forwarding charges.

-Transportation charges up to final destination.

-Installation & Commissioning charges

-HSN code

-The applicable GST shall be indicated .

- Optional items/AMC if any to be quoted separately.

The local content included in the basic price shall be mentioned

separately as % age of total basic price for availing the preference

as per PPP order

The offered prices shall be both in figures and words and in case of

any discrepancy between these two, the prices indicated in words

will only be considered.

CPRI reserves the right to increase / decrease the quantity. It will be

obligatory on the part of the Bidder to supply ordered quantity at

the offered rates.

Delivery : Offers should be FOR delivery at site as indicated, with

firm delivery date. If delivery is not specifically indicated by the

bidders, it will be construed that the delivery quoted is as per

delivery schedule indicated in our TENDER and will be binding on

the bidder. The delivery will be counted from the date of issue of

purchase order on the successful bidder.

A list of addresses of users of similar equipment with other

reference if any shall also be submitted along with the above in the

format given in Appendix I

For Non Local content :

The price should be on CIP/CIF basis in case of CPRI –

Bengaluru, and the port of landing shall be Bengaluru for Air

Freight and Chennai / ICD Bengaluru for Sea freight. In case of

CPRI – Bhopal the port of landing shall be Mumbai for Air Freight

and Mumbai port for Sea freight.

However the appropriate port of shipments for equipments required

at other units of CPRI at RTL Noida, UHVRL Hyderabad and RTL

Kolkata will be decided by CPRI at the time of placement of

Purchase order.

CPRI is exempted from payment of Customs Duty under

Notification NO.51/96 dated 23-7-1996 amended Notification

No.24/2007-Customs dated 1-3-2007.

INDICATE breakup SEPARATELY FOR :-

The F.O.B. / FCA Value.

Freight Charges (By Sea & Air for nearest port to be shown separately).

Insurance Charges.

Installation and commissioning charges. Optional items/AMC if any to be quoted separately

25 Technical Compliance shall be provided against the Guaranteed

Technical parameters of CPRI as indicated in the tender. (As per

“Section IV T” Technical Specifications)

Test Certificates :

Tests shall be carried out as per relevant standards by the supplier at

his expense and the test certificates shall be submitted for approval

by CPRI prior to dispatch

Technical Literature, Operating and Instruction Manuals: Along

with the offer, necessary Technical data pertaining to the materials /

equipment offered shall have to be submitted. This is essential for

evaluation purposes.

PROCUREMENT PROCEDURE OF CPRI (NON - WORKS)



Section V: Payment Terms खंड V: भुगताि की शतें

26 Payment Terms :

26.1 For Local Offers: 100% of the due price will be payable

within 30 days after receipt of complete quantity of

material/equipment in good working condition (supply, installation

and commissioning wherever applicable) at CPRI site and upon

submission of 10% Performance Security Deposit valid up to

minimum 60 days beyond the expiry of the guarantee period which

will be refunded only after the expiry of the guarantee period.

26.1 स्थािीय प्रस्तािि के मलए: सीपीआरआई साइट पर अछछी कायिशील स्थमत )आपमूति, स्थापिा और प्रितिि जहाँ भी लाग ूहो( िें सािग्री / उपकरण की परूी िात्रा की प्रामप्त के बाद उमचत िूल्य का 100% देय होगा और गारंटी अिमध की सिामप्त से कि से कि 60 दिि तक िधै 10% मिष्पादि सुरक्षा जिा प्रस्तुत करिे पर, जो गारंटी अिमध की सिामप्त के बाद ही िापस कया जाएगा।

26.2 For Non - Local Offer: 80% - 90% payment is payable by

way of an irrevocable Letter of Credit against presentation of

Shipment Documents and all other related documents. Balance

payment upon submission of 10% Performance Security Deposit

valid up to 60 days beyond the expiry of the guarantee period which

will be refunded only after the expiry of the guarantee period.

26.2 गैर - स्थािीय प्रस्ताि के मलए: 80% - 90% भुगताि मशपिेंट दस्तािेजि और अन्द्य सभी संबमंधत दस्तािेजि की प्रस्तुमत के खलाफ के्र डट के अपररितििीय पत्र के िाध्यि से देय है। गारंटी अिमध की सिामप्त से 60 दिि तक िधै 10% प्रदशिि सुरक्षा जिा प्रस्तुत करिे पर शेष भुगताि जो गारंटी अिमध की सिामप्त के बाद ही िापस कया जाएगा।

26.3 Performance Security Deposit :

10% of the order value by way of Bank Guarantee /DD shall be

furnished by the successful tenderer for proper Fulfillment of the

order.

26.3 मिष्पादि सुरक्षा जिा: बैंक गारंटी / डीडी के िाध्यि से आदेश िूल्य का 10% आदेश के उमचत पमूति के मलए सफल मिविदाकताि द्वारा प्रस्ततु कया जाएगा।

26.4 LIQUIDATED DAMAGES: ½ % per week of delay in

delivery subject to a maximum of 10% of the value of the order.

However CPRI reserves the right to cancel the order and forfeit the

EMD in case of inordinate delays.

26.4 अििुामित क्षमतयाँ : आदेश के िूल्य के अमधकति 10% तक वितरण के विषय िें देरी का ½ प्रमतशत प्रमत सप्ताह। हालां क सीपीआरआई आदेश को रद्द करिे का अमधकार रखता है तथा अत्यमधक देरी के िािले िें ईएिडी ज़ब्त कया जाएगा ।

26.5 The applicable GST on the Liquidated Damage shall have to

be borne by the Seller. Accordingly, the Liquidated Damage shall be

recovered from the Seller along with applicable GST.

26.5 अििुामित क्षमतयि पर लागू जीएसटी को विके्रता को िहि करिा होगा। तदिसुार, लाग ूजीएसटी के साथ विके्रता से अििुामित क्षमतयि की िसूली की जाएगी।

Section VI : GUARANTEE / WARRANTY खंड VI: गारंटी / िारंटी

27 GUARANTEE / WARRANTY : Equipment/material shall be guaranteed for a period of 18 months

from the date of receipt in good working condition at site. OR 12

months from the date of satisfactory commissioning of the

equipment at site.

Guarantee / Warranty shall cover against any manufacturing defects,

faulty design, materials or workmanship etc., and shall be replaced

free of cost at the final destination .

गारंटी / िारंटी : उपकरण / सािग्री की गारंटी, स्थल पर अछछी कायिशील स्थमत िें प्रामप्त की तारीख से 18 िहीिे अथिा स्थल पर उपकरण के संतोषजिक प्रितिि की तारीख से 12 िहीिे की अिमध के मलए दी जाएगी । गारंटी / िारंटी कसी भी मििािण दोष, दोषपणूि डजाइि, सािग्री या कारीगरी आ द के खलाफ किर कया जाएगा, और अमंति गंतव्य पर मि: शुल्क प्रमतस्थावपत कया जाएगा।

Section VII : Packing and Transit Insurance खंड VII : प ैकंग और पारगिि बीिा

28 PACKING :- 28.1 The equipment shall be packed suitably for dispatch

directly to CPRI at Suppliers expense and tenderer

shall be responsible for any damages during transit.

28.2 External and/or internal damages or shortages that are prima facie the result of rough handling in transit

or due to defective package will be intimated within a

fortnight of the receipt of materials / equipment.

28.3 External and/or internal, defects or shortages of integral parts which cannot ordinarily be detected

on a superficial visual examination due to bad

handling in transit or defective packing would be

intimated within two months from the date of receipt

of the articles.

प ैकंग :- 28.1 उपकरण सीधे सीपीआरआई को आपमूतिकतािव ं के व्यय पर भेजिे के मलए उपयकु्त रूप से पकै कए जाएंगे और पारगिि के दौराि कसी प्रकार की क्षमत के मलए मिविदाकार जम्िेदार हिगे। 28.2 बाह्या और / अथिा आतंररक क्षमत या किी जो प्रत्यक्षतः हैं जो पारगिि िें बरेु हैंडमलगं का पररणाि है अथिा दोषपणूि पकेैज के कारण है, सािग्री / उपकरण की प्रामप्त के एक पखिाडे़ के भीतर सूमचत कया जाएगा। 28.3 बाह्या और / अथिा आतंररक, दोषि या अमभन्द्ि अगंि की किी, जो पारगिि या दोषपणूि प ैकंग िें बरेु हैंडमलंग के कारण सतही दृश्य परीक्षा पर आितौर पर पता िहीं लगाया जा सकता है, सािमग्रयि की प्रामप्त की तारीख से दो िहीिे के भीतर समूचत कया जाएगा।

29 TRANSIT INSURANCE The goods shall be insured up to the final destination at

supplier’s risk and cost. The transit insurance charges are NOT

admissible by CPRI.

Suppliers shall transport goods through registered common

carriers only. Any transportation of goods through

unregistered common carriers is illegal.

LOSS OR DAMAGE: If goods supplied are found

defective in materials or workmanship or do not conform to the

specifications or unsuitable for the purpose for which they are

meant to be , then the seller has to replace the required goods

at free of cost . However CPRI reserves right to reject the

goods and repudiate.

पारगिि बीिा आपमूतिकताि के जो खि और लागत पर अमंति गतंव्य तक िाल का बीिा कया जाएगा। सीपीआरआई द्वारा पारगिि बीिा शुल्क स्िीकायि िहीं हैं। आपमूतिकताि केिल पजंीकृत आि िाहकि के िाध्यि से िाल पररिहि करेंगे। अपजंीकृत आि िाहक के िाध्यि से िाल का कोई भी पररिहि अिधै है। हामि या िकुसाि: य द आपमूति की गई िस्तुए,ँ सािग्री या कारीगरी िें दोषपणूि पाई जाती हैं या िे उस उदे्दश्य के मलए विमिदेशि या अिपुयकु्त के अिरुूप िहीं होती हैं, जसके मलए उिका उदे्दश्य होता है, तो विके्रता को आिश्यक िस्तुव ं को मिःशुल्क बदलिा होगा। हालां क सीपीआरआई िाल को अस्िीकार करिे एि ंमिराकरण करिे का अमधकार रखता है।

Section VIII : Force Majeure , Disputes and Jurisdictions खंड VIII: अप्रत्यामशत घटिा, वििाद, के्षत्रामधकार

30 30.1 FORCE MAJEURE: In the event of either of the parties being rendered unable,

wholly or in part by force majeure to carry out its obligations

under the agreement when entered into, it is agreed that on

such party giving notice and full particulars of such force

majeure in writing / electronic mail to other party as soon as

possible (within 15 days ), after the occurrence of the cause

relied on then the obligations of the party giving such notice

with proper documentary evidence so far as they are affected

by such force majeure, shall be suspended during the

continuance of any inability so caused but for no longer period,

and such cause as far as possible be remedied with all

reasonable effort.

30.1 अप्रत्यामशत घटिा : दोिि पक्षि िें से कसी को भी असिथि होिे की स्थमत िें, सिझौते के तहत अपिे दामयत्िि को परूा करिे के मलए परूी तरह से या आमंशक रूप से िजबरू कया जाता है, यह सहिमत दी जाती है क ऐसी पाटी को िो टस और इस तरह के बल विशेष के पणूि वििरण अन्द्य पाटी को जल्द से जल्द मल खत /इलेक्ोंॉमिक िेल िें )15 दिि के भीतर( देिा है, तब होिे िाले कारण की घटिा के बाद, पाटी के दामयत्िि को उमचत दस्तािेजी साक्ष्य के साथ इस तरह के िो टस देिे के बाद, जहां तक िे इस तरह के बल से प्रभावित होते हैं, कसी भी अक्षिता की मिरंतरता के दौराि मिलंवबत कर दया जाएगा, कन्द्तु अमधक सिय तक िहीं, और ऐसे कारण जहां तक संभि हो सभी उमचत प्रयास के साथ सुधार कया जाएगा ।

The term “Force Majeure" as used herein shall mean ‘Acts of

God’ including Landslides, Lightning, Earthquake, Fires,

Storms, Floods, declared Wars, Blockades, insurrection, riots,

Government regulations etc., which are not within the control

of the party claiming suspension of its obligations within the

meaning of the above and which renders performance of the

contract by the said party completely impossible

"अप्रत्यामशत घटिा" के रूप िें इस के साथ प्रयोग कया गया शब्द का अथि होगा ‘भगिाि की करिी’ यथा भूस्खलि, वबजली, भूकंप, आग, तूफाि, बाढ, घोवषत यिुि, िाकाबदंी, विरोह, दंगे, सरकारी मियि आ द जो अपिे दामयत्िि के मिलंबि का दािा करिे िाले पाटी के मियतं्रण िें िहीं हैं और जो उक्त पाटी द्वारा अिबुधं के प्रदशिि को परूी तरह से असभंि बिा देता है।

30.2 JURISDICTION / DISPUTES: In all disputes, the

decision of the Director General, CPRI, Bangalore, shall be

final, conclusive and binding on the supplier/tenderer. All

disputes shall be subject to the jurisdiction on the Courts in the

City of Bengaluru, India.

30.2 के्षत्रामधकार / वििाद : सभी वििादि िें, िहामिदेशक, सीपीआरआई, बेंगलूर, का मिणिय अमंति, मिणियात्िक होगा और आपरूक / मिविदाकार पर बाध्यकारी होगा । सभी वििाद भारत के बेंगलूर िगर के न्द्यायालयि के के्षत्रामधकार के अधीि हिगे।
