Sir,

This has reference to your application Nil dated 16.09.2014 andsubsequent letters dated 21.01.2015 seeking Environmental Clearance on theabove-mentioned subject.

2. The Ministry of Environment, Forests & Climate Change has consideredthe application. It is noted that the proposal is for grant of EnvironmentalClearance for Construction of residential cum commercial project on plotbearing S. No. 54, 62, 63, 78, 79, 80, 81, 82, 83, 192, 193 at Village -More, Virar (E), Taluka Vasai, District Thane, Maharashtra by M/s VivaHoldings. The proposal was considered by the EAC in 144th its meeting heldon 28th- 30th January, 2015. The proponent has informed that:

i. The proposal involves construction of residential cum commercial projecton plot bearing S. No. 54, 62, 63, 78, 79, 80, 81, 82, 83, 192, 193 atVillage - More, Virar (E), Taluka Vasai, District Thane, Maharashtra byMjs Viva Holdings. The project is located at on 19°26'14.0T'N Latitudeand 72°49'14.50"E Longitude.

11. The total plot area is 80,920.00 sqm. FSI area is 1,20,847.82 sqm andtotal construction area of 1,47,850.38 sqm. The project will comprise of9 residential buildings with 28 wings. Total 1296 nos. for Mhada and2195 nos. of tenements for sale with 146 nos. shops will be developed.Maximum height of the building will be 66 m.

iii. During construction phase, total water requirement is expected to be120 KLD which will be met by tanker water. Soak pits and septic tankswill be provided for disposal of waste water. Temporary sanitary toiletswill be provided for labor force.

(ii) The Project Proponent shall obtain all necessary clearance/permission from all relevant agencies including town planningauthority before commencement of work.

iv. During operational phase, total water demand of the project is expectedto be 2,376 KLD which will be met by fresh water from VVMC andrecycled water. Wastewater generated (2,218 KLD)will be treated in STPof 2300 KLDcapacity. 799 KLDof treated wastewater will be recycled forflushing and 38 KLDrecycled water for gardening. About 1359 KLDwillbe disposed in to municipal drain.

v. About 8,815 kg/ d solid wastes will be generated in the project. Thebiodegradable waste (5289 kg/d) will be processed in mechanicalcomposting and the non-biodegradable waste generated (3526 kg/d) willbe handed over to authorized local.

vi. The total power requirement during construction phase is 300 kVAwhich will be met from MSEDCL and total power requirement duringoperation phase is 11.8 MWwhich will be met from MSEDCL.

vii. D.G. Set of having capacity 3400 kVA is proposed to be installed asstandby.

viii. Rooftop rainwater of buildings will be collected in RWH tank of total 180m3 capacity for harvesting after filtration.

ix. Parking facility for 760 four wheelers is proposed to be provided.x. Proposed energy saving measures would save about 23.3 % of power.xi. The cost of the project is Rs.320 crore.xii. Wildlife issues: It is located within 10 km of Tungareshwar Wildlife

Sanctuary.xiii. Forest land: No forest land involved in the project.xiv. There is no court cases/violation pending against the project.

3. The proposal was considered by the Expert Appraisal Committee (EAC)and recommended in its 144th EAC meeting held on 28th - 30th January, 2015for granting Environmental Clearance. The Ministry of Environment, Forests &Climate 'Change hereby accords Environmental Clearance for the above-mentioned Construction of residential cum commercial project on plotbearing S. No. 54, 62, 63, 78, 79, 80, 81, 82, 83, 192, 193 at Village -More, Virar (E), Taluka Vasai, District Thane, Maharashtra by M/s VivaHoldings under the provisions of the Environment Impact AssessmentNotification, 2006 and amendments thereto and Circulars issued thereon andsubject to the compliance of the following specific conditions, in addition to thegeneral conditions mentioned below:

PARTA - SPECIFICCONDITIONS

I. Construction Phase

(i) The Project Proponent shall insure that the guidelines issued videthis Ministry's OM No. 19-2/2013-IA.III dated 09.06.2015, to befollowed for building and construction projects to ensuresustainable environmental management in pursuance ofNotification No. 3252 (E) dated 22. 12.2014 under the EIANotification, 2006, as applicable, are followed in this project.

(iii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act,1981 and Water (Prevention and Control of Pollution) Act, 1974.

(iv) The environmental clearance is subject to obtaining prior clearancefrom wildlife angle including clearance from the StandingCommittee of the National Board for Wildlife as applicable.

(v) Grant of environmental clearance does not necessarily implies thatWildlife Clearance shall be granted to the project and that theirproposals for Wildlife Clearance shall be considered by therespective authorities on their merits and decision taken.

(vi) The investment made in the project, if any, based on environmentalclearance so granted, in anticipation of the clearance from wildlifeangle shall be entirely at the cost and risk of the project proponentand Ministry of Environment, Forests & Climate Change shall notbe responsible in this regard in any manner.

(vii) The total plot area is 80,920.00 sqm. FSI area shall be 1,20,847.82sqm and total construction area shall be 1,47,850.38 sqm. Theproject will comprise of 9 residential buildings with 28 wings. Total1296 nos. for Mhada and 2195 nos. of tenements for sale with 146nos. shops shall be developed. Maximum height of the buildingshall be 66 m.

(viii) During construction phase, total water requirement is 120 KLDwhich shall be met by tanker water. Soak pits and septic tanksshall be provided for disposal of waste water. Temporary sanitarytoilets shall be provided for labor force.

(ix) During operational phase, total water demand of the project is2,376 KLD which shall be met by fresh water from VVMC ancrecycled water. Wastewater generated (2,218 KLD) shall be treatecin STP of 2300 KLDcapacity. About 1359 KLD shall be disposed irto municipal drain.

(x) About 8,815 kgjd solid wastes will be generated in the project. Thrbiodegradable waste (5289 kgj d) shall be processed in mechanicacompo sting and the non-biodegradable waste generated (352(kgj d) shall be handed over to authorized local.

(xi) The total power requirement during construction phase is 300 kVlwhich shall be met from MSEDCL and total power requiremenduring operation phase is 11.8 MW which shall be met frorMSEDCL.

(xii) D.G. Set of having capacity 3400 kVAshall be installed as standbyD.G set shall be at least 6 m away from the boundary.

(xxv) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposedtaking the necessary precautions for general safety and healthaspects of people, only in approved sites with the approval ofcompetent authority.

(xiii) Rooftop rainwater of buildings shall be collected in RWH tank oftotal 180 m3 capacity for harvesting after filtration.

(xiv) Parking facility for 760 four wheelers shall be provided.

(xv) The project proponent shall comply with the conditions of INOC/Clearance obtained from Fire Department.

(xvi) All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessaryclearances.

(xvii) The project proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures withits allottees, as projected, in perpetuity. This would be monitoredby the designed Energy Conservation/ efficiency Authority in theState.

(xviii)Temporary toilets will be provided for all construction labour.

(xix) Suitable toilet fixtures for water conservation shall be provided.

(xx) Proponent shall obtain permission for ground water withdrawalfrom State Ground Water Authority.

(xxi) The rainwater harvesting plan should be incorporated by theCGWA.

(xxii) Provision shall be made for the housing of construction labourwithin the site with all necessary infrastructure and facilities suchas fuel for cooking, mobile toilets, mobile STP, safe drinking water,medical health care, creche etc. The housing may be in the form oftemporary structures to be removed after the completion of theproject.

(xxiii)A First Aid Room will be provided in the project both duringconstruction and operation of the project.

(xxiv)All the topsoil excavated during construction activities should bestored for use in horticulture/landscape development within theproject site.

(xxvi) Soil and ground water samples will be tested to ascertain that thereis no threat to ground water quality by leaching of heavy metalsand other toxic contaminants.

(xxvii) Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminatewatercourses and the dump sites for such material must besecured so that they should not leach into the ground water.

(xxviii)Any hazardous waste generated during construction phase, shouldbe disposed off as per applicable rules and norms with necessaryapprovals of the State Pollution Control Board.

(xxix) The diesel generator sets to be used during construction phaseshould be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noiseemission standards.

(xxx) The diesel required for operating DG sets shall be stored inunderground tanks and clearance from Chief Controller ofExplosives shall be taken, as applicable.

(xxxi)Vehicles hired for bringing construction material to the site shouldbe in good condition and should have a pollution check certificateand should conform to applicable air and noise emission standardsand should be operated only during non-peak hours.

(xxxii) Ambient noise levels should conform to residential standards bothduring day and night as per Noise Pollution (Control andRegulation) Rules, 2000. Incremental pollution loads on theambient air and noise quality should be closely monitored duringconstruction phase. Adequate measures should be made to reduceambient air and noise level during construction phase, so as toconform to the stipulated standards by CPCB/ SPCB.

(xxxiii)Fly ash should be used as building material in the construction a~per the provisions of Fly Ash Notification of September, 1999 ancamended as on 27th August, 2003.

(xxxiv)Ready mixed concrete must be used in building construction.

(xxxv) Storm water control and its re-use as per CGWB and BI~standards for various applications.

(xxxvi) Water demand during construction should be reduced by use 0pre-mixed concrete, curing agents and other best practicereferred.

(xxxvii)Permission to draw ground water shall be obtained from thcompetent Authority prior to construction/ operation of the project.

(vii) The installation of the Sewage Treatment Plant (STP) should becertified by an independent expert and a report in this regardshould be submitted to the Ministry before the project iscommissioned for operation. Treated affluent emanating from STP

(xxxviii)Separation of grey and black water should be done by the use ofdual plumbing line for separation of grey and black water.

(xxxix) Fixtures for showers, toilet flushing and drinking should be of lowflow either by use of aerators or pressure reducing devices orsensor based control.

(xl) Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use highquality double glass with special reflective coating in windows.

(xli) Regular supervision of the above and other measures formonitoring should be in place all through the construction phase,so as to avoid disturbance to the surroundings.

(xlii) Under the provisions of Environment (Protection) Act, 1986, legalaction shall be initiated against the project proponent if it wasfound that construction of the project has been started withoutobtaining environmental clearance.

II. Operation Phase

(i) The quantity of fresh water usage, water recycling and rainwaterharvesting shall be measured and recorded to monitor the waterbalance as projected by the project proponent. The record shall besubmitted to the Regional Office, MoEF&CCand the Ground WaterAuthority along with six monthly Monitoring reports.

(ii) The treated wastewater of 799 KLD shall be recycled and reusedfor flushing and gardening to reduce the demand of fresh water ascommitted.

(iii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management &Handling) Rules, 2000. No municipal waste should be disposed offoutside the premises.

(iv) The Operation and Maintenance of STP shall be made in the MoUwith STP supplier. Project Proponent shall ensure regularoperation and maintenance of the STP.

(v) Parking facility with 9 m clear driveway shall be provided ascommitted.

(vi) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

shall be recycled/ reused to the maximum extent possible.Treatment of 100% grey water by decentralized treatment shouldbe done. Discharge of unused treated affluent shall conform to thenorms and standards of the State Pollution Control Board.Necessary measures should be made to mitigate the odourproblem from STP.

(viii) The solid waste generated should be properly collected andsegregated. Wet garbage should be composted and dry/inert solidwaste should be disposed off to the approved sites for land fillingafter recovering recyclable material.

(ix) Diesel power generating sets proposed as source of back-up powerfor elevators and common area illumination during operationphase should be of enclosed type and conform to rules madeunder the Environment (Protection) Act, 1986. The height of stackof DG sets should be equal to the height needed for the combinedcapacity of all proposed DG sets. Use low sulphur diesel. Thelocation of the DG sets may be decided with in consultation withState Pollution Control Board.

(x) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measuredat the boundary of the building shall be restricted to thepermissible levels to comply with the prevalent regulations.

(xi) The green belt of the adequate width and density preferably withlocal species along the periphery of the plot shall be raised so as toprovide protection against particulates and noise.

(xii) Rain water harvesting for roof run- off and surface run- off, asplan submitted should be implemented. Before recharging thesurface run off, pre-treatment must be done to remove suspendedmatter, oil and grease. The borewell for rainwater rechargingshould be kept at least 5 mts. above the highest ground watertable.

(xiii) Energy conservation measures like installation of CFLs/TFLs forthe lighting the areas outside the building should be integral partof the project design and should be in place before projectcommissioning. Use CFLs and TFLs should be properly collectedand disposed off/ sent for recycling as per the prevailingguidelines/rules of the regulatory authority to avoid mercurycontamination. Use of solar panels may be done to the extentpossible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayecon the website of the concerned State Pollution Control Board. Th.EC letter shall also be displayed at the Regional Office, Distric

Industries centre and Collector's Officej Tehsildar's office for 30days.

(ii) The funds earmarked for environmental protection measures shallbe kept in separate account and shall not be diverted for otherpurpose. Year-wise expenditure shall be reported to this Ministryand its concerned Regional Office.

4. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be givenfull cooperation, facilities and documentsj data by the project proponentsduring their inspection. A complete set of all the documents submitted toMoEF&CC should be forwarded to the CCF, Regional office of MoEF&CC,Nagpur.

5. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

6. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection)Act, 1986, to ensure effective implementation of the suggested safeguardmeasures in a time bound and satisfactory manner.

,7. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil AviationDepartment, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972etc. shall be obtained, as applicable by project proponents from the respectivecompetent authorities.

8. These stipulations would be enforced among others under the provisionsof Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, thePublic Liability (Insurance) Act, 1991 and EIA Notification, 2006.

9. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance andcopies of clearance letters are available with the State Pollution Control Boardand may also be seen on the website of the Ministry of Environment, Forests &Climate Change at http://www.envfor.nic.in. The advertisement should bemade within Seven days from the date of receipt of the Clearance letter and acopy of the same should be forwarded to the Regional Office of this Ministry atNagpur.

10. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation vj s. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to this project.

11. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section16 of the National Green Tribunal Act, 2010.

12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and theLocal NGO, if any, from whom suggestions/ representations, if any, werereceived while processing the proposal. The clearance letter shall also be put onthe website of the company by the proponent.

13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shallupdate the same periodically. It shall simultaneously be sent to the RegionalOffice of MoEF&CC, the respective Zonal Office of CPCB and the SPCB. Thecriteria pollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as wellas stack emissions) or critical sectoral parameters, indicated for the projectshall be monitored and displayed at a convenient location near the main gate ofthe company in the public domain.

14. The environmental statement for each financial year ending 31st

March inForm-Vas is mandated to be submitted by the project proponent to theconcerned State Pollution Control Board as prescribed under the Environment(Protection) Rules, 1986, as amended subsequently, shall also be put on thewebsite of the company along with the status of compliance of EC conditionsand shall also be sent to the respective Regional Offices of MoEF&CC bye-mail.
