Illinois DUI and IVC Legal Update New Lenox Police Department

Constitutional Use of LE Authority | Legal Updates Course Description: This course is design and instructed by an experienced and practicing assistant state’s attorney to give police officers, first line supervisors and command level personnel a review and update in the area of DUI and many of the associated issues. In addition to the DUI update, recent legislation and case law involving other aspects of the Illinois Vehicle Code will also be examined.

Topics to be covered include: • Updates on DUI/Traffic laws (both statutory and case law) • Legal issues associated with fatal/life threatening crashes with and without evidence

of impairment • Summary suspension issues • Trial and courtroom issues • Chemical testing • Updates on other issue pertaining to the Illinois Vehicle Code

Instructor: Deborah Mills had been a prosecutor for 19 years, 5 years with the Milwaukee District Attorney’s Office and the remaining 13 years with the Will County State’s Attorney’s Office. Deborah served as the supervisor of the DUI/Traffic Unit in the Will County State’s Attorney’s Office since 2004 and has primarily prosecuted DUI/Traffic cases since 2004. She currently serves as a felony prosecutor. Additionally, Deborah has trained officers and prosecutors in both Illinois and Wisconsin on various DUI and traffic issues.

Assistant State’s Attorney, Dant Foulk of the Will County State’s Attorney’s Office, manages the Forfeiture Unit and serves in the office’s Financial Crimes Prosecution Unit. In the Forfeiture Unit, Dant specializes in identifying, locating, seizing and forfeiting illegally gained proceeds from narcotics and money laundering activities and other financial crimes. In the Financial Crimes Unit, he coordinates the long-term investigations of complex financial crimes, including credit card and check fraud rings, identity theft conspiracies and organized money laundering activities. Dant is admitted to practice in Illinois and before the U.S. Patent and Trademark Office as a patent lawyer.

Dant has taught Criminal Law as an adjunct professor and routinely lectures in the areas of criminal law, use of force, search and seizure, money laundering, and asset forfeiture. He has also lectured for the DEA, El Paso Intelligence Center (EPIC), the Department of Homeland Security, The State of Indiana, The Chicago Police Department, the Miami Dade Police Department Training Unit, the Illinois Gaming Board, the IDEOA, CCROC, the NICB, and the Illinois Law Enforcement Training and Standards Board MTU system. Dant is the principal trainer for the Illinois State Police in the area of Asset Forfeiture and Money Laundering.

Lead Homicide Investigator

Course Description: This course will meet all the requirements of the Sexual Assault Incident Procedure Act (Public Act 099-0801) which was enacted January 1, 2017. This Act requires all agencies employing law enforcement officers, who conduct sexual assault and abuse investigations, be required to provide specialized training.

Instructors:

Sergeant John Arizzi has worked for the Lockport Police Department since 2005. He is the Investigations Sargent

and currently serving as a Division Commander in the Will/Grundy Major Crimes Task Force. John is a former Deputy

Director of the Metro Area Narcotics Squad and has worked undercover for both state and federal authorities. John

is also an FBI certified crisis negotiator and served on the Will County SWAT team. John holds a Bachelor’s Degree

in Criminal Justice from Benedictine University.

Cordelia Coppleson is an Assistant Attorney General assigned to Criminal Enforcement. She is the Law Enforcement

Training Project Coordinator for the Sexual Assault Incident Procedure Act. Cordelia is responsible for helping and

supporting law enforcement agencies as they implement the new law through adopting policies, training and other

requirements of the Act. Cordelia is a committed prosecutor, having spent the majority of her 20-year career as a

Cook County State’s Attorney assigned to the criminal division, with extensive experience in investigating, preparing

and trying sexual assault cases.

Sergeant Jason Opiola has worked for the Crest Hill Police Department since 2001, and has been the supervisor of

the Crest Hill Police Department’s Criminal Investigative Division since the fall of 2017. Prior to his promotion, Jason

was an Investigator assigned to the Criminal Investigative Division since 2009.

He has also been an Investigator with the Will/Grundy Major Crime’s Task Force since 2010 and is currently serving

as a Division Commander in the Task Force. Before being assigned to the Criminal Investigation Division, Jason

served as the Crest Hill Police Department’s Use of Force Instructor, Field Training Officer, Head Firearms Instructor,

and member of Joliet Special Operations Squad. Jason holds a Bachelor’s Degree in Business Management from

Illinois Benedictine University.

offenders • Community mediation, probation adjustments, and teen courts • Changes in record reporting and access provisions • Statutory basis for adult prosecution of juveniles

Court decisions dealing with delinquent, neglected, abused and dependent minors will be examined and a brief discussion of “Minors Requiring Authoritative Intervention” will also be included. Course Description: The focus of this dynamic one-day seminar is to simply clarify each and every aspect of working hand and hand with an “informant” in any criminal investigation, such as of drug cases, property crimes and other serious crimes against person including homicides. This seminar has been developed for patrol officers, tactical officers, detectives, gang investigators, agents and command staff. Your expert instructor will share his experiences and address issues to help you develop your own strategies in spotting, cultivating and safely getting informants to work for you.

From first time offenders to high-level criminal organizations, the mentality of those heavily involved in today’s most serious crimes is rapidly changing. Course Description: This forty-hour course is specifically designed for experienced uniformed patrol personnel

selected to serve as Field Training Officers with probationary employees. The course emphasizes the FTO’s role in assisting probationers certify for solo patrol operations by applying the knowledge and skills acquired during Basic Police Training/Certification and using them according to agency policy, procedures and community service delivery standards. The instruction highlights two essential Field Training and Evaluation Process skills: 1) the ability to examine and objectively document the probationer’s job behaviors using the 2009 revised non- numerical/behaviorally anchored standardized assessment guidelines and, 2) analyzing the probationer’s training needs and using proper instructional techniques for corrective action. The instruction presentation will focus upon discussion as well as hands-on application of the course materials in small group and individual/student exercises. Students will be required to complete out- of-classroom reading assignments from the course text and workbook, Breaking Routine™: Field Training Officer.

The course content will include:

• What every FTO really needs to know about the operational structure of the Field Training

& Evaluation Process.

• Documenting the extent of training and coaching without becoming a best-selling author.

• Strategically addressing Probationer areas of Corrective Action Necessary.

• Utilizing the Probationer Officer Manual as the Field Training playbook.

• Practical Directed Patrol Mapping™: Preparing the Probationer for Proactive –

Community Oriented Policing: Dancing with SARA!

• Creating a Self-Reliant™ law enforcement agent.

Course Description: Officers completing this program will be certified as Illinois Breath Analysis Operators by the Illinois State Police. This sixteen-hour course is also certified by the Illinois Law Enforcement Training and Standards Board. Some of the topics that will be discussed are as follows:

• Operation and function of the breath testing equipment approved for use in Illinois • Detailed discussions on drinking driver enforcement • Laboratory training in the use of equipment • Pharmacological effects of alcohol • Legal matters relating to drinking driver enforcement (including implied consent and

case presentation for court)

Successful completion and attendance of the course including passing the exam is required to be a state certified Breath Alcohol Operator (BAO).

Instructor: The instructor for this course is Tim Perry. Tim is an 8-year veteran of the United States Air Force with over 3,000 hours of flight time and served in the first Gulf War. He also has over twenty years of award-winning leadership experience in three Fortune 10 U.S. organizations in product marketing, project and process management, learning development, and sales. He is founder of two non-profit organizations - one that serves Native American Indian Reservations and another that provides crisis counseling for police and fire agencies. He is a graduate of Embry-Riddle Aeronautical University and received a Master of Leadership degree (Philosophy, Theology, and Psychology) from Rockbridge Seminary.

Course Description: This program is designed for recently assigned evidence technicians and will introduce them to various evidence collection, identification, and preservation techniques. The impact of these techniques upon specific criminal investigations will also be discussed.

Course topics include: • Crime scene management • Crime scene photography • Crime scene sketching, diagramming, and animation • Forensic Laboratory Sections • Evidence recognition, handling, packaging, and submission • Trace, tool mark, and firearm evidence • Footwear/tire track castings • Latent prints and impression evidence • Biological evidence and D.N.A. • Search warrants and consent to search • Gunshot residue tests and results • Advances in evidence technology

❖ Each officer should be familiar with his/her Department’s digital camera and

Course Description: This course will inform and update police officers on criminal procedure laws as they pertain to criminal investigations. The instructor, a veteran prosecutor, will examine procedural law, substantive law, case law, and photographic crime scene evidence. Documented case studies will be used to illustrate current legal requirements. Topics to be discussed:

Instructor: Jeffrey J. Pavletic is an award-winning trial attorney who has built a reputation of integrity and exceptional skill in the courtroom. As a prosecutor for the past two decades, he has tried countless cases to victory (including approximately 150 jury trials with a concentration in homicide and violent crime). In addition to trying some of the highest profile and complex cases that have occurred in the history of Northern Illinois, Jeff was Chief of the Felony Review Division, and is currently the First Assistant State’s Attorney for the Lake County (Illinois) State’s Attorney’s Office. Jeff served as Special Counsel to the U.S. House of Representatives Judiciary Committee in the impeachment of President Clinton. His duties included all aspects of independent counsel review, the impeachment inquiry, presentation of articles of impeachment to the U.S. House of Representatives, all witness interviews and depositions of trial witnesses, and the actual impeachment trial before the U.S. Senate. Jeff has received numerous federal, state, and local awards. These include Illinois State Crime Commission’s State’s Attorney of the Year, Felony Trial Attorney of the Year, The Fred L. Foreman Criminal Justice Award, The Ruth Rosengarden Victim Service provider Award, and a special U.S. House of Representatives Award presented by Congressman Henry Hyde. Course Description: Property and evidence management functions have long presented logistical and procedural challenges to police agencies. The aim of this course is to provide persons assigned to the property control function – whether sworn or civilian - with the knowledge and skills needed to properly handle, store, and purge items commonly found in evidence rooms. Applicable laws, common policies, and standards which form the backbone of a well-functioning property room will be reviewed in detail. Topics to be addressed include the following:

• Property management policies and best practices

• Employing a systematic approach to property management

• Issues and difficulties faced by other agencies

• Laws and regulations affecting the property control function

• Proper documentation of evidence and property

• Identification of problem areas through review of current practices

• Proper inventory and auditing procedures

• Processes for fixing “broken” property rooms

Instructor: Hiroshi Witt is the Administration Supervisor for the Schaumburg Police Department. He retired as a Lieutenant from Glencoe Department of Public Safety in 2013 after 25 years of service. He is a state certified Fire Officer and Fire Instructor and is an instructor for the National Fire Academy.
