The regular meeting of the Sullivan County Planniny Commission was held on Tuesday, October 19, 1999, 7.00 P.M ,Courthouse, Blountville, Tennessee.

The meeting was called to order by the chairman with a quorum present. The minutes from the September 27, 1999 meeting were amended. Motion to approve the September 27, 1999 minutes as amended by Brown, second Boggs. Vote in favor of the motion unanimous.

B. Rezoning Request

1. File Number 8199-1. Lvnn W. Hicks Reclassify R-1 property on Arcadia Drive to A-l for a "paint-ball game field"

The applicant was present. Tim Stafford and William Boyle were chosen to represent the opposition and spoke against the rezoning. A petition was submitted in opposition for the denial of rezoning. Also a map and list of names were submitted in approval of the rezoning. Staffs recommendation was to approve the request.

Motion to deny the request by Mullins, second Belcher. Vote in favor of the motion 4 to 3 (Tie vote with the Chairman, Greene, voting in favor of the motion). Belcher, Mullins and Brown voted in favor of the motion. Boggs, H. Barnes and Childress voted against the motion. S. Barnes passed.

E. New Business:

I . Tri-Cities Regional Airport Transfer of ownership of the portion of Holston Road from Sullivan County to Tri-Cities Regional Airport to allow access to the "Fuel Farm".

John Hanlin (Executive Director of Tri-Cities Regional Airport) gave a presentation that explained the purpose and the exact route that is to be changed. Motion Muliins, second Childress to transfer the ownership of the road. Vote in favor of the motion 6 to 0 with one pass. The motion will now be sent to the Sullivan County Executive committee for their approval.

F. Old Business:

1. Cell Tower Regulations. No progress was made. To be deferred for the meeting of November.

2. Quillen Request (for approval ofover size storage building) Motion to approve the addition by Brown, second Boggs. Vote in favor of the motion 6 to1

3. Tent on the "Light Commercial Recreation" Staff recommended deferring to next months agenda where a more comprehensive draft can be completed for review.

4. Johnson City "Rocky Mt. Historic District" A representative from the Johnson City Planning otfice could not attend the October meeting but we were informed that they would attend the November meeting.

It is our view that the issue of noise is simply overstated. The sounds of a youth group enjoying a structured afternoon of paintball should fit nicely in a community where tractors plow fields, dogs bark, other children play and live country music has been known to play loudly into the night. Since Stone Drive is the major artery to the area we conclude that 90% of our patrons would be traveling from this direction, leaving only 10% traveling from Bloomingdale Pike and past Dr. Boyle's property. An average group will be around 20 people, which would translate into approximately 10 cars per day. This means 9 extra cars will travel to the field and never even come close to Dr. Boyle's house leaving only 1 car actually passing by. In addition we measured Arcadia Road and it is 21 feet, the same width as Bloomingdale Pike.

Furthermore, the speed limit on Arcadia is 25 mph, contrasted to 45 mph on Bloomingdale. With such a low speed limit the likelihood of any incidents would be low. In addition to all this we are only open two days a week, which translates into 20 extra cars per week.

member abstaining his vote. 2. During a recess, a discussion with members revealed that

they were unaware of our full situation, due to us being caught off guard by the unexpected opposition, and stated they would have voted differently had they known.

3. The majority of the adjacent property owners supported the zoning by signing our petition.

4. The opposing petition should be disavowed since it states opposition to 5-1 (business) zoning while we are interested in A-1 (agriculture) zoning.

5. Stan Harrison, the Principle Planner for East Tennessee, and the Sullivan County Planning office advised that the zoning request should be approved.

6. The paintball field is not permanent and is designed to be able to move within 2 to 3 days.

7. Arcadia Road is a very well maintained road that has no potholes or other obstructions and is quite safe at the posted speed limit.

Special events such as sports lock-ins and camping trips are scheduled monthly. Tlie Junior High staff strives to develop friendships with kids through regular, one-on-one contact during the school year. And yes, it's an acronym -- Excited People Listening Oh So Intently ON Sunday!

SENIOR HIGH Wednesday N~ght Live! meets weekly at the church to help students see how the Bible impacts life at school, at home, and with friends. There are frequent special events, including a ski trip, paintball, and camping. The Senior High leadership team gives those students with a high level of commitment to Christ the chance to help coordinate Senior High events.

Back by popular (maybe even insistent) demand, the Junrez Youth Group is offering another DateNite on Saturday, July 11, anytime between 6:30 & 9:30 p.m. Bring your children to church and we will care for them and play with them while you get a night out. There is no advance sign up and no set cost -- though your donations are very welcome!

On Monday June 22 the Chanhassen City Council gave tinal approval to the re-zoning and re-platting of our future property. A recent meeting with the de-veloper concluded most remaining pre-closing is-sues, i, e., final language about timing and contio-gencies on the north-south road (an extension of Stone Creek Drive), finals on surveys, title docu-ments, etc. Pending approval by officials of our national church body (the ELCA), a closing on the land purchase is expected about August IS.

Family of Christ will then make a payment of $5 15,000 for the balance due on the land and about $15,000 for engineering and city fees. This gets us the land as we see it today. Another $120,000 of grading, ponding, drainage, park~trailisewerlwater

Dear County Commissioners:

We are writing this letter concerning the rezoning application of Lynn Hicks for a parcel of Land adjoining Arcadia Dr. We testified against this application at the October 19, 1999 Zoning Commission Hearing and are still very opposed to it.

This property has been developed as a team paint ball facility in direct violation of current zoning laws. They are seeking a retroactive rezoning from R-l to A-1 to legitimize their activities. Arcadia Drive and the Reedy Creek community is an inappropriate area for this type of business for the following reasons:

I . The entrance creates a severe traffic hazard. Arcadia Dr. is a narrow, winding, rural road with no shoulders, multiple blind hills and numerous hidden driveways. The entrance cannot be seen when approached from either direction. Frequent use of this business entrance is an accident waiting to happen and puts all of us who live on Arcadia and drive it daily at risk. We resent the disregard of the developers for our common safety

2. When in full activity, it is a major source of noise pollution, especially to those residents on the east end of Vandemool Dr. It is located directly in front of the Stafford and Simpson homes.where they can clearly hearihe discharge of the guns and the yelling of the participants. As much of the activity will occur on the weekends this creates an intolerable situation for these families

3. Because of this loud and disruptive activity it will have a depressing effect on property values on Vanderpool Dr. and Reedy Creek i n general. Would you want this facility in your front yard7

4. It is an eyesore to the community and will only become more so during the upcoming wet and rainy winter and spring months.

This business is no asset to the Reedy Creek Community. It should be relocated to a commercial area already appropriately zoned where it will not be so destructive to property values and such a threat to public safety. As taxpaying, voting landowners, we strongly protest this intrusion into our quiet neighborhood. We live here because of the peace and privacy it has provided. This is all jeopardized by this paint ball facility Arcadia Drive and the Reedy Creek Community should be left as a R-1 zone.
