Special Bulletin of the Supreme Court

Notes of Managing Director! Directorate of exclusive program (Bulletin) following to publishing monthly activity reports of the courts particularly in addressing different cases of administrative corruption and narcotics, has attempted in the current version to prepare and publish a collection of activities reports of the primary and appellate courts of administrative corruption, narcotics, violence against women and sexual assaults criminal cases in the year 2015 comparing with the year 2014. Undoubtedly, the published annual activities report of these courts show the performance level of the mentioned courts in the addressing of the above cases and reflects the necessary image from quality and quantity of addressing criminal cases related to administrative corruption and narcotics in years 2014 & 2015 and hope it is used by the interested parties.

COUNTER ADMINISTRATIVE CORRUPTION

A: Report of Kabul Anti-Corruption Primary Court

1. Report

Kabul Anti-Corruption primary court has adjudicated (180) criminal cases related to administrative corruption in the year 2015 and have issued necessary decisions in this regards.

1. Report Analysis

In these cases different accusations has been addressed as the following:

• Misuse of official authority (64) cases • Embezzlement (10) cases • Bribe (34) cases • Forgery (10) cases • Exceeding of official authority (10) cases • Lack of using official authority (4) cases • Illegal possession (5) cases • Waste of documents (3) cases • Misuse of official authority and bribe (27) cases • Embezzlement and misuse of official authority (5) cases • Embezzlement, Forgery and misuse of official authority

(8) cases In accusation to these cases (388) persons are arrested and publicly trialed, in the result of these trials (100) of these accused have received acquittal and (288) of them sentenced to the following punishments:

• 1 month to 1 year imprisonment (210) persons

• 1 year to 5 years imprisonment (34) persons • 5 years to 15 years imprisonment (2) persons • Cash penaltyy (42) persons

Some of the above convicts, who are sentenced to imprisonment, are also sentenced to cash penalty, the total amount of these cash fines are ($ 3,947,987). However, besides that they are sentenced to cash penalty, they are obliged to compensate the state causalities and to reimburse the money received through committing crimes.

1. Report analysis The entered data in the above table shows that they Kabul Anti-Corruption Appellate court has addressed (106) cases and necessary decisions has been taken. The accusations of these cases are as following:

• Misuse of official authority (50) cases • Embezzlement (10) cases • Bribe (16) cases • Exceeding of official authority (4) cases • Forgery (5) cases • Waste of documents (2) cases • Misuse of official authority and bribe (5) cases • Illegal possession (7) cases • Misuse of official authority and embezzlement (5) cases • Forgery and embezzlement (2) case

In accusation to these cases (221) persons are arrested and trialed. In a result, (69) persons have received acquittal and (152) others are sentenced to imprisonment and cash fine, as following:

• 1 month to 1 year imprisonment (90) persons • 1 year to 5 years imprisonment (47) persons • 5 years to 15 years imprisonment (4) persons • Cash fine (11) persons

The above table shows that the no of cases of the year 2015 has been decreased by 3 cases than the year 2014. In the result, according to the above table, the cases which are addressed in the appellate court in the year 2015 vary widely than the year 2014, only (5) cases has increased but no of accused’s has increased in the year 2015 comparing to the year 2014.

It means, total no of (15) cases were addressed in the year 2014 and total no of (12) cases are reviewed in the year 2015 and verdicts are issued related to these cases, the above table shows this decrease.

The result of reviewed cases in the Balkh province anti-corruption primary court in the year 2015 show a decrease of (8) cases. It means, total no of (26) cases were addressed in the year 2014 and total no of (18) cases are reviewed in the year 2015 and verdicts are issued related to these cases, the above table shows this decrease.

Based on received reports, 519 cases accusing 693 persons were heard by the primary and appellate courts of the country in 2015. Based on these reports, 13 persons were sentenced to capital punishment, 9 persons were sentenced to continued imprisonment, 75 persons were sentenced to long term imprisonment, 67 persons were sentenced to medium imprisonment, 271 persons were sentenced to short term imprisonment and 142 persons were cash fined. The decisions of primary courts on 14 persons were accepted by appellate courts and 102 persons were acquitted due to none-existence of required evidence. Based on received reports, from top to bottom of the list, Kabul courts handled 111 cases, Daikundi Appellate Court handled 75 cases, Bamyan Appellate Court handled 36 cases, Herat Appellate Court handled 40 cases, Faryab Appellate Court handled 35 cases, Jawzjan Appellate Court handled 32 cases, Balkh Appellate Court handled 21 cases, Ghazni Appellate Court handled 18 cases, Nimrooz Appellate Court handled 17 cases, Parwan Appellate Court handled 16 cases, and Paktia Appellate handled 12 cases of and Nangarhar Court, Kunduz Court, Urzgan Court, Ghor Court, Zabul Court, Samangan Court, Farah Court, Sar-e-Pul Court, Helmand Court, Kandahar Court, Laghman Court, Maidan Wardak Court, Kapisa Court, and Takhar Court each of handled 10 cases related to violence against women. It is worth mentioning that Logar, Baghlan, Badghis, Nooristan, Khost, Paktika, and Panjshir Appellate

Courts did not hear any cases related to violence against women last year.

REPORT OF CENTRAL AND PROVINCIAL COURTS’ PERFORMANCES ON ADDRESSING SEXUAL ASSAULT

CASES IN 2016

Based on the reports received from Primary and Appellate Courts of the center and provinces in 2016 regarding (236) sexual assault cases assigned to the courts by justice institutions are all inquired and the accused of cases, reach to (269) in number were convicted to different punishments such as, one person sentenced to death penalty, (19) others to continued imprisonment, (125) persons to long term imprisonment, (71) persons to medium term, (17) persons to short term imprisonment and one person to cash fine while (35) others were acquitted due to lack of compelling reasons.

According to the figures reported, the courts of Kabul, Jawzjan, Samangan and Kandahar provinces located on the top of the table for addressing (30, 28, -24 and 23) cases in order. Badghis Appellate Court for addressing (17) cases, Balkh Province Appellate Court for addressing (13) cases, Takhar Province Appellate Court for addressing (12) cases and Herat Province Appellate Court for addressing (11) cases are located in the lower row of the table.

Likewise, Appellate Courts of Kunduz, Ningarhar, Parwan, Ghor, Zabul, Sare Pul, Helmand, Laghman, Baghlan, Daykundi, Bamyan, Ghazni and Faryab provinces have addressed up to 10 cases each but the Appellate Courts of Paktika, Paktia, Khost,

Nooristan, Logar, Kapisa, Panjshir, Maidan Wardak, Badakhshan, Kunar, Uruzgan, Farah and Nimroz provinces lacked solving cases of sexual assaults during the last year. It is worth mentioning that there are tens of cases with the same crime under process in the courts which will be decided accordingly in specific time.

1. What is your view regarding overall corruption in Afghanistan and more specifically in Supreme Court of Afghanistan?

• We cannot mention a specific figure for the corruption, as corruption is a complicated issue and exact census does not exist for it. But it is obvious that corruption exists in Afghan government system where various factors can be effective in this part. The past forty years long war is a factor of corruption. Besides, a number of corrupted people in Afghanistan take opportunities from the present insecurity and pave ways for corruption.

2. According to the survey conducted by Asia Foundation in 2015 shows that the judicial system of Afghanistan is considered the most corrupted institution of this country in people’s views, what is your opinion in this regards?

• The judicial system is not only the Supreme Court, but it consists of Supreme Court, Attorney General Office, Ministry of Justice and a part of Interior Ministry. I suggest these institutions should not to be mistaken while reporting corruption. Regarding the survey, I’d like to say that we have no idea whom had been interviewed. But I’d like to say that Supreme Court of Afghanistan might be one of the institutions where there is less corruption. Existence of Anti-Corruption Courts shows availability of corruption in Afghanistan, but putting its responsibility utterly on Supreme Court is unfair. Work has been done in this regard, but it might not be sufficient for the whole Afghanistan.

3. What should be done in order to change the viewpoints of people to Judicial System of Afghanistan, and is there any plan in this regards?

• We have launched various programs in this regards. One of it is that we sent new Directors for the Appellate Courts in all (34) provinces of Afghanistan. In addition, we transferred and also downgraded a number of high ranking Judges. We are planning to transfer (537) more Judges in the coming days. We are also attempting to swift addressing the cases we received from the people. If Courts neglect in any way they will face disciplinary punishments, as we trialed two Judges on charge of corruption during the past few months. About 85 Supreme Court staff have been arrested in the charge of administrative corruption in 2015 only including (7) Judges, (14) Administrative staff and (65) others.

4. To what extent the judicial system is independent and how you react to the interferences of politicians?

• According to the Afghanistan Constitutions, members of Supreme Court High Council are appointed by the President and then receive approval of Parliament to stay for (10) years. Hence, President has no authority to remove members of

Supreme Court. No one, including the President has authority to influence Judicial Power and independency of this institution is enshrined in the law. Therefore, members of Supreme Court High Council fear no one and issue their rulings independently. So far we haven’t faced any pressure from the President about cases.

5. What plans does Judicial System of Afghanistan have in hand to wind up the exemption culture and handle big corruption cases?

• I would say that crime detection, investigation and preparing files for the accused is the duty of Police and AGO. Supreme Court of Afghanistan files no lawsuit against anyone and the Courts make decision only. Any case sent to the Courts by AGO or other institutions, decisions will be issued by the Courts accordingly without any fear.

6. How are the relations of Supreme Court with Civil Society and people regarding fight against corruption?

• Supreme Court believes that getting closer to the people guarantees their trust on Judicial System, hence, this system has made attempts to keep and maintain this relation with the people. Increment of open trial in the presence of media, civil activists and people, cooperation with Social Services Institutions and Legal Consulting Organizations can be samples that show boosts in relationships.

7. The New Year has been named “The year of anti-corruption” by the President, what is your message to the people?

• My message to my people is to report corruption cases to the government, especially to the justice and judicial institutions and support them in order to uproot this phenomenon, never be disappointed to do so because hard work and a strong will can overcome this campaign.
