ECONCljiiC SITUATION IN THE COMMUNITY

On the basis of a."'l in·~roductory statement by rr1r ORTOLI, Vice~President of the Corrnnission, and in the light of the preparatory work done by the Policy Co-ordination Group on Economic ru1d Financial Policies, the Council carried out its second quarterly examination of the economic situation in the Community.

QUESTIONS CONCERNING THE Et·.m

The Council took stock of the work to be done in the coming months in connection with the European Iiionetary System, both with regard to the establishment of the European monetary Fund and the re-examination of exchange rate and intervention arrangements in the light of the experience gained during the first six months of the System's operation, in accordance vlith

the Resolution of the European Council of 5 December 1978.

INTEREST SUBSIDIES FOR CERTAIN LOANS

After having resolved the last remainin~ problems, the Council defined its coi!llilon position on the draft Regulation on interest subsidies for certain loans granted under the European 1/Ionetary System. This common position v'r.Lll be notified to the Greek delecation under the consultation procedure agreed upon in connection with Greece's accessi.on •

OECD mmERSTANDING ON EXPORT CREDITS FOR SHIPS

The Council defined its common view on the position of the Community regarding participation in the OECD Understanding on export credits for ships and on amendments to that Understanding. This common view vdll be notified to the Greek delegation w1der the consultation procedure agreeQ upon in connection with Greece's accession.

The Council adopted, in the official languages of the

Communities, the Reg~lations on

- the opePinE, allocation and administration of the Community tariff q·~ota of 38,000 head of heifers and cows other than those intended for slaughter, of certain mountain breeds, falling within subheading ex 01.02 A II b) of the Common Customs Tariff;

- the opening, allocation and administration of the Community ·tariff quota of 5,000 head of bulls, cows and heifers, other than those intended for sla•..1ghter, of certain Alpine breeds falling within subheading ex 01.02 A II b) of the Common Customs Tariffo

The Council adopted, in the official languages of the

Communities,

- the Reg,J.lation amending Regulations (EEC) No 1408/71 and (EEC) No 574/72 on the application of social-securi~J schemes to employed persons and their families moving within the Community (technical adjustments);

- the Decision setting up a second joint programme to encourage exchanges of young workers within the Community (see Press Release 6886/79 (Presse 54) of 15.V.79, p, 11).

The cus·homary meeting took place under the budgetary

procedure between the Council and a delegation 'from the

on Budgets), Idr NOTENBOOfll: ('lice-Chairman of the Committee on

Budge.ts), IVIr SPINELLI (Vice-Chairman of the Conni ttee on

Budgets), 1~rs SCRIVENER,' deputy, :r.ir ROSSI (Vic.;;-Chairman of

the Comr.ai·1;-Gee on Budgets), lir AIGNER (Chairman of the Board of

Auditors), r:lr DANKERT (Rapporteur for Section III of the

budget- Commission),,Mr JAC~SON (Rapport9ur for the budget of

the European Parliament, the Court of Justice and the Court of

Auditors) Dnd Mr f.NSQUER and i.Tr BONDE (Members of the Committee

This meeting enabled the delegation from the European

Parliament to inform the CotUlcil of the Parliament's initial

reactions to the prelim:inary draft budget for 1980. It also

enabled members of the Council and the delegation from the

European Parliaoent to have a detailed discussion on other

budgetary q,uestions, such as the problem of own resources,

application of the conciliation procedure anc1 the timetable

for continuation of the budgetary procedure.

The Council then proceeded to ex2minc the proliminar; draft budget item by item~ be£Ting in mind the views expressed by the European Parlia~ent delegation.

At the conclusion of this discussion~ tho Cotu~cil established the draft generetl budget of the European Communi ties for 1980, including the sections relating to the European Parliament, the Council (with the Economic and Social Co~nittee), the Commission, the Court of Justice and tho Court of Auditors and the budget estimates for tho Publications Office.

This draft budget will be forwarded to the European Parliament as soon a~ possible.

The Council adopted in the official lanc~uages of the Communities a four-year programme for the development of data processing covering the period 1979 to 1983.

This programme comprises two sections: general measures and promotion measures. The general meastu~es cover standexdization policJr, public procurement, collaboration in research ~~d development, the effects of data processing on emplo;yment, its impact on society, confidentiality and data security~ and leeal protection for computer programmes. The promotion measures ·cover the field of general software and applications (e.g. 2.:pplications of a tra..."'lsnational charactel~ or ,nhich help to fulfil Communi tJr policy aims) •

.An amount of up to 25 J,:EUA \lvill be allocated to this progr&il.i1le, with 1 0 r!IEUA for the general measures and 15 l'IEU.A

Energy Research and Development Programme

The Council adopted in the official languages of the Communities an Energy Research and Development Programme.

This programme comprises five sections:

energy conservation (27 lliEUA) = residential and commercial applications, industry,

transport, energy transformation and storage

- production and utilization of hydrogen (8 liEUA)

= thermochemical and electrolytic production of hydrogen, transportation,·storage and utilization of hydrogen

- solar energy (46 lhEUA)

= solar-energy applications to dviellings, thermomechan:i;cal .solar•power plants, photovoltaic-power generation, photo­chemical, photoelectrochemical and photobiological processes, energy from biomass; solar-radiation data, wind energy, solar energy in agriculture and industry

geotherBal energy (18 mEUA)

= integrated geological, geophysical and geochemical investigations, subsurface natural hydrothermal resources, surface use of hydrothermal resources, hot dry rocks

systems analysis and strategy studies ( 6 liEUA)

= development of the medium and long term Community energy models, development of new concepts for energy systems' representations, development of new means for better communication between model builders and model users, world energy modelling.

A total of 1 05 r,::.EUA will be entered in the ·budget for carrying out this energy programme from 1979 to 1983 •

Emergency aid

The Council agreed to an emergency aid action amounting to 2, 300,:000 EUA for the victims of hurricane DAVID in non~ember countries.

This aid will be allocated as follows:

= emergency aid of 1,000,000 EUA for Guadeloupe and Martinique · (PODs) ; · ·

- emergency aid of 300,000 EUA for Dominica· (ACP State);

= energency aid of 1;000,000 EUA for countries affected by the hurricane which are neither ACP States nor French Overseas Departments.

The Council adopted in the official languages of the Communities the Directive on the approximation of the laws of the Member States relating to hot-water meters •

FOUR-YEAR PROGRAillffiiiE FOR THE DEVELOPMENT OF DATA PROCESSING IN THE COMMUNITY

The Council signified its agreement to a four-year Conni:ru.nity programme to promote research, industrial development and applications of data processing. ( 1)

This programme will be in ·two main parts.

The first part will consist of general measures in the area of standardization, public procurementt co-operation between research centres· and organizations su:ppor·~ing the use of data processing, training protection of individual privacy and of industrial property.

Within this framework careful study will be made of developments in data processing, taking account in particular of its influence on employment generally.

The second part will put into effect a Comrmxnity support mechanism to promote co-operation between users on a Community. scale, notably through the development; of software and of applications with a view to greater standardization.

In addition, the Council, in a Resolution, expressed its interest in the promotion of micro-electronic technol.)gy at Com;:aunity level.

REGISTRATION OF CRUDE OIL AND PETROLEUM PRODUCT IMPORTS

The Council recorded its agreement ( 1) to a Regulation introducing registration in the European Communities for crude oil and/or petroleum product purchases. Under this Regulation importers of crude oil and/or petroleum products from third countries or the Member States have to inform the Me.mber States concerned of details of their imports.

The Member Stntes nill then supply the Coccission vdth information at regular intervals so. as to give it a true picture of trends in import conditions under which the products have been imported; this. information will be distributed to the Member States.

Information collected and forwarded will be confidential although this will not impede the publication of general or sunnri.ery information which does not contain specific details relating to specific companies.

The actual implementing rules of registration will be covered in a further Regulation to be drawn up without delay. The Commission will lay down the detailed implementing arra.'lgements later.

The Council also noted that the Commission was conducting surveys together with the MemberStates on the import targets for each country between now and 1985.

The Council noted that the Commission is also considering, in conJunction with other oil consumer countries, the feasibility of a system of crude oil price certificates starting from the :producer country.

SUPPLIES OF NUCLEAR FUEL FOR THE COMl'ruNITY

The Council heard a statement by the French State Secretary who presented a memorandum from the French Government on supplies of nuclear fuel for the Community. (Chapter VI of the Euratom Treaty).

This memorandum will be examined together with the Commission's recent communication on the same subject.

ENERGY RESEARCH PROGRAMME

~he Council recorded its agreement ( 1) on an energy research and development programme for the period 1979 to 1983.

The new four-year programme follows on from the one adopted in 1975 which has achieved positive and promising results. The programme consists of indirect projects, i.e. projects carried out under contract. The expenditure to be conrnitted for the implementation of the programme has been fixed at 105 J!EUA and the staff complement at 34, and this will be entered in the ·budget of the Communities.

The programme covers projects in the following areas:

- energy conservation

- production and use of hydrogen

solar energy

geothermal energy

- systems analysis and strategy studies in the energy field

Even greater stress has been placed on solar energy and research into energy conservation than in the first programme since.these two areas are thought to have particular potential in the search for ways to alleviate energy problems.

The amount allocated, which is considerably more than was allocated to the first programme, will enable several hundred research contracts to be concluded with laboratories, firms and research centres in the nine member countries.

The programme will be managed by the relevant departments of the Commission, assisted by national experts who will form five Advisory Committees on Programme lffianagement (CCMGP).

GATT MULTILATERAL TRADE NEGOTIATIONS

The President of the Counoil drew the following conclusions:

The Council took note of the statement by the Commission on the most recent Q.evel.opments in the incorporation of. the results of the multilateral trade negotiations in United States law, and welcomed the speedy passage by both Houses of the United States Congress of the Trade Bill.

At the same time the Council reaffirmed the importance it attached to a full and satisfactory implementation of the Tokyo Round results by all Parties. The Council agreed that in the autumn it would consider on the basis of a final report by the Commission the concluf1!ion of the negotiations.

On the issue of safeguards, the Council took note of the Commission's intention of continuing its efforts in Geneva to find a solution.

CONCLUSIONS OF AND FOLLOW-UP TO THE GENEVA CONFERENCE ON SOUTH-EAST .ASIAN REFUGEES (20 and 21 JULY 1979)

1. The Council confirmed the undert~~ings made by the Community in Geneva regarding the provision of emergency food aid for refugees of South East Asia through the United-Nations High Commissioner for Refugees.

These undert~~ings are as follows:

- the provision of 20,000 tonnes of rice ~n addition to the 8,000 tonnes already approved by the Council decision of 4 July 1979) to cover 50% of the needs of refugees in South-East Asia up to Februarj 1980;

-the provision.of 1,500 tonnes of vitaminized milk powder (in addition to the 1,500 tonnes already approved by the Council decision of 4 July 1979);

the provision of 10 ~lliUA for the general programme of the UNHCR for refugees in South-East Asia;

-the allocation of 2,700 tonnes of rice for Cambodian refugees in Vietnam through the UNHCR.

2. The Council also decided to earmark a provisional appropriation of 4 lnEUA for Cambodian refugees, in both Thailand and Cambodia~ which would be implemented as ru1d when the appropriate channelling could be arranged through international orgrunizations.

COMThiDNITY CITRUS FRUIT

The Council discussed the, proposed extension of the deadline -for the grariting of· aid fo'r projects for the conversion of orange' and mandarine groves, the improvement of marketing and processing structures for citrus fruits and the deadline for the granting of additional aid to growers who have sustained losses of income as a result of the above-mentioned conversion operations.

The Council agreed to discuss this question further at its next meeting, scheduled for 17 and 18 September 1979.

REGISTER OF OLIVE CULTIVATION

After discussing the procedure for financing the compilation of the register of olive cultivation,·the Council decided that it would be financed by deductions from the production aid for olive oil. The rate of deduction was fixed at 1.47% for the 1979/1980 marketing year.

The Council held a general discussion of the proposal for a Regulation on a co1nmon organization of the L~ket in sheep~eat, in the course of which delegations made known the oain problems with which it presented them.

The discussion focussed on the complexity of the ' .

proposed common organization, its effectiveness as regards both intra-Community and international trade, how it could be financed and what it was likely to cost.

In conclusion, the Council instructed the Special ComDittee on Agriculture to examine the n~tter in greater detail in the light of the day's discussion, and agreed to return to the issue at its next meeting with a view to reaching a consensus enabling it to take a decision before the end of October 1979.

The Council restated its intention of taki11g a decision on the whole wine-gro~rrng package at its meeting in October, and instructed the Special Co~ttee on Agriculture to continue its work to this end.

The Council adopted, in the official languages of the

Communities, the Directive amending Directives 66/~01/EEC,

66/~02/EEC, 70/458/EEC and 70/457/EEC on the marketing of fodder plant seed, cereal seed and vegetable seed and on the

common catalogt~ of varieties of agricultural plant species.

The Council also adopted in the official languages of the

Communities the Directive on the approximation of the laws of the Member States relating to fruit jams, jellies and marmalades and to chestnut puree. This Directive is a further addition to

the body of Community foodstuff regulations. As in the case of the previous Directives, (sugar, cocoa/chocolate, honey, dietetic and dietary foodstuffs, coffee extracts), the present Directive contains the various Community provisions governing

trade in these products and lays down rules concerning definition,

composition and reserved designations, additives, authorized

manufacturing processed and compulsory and optional labelling

SHEEPMEAT

The Council held a detailed discussion on the orgru1ization of the market in sheepmeat, which enabled all the delegations to indicate their concerns in this area and enabled the Council to asc,tirtain the ma.in problems arising in connection vd. th internal

arrangements, those for third countries and the question of financing.

The Special Committee on Agriculture was instructed to examine certain technical aspects - in particular the question of premiums and a possible floor price - in order to enable the Com1cil to act in the near future.

CmiE'lUNITY CITRUS FRUIT

The Council agreed to extend until 31 December 1983 the deadline fixed for granting aid for action taken before then to convert orange and mandarin groves, .to improve marketing and processing structures for citrus fruits, and also the deadline for granting additional aid to growers who have sustained losses in revenue as a result of the above-mentioned conversion operations.

The Council adopted in the official languages of the Communities the Regulation amending, with respect to the German mark and the currencies of the Benelux countries, Regulation (EEC) No 878/77 on the exchange rates to be applied in agriculture. The purpose of this Regulation is to delay the effect on the seeds sector of the new representative rates for the revalued currencies.

Pursuant to the Commission's talks with the Government of Thailand and :following an exchange .;of vi.ews on the problem of imports of m~oc into the Community, the Council noted that tp.e COirnnission would be submitting proposals concerning the negotiation of a voluntary restraint agre.eip.ent .vii th Thailand, and the various problems posed by such an agreement, for its next meeting and agreed to give an opinion on the substance of the whole file on the basis of these proposals.

The Council also agreed to the Commission embarking on exploratory.talks with the United States with a view to the advance iJ-nplementation of the Agreement on trade in civil aircraft negotiated as part of GATT trac1e negotiations, and it agreed to give an opinionon the substance of this matter before the end of September on the basis of the report to be submitted by the Commission.

The Council, which had before it a Commission communication on the supply of nuclear fuel to the pommunity and a French memorandwn on the amendment of C1mpter ·vr of the Euratom Treaty, held a policy debate on the issues raised by these two docwnents.. The discussions enabled the delegations to outline their initiel reactions to the docun1ents in question and their. basic approach to the question of the future supply of nuclear fuel to the Community.

The Council noted thGt for the purpose of examining the problems at issue the Cor~1ission would seek the s~sistance of a group of high-level independent experts and that following this it would submit a report to the Council, ·accompanied by any proposals it considered appropriate.

ENERGY SITUATION OIL CONSUl'HPTION IN 1979

On the basis of an oral report by Commissioner BRUNNER, the Co1.1D.cil canducted Bn exchange of views on recent developments in the snergy situation and the further outlook, both in the Community and worldwide.

The Council noted that the situation on the oil markets, which had earlier sho~n signs of settling do~m, had again become a matter of concern and reiterated the resolve of the Community and its Member States steadfastly to continue .their efforts to save energy and to develop alternative energy sources.

With particular reference to oil consumption in 1979, the Council took note of progress. to date in the drive to reduce demand and agreed that this action should be continued and

intensified.

The.Council also agreed to place the Commission proposals for ~~rthcr Community energy-saving measures on the agenda

for a forthcoming meeting.

DISTRTBUTION OF THE_ c(mmoN TARGET FOR OIL IMPORTS

The Council held a detailed discussion on the question of the distribution of the common target for oil imports among the Member States; it evolved a number of guidelines which are to be finalized by the Perm~~ent Representatives Committee so as to enable the Community ~d its Member States to express their position on the subject at the meeting to be held in Paris on 26 September 1979 by the ministers for Energy of the countroies which participated in the Tokyo Summit Conferenceo

INTERNATIONAL E~lliRGY TECHNOLOGY GROUP

The Council adopted the Community position on the International Energy Technology Group (IETG) which the Haads of State and Governn1ent decided to set up when they met in Tokyo at the end of June 1979.

This Group's terms of reference, composition and operation will be on the agenda for the meeting in Paris on 26 September 1979.

REGISTRATION OF CRUDE OIL IMPORTS

The Council held a detailed discussion on the arrangements for registering imports of crude.

. . The Council agreed in particular that the representatives

of the Community and of the Member States attending the meeting in Paris on 26 September 1979 would discuss with the other major industrialized countries which had participated in the Tokyo Summit whether an early information system should be introduced for a limited number of crude oil transactions.

CERTIFICATION OF PURCHASE PRICES

The Council also discussed for the first time the question of the certification of purchase prices for crude, which will also be on the agenda for the meeting in Paris on 26 September 1979.

DATE OF THE NEXT COUNCIL MEETING

The Council agreed to hold its next meeting in Luxembourg on 9 October 1979.

Mr Brunner, Member of the Com­mission with special responsibility for energy, science .and research, reponed to the Council on the energy situation in the Community and presented the impor:tant document enti~ tied 'The energy programme of the European Communities's adopted by the Commission' on 3 October and sent .to the Council and Parliament. Mr Brunner's analysis and com-i ment5 were well received by the Council. ·

Action following the Tokyo Summit and Paris Conference

The Council approved in principle the draft supplementary regulation setting out the rules governing thf! registration in the Community of crude oil imports. The Council took note that the Commission would adopt imple~ menting measures for this regulation by 31

. October. The Council also undert()()k to take a decision before the end of the year on another supplementary regulation concerning the registration of oil products. Finally, where transparency of the oil market is con­cerned, the Council took note that the Com­mission would examine in detail the sugges- · tions submitted by the French Delegation. at the Paris meeting and would then table any proposals it considered necessary in this field.

Energy objectives for 1990

2.1.126. The Council welcomed the general lines of the Commission's communication entitled 'Energy objectives of the Community for 1990 and convergence of policies of the Member StateS', drawn up at the Council's request and submitted on 15 June.1 This com-

.. ·. munication supplements the proposals on the objectives for 1990 submitted to the Council on 22 November 1978.1 ·

The Community's energy prOgramme

2.1.127. At the beginning of October the Commission sent the Council and Parliament a commumcation entitled 'The energy pro-

. gramme of the European Communities'.

· This document summarius ·all the Com­munities' objectives and achievements in the field of energy since the foundation for a Community energy policy was laid in respoll$e to the initiatives of the European Council meetings of October 1972 and December 1973. For each major sector of

energy policy, the paper indicates what mea­sur:es are in force and what has been prop­osed by the Corimiission. This is preceded by an analysis of the energy . situation at the beginning of October.

When presenting the programme to Parlia­ment and to the Council meeting on energy, Mr Brunner, Member of the Commission, said:

'Although we have made progress since the first oil crisis in 1973, rhe Community still. relies on out­side sources for 55 'Yo of its energy needs. This is too much.

The essence of .our policy must .be "to recover our freedom of action. ·

Some strides fornard have been made in the past few months. we· have agreed i:o limit our oil imports to 472 million tonnes a year and .our oil consumption to 500 million tonnes. Theile targets are also bciing coordinated with the other big con­sumers, Japan and the United States.

The comprehensive programme now drawn up shows what· can be achieved by 1990. It gives ·us all a .concise programme .for building up our own resources in coal and nuclear capacities, in energy

. savings, .in .the search for new sources and in coor­dinating our policies with the produce~ all,d con• sumers including developing countries with few resources of their own.' · ·

Coal

New initiatives to be taken in the ooal sector

2.1.132. Recognizing the increasing import.:! ance .of coal in reducing the Comm-unity's dependence on imported oil, the Council held a wide-ranging debate op coal problems. If instructed the Permanent Representative~1 Committee to undertake an urgent and conJj structive ex_amination of existing measure$,~ and proposals for any new measures whicl( the Commission presents. The Council also agreed to take a decision before the end of 1979 extending the present system of aid to

· coking .coal and adapting it to present cii~ cumstances.

Hydrocarbons

Support for technological development projects

2.1.130. On 9 · October the Council authorized1 support measures· involving a total of 22 528 739 EUA for twenty-four technological development projects in the hydrocarbons sector, as proposed by the Commission. 3 ·

The Council also exchanged views on the proposal concerning the support of joint hyd­rocarbon exploration projects forwarded by the Commission on 29 November 19744 and amended in October 1977.5 The Council expected to continue the discussion at the next session.

SHEEPMEAT

The Council conducted a detailed discussion on the sheepmeat sector, having regard to the situation resulting from the recent judgment by the Court of Justice.

Delegations emphasized firstly that the basic principles of the common agricultural policy - freedom of movement, Community preference and·financial solidarity- must be maintained, and secondly that the objectives laid down in Article 39 o.f the Treaty must be observed, particularly as regards the situation of producers.

With this in mind, it was stressed .that the Council must expedite its proceedings with a view to introducing, as quickly as possible, machinery to ensure the balanced operation of the market in sheepmeat.

It was therefore agreed that a special meeting would be held on 30 October. The meeting would be prepared by the Special Committee on Agriculture and through informal contacts to be undertaken by the Presidency and the Commission with the Member States most directly concerned.

The Council conducted a detailed discussion on a series of measures for rationalizing the market and restructuring the wine sector. In the course of the discussion the Council achieved substantial progress towards arriv~ at an overall compromise.

However, the Council concluded that a number of important issues called for further reflection and agreed to finalize this action

.programme at its next meeting.

OLIVE OIL

Subject to completion of the procedure agreed on with Greece for the interim period, the Council approved two Regulations on olive .oil for which the marketing year 1979/1980 begins on 1 November.

The first Regulation lays down special measures for the marketing year 1979/1980 in respect of olive-oil producer organizations.

The second Regulation fixed for the marketing year 1979/1980 the representative market price - at 147 ECU per 100 kg - and the threshold price; the percentage of consumer aid to be used for promotional purposes was fixed at 4.5%.

EMERGENCY AID FOR THE AGRICULTURAL AREAS OF THE FOD

The Council conducted a policy discussion on the proposal concerning emergency aid measures to reconstitute the agricultural areas of the FOD damaged by hurricanes "David" end "Frederick", which resulted in a consensus in favour of such measures.

The Commission proposal was for the grant of 12.8 MEUA, with the Community contribution accounting for 40% of the total action. A for.mal decision on the matter will be taken upon receipt of the Opinion of the European Parliament.

AUBERGINES FROM THE FRENCH ANTILLES

The Council held a brief discussion on the proposal for a Council Regulation establishing a system of aid for the marketing of aubergines grown in the French.Antilles. The Council expressed its sympathy for the difficult situation faced by producer{3 in this region and asked the. Commission to give further thought to the most appropriate means of remedying the situation. The Council will resume its examination of the matter at its meeting on 12 and 13 November.

MISCELLANEOUS DECISIONS

The Council adopted, in the official ,languages of the C0mmunities, the Regulations

-amending Regulation (EEC) No 1117/78 on the common organization of the market in dried f'dder (extension from 30 June 1979 to 30 June 1980);

-fixing for the 1979/1980 marketing year the flat-rate production aid for dehydrated potatoes (11.72 ECU per tonne);

- on the transfer to the Italian intervention agency of common wheat held by the intervention ngency and on the conditions for bringing such wheat back on to the market;

- on the conclusion of the agreements between the Community and certain sugar-exporting ACP States and the Republic of India on the guaranteed prices for cane sugar for 1979/1980 (34.13 ECU per 100 kg of raw sugar and 42.30 ECU per 100 kg of white sugar); fixing the guaranteed prices applicable to cane sugar originating in the overseas countries and territories (OCT) for 1979/1980 (34o13 ECU per 100 kg of raw sugar and 42.30 ECU per 100 kg of white sugar);

- on exceptional food aid to the Republic of Malta in the form of 2,500 tonnes of pigmeat.

The Council adopted the draft Decisions Nos 3/79 and the draft Recommendations Nos 1/79 of the EEC-Austria and EEC-Switzerland Joint Committees (Community Transit) as the common position to be formulated by thE': Community delegation on these· Jc.•int Committees.

In preparation for the high-level meeting in the framework of the European Commission for Europe on the protection of the environment (Geneva, 13 to 16 November 1979), the Council approved the signing by the Community of the Convention on lcng-range transboundary air pollution. At the same time, it agreed to the Resolution on long-range transboundary air pollution and on the Declaration on low and non-waste tec~~ology and on the re-utilization and recycling of wastes.

MUTUAL ASSISTANCE ON VAT

The Council recorded its agreement to the texts of two Directives concerning mutual assistance of the tax authorities of the Member States on VAT. These two Directives mark significant progress in connection with the measures already taken to combat tax fraud and evasion on a Community scale.

Assessment of VAT --~--~-~~-----~

Under the Directive of 19 December 1977, the tax authorities of Member States are empowered to co-operate in the field of direct ·taxation. The first Directive to which the Council recorded its agreement extends mutual assistance to the assessment of VAT.

The aim of the second Directive to which the Council recorded its agreement is to extend to the recovery of VAT the Council Directive of 15 March 1976 on mutual assistance for the recovery of claims resulting from operations forming part of the system of financing the EAGGF, snd agricultural levies and customs duties.

EIGHTH DIRECTIVE ON VAT

. The Council recorded its agreement to the eighth Directive on VAT laying down arrangements for the refund of VAT to taxable persons.not established in the territory of the country.

It will be recalled that the sixth Directive on VAT established the principle that any taxable person is entitled to have VAT deducted or refunded whatever the country in which such a person incurs expenditure attracting VAT. The eighth Directive harmonizes, at Community level, the arrangements for refunding VAT to foreign taxable persons, thereby abolishing the differences existing in this field in the various Member countries of the Co~munity which could have given rise to a deflection of trade and distortion of competition.

In order to facilitate applications for refunds, the eighth Directive contains among other things a speciman application

.form for refunds which will be the same for all Community countries. Accordingly, taxable persons will only have to submit their application accompanied by the subst~\tiating documents and a statement issued by the authority certifying that he or she is liable to VAT in that Member State.

TID~TH DIRECTIVE ON VAT

The Council held n policy debate on the proposal for a tenth Directive on VAT, the aim of which is to clarify the provisions of the sixth Directive on VAT relating to the place where a service is provided in the case of hiring out of moveable tangible property.

At the close of this exchange of views, the Council requested the Permanent Representatives Committee to examine this matter further, particularly in the light of the Opinion expected from the European Parliament.

EXCISE DUTIES ON ALCOHOLIC BEVERAGES.

The Council held an exchange of views on the Commission proposals relating to the harmonization of excise duties on wine, beer and alcohol.

Winding up, the Council instructed the Permanent Representatives Committee to continue its work in the light of this discussion.

NEW JOINT RESEARCH CENTRE PROGRAMME

The Council discussed in depth the problems arising with respect to the new Joint Research Centre Programme proposed by the Commission for the period 1980 to 1983.

Following its.discussions, the Council noted that several problems regarding both the Super SARA Project and the funding for the programme together with the staffing of the Centre required further thought, and agreed to resume discussion of this item at its next meeting on research problems in December so that a decision could be taken before the end of the year.

NEW FUSION PROGRAMME

·The Council examined the problems still outstanding with respect to the new five-year Community Fusion Programme, with particular reference to the funding for the programme, incl 'lding the JET project, and to the advisability of retaining inertial .confinement in the programme.

The Council noted the progress made on all these problems and agreed to resume discussion in December with a view to reaching agreement.

SECONDARY RAW MATERIALS

The Council recorded its agreement - subject to conclusion of the procedure agreed upon with Greece for the interim period -on a Community multiannual research and development programme on the recycling ~f urban and industrial waste (secondary raw materials).

The programme will take the form of indirect action and co-ordination activities to be implemented between 1979 and 1982 with appropriations amounting to 9 MEUA and a staff of five. The following research areas will be covered: sorting of household waste, thermal treatment of waste, fermentation and hydrolysis and recuperation of rubber wa8te.

MANAGEMENT AND STORAGE OF RADIOACTIVE WASTES

The Council - while awaiting completion of the consultation procedures in progress - noted that there was a tendency towards consensus on a second five-year programme, for the period 1980-1984, concerning the management and storage of radioactive wastes.

This research programme, which covers an aspect of the important question of nuclear safety, will take the form of an indirect action with funds amounting to 43 MEUA and a staff of

.ten.

RADIATION PROTECTION PROGRAMME

After looking into the fUnding of a new five-year research and training programme (1980-1984) in the field of biology­health protection (radiation protection programme), the Council noted that eight delegations were now willing to allocate 63 MEUA thereto but that one delegation had stated it was not able to give its agreement at this stage.

COMMON RESEARCH POLICY

The Council held a wide-ranging exchange of views, on the basis of an analysis prepared by the Permanent Representatives Commi tte·e, on the two major features of the common research policy, namely: the co-ordination of national policies and the optimization of Community research and development activities.

The Council evolved certain guidelines to be followed by the Commission for its further proceedings.

MISCELLANEOUS DECISIONS

The Council adopted, in the official languages of the Communities, a Decision adopting a concerted action project for research into the effects of thermal processing and distribution on the quality and nutritive value of food. Implementation of the research work to be undertaken by the Member States in this area will necessitate a financial outlay of around 8 million ECU; the appropriations necessary to cover the Community's financial contribution to the co-ordination amount to 287,000 ECU. Participation in this action project is also open to third countries which are members of COST.

The Council also adopted in the official languages of the Communities a Decision amending Decision 77/186/EEC on the

. exporting of crude oil and petroleum products from one Member State to another in the event of supply difficulties.

AID TO NON-ASSOCIATED DEVELOPING COUNTRIES

The Council gave overall consent to the 1979 financing programme proposed by the Commission in accordance with the general guidelines appro.ved by the Council in October 1978.

The programme involves a sum of 110 MEUA and the appropriations can thus be committed in good time before the end of the current year. The programme will be finalized in the light of the comments made during the Council's discussions.

On the basis of Commission suggestions, the Council reached agreement on the general guidelines which the Commission will follow in preparing the 1980 financing programme.

The Council also held an exchange of views on the amount of aid ..r-Jr 1980 in v;hich delegations were able to state their positions on the subject. The Budget Authority was asked to take a final decision on the matter at the end of 1979.

The Council held an exchange of views on the main unresolved pi·oblems connected with the preparation of a framework Regulation on food-aid policy and management. It noted that discussions had to continue and that in the meantime the former procedures would remain in force.

PROGRESS OF NORTH-SOUTH DIALOGUE

The Council held a general discussion on the present state of the North-South dialogue, covering in particular the proposal of the Group of 77 that global negotiations be re-activated, which was currently being discussed in the United Nation General Assembly, and the preparation of the Jrd International Development Strategy.

The Council's discussion confirmed the importance attached by the Community to North-South relations and revealed a substantial con­vergence of the views expressed by the delegations.

The Council made the necessary procedural arrangements to ensure that preparation of a common position of the Community and its Member States with a view to the next stages of the international discus­sions was continued.

The Commission reported to the Council on the carrying out.of ~:•c i~g:ceement concluded between the Community and the International Development Association for the implementation of the Community's con­tribution of$ 385 million to the Special Action decided.on by the Conference on International Economic Co-operation.

The Council noted with satisfaction that application of this agreement was progressing smoothly.

EMERGENCY HUMANITA.."UA.N AID FOR THE CAMBODIANS

The President informed the Council of the outcome of tL:: r~is.;.,

The Counci~ adopted, in the official languages of the Communities, a Decision approving the OECD Council Recommendation concerning institutional co-operation between authorities of member countries responsible for supervision of private insurance.

On a proposal from the German Government the Council appointed Mr Werner ERDMANN, Ministerialrat im Ministerium fUr Arbeit, Gesundheit und Soziales des Landes Nordrhein-Westfalen, as alternate member of the Advisory Committee on Training in Nursing in place of·Mr FEMMER for the remainder of the latter's term of office, which runs until 14 January 1982.

RELATIONS WITH ASEAN

The Council authorized the Commission ·t<Y· open negotiations with the ASE.AN countri.es with a view to ·concluding a Co-o-peration- Agreement and ado.pted the directives for these negotiations.

On this occasion, the Council reiterated the political impo.rtance which it attributed to the development of relations between the Community and this group of' countries. ann expressed the hope tbat the Commission would be able to .conclude these important !,legotiations successfully before the end of this._year.

IRON AND STEEL PROBLEl'.1S - AID

The Council took stock of the dossier concerning the Community framework for aid for.the iron and steel industry.

It noted that only one delegation upheld certain reservations at this juncture and expressed the hope that these reservations could be withdravm very shortly to enable the Council to take a final decision on the assent concerning the draft Commission Decision at its next meeting on 20 November at the latest.

CYPRUS: PREPARATION OF THE ~:~EZTING OF THE ASSOCIATION COUNCIL

The Council determined the position to be adopted by the Community delegation at the 5th meeting of the EEG-Cyprus Association Council which was held on Tuesday 30 October 1979.

NEW ACP-EEC CONVENTION OF Lor,:E

The Council formally approved the final text of the new ACP-EEC Convention which will be signed tomorrow, 31 October, · in Lome, Togo. At the same time, the.Council designated its ~resident and Commissioner Cheysson as the Comrnunity's plenipotentiaries for the signing of this Convention.

The Council also agreed that in view of the periods of time necessary for ratification, the ACP-EEC Council of liinis.:t.ers shou~d delegate powers to the ACP-EEC Committee of Ambassadors as regards the adoption of transitional measures to cover the period between the expiry of the present Convention and the entry into force of the new Convention.

RELATIONS WITH TURKEY

The Council took stock of relations between the Community and Turkey, particularly in the ligh~ of the contacts between the President of the Council and Vice-President HAFERKAMP and the Turkish authorities during the former's visit to Ankara.

The Council also noted the suggestions made by the CommissiCiL concerning the possibi~ity of initiatin~ the technical prep­arations for certain projects to be financed from the specific financial aid proposed to Turkey as part of the Community's overall offer for developing the Association~ The Council · instructed the Permanent Representatives Committee to continue its examination of this matter.

GATT - FINAL REPORT ON THE IVlULTILATERAL TRADE NEGOTIATIONS

The Council took note of the Co!lll1lission report and noted that the final package of the negotiations represented a balanced result subject to 1.L.niformly correct implementation by the principal signatqry countries.

l~oreover, the Council noted the state of work regarding implementation of the MTN results by the Community and its principal partners.

Although the majority of. delegations were now ready to accept the res:ults of the MTN and to conclude the negotiations, the Council asked the Pennenent Representatives Committee and the Article 113 Committee to continue examining, with the Commission, the internal implementation provisions and the legal problems related tp conclusion~ so that it might also at· or before its next meeting in November take the e.ppropriate decisions concerning the conclusion of the MTN by the Co~~unity.

The Council also noted that the Commission was continuing to examine the dossier relating to synthetic textile fibres and th~t the Co~~ission's report would be submitted to it at its next meeting in November.

The Council finally evolved the approach to be adopted by the Commission in its talks with the United States on the

advance implementation of certain tariff provisions of the Agreement on trade in civil aircraft •

RELATIONS WITH PORTUGAL

After reaching substantive agreement in preparing the negotiating directives for the Commission with a view to concluding an Additional Protocol to the EEC-Portugal Agreement of 1972, the Couricil instructed the Permanent Representatives Committee to prepare the final text of these directives as soon as possible.

E1ERGENCY AID FOR THE PEOPLE OF CMdBODIA

In response to the recent appeal by the United Nations Secre'tary-General 7 the Council agreed on the proposal from the Cmmnission to make 25 MEUA available for a continued and increased humanitarian emergency aid to assist the people of Cambodia, including those coming in to Thailand.

20 HEUA wiil be allocated by the Commission to the international organizations concerned, particularly to the ICRC and UNICEF, for the financing of those organizations' relief efforts in the area.and the remaining 5 MEUA will be used for financing the supply of food aid in the form of 20,000 tonnes of rice. In addition, the Council agreed, as suggested by the Co~~ission, to supply, if need be, 1,500 tonnes of skimmed­milk powder.

The necessary budgetary procedures will be undertaken immediately.

vVhile recognition was given to the leading role of ICRC and UNICEF, the valuable role to be played by non-governmental and voluntary agencies who were currently engaged in the relief effort in Cambodia was also emphasized.

The aforementioned 25 MEUA plus 1 MEUA for skimmed milk powder added. to the already allocated 5.,1 lVrEUA implies a total Community aid of 31.1 llBUA (the equivalent of 43 million us:B) which, together with the bilateral contributions by the Community Member States amounts to approximately half of the 110 million us:.~ which the Secretary-General of the United Nations has estimated necessary for the next 6 months.

The Council expresses its appreciation of the recent decision of the Thniland Government to crant the status of refugees to Cambodians crossing into Thailand and its determination to give substantial assistance to the Government of Thailand to cope with this problem.

In the general context of its decisions on aid for the people of Cambodia, i·c was decided to send a Community mission

to Bangkok.

OTHER DECISIONS

The Council adopted in the official languages of the Communities the Regulations on the conclusion of agreements (already signed by the Commission during the gummer of 1979) on trade in textiles between the European Economic Community and the following countries: Argentina, Bangladesh, Korea, Hac ao, Pakistan, Sri Lanka and · Thailand.

The Council also adopted in the official languages of the Communities the Decision amending the arrangements for imports from Romania into Italy and the Federal Republic of Germany.

FISHERIES

The Council resumed its discussion of the establishment of a common fisheries policy, in the light in particular of the first report from the Scientific and Technical Committee for Fisheries and the communication on stocks submitted to the Council by the Commission. It agreed on a procedure for examining as soon as possible the proposals which the Commission intends to submit (particularly those on TACs) and agreed to return to the entire matter on 3 and 4 December 1979 when the Commission had consulted the sectors concerned.

Pending its decisions on the subject the Council agreed to extend until the end of 1979 its interim Decision which stipulates that:

= Member States will conduct their fishing activities in such a way that the catches taken by their vessels over the interim period take into account the total authorized catches (TACs) submitted by the ::ommission to the Council in its communications of 23 November 1978, 16 February and 25 October 1979 and the share of the TACs allocated to third countries under agreements or arrangements concluded with the Community.

= As regards technical measures for conserving and monitoring fishery resources, Member States will apply the same measures as they applied as at 3 November 1976, together with other measures taken in accordance with the procedures and criteria laid down in Annex VI to the .Council Resolution of 3 November 1976.

In addition, the Council noted a statement by Vice-President GUNDELACH on the sub~ect of the whole external aspect of the common fisheries policy and agreed to return at its next meeting to, inter alia, the question of the conclusion of the framework agreement with Canada.

In conclusion, the Council held an exchange of views on the subject of Community participation in a preparatory meeting on the new International Whaling Convention.

laying down special measures in respect of olive oil producer organizations for the 197971980 marketing year;

- on the standard amount for unprocessed olive oil produced entirely in Greece and transported direct from that country into the Community;

- amending Regulation No 724/67/EEC as regards the disposal of oil seeds bought in by intervention agencies;

amending Regulation (EEC) No 358/79 on sparkling wines produced in the Community and defined in item 13 of Annex II to Regulation (EEC) No 337/79;

- amending both the Common Customs Tariff in respect of wines and Annex V to Regulation (EEC) No 337/79 on the common organization of the market in wine.

The Council also adopted in the official languages of the Communities the Directive amending Directive 76/630/EEC concerning surveys of pig production to be made by Member States.

The Council debated at length the questions at issue in the sheepmeat sector. The debate brought the differing posi­tions of the delegations on the subject substantially close1~. Alternative solutions were put fo1~ard and will be examined by the Commission and the Special Comr.ai ttee on Agriculture over the next few days.

The Council agreed to resume its discussion of the issue on the basis of these examinations with a view to reaching a conclusion at its meeting on 12 and 13 November 1979.
