00209 CITY OF VANCOUVER REGULAR COUNCIL MEETING A regular meeting of the Council of the City of Vancouver was held on Tuesday, October 16, 1979, in the Council Chamber commencing at approximately 2:00 p.m. PRESENT: Mayor Volrich Aldermen Bellamy, Boyce, Ford, Gerard, Harcourt, Kennedy, Little, Marzari, Puil and Rankin CLERK TO THE COUNCIL: R. Henry PRAYER The proceedings in the Council Chamber were opened with prayer, offered by the Civic Chaplain, Major H. Tilley, of the Salvation Army. ACKNOWLEDGEMENT The Mayor acknowledged the presence in the Council Chamber of students from Musqueam Reserve, attached to Vancouver Community College, who are participating in the Basic Job Training Program, under the direction of their instructor, Laverne Edwards. 'IN CAMERA' MEETING The Council was advised there were matters to be considered 'In Camera' later this day. ADOPTION OF MINUTES MOVED by A ld . CLASSIFICATION: RECOMMENDATION.

The D irector o f Planning reports as fo llow s:

"An app lica tion has been received from Mr. J. Funaro requesting an amendment to Zoning and Development By-law, No. 3575, whereby the property on the north side o f the 2500-block Franklin S treet (Lots 17 to 32 o f Lot 38, THSL, Plan 379) would be rezoned from RS-1 One- Family Dwelling D is t r ic t to C-2 Commercial D is t r ic t fo r the stated purpose o f:

'constructing a superm arket/office complex to be tte r serve the Hastings east a rea '.

SITE DESCRIPTION AND BACKGROUND

As shown on the Appendix A Map attached, the s ite comprises 16 lo ts generally developed w ith o lder one-and-a-half-storey, one-family dwellings i n good condition . D eta ils o f e x is tin g development on the s ite and on RS-1 zoned lands to the south, east, north and west are shown on Appendix B Map attached.

An extensive discussion o f supermarket development i n the East Hastings area i s contained i n the C ity Manager's report o f Ju ly 26, 1978 which dealt w ith a previous rezoning app lica tion by Mr. Funaro. For various legal reasons re la ted to the Hastings Street C o llec tive Parking Agree­ment, the proposed rezoning o f lands on the south side o f the 2500-block Franklin Street was refused by Council on August 29, 1978. D eta ils o f th is previous consideration are provided i n the Council Minutes attached as Appendix C.

Planning s ta f f have been i n contact w ith the applicant since March,1979 regarding the current proposal. Following various meetings and a tour o f the area w ith the app lican t, the applicant was advised o f is sues which should be considered in subm itting a formal rezoning app lica tion fo r lands on the north side o f the 2500-block Franklin S tree t. A copy o f th is le t te r is attached as Appendix D.

On August 31, 1979 a p e tit io n from owners and residents o f the 2400- and 2500-blocks o f Pandora S treet voicing strong protests to any rezoning on the north side o f the 2500-block Franklin S treet was c ircu la ted to Council. A copy o f th is p e tit io n was sent to Mr. Funaro on September 6, 1979.

A formal rezoning ap p lica tio n , accompanying le t te r and drawings were received from Mr. Funaro on September 11, 1979. Also submitted were two p e titio n s expressing support fo r the proposal: one p e tit io n which the applicant states represents over 1,500 homes In the area; the other p e tit io n which the applicant states re fle c ts 95 percent support from merchants and tenants o f the 2400-, 2500- and 2600-blocks o f Hastings S treet.

PROPOSED DEVELOPMENT

(3,316 m2 or 35,700 s q . f t . ) o f f ic e commercial (2,248 m2 or 24,200 s q . f t . ) , and storage (929 m2 or 10,000 s q . f t . ) fo r a to ta l o f 8,630 m2 (92,900 s q . f t . ) . A to ta l o f 170 o ff -s tre e t parking spaces and two o f f -s tre e t loading spaces are to be provided.

The applicant also ind icates tha t the proposed development would have a f lo o r space ra t io o f 1.44 (the C-2 Commercial D is t r ic t Schedule perm itting a maximum F.S.R. o f 3 .0 ). The proposed develop­ment provides no setbacks from property line s and exceeds, in pa rt, the maximum height o f 40 fee t permitted under the C-2 Commercial D is t r ic t Schedule.

Under C-2 zoning, the u ltim a te development o f th is s ite would not be re s tr ic te d to the uses, the gross f lo o r area or the form o f development expressed in th is app lica tion .

ANALYSIS

Six issues were addressed in dealing w ith the previous rezoning app lica tion fo r the south side o f the 2500-block Franklin S treet.Four issues were sp e c ific to the C o llec tive Parking Lot s ite then under consideration fo r rezoning. The fo llow ing two issues as previously stated are equally applicable to the current rezoning proposal.

1. While there is a recognized need fo r a supermarket in the Hastings East area, the form o f development must have a posi­t iv e physical re la tion sh ip to the adjacent s in g le -fa m ily res id en tia l neighbourhood;

2. Given the existence o f a large amount o f C-2 zoning and develop­ment in th is area, o ff ic e or re ta i l space provided on th is s ite w i l l , as substantiated in Mr. Funaro's own Environmental Impact Assessment, have a detrimental impact on ex is tin g commercial businesses.

Although the Planning Department is very sympathetic to the need fo r a supermarket f a c i l i t y in the Hastings East area, the proposed rezoning now before Council cannot be supported fo r a number o f reasons.

F ir s t , the proposed rezoning represents a s ig n if ic a n t in tru s io n o f commercial development in to an established, s tab le , res iden tia l community. The provisions o f the C-2 D is t r ic t Schedule would accommodate a development s im ila r to th a t proposed by the applicant as shown on the drawing submitted. C lea rly , both the uses and scale o f such a development would have an adverse impact on the adjacent re s id en tia l neighbourhood, p a r t ic u la r ly w ith respect to the residences across the lane to the north.

Secondly, C-2 zoning now extends from the 1900-block to the 2800- block on both sides o f Hastings S treet. This amount o f commercial zoning p o te n tia lly provides a number o f a lte rn a tive locations where comparable s ites might be assembled to accommodate a supermarket development. The e x is tin g C-2-zoned land in the East Hastings area is more than adequate to serve the needs o f th is community.While cost and ownership fac to rs have a lleged ly fru s tra ted the applicant in attempting the acqu is ition and consolidation o f e x is tin g C-2 p roperties , the re la tiv e ease and cost o f consolidating RS-1 p roperties, even a t reputedly commercial p rices , is in s u ff ic ie n t ju s t i f ic a t io n to warrant the in trus ion o f commercial zoning and development in to a res iden tia l community.

Thirdly, the commercial zoning and development of the 2500-block Franklin Street needs to be considered in light of similar subsequent requests in the 2400- to 2800-blocks of Franklin Street or of Pender Street to the south, any of which could potentially support such a development or other lesser-scale development.

Should the requested rezoning be approved, i t can be anticipated that similar rezonings will be proposed for other comparable sites in the East Hastings Area, as well as other similar commercial arterials throughout the City.

The in itia l written response to the applicant stated the need for justifying such a development proposal in this location as opposed to existing zoned commercial land along Hastings Street and any other similar block of residential development flanking Hastings Street.To date, that justification has not been forthcoming.

CONCLUSION

For reasons previously related to ease of land acquisition the applicant has proposed a major commercial development in a stable residential area. In the adjoining commercial district a considerable amount of land is already zoned and appropriate for commercial redevelopment.

I t is believed the proposal would have major detrimental consequences on the adjoining homes, would set a most damaging precedent in the area and not assist in the improvement of Hastings Street commercial district.

Further, the requested C-2 schedule would remove the City's ability to negotiate a sensitive form of development or to restrict the development to a density less than 3.00 F.S.R.

Because these problems seem to be so obvious, and the upset and unstabilizing effects on the community are so serious the Director of Planning has not undertaken a fu ll and detailed assessments to cover all the fine points of this argument that would be necessary i f this was referred to a Public Hearing. The Director of Planning believes that further resources and the time of many citizens and businessmen should not be further expended on this inappropriate proposal.

RECOMMENDATION

The Director of Planning recommends that the application be not approved."

The City Manager RECOMMENDS that the foregoing recommendation of the Director of Planning be approved.

Ocean Construction offered an additional 10% discount i f the sections could be supplied in 1.2 metro lengths as opposed to the 1 metre length specified. The 1.2 metre length is acceptable.

SITE DESCRIPTION AND BACKGROUND

The s ite is located at the southwest corner o f Kingsway and Nanaimo Street and is bounded on the west by Baldwin Street and on the south by East 30th Avenue. The ir re g u la r s ite has a frontage along Kingsway o f 67.64 m (221.93 f t . ) and a to ta l s ite area o f approximately 7165.70 m2 (77,131 s q .ft.) .(S e e Appendix A Map).

The s ite is presently zoned CD-I Comprehensive Development D is t r ic t and developed w ith a restaurant (which ex is ts as a non-conforming use), re ta il s tores, o ff ic e s , and a bank, a ll accommodated w ith in a one-storey bu ild ing fro n tin g onto Kingsway. On the southerly portion o f the s ite two three- storey apartment bu ild ings have been developed under the CD-1 zoning. These are oriented towards the qu ie te r re s i­dentia l areas located to the west, south and southeast o f the s ite which are zoned R5-1 One-Family Dwelling D is tr ic t .A va rie ty o f commercial uses inc lud ing a restaurant, trave l agency, green grocer and a gasoline service s ta tion e x is t in the v ic in i ty o f the s ite on lands zoned as C-2 Commercial D is t r ic t generally along both sides o f Kingsway. Commercial space w ith in a newer commercial and re s id e n tia l development under CD-I zoning at the northeast corner o f Kingsway and Nanaimo remains vacant.

The s ite was rezoned from RT-2 Two-Family Dwelling D is tr ic t and RS-1 One-Family Dwelling D is t r ic t to CD-I Comprehensive Development D is t r ic t on May 6, 1975. The CD-I By-law (No. 4861) re s tr ic ts the development o f the s ite to :

"(a ) an apartment bu ild ing w ith customary a n c illa ry uses includ ing underground parking and

(b) re ta il stores, o ff ic e s , a bank, w ith customary a n c illa ry uses includ ing o ff -s tre e t parking and loading,

subject to such conditions as Council may be reso lu tion p rescribe ."

A recent Development Permit App lica tion to a lte r and use approximately 91.045 m2 (980 s q . f t . ) o f the ex is tin g bu ild ing as a restaurant was refused because the proposed use was non­conforming w ith the ex is tin g CD-I By-law (No. 4861).

The applicant subsequently f i le d an Appeal o f the D irecto r o f Planning's decision to the Board o f Variance. He was advised by the Planning S ta ff to withdraw tha t Appeal and to make app lica tion to amend the CD-I By-law to allow a restaurant as a conforming use.

ANALYSIS

I t was the in te n t o f the CD-I By-law to es tab lish r e ta i l stores and o f f ic e s to serve the loca l commercial needs o f th is neigh­bourhood. A s t a f f s i te inspection o f th is e x is t in g restaurant ind icates th a t the proposed use would be cons is ten t w ith the in te n t o f the By-law as the operation is o f a sandwich bar delicatessen-type and genera lly dependent upon ca rry -ou t lunch­time trade from surrounding residents and commercial business s ta f f . S ite inspection revealed no noticeab le t r a f f i c or parking problems.

The required parking estab lished under CD-I By-law No. 4861 is 97 parking spaces and one loading bay as determined by Table 12-1 o f the Zoning and Development By-law No. 3575 . A break­down o f th is parking requirement ind ica tes th a t 17 spaces are required fo r the commercial component o f th is CD-I development and 80 parking spaces fo r the apartment complex. The s t a f f s i te inspection ind ica tes tha t the 17 commercial parking spaces have been provided on the surface - 5 to the rear o f the com­mercial development on the west side and 12 to the rear o f the bank on the east side.

A re -ca lcu la t io n o f the parking requirements to include the proposed restaurant use ind ica tes th a t no change in the amount o f parking to be provided would be required. On th is basis and in view o f the loca l nature o f th is e x is t in g restaurant use the D irec to r o f Planning believes th a t the inc lus ion o f 're s ta u ra n t ' as a permitted use in CD-I By-law No. 4861 is appropria te.

RECOMMENDATION:

The D irec to r o f Planning recommends th a t the fo l low ing recommendation be received and the whole matter be re fe rred d i r e c t ly to Public Hearing:

"On July 12, 1977, Council approved the Grandview-Woodland N.I.P. Concept Planwhich i ncluded an a lloca tion o f $146 000 to 'provide a subsidy to encourage the completion o f local i mprovements i ncluding curbing o f res iden tia l s tree t and construction o f sidewalk, with f inanc ia l pa rt ic ip a t io n by property owners'.

The purpose o f th is report i s to recommend the appropriation of funds to make such a subsidy available fo r the encouragement o f sidewalk i n s ta l la t io n i n th is area.

While i t i s general Council po licy (18/09/73) tha t 'loca l res iden tia l sidewalks be i n s ta l le d b y p e t i t io n o n ly , ' sidewalk i mprovements have been given the highestp r io r i t y , by the Grandview-Woodland N.I.P. Committee, fo r i mprovement amongpotentia l local i mprovement projects due to the large number o f i ncomplete side­walks and higher than average number o f residents without the use o f automobiles i n th is area. Through t r a f f i c on res iden tia l s treets causes a hazard to pedestrians, p a r t ic u la r ly children tra v e l l in g to and from neighbourhood schools. The completion o f a more extensive network o f sidewalk would o f fe r a p a r t ia l r e l ie f o f th is hazard.

A C ity - i n i t ia te d local i mprovement has been proposed by the N.I.P. Committee fo r every block face or flankage i n the N.I.P . area curren tly lacking a sidewalk. A recommended subsidy o f fe r o f 25% o f the to ta l cost i s, therefore, i ntended to encourage the adjacent property owners to proceed with such i mprovements. In accordance with past practice , th is subsidy would be extended to apply to the C ity 's costs as w e l l .

The to ta l cost of i n s ta l l in g a l l remaining sidewalks i n the N.I.P. area i s estimated to be $272 000. Thus a 25% subsidy would re su lt In a N.I.P. contr ibu tion o f $68 000. This pro ject requires the cost-sharing formula applicable to services and u t i l i t i e s under which the C ity , P rov inc ia l, Federal s p l i t i s 62.5%, 12.5% and 25% respective ly.

Streets Capital funds are not available from Basic Streets Capital since the side­walk construction a lloca tion i n the Five-Year Program does not allow fo r such an i ntensive area i mprovement. The apparent source o f funds i s the 1979 Supplementary Capital Budget. The Grandview-Woodland N.I.P. program terminates Ju ly , 1980, which necessitates a commitment i n p r in c ip le at th is time, i n order to success­f u l l y complete the N.I.P . program w ith in the approved time frame.

In one i nstance i n the Mount Pleasant N.I.P . area, Council approved o f the extensionof such a subsidy where a re s id e n t- in i t ia te d p e t i t io n had been approved ju s t p r io rto the N.I.P. funding o f i mprovements. Such a re troactive extension o f the subsidy i s proposed fo r one such p e t i t io n (west side o f Nanaimo Street, 6th to 7th Avenues) submitted during 1979 p r io r to th is report. An additional $1 275.00 N.I.P. a lloca tion i s required to allow th is re troactive subsidy.

I t i s proposed that the i mprovements be i n i t ia te d i n small groups o f geographically homogeneous blocks. This would re su lt i n the i n i t ia t io n o f 17 groups o f sidewalks rather than 48 i ndividual blocks (re fe r to l i s t , Appendix I ) .

The Grandview-Woodland N.I.P. Committee recommends the appropriation o f N.I.P. funds necessary to provide a subsidy o f 25% to both property owners and the City i n order to stimulate the completion o f the sidewalk network i n th is neighbourhood. I t also supports the extension o f th is subsidy o f fe r to property owners fronting along the west side o f Nanaimo Street, 6th to 7th Avenues, who have successfully petitioned fo r sidewalk i mprovements during 1979.

RECOMMENDATIONSThe Director o f Planning and the C ity Engineer therefore recommend:

A. THAT Council approve the a lloca tion o f $132 600 from 1979 Supplementary Capital to cover Streets Capital funds required fo r constructing sidewalks l is te d i n Appendix I .

B. THAT Council approve i n p r inc ip le a 25% subsidy o f the costs to theCity and adjacent property owners fo r constructing sidewalks l is te di n Appendix I i ncluding a re troactive subsidy to January 1, 1979 fo r the one p e t i t io n submitted p r io r to th is report.

C. THAT Council approve i n p r in c ip le the appropriation o f $68 000 from the Grandview-Woodland N.I.P. Council instructed the D irector o f Planning to make applica­tion to so amend the By-law and re ferred th is application d ire c t to Public Hearing fo r consideration.

P rio r to consideration o f th is application at a Public Hearing and upon fu r the r analysis by the D irector o f Planning, a fu r the r report by the D irector o f Planning recommending w ith­drawal o f the aforementioned application was considered by Council at i t s meeting of August 15th, 1978.

In considering th is la t te r report, and upon request o f the City Engineer, Council referred th is matter to the Transporta­tion Committee fo r consideration. A report from the City Engineer fo r concurrent consideration with the report from the Director o f Planning was antic ipated.

ANALYSISIn reporting back to Council with a recommendation to withdraw the application requesting an amendment to Zoning and Development By-law No. 3575, the D irector o f Planning noted the potentia l impact o f the proposed amendment w ith p a r t icu la r regard to develop­ment p o s s ib i l i t ie s on smaller commercially zoned properties.Here the amendment to have been approved, the p o s s ib i l i ty of developing one and two dwelling un its in conjunction with commercial space would have been s ig n if ic a n t ly reduced. This was f e l t to be inappropriate.

The Director o f Planning also noted the recent establishment of an Engineering and Planning Department Task Force to undertake a comprehensive review of o f f - s t re e t parking and loading require­ments and standards w ith in the C ity . I t was antic ipated tha t th is review would lead to proposed changes to o f f -s t re e t parking requirements which would a f fe c t commercial properties and that such proposals should be comprehensively developed and discussed with both the affected property owners and Council. For these reasons, the Director o f Planning recommended tha t the above-noted application be withdrawn.

In 1978 the Engineering Department requested funds fo r a compre­hensive parking study on a c ity-w ide basis. Funds were not allocated however.

The City Engineer believes th is matter is important and should be considered as part o f a comprehensive study. Therefore, funding w i l l be requested again in 1980.

5 . R i le y P a rk N . I . P . A p p r o p r ia t io n o f Funds:Changes to B rock Annex S ch o o l to Accommodate a D a ycare F a c i l i t y _________________________________

The D irector o f Planning reports as fo llow s:

"On July 26, 1977, C ity Council approved the R iley Park N .I.P . Concept plan which included an a llo ca tion o f $75,000.00 fo r improvements to local schools. The purpose o f th is report is to recommend the appropria tion o f a portion o f these funds fo r changes to Brock Annex School to accommodate a Daycare F a c ility .

A goal o f the R iley Park C itizens ' N .I.P . Planning Committee is to make public fa c i l i t ie s in the neighbourhood more accessible fo r community use. Because o f recent school enrollment decreases, the kindergarten room at Brock Annex w i l l not be used as a classroom th is f a l l . The L i t t le Mountain Neighbourhood House Society is organizing a daycare in the loca l area. I t is f e l t tha t the vacant space at Brock Annex would be an appropriate s ite fo r such a f a c i l i t y , provided tha t some a lte ra tio n s and renovations are undertaken in order to meet Community Care Licensing requirements and to iso la te the room from the res t o f the school.The cap ita l costs fo r these changes have been estimated to be $5,000.00.

The proposed changes are itemized in Appendix A, attached, as agreed upon by the L i t t le Mountain Neighbourhood House Society, M in is try o f Human Resources and the Vancouver School Board.

The M in is try o f Human resources has agreed to cover a l l s ta ff in g and operating costs fo r the daycare f a c i l i t y as well as $3,000.00 in cap ita l funds fo r physical Improvements (as noted in attached Appendix B). This leaves a balance o f $2,000.00 in cap ita l funds which is proposed to be covered by R iley Park N .I.P .

The R iley Park C itizens ' N .I.P . Planning Committee strong ly supports the proposed expenditure o f up to $2,000.00 in N .I.P . funds because i t w i l l provide fo r a needed service to many sing le and working parents in the community while a t the same time using ex is tin g pub lic space th a t would otherwise not be used.

CMHC and the Province o f B.C. have been advised and concur w ith the proposed p ro jec t and funding.

The D irecto r o f Planning recommends:

THAT Council approve an expenditure o f up to $2,000.00 to be appropriated from the R iley Park N .I.P . Social and Recreational Budget Account 898/9413 fo r additions and renovations a t Brock Annex School, costs to be shared as fo llow s:

Recently i t has been brought to our a tte n tio n th a t some aspects o f the Board's funding o f these programs may not be le g a l since they may contravene the P ublic Schools A c t. North Vancouver Court Case

Subsequent to the above le t te r , the judgment in the Court case in North Vancouver, th a t had caused the concern, was handed down and was found b a s ic a lly in favour o f the North Vancouver School Board.

Estim ated Costs o f Program

The 1978 cost to th e Vancouver School Board fo r th e operation o f th e community use o f schools was $362,279.

Recommendations

Since the recent Court decision appears to re lie v e the School Boards o f some o f th e ir concerns, and since the programs were commenced by and a re g en era lly accepted and financed throughout the school system, then the D ire c to r o f Finance recommends th a t:

A. THE le t te r from the Chairman o f the Vancouver School Board be RECEIVED,

B. the Vancouver School Board be advised t hat i t is C o u n cil's opinion th a t they should review the Court fin d in g s to see i f fu rth e r action is needed by the M in is te r o f Education to amend the P ublic Schools Act to avoid th is problem in the fu tu re ,

C. the Vancouver School Board be advised th a t in any case the C ity is not prepared to e n te rta in a g ran t s tru c tu re fo r th is purpose as i t f u l f i l l s an im portant educational need."

4 . A ld e r Bay Housing C o - o p e r a t i v e Land Lease i n F a ls e C re e k - E a r th q u a k e In s u r a n c e

The D irector o f Finance reports as fo llow s:

"A ll ground leases in False Creek require the lessees to obtain earthquake insurance on th e ir bu ild ings. This requirement was fo r the purpose o f ensuring th a t, i f an earthquake occurs, there w i l l be funds to rebuild and th a t, at the end o f the lease there w i l l be a bu ild ing on the land.

However, insurance against earthquake is not common in Vancouver. Most property owners do not insure th e ir properties against earthquakes because the cost o f such insurance can increase premiums by 30% to 50% over normal insurance.

The Alder Bay Housing Co-operative has requested tha t the clause in th e ir lease tha t requires earthquake insurance be modified to e lim inate th is requ ire­ment. This matter was brought to Council w ith respect to the False Creek Co­operative Housing Association in August o f 1977 and Council a t tha t time approved a recommendation tha t th is requirement not be enforced fo r tha t group. Since then Council has approved a report o f the Champlain Heights P roject Manager excluding th is provision from leases in Champlain Heights. I t is possible to include the provision in the lease and merely not enforce i t a t the present time. This leaves open the a b i l i t y to enforce i t in the fu tu re i f tha t seems wiser.

Council may not wish to deal w ith every request fo r non-enforcement. In tha t case, the au tho rity to approve the non-enforcement could be delegated to the D irector o f Finance and the C ity Manager.

I t is recommended

a) That Council not enforce the earthquake insurance requirement inthe False Creek ground lease w ith the Alder Bay Housing Co-operative,

b) That Council delegate to the D irecto r o f Finance and the C ity Manager the au tho rity to approve the non-enforcement o f the clause in fu ture instances."

The Project Manager reports as fo llow s:

"The d ra ft ground lease between the C ity and United Properties fo r the above development was recently delivered to the bu ild e r to review p r io r to execution.As ou tlined in the concurrent report dated October 4, 1979, on Enclaves 2 and 21, United Properties have requested amendments regarding the f i l in g o f the bare lo t s tra ta plan as well as an amendment perm itting conveying t i t l e on a sing le u n it p r io r to substantia l completion o f a l l the u n its . In a d d ition , in th is spe c ific instance, United Properties have also requested an amendment to the rental payment requirements. The purpose o f th is report is to review the matter w ith Council and request a change to our payment schedule.

Normal C ity terms fo r prepaid leases are ba s ica lly a 5% deposit on acceptance by Council, 20% down on execution o f the lease and the remaining amount paid in equal insta llm ents 6, 12 and 18 months from the date o f lease together w ith in te re s t on the outstanding balance.

A clause in the ground lease re la tin g to sub le tting and assigning states tha t payment o f a ll basic rent in f u l l must be made p r io r to sub le tting or assigning o f any un its . What th is means is tha t before the bu ilder conveys the f i r s t u n it , he must prepay the e n tire ground rent regardless o f the 6, 12 and 18 month schedule. In th is case, i t would mean tha t the bu ilde r would have paid out approximately $1,000,000.00 a t the time o f the f i r s t conveyance. Again, in th is case, the to ta l p ro ject development costs inc lud ing the ground rent amount to approximately $5.6M. Carrying a $1M land payment from the time of the f i r s t conveyance creates a s ig n if ic a n t problem to the bu ilde r.

At the same time, s ta f f are concerned tha t the C ity 's pos ition must be ade­quately protected. In order to resolve th is problem, s ta f f met w ith the bu ilder and negotiated the fo llow ing proposal:

The Project Manager reports as fo llows:

"During recent negotiations w ith United Properties and Fore Development regarding the C ity 's ground leases, several points emerged which appeared to create p a r t icu la r d i f f i c u l t y in financing the pro jects.

These problems were in part due to the fac t tha t the builders were developing'bare lo t s tra ta p ro je c ts ' , as opposed to the more t ra d it io n a l s tra ta t i t l e townhouses. The essential d ifference between these two s itua tions is that in the la t te r case build ings must be subs tan tia l ly complete before the stra ta plan can be registered, whereas with a bare lo t s tra ta plan, the property is simply surveyed and actual lo ts created. In most instances construction of the build ings would not have started at the time the plan is f i le d .

The benefit o f a bare lo t s tra ta from the purchasers perspective is in that they obtain exclusive use of the outdoor areas (back yards e tc . ) which createsmore o f a single family ownership fee ling than a 'condominium' fee ling , where normally 'exclusive use' includes only the in te r io r spaces.

Our ground lease states tha t a l l rent is due and payable on re g is tra t io n o f the stra ta plan. The lease also states tha t no single u n it can be conveyed u n t i l a l l the units are subs tan tia l ly completed.

These conditions create s ig n if ic a n t financing d i f f i c u l t i e s in tha t thebuilder is unable to reg is te r the plan and convey un its u n t i l a l l are sub­s ta n t ia l ly complete. In a pro ject involv ing 50 - 70 semi-detached or townhouse un its , th is is an unreasonable constra in t.

The City was requested by the developers to amend our ground lease in the fo llowing manner:

SITE DESCRIPTION

The s ite is zoned C-3A Commercial D is t r ic t and is developed w ith a two-storey commercial bu ild ing which covers a l l but the southerly (rear) 3.048 m (10 fee t) o f the s ite . The development o f th is s ite w ith a warehouse was approved under a bu ild ing permit issued in May, 1948. In 1962 the approved use was extended to include whole­sale use o f the bu ild ing . On A p ril 30, 1974, Development Permit No.66301 was issued to a lte r and use a portion o f the main f lo o r fo r ac­cessory re ta il (J. & M. Canada Coin & Stamp Co. L td .) to the ex is tin g wholesale use ( Io r io Coin & Stamp Supply Co.). The development was already d e fic ie n t in parking, two o ff -s tre e t parking spaces being provided where f if te e n were required. The proposed accessory re ta i l use a c tu a lly reduced the required amount o f parking to nine spaces.

In 1975, Development Permit A pplica tion No. 69523 was submitted, requesting permission to a lte r and use a portion o f the main f lo o r fo r lithography (w ho lesa le /re ta il e x is tin g ) and a lte r and use the second f lo o r fo r o ff ic e s . These proposed uses would have a requirement fo r f if te e n o ff -s tre e t parking spaces and fou r loading spaces (one loading bay being required fo r each use). This Development Permit Application was refused by the D irecto r o f Planning on A p ril 4, 1975, as there was f e l t to be " in s u ff ic ie n t p e c u lia r ity o f s ite o r development to warrant the re laxation o f the required f if te e n o f f -s tre e t parking spaces and four o ff -s tre e t loading spaces to two o f f -s tre e t parking spaces and one o ff-s tre e t loading space."

This decision was appealed to the Board o f Variance which considered and approved the proposed uses, fo r a period o f two years, exp iring in A p ril 1977. The uses were subsequently approved fo r a second two- year period in May, 1977, and a five -ye a r period on A p ril 18, 1979. This la s t appeal and subsequent development permit approved the fo llow ing :

In the opinion o f the D irecto r o f Planning the development located at 106-110 West Broadway is extremely d e fic ie n t w ith respect to the required o ff -s tre e t parking and loading spaces. F ifteen o ff-s tre e t parking spaces and fou r o f f -s tre e t loading spaces are required - no parking and only one loading space is provided. As s tra ta t i t l i n g w i l l l ik e ly extend the l i f e o f th is non-conforming bu ild ing (w ith respect to regu la tion) the D irecto r o f Planning cannot support th is proposed s tra ta t i t l e conversion. The decision to redevelop or maintain the property would, i f the s tra ta were approved, be dependent on the decision o f two separate owners, not ju s t one owner as is the present s itu a tio n . Further, s tra ta t i t l i n g in to two separate legal "s tra ta lo ts " gives added permanency to at least two separate uses o f th is bu ild ing when even the ex is ting uses have been

The s ite is located on the south side o f Kingsway between Battison and Lincoln Streets and was s p e c if ic a lly examined by the Kingsway Task Force. The general po lic ie s and s ite s p e c ific design guidelines recommended by the Kingsway Task Force were adopted by Council on October 17, 1978 and have formed the basis fo r assessment o f the proposed rezoning and scheme o f development.

The scheme o f development responds well to the guidelines o f the Kingsway Task Force. Various deta iled matters have been noted during assessment o f the proposal and have been transm itted to the applicant and a rch itec t fo r consideration. These matters can most appropria te ly be reviewed at the Development Permit stage should the rezoning be approved. The proposed rezoning and accompanying scheme have m erit and should be given consideration at a Public Hearing.

RECOMMENDATION

The s ite and ex is tin g zoning are ou tlined on the attached Appendix A plan. A general land use map has been attached as Appendix B.The s ite has a to ta l area o f 1.80 hectares (4.44 acres).

The Peacock Court Motel which began development in 1946 was recently demolished under Permit. P rio r to dem olition , the tw o-un it bungalows were being advertised fo r renta l as duplex re s id en tia l accommodation but remained la rg e ly vacant.

The Mountain View Motel developed increm entally since 1938. In 1956 the westerly portion o f the s ite was cleared and paved fo r use as a t r a i le r court. The s ite remains well used: the Mountain View Motel has unquestionably been used fo r other than short-term residen­t ia l accommodation fo r several years; the Mountain View T ra ile r Court has evolved to accommodate short-term accommodation o f recreational vehicles in addition to the more permanent 'mobile homes'.

The s ite or portions thereof were the subject o f two previous rezoning applications submitted in recent years. In March 1977 an app lica tion to rezone the most westerly lo t (the Mountain View Motel and T ra ile r Park s ite ) to CD-I Comprehensive Development D is t r ic t fo r the purpose o f constructing a mixed commercial and re s id en tia l p ro ject was received. This rezoning app lica tion was one o f fou r located w ith in the eastern Kingsway area and Council a t i t s meeting on November 8, 1977 agreed to place a hold on processing o f these a p p li­cations u n til such time as the D irec to r o f Planning and the C ity Engineer report back on various options fo r a study w ith respect to the e ffec ts o f changes in land use, t r a f f i c , t ra n s it , etc. on the area along Kingsway from Boundary Road to Rupert S treet. On January 10, 1978 Council approved the establishment o f a Kingsway Task Force to determine development po lic ie s fo r Kingsway, and instructed the D irecto r o f Planning to continue to place a hold on the processing o f the four rezoning applications on hold since October 20, 1977. The app lica tion fo r rezoning o f the Mountain View Motel and T ra ile r Court s ite was withdrawn by the applicant on A p ril 21, 1978.

On A p ril 24, 1978, an app lica tion was submitted by Qualico Develop­ments Ltd. requesting a rezoning o f the same s ite as under the current rezoning ap p lica tion . In view o f the recommendations o f the Kingsway Task Force which were approved by Council a t i t s meeting on October 17, 1978, th is in i t i a l app lica tion by Qualico Developments Ltd. was withdrawn on November 21, 1978.

The current app lica tion on behalf o f Qualico Developments Ltd. was submitted on June 6, 1979. The proposed development has la rge ly been assessed against the s p e c ific development parameters and guidelines o f the Kingsway Task Force study as approved by Council.

2. PROPOSED DEVELOPMENT

Following pre lim inary discussions w ith the a rch ite c t and developer in A p ril 1979 regarding a development concept fo r th is s ite , the applicant has submitted drawings w ith his app lica tion stamped 'Received, C ity Planning Department, June 6, 1979'. 3. CALCULATIONS

The s ite has a to ta l area o f 1.798 hectares (4.444 acres). This to ta l may be broken down in to two components: the Kingsway frontage which accommodates the commercial/apartment component, having a s ite area o f 0.66 hectares (1.564 acres); and the remaining southerly portion which contains the townhouse component, having a s ite area o f 1.165 hectares (2.880 acres).

The commercial/apartment component contains a proposed gross f lo o r space o f 11 806.289 m2 (127,086 square fe e t) . Relative to the Kingsway portion o f the s ite th is represents a f lo o r space ra t io o f I.865 (or 2.999 i f calculated in accordance w ith the C-2 Commercial D is t r ic t Schedule which permits a maximum f lo o r space ra t io o f 3.0, res iden tia l f lo o r space being computed at two-and-a-half times actual f ig u re ) . Build ing height along Kingsway is approximately II.887 m (39 f t . ) . A to ta l o f 130 underground and 10 surface parking spaces are provided fo r the commercial f lo o r area. A to ta l o f 50 underground o ff-s tre e t parking spaces are provided fo r the apartment u n its , being one space per u n it. Two o ff -s tre e t loading spaces are provided.

The townhouse component maintains a f lo o r space ra t io o f 0.625 (themaximum allowable FSR on adjacent RS-1 lands being 0 .6 ). Mean heighton the highest bu ild ing measures approximately 9.753 m (32 f t . ) , adjacent RS-1 lands perm itting a maximum height o f 10.668 m (35 f t . ) . O ff-s tre e t parking fo r residents is provided underground a t one-and-a-half spaces per dwelling u n it. Thirteen add itiona l o ff -s tre e t parking spaces are provided at grade fo r v is ito rs .

4. URBAN DESIGN PANEL

The Urban Design Panel reviewed th is app lica tion at i t s meeting o f June 21, 1979 and commented as fo llow s:

The Panel was concerned about the re la tionsh ip o f the townhouses to the re s id en tia l un its at the rear o f the commercial bu ild ing . These two aspects seem to be disparate in form. Proxim ity appears to be one o f the aspects to be considered in resolving th is re la tion sh ip .There was fu rth e r concern at the possible c o n f l ic t between pedestrian and car movement at the Kingsway side where these two components converge in fro n t o f the courtyard.

The Panel would support the proposal i f the above concerns were adequately resolved through a revised design.

5. URBAN DESIGN GROUP

6. CITY ENGINEER

The C ity Engineer responded to the proposed development under memorandum dated June 21, 1979, ind ica ting tha t the rezoning proposal was generally acceptable to the Engineering Department. The applicant was advised o f various engineering design problems includ ing o f f - s tree t parking, o ff -s tre e t loading, garbage f a c i l i t ie s and the loca­tion o f veh icu lar access from West 43rd Avenue. These items must be resolved to the sa tis fa c tio n o f the C ity Engineer a t the Development Permit stage, should the proposed rezoning be approved.

7. PUBLIC INFORMATION MEETING

About 20 loca l area residents attended a Public Information Meeting sponsored by the Planning Department on Thursday, Ju ly 26, 1979. The applicant and his a rch ite c t responded to a va rie ty o f spe c ific concerns re la ted to d e ta ils o f the development (such as fin ished grade e leva tion , setbacks and peripheral s ite treatm ent). General concerns raised re la ted to items such as re su ltan t t r a f f ic percola­tio n through the neighbourhood the fu tu re ro le o f East 43rd Avenue, po ten tia l view impairment fo r residents l iv in g south o f East 43rd Avenue, and property maintenance provisions w ith p a rtic u la r regard to tenure o f occupants w ith in the development proposed.

8. ANALYSIS

The fo llow ing p o lic ie s , re la ted most s p e c if ic a lly to rezoning and redevelopment o f lands adjacent to Kingsway, were adopted on October 17, 1978 when the recommendations o f the Kingsway Task Force were approved by Council:

a) The maximum scale o f commercial development along Kingsway should not exceed the requirements set out in the C-2 Commercial D is t r ic t Schedule;

b) Rezoning applications should be considered under the Comprehensive Development D is t r ic t Schedule to ensure good design and compatible uses;

c) Low to medium density re s id en tia l development should be considered in Kingsway East w ith consideration given to :

i ) A ll re s id en tia l development must conform to the'Normally Acceptable' category fo r HUD noise c r ite r ia (60 decibe ls);

i i ) Housing redevelopment should not encroach or reduce re s id en tia l amenities in the ex is tin g adjacent s ing le ­fam ily community;

i i i ) Family-oriented accommodation should be encouraged w ith at least one-th ird o f the to ta l un its in each pro ject (considered su itab le fo r fam ilies) to have three or more bedrooms:

iv ) Primary vehicle access to re s id en tia l developments should not be located on Kingsway.

S pecific design guid lines fo r the s ite o f the proposed rezoning were also adopted by Council when dealing w ith the Kingsway Task Force report. These s ite guidelines are attached as Appendix C.

BACKGROUND

PACT is a re g is te re d n o n -p r o f i t s o c ie ty concerned w ith p ro v id in g tre a tm e n t s e rv ic e s to p h y s ic a lly abused c h ild re n and t h e i r p a re n ts . The S o c ie ty has leased the house on West 15 th fo r i t s c o o rd in a te d tre a tm e n t program , fo r the p e rio d o f th re e y e a rs . A f te r p ro fe s s io n a l assessment by th e VGH C h ild Abuse Team, an in d iv id u a l tre a tm e n t program w i l l be developed fo r each c h i ld and fa m ily . E ig h t c h ild re n w i l l re s id e a t th e C entre and 10 more c h ild re n p lu s p aren ts w i l l a tte n d on a d a i ly b a s is .

The annual o p e ra tin g budget fo r th e p r o je c t is a p p ro x im ate ly $ 2 1 2 ,0 0 0 . N a tio n a l H e a lth and W e lfa re Dem onstration G rants is p ro v id in g $200,000 a y e a r to cover s t a f f s a la r ie s and program costs and th e Vancouver Foundation is c o verin g the r e n t a l co st o f $12 ,000 a y e a r .

Renovation Costs

The t o t a l re n o v a tio n costs a re now e s tim a te d a t $ 8 6 ,1 7 2 , acco rd in g to the c o n tra c to rs b id . (see Appendix I ) . The V a r ie ty Club has c o n tr ib u te d $ 4 0 ,0 0 0 , which PACT o r ig in a l ly in ten d ed to use to cover bo th re n o v a tio n s and fu r n is h in g s . However, because the re n o v a tio n s re q u ire d under C iv ic B u ild in g and Community Care F a c i l i t i e s L icen s in g are more e x te n s iv e and expensive than f i r s t e s tim a te d , the e n t i r e $40 ,000 w i l l now go towards re n o v a tio n s . The V a r ie ty C lub has prom ised a fu r th e r $20 ,000 g ra n t , c o n d it io n a l on C o u n c il's a p p ro va l o f PACT'S c iv ic g ra n t req u es t o f $36 ,000 w ith in 30 days a f t e r September 2 1 s t , 1979.

Of the $36,000 c iv ic g ra n t re q u e s te d , PACT w i l l use $20 ,000 tow ard re n o v a tio n s .The S o c ie ty w i l l r a is e funds to cover rem ain ing re n o v a tio n costs (a p p ro x im ate ly $6 ,000 ) through a fund r a is in g p r o je c t scheduled f o r November 1979.

Kenneth Mahon, a u d ito r fo r th e Frankenburg Foundation: "The b e n e f ic ia l owner o f th e house is th e Frankenburg F oundation , which is a c h a r ita b le fo u n d a tio n in c o rp o ra te d under th e S o c ie t ie s A ct o f B .C . and is in th e process o f being approved by the F e d e ra l Departm ent o f N a tio n a l Revenue under S e c tio n 149 o f th e Income Tax A c t. The C o s t-S h arin g Formula

The Urban T ra n s it A u th o r ity Act o f 1978 p ro v id ed th a t the UTA and s e v e ra l lo c a l t r a n s i t commissions would 'p ro v id e and m a in ta in p u b lic t r a n s p o r ta t io n systems in the P ro v in c e '. To accommodate t h is , the lo c a l m u n ic ip a l i t ie s in which the t r a n s i t system operated were to become re s p o n s ib le fo r s e rv ic e le v e ls and fo r a p o r t io n o f the d e f i c i t . I t was s ta te d in the c o s t-s h a r in g re g u la t io n s o f the Act t h a t , fo r the G re a te r Vancouver m e tro p o lita n a re a , the revenues o f the system should account fo r 35% o f the annual o p e ra tin g c o s ts . T h e re fo re , s m a ll d if fe re n c e s between the payments under each fo rm u la a re no t seen to be s ig n i f ic a n t (see Appendix 1 ) . T h e re fo re , i f LRT is c o n s tru c ted in the GVRD, the two form ulae seem about e q u a l.

I f LRT is n o t b u i l t , the new fo rm u la is o b v io u s ly b e t t e r . A ls o , by c o s t-s h a r in g LRT c o s ts , we w i l l be in a b e t te r p o s it io n to decide on i t s im p lem en ta tio n . There are a ls o b e n e f its in ty in g down the c o s t-s h a r in g o f LRT a t th is t im e , ra th e r than le a v in g fo r fu tu re n e g o t ia t io n s .

C ouncil may s t i l l have re s e rv a tio n s about what s h a rin g w i l l be in e f f e c t in the second f iv e years and may wish to t i e th is down now. However, th e re may a ls o be some advantage in n e g o t ia t in g the second f iv e years in 1984.

The Method o f F in an c in g the L o ca l Share o f T ra n s it D e f ic i t

The UTA Act a llow ed th re e sources o f funds to the lo c a l a rea to fin a n c e the t r a n s i td e f i c i t . These were:

1) a .6 6 ¢ per l i t r e (3 ¢ p e r g a llo n ) g a s o lin e ta x2) a power u t i l i t y surcharge3) the m u n ic ip a l p ro p e rty ta x .

The f i r s t two revenue sources were seen as inadequate under the o ld c o s t-s h a rin g form ula and i t was f e l t th a t the p ro p e rty ta x would q u ic k ly be drawn upon to fin an ce the o p e ra tio n o f even a b u s -o n ly t r a n s i t system .

This remains tru e under the new c o s t-s h a r in g fo rm u la . The gas ta x revenue would be t ie d under the above fo rm u la tio n to the number o f g a llo n s o f g a s o lin e so ld and th is is n o t expected to grow ra p id ly in the fu tu r e . F u r th e r , the hydro surcharge is l im ite d to an amount equa l to the g a s o lin e ta x . T h e re fo re , n e i th e r source would grow a t the same r a te as c o s ts .

The GVRD N e g o tia t in g Sub-Committee have re p o rte d th a t :

'The M in is te r has agreed to the g e n e ra l p ro p o s it io n th a t a percentage on the s a le o f g a s o lin e be charged as the m u n ic ip a lly le v ie d s u r ta x in l i e u o f a number o f cents p e r g a llo n o r l i t r e , bu t has advised th a t le g a l d i f f i c u l t i e s make the a tta in m e n t in th a t form im p o s s ib le .'

No s a t is fa c to r y e x p la n a tio n has been p ro v id ed o f th e le g a l d i f f i c u l t i e s seen by th e M in is te r . In f a c t , th e D ir e c to r o f Lega l S e rv ice s sees no reason why th is should be so. C la r i f ic a t io n on th is p o in t is b e in g sought from th e M in is te r .

I f the gas tax remains a t a s e t cents per g a llo n o r r is e s w ith some in d e f in i t e ra te o f in f la t io n s e t by the P rov ince from y e a r to y e a r , the revenues from the gas tax and hydro surcharge are u n l ik e ly to fund the e n t i r e re g io n a l share o f the t r a n s i t d e f i c i t . W ith the gas ta x s e t a t 3% (o r 4% )of gas sa les revenue, th e re is much less l ik e l ih o o d o f having to draw on the p ro p e rty ta x , a lthough th a t is s t i l l a p o s s ib i­l i t y . The a n a ly s is conducted by C ity s t a f f employs some more c o n s e rv a tiv e assump­tio n s about the fu tu re than the GVRD e s t im a te s , and is shown in Appendix 1 , and the p ro p e rty ta x is re q u ire d to support t r a n s i t in 1984.

S t a f f f e e l th a t the issue o f an e s c a la t in g gas ta x revenue is c r i t i c a l fo r the success o f the new c o s t-s h a r in g fo rm u la , to the p o in t where i t is f e l t th a t unless the gas ta x revenue is ensured a t an adequate e s c a la t io n r a t e , i t is recommended th a t no sh a rin g fo rm ula be approved.

The proposed form ula has the P rov ince paying 2 /3 o f the o p e ra tin g d e f i c i t and about 43% o f the o p e ra tin g c o s t.

I t a ls o n e g o tia te s on b e h a lf o f the P rov ince va rio u s agreem ents, undertakes the necessary a u d its to ensure th a t the agreements are c a r r ie d o u t, and undertakes v a rio u s te c h n ic a l s tu d ie s o f a g e n e ra l n a tu re as re q u ire d by the m u n ic ip a l i ty .

Commission

The new pro p o sa l in c lu d e s no p ro v is io n fo r a T ra n s it Commission fo r the Lower M a in lan d . The d u tie s fo r a Commission as p ro v id ed by the UTA A ct would be shared to some e x te n t between the GVRD and the UTA. E lim in a t io n o f a Commission fo r the Lower M ain land appears to re p re s e n t a p o s it iv e s tep in th a t i t e lim in a te s confusion and d u p lic a t io n c re a te d by an o th er group o f d e c is io n -m a k e rs . I t does, however, r e s t r i c t the C ity 's in f lu e n c e in t r a n s i t and LRT m a tte rs as the C i t y 's vo te in the GVRD is about 35% now and d rop p in g .

M e tro p o lita n T ra n s it O p era tin g Company (MTOC)

The MTOC has been e s ta b lis h e d to take the p la c e o f B .C . Hydro as the o p e ra tin g company. I t s r e s p o n s ib i l i t y w i l l be to p ro v id e the t r a n s i t s e rv ic e and ensure th a t th e re is perform ance accord ing to the o p e ra tin g agreem ents. The Board o f Managers fo r the MTOC w i l l be s e le c te d j o i n t l y by the GVRD and the Urban T ra n s it A u th o r ity and w i l l c o n s is t o f people experienced in management and t r a n s i t . The fu n c tio n o f the Board w i l l be to p ro v id e m anaging d ir e c t io n fo r the o p e ra tin g company and to s e le c t the g e n e ra l manager.

M u n ic ip a lity

The M u n ic ip a l i ty , as d e fin e d under the UTA A c t, w i l l be the G re a te r Vancouver R egional D i s t r i c t . As a r e s u l t , the GVRD Board w i l l e s ta b lis h p o l ic ie s and d ir e c t io n fo r t r a n s i t s e rv ic e s in the Lower M a in la n d . 2 . I t was cau tioned th a t d ram atic changes should n o t be expected in th e p ro v is io n o f t r a n s i t s e rv ic e s fo r the f i r s t couple o f y e a rs . Th is is due to the number o f m a tte rs which re q u ire a t te n t io n in the o p e ra tin g company.

Comments on the O rg a n iza tio n

The Urban T ra n s it A u th o r ity Act and subsequent n e g o tia t io n s c re a te an o rg a n iz a t io n a l framework which e s ta b lis h e s some very co m plicated in t e r - r e la t io n s h ip s . The a rran g e ­ment is unique among t r a n s i t p ro p e r t ie s in N o rth ern Am erica and p ro v id es a d i f f i c u l t form at fo r managing the t r a n s i t fu n c t io n . Changes in the o rg a n iz a t io n a l framework re c e n tly n e g o tia te d are noted below :

1 . The T ra n s it Commission has a p p a re n tly been e lim in a te d in the Lower M a in lan d , reducing c o m p le x ity .

2 . The M u n ic ip a lity (GVRD) w i l l be g iven the r e s p o n s ib i l i t ie s necessary to p ro v id e d ec is io n -m ak in g in the p ro v is io n o f t r a n s i t s e rv ic e s .

3. A la b o u r n e g o t ia t in g committee w ith re p re s e n ta t io n from the GVRD, P ro v in c ia l Government and the O p era tin g Company is c re a te d to oversee and to r a t i f y a l l lab o u r n e g o t ia t io n s . Th is committee w i l l be re s p o n s ib le fo r en su rin g th a t lab o u r c o s ts , which re p re s e n t the s in g le most c o s tly ite m , are kept a t a f a i r and e q u ita b le le v e l .

4 . The GVRD re ta in s some c o n tro l over the o p e ra tin g company by h e lp in g to s e le c t the Board o f D ire c to rs . F u rth e r work is needed in th is a rea by c re a tin g an o p e ra tin g agreement which re q u ire s the company to measure and re p o rt on i t s perform ance under the terms o f the agreem ent.

Loca l R e p re s e n ta tio n on the T ra n s it F u nction

Although the r o le o f the lo c a l m u n ic ip a l i t ie s has n o t y e t been d e fin e d , i t is c le a r th a t the C ity o f Vancouver is less rep resen ted than the c u rre n t arrangem ent. In the p a s t, the C ity has d e a lt w ith B .C . Hydro d i r e c t ly on such m a tte rs as ro u te s , program s, a d d it io n a l s e rv ic e s , bus stop lo c a tio n s and many o th e r t r a n s i t is s u e s , w ith C ouncil a p p ro va l re q u ire d on these m a tte rs . A lthough the C ity was n o t ab le to accom plish a l l o f i t s o b je c t iv e s r e la te d to t r a n s i t , many w o rth w h ile s e rv ic e s such as the F a lse Creek s e rv ic e , 49 th Avenue crosstow n, FreeBus, e t c . were im p le ­mented. The new arrangem ents w i l l re q u ire the C ity o f Vancouver to n e g o tia te w ith the GVRD. The C ity w i l l then be rep resen ted in the f i n a l d e c is io n process to the e x te n t o f i t s re p re s e n ta t io n on the Board. The C ity 's c u rre n t re p re s e n ta t io n is 35%, bu t w i l l be less in the fu tu r e .

3 . Over 45% o f the Vancouver r id e rs h ip do not h o ld v a l id d r iv e r 's lic e n s e s , which is an in d ic a t io n o f c a p tiv e r id e rs w ith l im ite d a l te r n a te means o f tra n s p o r­ta t io n .

The 35% o r s m a lle r vo te in the GVRD does n o t seem to g ive the C ity a v o ic e commen­s u ra te w ith the im portance o f t r a n s i t o u t lin e d above. C ouncil has p re v io u s ly recogn ized the ro le o f t r a n s i t in p ro v id in g a ba lanced t ra n s p o r ta t io n system w ith in Vancouver. C ouncil has adopted s e v e ra l p o lic y s ta tem ents in the p a s t which serve to encourage the maximum use o f t r a n s i t and d iv e r t t r a v e l from cars to t r a n s i t .In a d d it io n to the s ig n i f ic a n t r o le t r a n s i t p lays in Vancouver, the re s id e n ts o f the C ity w i l l c o n tr ib u te a la rg e p ro p o rt io n o f the fa re -b o x revenues and o th e r taxes to fund the d e f i c i t . As a r e s u l t , the C ity should ensure th a t i t has good re p re s e n ta t io n in o rd e r to ensure th a t i t s p o l ic ie s and programs a re ach ieved .

In o rd er to ach ieve good lo c a l in v o lv e m e n t, s e v e ra l aspects should be in c o rp o ra te d in to the d ec is io n -m ak in g p ro cess . These aspects are summarized below:

1.The d e c is io n process should a llo w tim e to p ro v id e the lo c a l C ouncils ano p p o rtu n ity to rev iew and recommend a c tio n s to the GVRD Board on t r a n s i t m a tte rs . This lo c a l rev iew ro le should occur p r io r to c o n s id e ra tio n by the GVRD Board. C ouncil should a ls o r e ta in ap p ro va l on c e r ta in item s which go to the GVRD Board. For exam ple, a p p ro va l o f new ro u te s o r s e rv ic e e x te n s io n s , t r a n s i t s to p s , and t r a n s i t p r io r i t y measures in v o lv in g t r a f f i c c o n tr o l, should rem ain a t the lo c a l l e v e l . In a d d it io n , C o u n c il should r e ta in an ad v iso ry ro le on s e rv ic e m o d if ic a t io n s , budgets , agreem ents, c a p i ta l and o p e ra tin g p lans and s p e c if ic p roposals in v o lv in g fa r e s , s tu d ie s , e t c .

2 . A te c h n ic a l com m ittee should be formed from the v a rio u s s t a f f s o f the lo c a l m u n ic ip a lit ie s to p ro v id e in p u t in to the GVRD d ec is io n -m ak in g process and th is should be c o n s t itu te d fo rm a lly as is the te c h n ic a l committee o f p la n n in g . This te c h n ic a l committee could h e lp ensure th a t v a rio u s in p u ts from the lo c a l m u n ic ip a l i t ie s are c o o rd in a te d . In a d d it io n , a c e n t r a l forum o f te c h n ic a l re p re s e n ta t iv e s is needed to p ro v id e a te c h n ic a l and a d m in is tra ­t iv e rev iew fu n c tio n and as a mechanism to fo rm u la te p o lic y choices fo r the d e c is io n m akers. The te c h n ic a l committee would re p o r t to the GVRDBoard on a l l m a tte rs re q u ir in g m ajor p o lic y d e c is io n s , bu t i t s members would a ls o be re s p o n s ib le to t h e i r lo c a l m u n ic ip a l i t ie s o r c i t i e s through t h e i r norm al s t a f f p o s it io n s .

3 . In o rd e r to ensure th a t t r a n s i t s e rv ic e s a re a l lo c a te d in the Lower M ain land on a f a i r and e q u ita b le b a s is , a fo rm u la o r agreed upon c r i t e r i a is re q u ire d to a l lo c a te t r a n s i t s e rv ic e s o b je c t iv e ly . W ithou t a fo rm u la o r s p e c if ic c r i t e r i a fo r s e rv ic e a d d it io n s and d e le t io n s , the a l lo c a t io n o f s e rv ic e could become a very tim e-consum ing p ro cess , le a d in g u l t im a te ly to poor d e c is io n s . Th is could r e s u l t in an in e f f e c t iv e system , p ro v id in g poor s e rv ic e o r unneeded s e rv ic e w ith la rg e d e f i c i t s . O b je c tiv e c r i t e r i a basedon needs w ith in the a v a i la b le resources must be used to e v a lu a te and a llo c a te new or e x is t in g t r a n s i t s e rv ic e s . O b v io u s ly , c re a t io n o f such c r i t e r i a w i l l be a complex and c o n tro v e rs ia l m a tte r which the noted te c h n ic a l committee should address as soon as i t is form ed.

I t is im p o rtan t to ensure th a t the re te n t io n o f lo c a l powers, w hether on an approva l o r ad v iso ry b a s is , and the fo rm a tio n o f a te c h n ic a l committee should be in c o rp o ra te d in to the L e t te rs P a te n t . This w i l l h e lp to ensure lo c a l in p u t and enable t r a n s i t s e rv ic e s to be a llo c a te d in a manner c o n s is te n t w ith lo c a l p o lic ie s and o b je c t iv e s .

Fo llo w in g a req u es t from the Blenheim S tr e e t R es id en ts ' A ss o c ia tio n (p re v io u s ly c ir c u la te d and on f i l e in the C ity C le rk 's O ff ic e ) fo r a number o f four-w ay stop signs to be in s ta l le d along Blenheim S tr e e t to reduce v e h ic u la r speeds, surveys were under­taken by the E ng ineering Department and as a r e s u l t , the Committee had fo r c o n s id e ra tio n a Manager's R eport dated September 13, 1979 (on f i l e in the C ity C le rk 's O f f ic e ) , in which the C ity Engineer re p o rts on the ro le o f Blenheim S tr e e t in the s t r e e t system, review s the a c c id e n t h is to ry from 1974 to 1979 ( A p r i l ) , p resents an a n a ly s is o f speed s tu d ies undertaken and puts fo r th recommend­a tio n s on the re s id e n ts ' req u es ts .

Blenheim S tr e e t was p re v io u s ly c la s s i f ie d as a p rim ary a r t e r i a l bu t as p a r t o f th e Local Area P lann ing process in K its i la n o Conversion A reas , C ouncil on J u ly 26 , 1977, a f t e r re v ie w , re v is e d the c la s s i f ic a t io n o f Blenheim S tr e e t to become a secondary a r t e r i a l south o f Broadway and a neighbourhood c o l le c to r s t r e e t n o rth o f Broadway.

Data c o lle c te d from speed checks taken d u rin g the a fte rn o o n base p e r io d , a fte rn o o n rush hour and evening shows th a t speed v io la t io n s are o c c u rr in g .

S t a f f Sergeant K. M cLarty o f th e P o lic e Departm ent was p resen t and re p o rte d th a t du ring a th re e day p e rio d o f speed m o n ito rin g ,36 t r a f f i c v io la t io n s were issued ; 34 fo r excess speed and 2 fo r stop s ig n s . The average speed o f v e h ic le s compared w ith the data o f the E ng ineerin g Departm ent.

In t h e i r l e t t e r , th e Blenheim S tr e e t R e s id en ts ' A s s o c ia tio n had requested four-w ay stops s p e c i f ic a l ly a t 2 1 s t, 2 4 th , 2 9 th ,33rd , 37th and 43rd Avenues, and a marked crossw alk on Blenheim S tr e e t a t 16th Avenue.

d) t r a f f i c volum es a re n o t re d u c e d .

The r e p o r t s t a t e s t h a t d u r in g a r e c e n t re v ie w f o r a p e d e s t r ia n a c tu a te d s ig n a l a t 1 6 th and B le n h e im , i t was fo u n d t h a t because o f th e few p e d e s t r ia n s and la r g e gaps i n t r a f f i c , a p e d e s t r ia n s ig n a l a t t h is lo c a t io n c o u ld n o t be s u p p o r te d , and s in c e t h is in t e r s e c ­t io n dees n o t m eet th e c r i t e r i a f o r a m arked c ro s s w a lk , i t was recommended t h a t no f u r t h e r a c t io n be ta k e n .
