LOOKING AT TOM WOLFE on the cover this monthmade me think of wildflowers, which made me thinkof something I call the lawn-mowing approach to man-agement. This is the approach in which all blades ofgrass (read: employees) are cut to an even height.
But where are the wildflowers?There is an understandably irresistible force within
a large-scale management (be it corporate or otherwise)
to aim for contentment within its workforce. Yes, we allwant to be happy. We all want our employees and co-workers, even our bosses, to be happy. But there is a big,
BIG difference between being happy and being content. Contentment has to do withliking the status quo.
No, repeat, no great advances in Western culture have ever been initiated by peoplewho were content.
Were the people boarding the colony-bound ships in 17th-century Southampton,England, content with their lot in Europe?
Were those who contrivedand, yes, connivedto construct Americas transconti-nental railroads content with the horse and buggy?
Was it contentment with their lot as earthbound creatures that drove Orville andWilbur Wright to help mankind take its first small hop into space?
And so it goes with the creation of great companies. Think of IBM, of General
Electric (built around the inventions of Edison), of Disney and, dare I say, Costco.The act or process of innovation carries within it a necessary dissatisfaction. A greatcompany endures, and is often transformed, with the help of the dissatisfied, the maver-ick, the nonconformist, the wildflower, the Tom Wolfes of the world. C

Sweeter Sleep for Seniors in the June issuedid not mention sleep apnea and a sleepstudy. After taking medication for almost ayear to help me sleep my doctor decided Ishould have a sleep study. I am a very healthyperson, but I found out that I stopped breath-ing 31 times in the four-hour period and myheart stopped four times. I was an ideal can-didate for a CPAP (continuous positive airpressure) machine. I have never slept betterand am sold on this machine. (My husbandsleeps better also, since I am no longer snor-ing.) A sleep study is an excellent diagnostictool and is covered by Medicare.

IF YOU OWN a small business, are you more of
a leader or more of a manager? As an
entrepreneur, you need to be both, but these
roles require different approaches.
A leader looks at the big picture, sets
high-level goals and strategy, establishes
clear standards and values, motivates,
identifies opportunities and threats on a
business-wide level, measures success at the
financial and strategic level, and empowers
others to take action.
A manager looks at the details, identifies
tasks for employees and the organization,trains or arranges for training, solicits input
from others on how to improve operations,

In big corporations, you often have two
different people handling these roles: the

WANT TO BUY American-made products? Howcan you tell if a product is really Made in the USAlike it claims?
The Federal Trade Commission (FTC) is thenations consumer protection agency. In order for aproduct to claim it is Made in the USA in itsadvertising or on its packaging, it must complywith the FTCs Enforcement Policy Statement,which aims to protect consumers from being mis-led. The FTC regulates whether Made in the USAclaims are truthful.
FTCs Enforcement Policy Statement requiresany Made in the USA claim to be unambiguous sothat it leaves an accurate impression on consumers.With very limited exceptions, this policy applies toall products advertised and sold in America. Other
laws apply to fur, woolens, automobiles and textiles.Under the FTCs Enforcement Policy Statement,a product must be all or virtually all made inAmerica, meaning that only a small amount of for-eign content is used in making the product.Products are evaluated on a case-by-case basis, andthe FTC considers different factors, depending onthe product. Where the final assembly of a producttakes place and how far back in the productionchain the foreign content is used is taken into con-sideration.
Companies must be able to document anyMade in the USA claim they present. Document-ation depends on the specific product thats being
evaluated. Using symbols such as a flag or map ona product label might convey a Made in the USAclaim and are looked at in the context in whichtheyre used.

Red, white and trueIf you suspect a violation of Made in the USA
claims requirements, you can file a complaint withthe FTC at www.ftc.gov. However, evaluatingwhether a Made in the USA claim is false can bedifficult. Julia Solomon Ensor, enforcement attor-ney at the FTC, says, The accuracy of a Made inthe USA claim is extremely difficult for a consumerto verify. A consumer is unlikely to be able to deter-mine whether a Made in the USA claim is true orfalse simply by looking at a product.
Most complaints of Made in the USA labelingviolations submitted to the FTC are filed by com-petitors. Companies often have insights into theircompetitors manufacturing and importing that thetypical consumer would not have. As a result, thesecompanies can more effectively evaluate the truthof their competitors claims, and file complaintswhere appropriate, Ensor says.
If the FTC determines that a Made in theUSA claim is deceptive, a business can be fined orthe agency can ask for consumer redress.

Buying American owned
Just because a companys products areAmerican made doesnt mean the company isAmerican owned. For example, Firestone and7-Eleven are foreign-owned companies.
If buying American-made products made byAmerican-owned companies is important to you,you will have to do some research into a brands par-ent company. There are paid services online that pro-
vide information. However, you can get informationon your own, free, with a simple online search put-ting in the terms xyz parent company or xyzowned by. Google Finance, the U.S. Securities andExchange Commission and your Secretary of Stateswebsite are some other helpful resources.

you could pay if you rolled over the money into anIRA at a discount brokerage or fund company andbuilt a solid diversified portfolio from low-costfunds and ETFs.
It is fine to work with an adviser, but I sure hopeyour adviser didnt recommend a rollover becausehe or she would earn money from commissions onreinvesting your money. It is smarter, in my opinion,to work with a fee-only adviser, to whom you pay aset amount of money. That way the adviser can giveyou the best advice, not advice that will generatecommissions.
If you do decide on an IRA rollover, I encourageyou to think about converting the money into aRoth IRA. You will owe tax on the convertedamount, but once the money is in the Roth IRA youwill have the ability to make tax-free withdrawals. Itis vitally important to work with a tax pro with Rothconversion experience. You dont need to converteverything at once; a smart tax adviser will workwith you to minimize the tax hit.
I have about $50,000 in CDs that are maturingthis month, and reinvesting sounds ludicroussince they are earning only 0.3 percent today.I am 70 years old and dont want to invest inanything risky or that I cant get out of with-out too much difficulty.

IF THIS IS MONEY that you want to keep safe andsoundand liquidthe reality is that you will needto accept earning next to nothing. Because of FederalReserve policy, interest rates on federally insuredbank depositssuch as CDs and savings accountspay very little. And the Federal Reserve has indicatedit intends to keep those rates low through 2015. Iunderstand how frustrating that is for savers such as
yourself; back in 2008, you could earn close to 4 per-cent on a one-year CD. Today, you can typically earn0.25 percent. But if your priority is safety, you mustrealize that anything paying more carries some risk.
If you dont need that $50,000 for living expensesin the next few years, and if you are willing toassume some risk, I recommend that you learnabout dividend-paying stocks. Many solid blue-chipcompanies not only have dividend yields of 3 per-cent, they also have a history of raising the dividend.That creates a rising income stream for investors.There are low-cost ETFs that focus on dividend-paying stocks.
Of course, all stocks can be volatile. So I want to
stress, people should never invest money in stockseven dividend-paying stocksif there is any chancethey will need to cash out their investment within 10years. C

I am a teacher paying 9.4 percent of my sal-ary to a teacher retirement fund for my pen-sion. In addition, I have a 403(b) retirementaccount through my employer and a RothIRA. My district does not have any kind ofmatching program for 403(b) contributions.Recently, I stopped contributing to the 403(b)plan so that I could contribute the maximumamount to my Roth IRA before my husbandand I reach the income limits for marriedcouples filing jointly. Its my plan to reestab-lish contributions to my 403(b) account whenI am able. Is this the correct decision? Or is itbetter to contribute smaller amounts to boththe 403(b) and the Roth IRA?

And promise me that your Roth IRA is investedin no-load, low-cost mutual funds or exchange-traded funds (ETFs). You can build a smart diversi-fied portfolio with low-cost funds and ETFs that
charge an annual expense ratio of around 0.5 percentor less.We tend to focus on returns, while not appreci-
ating the impact low fees can have. Consider that$5,500 (the 2013 IRA contribution limit if you areyounger than 50) invested for 25 years in a portfoliowith an average expense ratio of 0.50 percent wouldgrow to about $297,000, assuming a 6 percent annu-alized gross return. If the same amount wereinvested in a portfolio with an average expense ratio
of 1 percent, your savings would grow to about$275,000. Paying attention to fees is a great way tomake more money.

A JOURNALISTIC ORGANIZATION recently leaked 2.5 million filesdetailing secret foreign bank accounts and shell companies, whichhas reignited controversy about banking money abroad in order topay less or no tax on it.
Those who support the practice say it encourages better alloca-tion of capital, more saving and investment and allows a measure ofprotection for savers and investors while discouraging political greedthrough tax competition.
Opponents argue that it drains much-needed U.S. revenues andputs firms and individuals who dont have access to sophisticated taxexpertise at a disadvantage.

THE USE OF tax havens byindividuals and corpora-tions hurts the Americaneconomy.
It undermines competi-tion, because it gives inter-national companies with
access to sophisticated tax advice an advantageover smaller and domestic companies that cantstash their profits offshore in low-tax countriestax havensto avoid tax.
It drains the United States of tax revenues thatcould be used to reduce deficits or invested incritical needs, including education, healthcare andinfrastructure. Many local businesses and ordi-nary Americans are already feeling the effects ofthe sequester cuts to domestic spending, in areasranging from children losing Head Start to seniorslosing Meals on Wheels. Yet multinational corpo-rations and wealthy individuals are allowed to usetax havens to avoid paying taxes that could helpforestall these harmful cuts.
And, its unfair to individuals and businessesthat pay their fair share of U.S. taxes.
Although tax havens are offshore, U.S. policy-makers could and should act to stop U.S. citizensand corporations from using them to avoid taxes.
Policymakers could provide the InternalRevenue Service (IRS) with the funding it needs to
ensure that people pay the taxes they owe, includ-ing sufficient funds to detect filers who are usingoffshore accounts to avoid paying their taxes.
Instead, Congress recently has starved the IRSof funds for administration and enforcement,including subjecting it to the sequester. FormerIRS commissioner Douglas Shulman estimatedthat such IRS budget cuts could reduce tax revenueby seven times as much as the cuts would save.
Policymakers could also close the loopholesin the U.S. tax code that allow companies toreduce their tax bills by moving their profits to taxhavens.
Instead, some U.S.-based multinationals wantto change the tax code to make shifting profits totax havens morelucrative by implementing a ter-ritorial tax system. Such a system would effec-tively lower the U.S. tax rate on profits kept in taxhavens to zero (or almost zero), thereby givingcompanies an even bigger incentive to use account-ing techniques to claim that they earned their prof-its in tax-haven countries. That change wouldfurther drain revenues, and domestic businessesand individual taxpayers could end up shoulder-ing the burden of making up the difference.
Policymakers have the ability to keep peopleand companies from using these offshore accountsto skirt their obligations as U.S. taxpayers. Theyshould use it. C
POLITICIANS HAVE ANunfortunate tendency tooverspend and overtax.When they do this for ashort period, growth in theproductive sector of theeconomy tends to diminish.And if they overtax and
overspend for a long period, you suffer the kind offiscal crisis we now see in so many Europeannations.
Thats not what any of us want, but how canwe restrain politicians? Theres no single answer,
but tax competition through tax havens is one ofthe most effective ways of controlling the greed ofthe political elite.
We know that taxes are onerous in Californiaand Massachusetts, but imagine how much worsethey would be if the politicians in those statesdidnt have to worry about investors, entrepre-neurs and small-business owners escaping tozero-income-tax states such as Nevada and NewHampshire?
The same principle applies on a global basis.Nations with pro-growth tax systems, such asSwitzerland and Singapore, attract jobs and invest-ment from uncompetitive countries such as France
and Germany. These tax havens force the politi-cians in Paris and Berlin to restrain their greed.
Some complain that these low-tax jurisdic-tions make it hard for high-tax nations to enforcetheir punitive tax laws. But why should the juris-dictions with good policy, such as the CaymanIslands, be responsible for enforcing the tax law ofgovernments that impose bad policy?
In any event, the best way to reduce tax eva-sion is to institute lower tax rates and tax reform.If the United States had a flat tax, for instance, wewould enjoy much faster growth and we wouldattract trillions of dollars of new investment. We
would be the tax haven, and thats a good thing!In addition to promoting good fiscal policy,tax havens also help protect human rights. Mostof the world still lives in nations where there ispolitical oppression, economic instability and per-secution of minorities. Tax havens help thesepeople protect their assets from venal govern-ments. To cite just a few examples, tax havensoffer secure financial services to political dissi-dents in Russia, ethnic Chinese in Indonesia andthe Philippines, Jews in North Africa, gays in Iranand farmers in Zimbabwe.
The moral of the story is that tax havensshould be celebrated, not persecuted. C
