CORCORAN UNIFIED SCHOOL DISTRICT REGULAR BOARD MEETING

September 8, 2015 6:00 P.M.

CALLTO ORDER Robert Alcorn, President of the Board, called the regular meeting of the Corcoran Unified School District Board of Trustees to order at 6:00 p.m. in the Board Room of the Administration Office. TRUSTEES PRESENT/ABSENT Trustees present were Robert Alcorn, Mary Wadsworth, Karen Frey and Bobby Toney. OTHERS PRESENT Others present were Rich Merlo, Steve Berry, Pamela Dihel, Keith Airheart, Elizabeth Mendoza, Antonia Stone, Eduardo Ochoa, Mike Anderson, Dave Whitmore, Danielle Alvarez, Patty Robertson, Julia Davila, Monica Mireles, Bettianne Siene, Audrey Long, Carri Holt, Jennie Valdez, Julio Trinidad, John Jason Mora, Holly Mendes, Michelle Merrigan, Kristin Martin, Judy Escobedo, Jonathan Sorrick, Abel Santos and Donnetta Murray. INTRODUCTION OF NEW TEACHERS Principals introduced the new teachers at the K-8 grade level and Kings Lake. Fremont Principal Eduardo Ochoa introduced Monica Mireles, Bettianne Sien, and Audrey Long. Mark Twain Principal Mike Anderson introduced Carri Holt, Jennie Valdez, Julio Trinidad, John Mora, Holly Mendes, Michelle Merrigan and Kristin Martin. John Muir Principal Dave Whitmore introduced Judy Escobedo and Jonathan Sorrick. Lastly, Keith Airheart, Assistant Principal at Kings Lake, introduced Abel Santos. c. A trip for 49 High School band students and staff Chad McCoy and Andy Turner to the Fresno State Band Day 2015 to be held Saturday, September 19, 2015 in Fresno. Requested bus transportation and other expenses to be paid by CAST and fundraisers.

d. A trip for four High School ROTC members and advisors Rudy Cardona and Carlos Guevara to the Biathlon Rifle Match to be held Saturday, September 12, 2015 in Parlier. Requested use of van and other expenses to be paid by AFJROTC Activities Fund.

e. A trip for John Muir eighth grade students and staff Dave Whitmore, Pearl Prins, Lee Anne Lucio, Sherry Leal, Jari Stokes, Nick Brown, Roseanne Salcedo, Justin Wakefield, Cain McDonald, Regan Hanes, Thomas Knight and Jennifer Steffen to the Museum of Tolerance on Friday, October 2, 2015 in Los Angeles. Charter buses and other expenses to be paid by CAST and Site funds.

f. A trip for five John Muir students and teacher Sherry Leal to the 2015 Future Business Leaders of America (FBLA) Central Section Officers and Advisors Training (OAT) Day to be held Saturday, September 19, 2015 in Visalia, to be paid by FBLA funds.

HIGH SCHOOL REPORT ASB representative Julia Avila reported that the High School had a Rush Week where all clubs and sports set up a table in the Quad to show students what extra-curricular activities were available to them. There was a good turnout. They also used the same format for Back-to-School Night so parents could also see the varieties of activities in which their students could participate. An Academic Rally was held and was claimed to exhibit the most school spirit in a long time. A Welcome Back Pool Party was held for the freshmen in an effort to integrate them into high school. Over 80 freshmen participated. Several other activities are coming up including an ROTC demonstration. Plus ASB is preparing for Homecoming activities. SUPERINTENDENT’S REPORT Welcome Back Luncheon: Superintendent Rich Merlo thanked the Board and appointed upcoming member Patty Robertson for attending the Welcome Back Luncheon for all employees. He added that Mr. David Diaz was a phenomenal speaker. Additionally, he thanked the staff and Board for holding down the fort while he and several administrators were in New Jersey.

LELA Update: Mr. Merlo, Antonia Stone, Eduardo Ochoa, Elizabeth Mendoza and Mike Anderson reviewed their trip to New Jersey through the LELA Foundation. While there the group of administrators, which included Lora Cartwright, put together the District’s goal in regards to personalized learning: “We will partner with our students to own their learning, pursue their ambitions, and achieve their goals.” They also strategized on how to carry that vision out. District Apple Award Application: Mr. Merlo informed the Board that the Tech coaches have been working with Lora Cartwright on an application for the Apple Distinguished School Award. They are producing an electronic book and it will be available for viewing in Apple’s iBooks. Goals: Mr. Merlo notified the Board that he has placed the Superintendent/Board Goals into their drop boxes and has added a reflection of the LCAP document and goals established in the past. CBO REPORT Nutrition Services: CBO Pamela Dihel advised the Board that Food Director Terri Thomas has sent in an application for Community Eligible Provision, a new federal program that includes 100% free breakfast, lunch and supper (after school) meals for all students. This would be a four-year contract through 2017-18, but the District could reapply at any time to restart the four-year timeline if the Identified Student Percentage is higher. The benefits are that there would be no need to collect lunch monies from students, although the District would still be collecting on past debts. In addition to breakfast, lunch and supper, the District would also be eligible for the Fresh Fruit and Vegetable program, as well as the Seamless Summer program (meals during summer break). The food lines would be faster as there would be no need for identification from students. BOARD OF TRUSTEES REPORT Trustee Bobby Toney: Mr. Toney attended the football game and noticed there were many high school and middle school personnel on duty. He asked if it was the norm. He was informed by the principals that yes it is. The high school admins are on duty and the middle school staff are there to make sure their students are on their best behavior. Trustee Mary Wadsworth: Mrs. Wadsworth noted that she thought the luncheon was fantastic, there was great enthusiasm and a big turnout. CFA REPORT CSEA REPORT CONSTITUTION DAY REPORT Lora Cartwright had prepared a report for the Board that included all Constitution Day celebrations at the sites and the reasoning behind the special day. COSTS FOR LOTS/DAMAGED DEVICES Steve Berry, Director of Technology, reported on the District’s financial costs for students’ damaged or lost technology devices. For 2014-15, the District spent $61,635 either repairing or replacing damaged/lost iPads or MacBook Airs. The cost for iPads was $24,515, while MacBooks cost the District $37,120. There were 2,100 iPads assigned to students and 840 MacBooks. This year’s newly purchased iPads have better protective covers that should help with broken screens. Also, new protective cases were purchased for the MacBook Airs. INTERDISTRICT FOR ESPINOZA The Board voted to approve an interdistrict agreement with Tulare Joint Union High School District for Luis Espinoza, ninth grade, to attend Corcoran High School for the 2015-16 school year. FIRST HEARING OF BP 5131.6 – ALCOHOL AND OTHER DRUGS The Board held the first hearing of Board Policy 5131.6 – Alcohol and Other Drugs. SIGNERS FOR THE CHS ASB CHECKING ACCOUNTS The Board voted to approve Antonia Stone, J.J. 2014-15 UNAUDITED ACTUALS APPROVED The Board voted to approve the 2014-15 Unaudited Actuals following a review by CBO Pamela Dihel. She relayed to the Board that Corcoran’s funded ADA was up by 3.98 from the previous year with CUSD receiving $7,993 per student. Revenues totaled $30,328,897. The largest portion of the District’s expenses of $30,445,251 went to salaries and benefits for 77% of total expenditures. The net change in the fund balance was a decrease of $116,354. The ending balance of $3,541,127.71 was carried forward to the 2015-16 budget. Motion: Bobby Toney Second: Karen Frey

Alcohol and Other Drugs

Regulation CORCORAN UNIFIED SCHOOL DISTRICT adopted: January 11, 1994

Instruction Students shall receive instruction by appropriately trained instructors about the nature and effects of alcohol and other drugs, including dangerous drugs defined by Health and Safety Code 11032. (Education Code 51260) Site administrators shall determine that drug education instructors are appropriately trained, having demonstrated that they possess: 1. The ability to interact with students in a positive way. 2. Knowledge of the properties and effects of tobacco, alcohol, narcotics, dangerous drugs, and shared drug apparatus. 3. Effective teaching skills and competency in helping students to express opinions responsibly and to become

aware of their values as they affect drug-use decisions. At all grade levels, instruction shall include a study of the effects of alcohol and other drugs upon the human system, as determined by science. (Education Code 51203, 51260) In grades 1 through 6, instruction in drug education should be given in health courses required by Education Code 51210. (Education Code 51260) In grades 7 through 12, instruction in drug education shall be conducted in health courses and in any other appropriate area of study required by Education Code 51220. (Education Code 51260) Instruction shall be sequential in nature and suited to meet the needs of students at their respective grade level. (Education Code 51260) Secondary school instruction shall include a study of the effects of alcohol and other drugs upon prenatal development, as determined by science. (Education Code 51203) The district drug education program shall augment any program provided by county drug education services. (Education Code 51260) Staff shall take every opportunity to cooperate with county staff in planning and implementing collaborative alcohol and drug prevention programs. (cf. 5131.63 - Anabolic Steroids) Intervention The staff shall intervene whenever students use alcohol and other drugs while on school property or under school jurisdiction. (cf. 5141.21 - Administering Medication) Staff members who believe that a student may be under the influence of alcohol or drugs shall immediately notify the principal or designee. If the principal or designee knows, observes or suspects that the student may be under the influence of alcohol or drugs, he/she may notify the parent/guardian. (Education Code 44049)

The principal or designee shall not report a known or suspected instance of alcohol or drug abuse by a student to the parent/guardian if this report would require the disclosure of confidential information in violation of law. (Education Code 44049) (cf. 5145.1 - Privacy) The principal or designee may refer families of these students to services that effectively deal with their drug problems. In severe cases, if the parents/guardians or the school medical personnel are not immediately available, the principal is authorized to call an ambulance to remove the student to a hospital. Parents/guardians will be notified of this action and shall be responsible for the incurred expenses. Enforcement/Discipline 1. Possession or Use of Alcohol or Illegal Drugs a. When any student uses or possesses alcohol or illegal drugs at school or while under school jurisdiction, the following shall result: (1) Parent/guardian contact. (2) One- to five-day suspension. (3) Contact law enforcement authority within one school day of the suspension. (4) Restriction from school activities. b. In addition, the following action may be taken: (1) Recommendation of expulsion. (2) Referral to an appropriate community counseling program with the expectation that at least one

counseling session will be held during the time of suspension. (3) Transfer/Alternative Placement. 2. Selling or Providing a. When a student sells or provides alcohol or other drugs at school or while under school jurisdiction, the

following shall result. (1) Parent/guardian contact. (2) Suspension with recommendation of expulsion. (3) Law enforcement contact within one school day of the suspension. b. Staff shall notify the principal or designee immediately upon suspecting a student is selling or providing

alcohol and other drugs. The principal or designee may notify law enforcement prior to confronting or searching the student.

c. A search for drugs may be made in accordance with the provisions of law, Board policy and administrative

regulations. d. When there is good evidence that a student has actually sold or provided alcohol or other drugs or drug

paraphernalia on or about the school premises or at school-sponsored functions, law enforcement must be notified. Law enforcement authorities will decide whether they or the school will notify the parent/guardian.

The curriculum of all elementary and secondary schools shall include instruction on the effects upon the human body, as determined by science, of tobacco, alcohol, narcotics, dangerous drugs as defined in Health and Safety Code 11032, and other dangerous substances. Instruction shall be sequential in nature and suited to meet the needs of students at their respective grade level. (Education Code 51203, 51260)

In grades 1-6, instruction in drug education should be given in health courses required by Education Code 51210. (Education Code51260)

In grades 7-12, instruction in drug education shall be conducted in health courses and in any other appropriate area of study required by Education Code 51220. (Education Code 51260)

Secondary school instruction shall also include a study of the effects of alcohol and other drugs upon prenatal development. (Education Code 51203)

Instruction shall be provided by appropriately trained instructors who have demonstrated competencies, as determined by the principal or designee, in the following areas: (Education Code 51260)

1. The ability to interact with students in a positive way

2. Knowledge of the properties and effects of tobacco, alcohol, narcotics, dangerous drugs, and shared drug apparatus

3. Effective teaching skills and competency in helping students to express opinions responsibly and to become aware of their values as they affect drug-use decisions

Intervention

District staff shall intervene whenever students use alcohol or other illegal drugs while on school property or under school jurisdiction. Staff members who have a reasonable suspicion that a student may be under the influence of alcohol or drugs shall immediately notify the principal or designee.

If the principal or designee, in his/her professional capacity or in the course of his/her employment, knows, observes or suspects that a student may be under the influence of alcohol or drugs, he/she may notify the parent/guardian. (Education Code 44049)

School staff shall not disclose confidential information provided during counseling by a student 12 years of age or older. A school counselor may report such information to the principal or parent/guardian only when he/she believes that disclosure is necessary to avert a clear and present danger to the health, safety or welfare of the student or other persons living in the school community. The school counselor shall not disclose such information to the parent/guardian if he/she believes that the disclosure would result in a clear and present danger to the student's health, safety or welfare. Because the use of alcohol and other drugs adversely affects a student's ability to achieve academic success, is physically and emotionally harmful, and has serious social and legal consequences, the Governing Board intends to keep district schools free of alcohol and other drugs. The Board desires that every effort be made to reduce the chances that our students will begin or continue the use of alcohol and other drugs. Alcohol is like any other drug; illegal for use by minors. The Superintendent or designee shall develop a comprehensive prevention program that includes instruction, intervention, recovering student support, and enforcement/discipline. The Superintendent or designee shall clearly communicate to students, staff and parents/guardians all Board policies, regulations, procedures and school rules related to this prevention program. (cf. 5131.61 - Drug Testing Program) (cf.5131.62 - Tobacco) (cf.5144.1 - Suspension and Expulsion/Due Process) Recognizing that keeping schools free of alcohol and other drugs is a concern common to the district and community, the Board supports cooperation among schools, parents/guardians, law enforcement and other appropriate community organizations involved in preventing alcohol and other drug abuse. To obtain the widest possible input and support for district policies and programs related to alcohol and other drug abuse prevention, the Board shall appoint a districtwide school-community advisory committee to make recommendations in this area. (cf. 1220 - Citizen Advisory Committees) The Board also supports site-level advisory groups in this area. (Health and Safety Code 11998) Instruction The district shall provide instructional programs which help students to avoid the use of alcohol or other drugs and which teach students how to influence their peers to avoid and/or discontinue the use of alcohol or other drugs. Instruction shall be preventive in nature and designed to help students who have questions related to alcohol and other drugs. The instructional programs will help students obtain and use current and accurate information, develop and maintain a positive self-concept, take positive actions to cope with stress, and use appropriate social and personal skills to resist involvement with alcohol and other drugs, and will assist the student toward maturity. The curriculum will be K-12, comprehensive and sequential in nature and suited to meet the needs of students at their respective grade levels. (cf. 6142.2 - AIDS Instruction) (cf. 6143 - Courses of Study) Intervention The Board recognizes that there are students on our campuses who use alcohol and other drugs and can benefit from intervention. The Board supports intervention programs that include the involvement of students, parents/guardians and community agencies/organizations.

The Board finds it essential that school personnel be trained to identify symptoms which may indicate use of alcohol and other drugs. The responsibilities of staff in working with, intervening, and reporting students suspected of alcohol and other drug use shall be clearly defined in administrative regulations. Students and parents/guardians shall be informed about the signs of alcohol and other drug use and about appropriate agencies offering counseling. Recovering Student Support The Board recognizes the presence of recovering students in the schools and the necessity to support these students in avoiding reinvolvement with alcohol and other drugs. The Board shall provide ongoing school activities which enhance recovery. (cf. 5125 - Student Records) (cf. 5145.1 - Privacy) Enforcement/Discipline The Superintendent or designee shall take appropriate action to eliminate possession, use or sale of alcohol and other drugs and related paraphernalia on school grounds, at school events, or in any situation in which the school is responsible for the conduct and well-being of students. Students possessing, selling and/or using alcohol or other drugs or related paraphernalia shall be subject to disciplinary procedures which may result in suspension or expulsion. (cf. 5144.1 - Suspension and Expulsion/Due Process) School authorities may search students and school properties for the possession of alcohol and other drugs as long as such searches are conducted in accordance with law, Board policy and administrative regulations. (cf. 5145.12 - Search and Seizure) Confiscation of Beepers Because electronic signaling devices (beepers) are used to facilitate illegal drug transactions, the possession or use of such devices by students is prohibited on school premises, at all school-sponsored activities, and at any time while students are under the supervision and control of district employees. An exception shall be made only when the principal or designee has determined that the beeper is essential for the student's health. Any beeper so allowed shall be used only for health purposes. (Education Code 48901.5) The Superintendent or designee shall confiscate beepers from students. The presence of a beeper may be cause for further search for the possession of drugs. The Governing Board believes that the use of alcohol or other drugs adversely affects a student's ability to achieve academic success, is physically and emotionally harmful, and has serious social and legal consequences. The Board desires to keep district schools free of alcohol and other drugs in order to help prevent violence, promote school safety and create a well-disciplined environment conducive to learning.

The Superintendent or designee shall develop, implement and evaluate a comprehensive prevention and intervention program that is coordinated with other school and community-based services and programs. The district's program shall be scientifically based and designed to prevent or reduce alcohol or other drug use and the possession and distribution of illegal drugs. It shall include primary prevention activities such as decision-making skills and conflict management, instruction, referral to a rehabilitation program, enforcement/discipline, activities that promote the involvement of parents/guardians and coordination with appropriate community agencies and organizations.

The Board and Superintendent shall agree upon performance measures that will be used to monitor and determine the effectiveness of the district's program in reducing drug and alcohol use. The Superintendent or designee shall develop and implement an evaluation process that includes ongoing assessment and analysis of objective data regarding the incidence of drug and alcohol use among district students, including discipline problems, and the prevalence of risk factors.

The Superintendent or designee shall consult with principals, teachers, other school personnel, students and parents/guardians when developing the district's program.

The Superintendent or designee shall clearly communicate to all students, staff and parents/guardians the district's policies, regulations and school rules related to the use of alcohol and other drugs on school campuses or at school activities. Information about program needs and goals shall be widely distributed in the community.

Staff should encourage students to participate as responsible partners in efforts to maintain a safe, constructive school climate.

All instruction and related materials shall consistently state that unlawful use of alcohol or other drugs is wrong and harmful. Instruction shall not include the concept of responsible use of drugs or alcohol when such use is illegal. (20 USC 7114, 7162; Health and Safety Code 11999.2)

The district shall offer staff development activities for staff who implement the comprehensive drug and alcohol prevention and intervention program.

Intervention, Referral and Student Assistance Programs

School staff, students and parents/guardians shall be informed about early warning signs which may indicate alcohol and other drug use and about appropriate agencies offering intervention programs, counseling, referral and other student assistance programs.

The Board strongly encourages any student who is using alcohol or drugs to discuss the matter with his/her parent/guardian or with any staff member. Students who disclose their use of alcohol or other drugs when seeking help from an intervention or recovery program shall not be disciplined for such use.

Enforcement/Discipline

The Superintendent or designee shall take appropriate action to eliminate possession, use or sale of alcohol and other drugs and related paraphernalia on school grounds or at school-sponsored activities.

Students possessing, using or selling alcohol or other drugs or related paraphernalia shall be subject to disciplinary procedures including suspension or expulsion and/or referral to law enforcement in accordance with law, Board policy and administrative regulation. In addition, such students may be referred to an appropriate counseling program, transferred to an alternative placement, and/or be restricted from extracurricular activities, including athletics.

The Governing Board recognizes that part-time employment can provide students with income as well as job experience that can help them develop appropriate workplace skills and attitudes. Upon obtaining an offer of employment, district students who are minors shall obtain work permits from the Superintendent or designee in accordance with law, regardless of whether the employment will occur when school is in session and/or not in session.

In determining whether to grant or continue a work permit, the Superintendent or designee shall consider whether employment is likely to significantly interfere with the student's schoolwork. Students granted work permits must demonstrate and maintain a 2.0 grade point average and 95% school attendance. On a case-by-case basis, the Superintendent or designee may approve a maximum work hour limit that is lower than the limit specified in law and administrative regulation.

Students with work permits may be exempted from attendance in a full-time day school provided they attend part-time classes. (Education Code 48230)

Work permits shall be limited to part-time employment as defined by law, except when the Superintendent or designee determines that circumstances warrant the granting of a permit for full-time employment.

Any student authorized to work full time when school is in session shall be enrolled in part-time continuation classes. A student age 14 or 15 who receives a permit to work full time shall also be enrolled in a work experience education program. (Education Code 49130, 49131, 49135)

Before accepting employment, a student under the age of 18 who is subject to the state's compulsory attendance law, including students who have not yet graduated from high school or have not received a certificate of proficiency, shall obtain a work permit.

The district also may issue a permit to any minor age 12-17 to be employed during a regular school holiday, during a regular or specified occasional public school vacation, and when the student is exempt from compulsory school attendance because he/she arrived from another state within 10 days before the end of the school term pursuant to Education Code 48231. (Education Code 49111, 49113, 49160)

If a minor has obtained an offer of employment in the entertainment industry, he/she shall request a work permit from the California Department of Industrial Relations, Division of Labor Standards Enforcement, pursuant to Labor Code 1308.5and 8 CCR 11752-11753.

A student shall not be required to obtain a work permit if he/she is self-employed; is working at odd jobs such as yard work and babysitting in private homes where he/she is not regularly employed; is a self-employed news carrier delivering newspapers to consumers on a regular route; is employed by his/her parent/guardian in domestic labor on or in connection with premises the parent/guardian owns, operates, or controls; or is otherwise exempted by law.

Persons Authorized to Issue Work Permits

The following individuals are authorized to issue a work permit to a minor student in the district: (Education Code 49110)

1. The Superintendent

2. An employee holding a services credential with a specialization in pupil personnel services or a certificated work experience education teacher or coordinator, when authorized by the Superintendent in writing

3. A principal, or another school administrator designated by the principal, provided that he/she:

a. Provides a self-certification that he/she understands the requirements of law for issuing a work permit

b. Does not issue a work permit to his/her own child

If the person designated to issue work permits is not available and delay in issuing a permit would jeopardize a student's ability to secure work, the Superintendent may authorize another person to issue the permit. (Education Code 49110)

Approval Process

The student's parent/guardian, foster parent, caregiver with whom the student resides, or residential shelter services provider shall file a written request for a work permit. (Education Code 49110)

The request for a work permit shall be submitted to the Superintendent or designee on a form approved by the California Department of Education (CDE). The Superintendent or designee shall have discretion to determine whether or not to issue the work permit.

In determining whether to approve a work permit, the Superintendent or designee shall verify the student's date of birth, the type of work permit to be issued, and whether the student meets any other criteria established by the Governing Board. The Superintendent or designee may inspect the student's records and/or may confer with at least one of the student's teachers for evidence of satisfactory grades and school attendance and to determine whether the student possesses the motivation and maturity to maintain academic progress while working.

Minors shall not be approved to work in environments declared hazardous or dangerous for young workers or otherwise prohibited by child labor laws. (Labor Code 1290-1298; 29 CFR 570.33, 570.50-570.72)

The Superintendent or designee shall ensure that the requested work hours do not exceed the maximum work hours specified in law based on the student's age and whether the employment will occur while school is in session and/or not in session. (Education Code 49111, 49112, 49116; Labor Code 1391-1391.1; 29 CFR 570.35)

Full-time employment may be authorized for students age 14-17 only in accordance with Education Code 49130-49135. Freshmen students will not be allowed a work permit except for work during winter break, spring break and summer. Sophomore students will be allowed work permits for work during winter break, spring break and summer, as well as during the school year under the following conditions: parent and student are required to attend a conference with a team of their teachers and administrators where they sign a student study plan; student must maintain a 3.0 GPA or better; and attendance must be 95% or better.

All work permits shall be issued in a format approved and authorized by the CDE. (Education Code 49117)

Each permit shall authorize work for a specific employer. Whenever a student changes employers, he/she shall request a new permit.

The student may be issued more than one work permit if he/she works concurrently for more than one employer, provided that the total number of hours worked does not exceed the total number of hours allowed by law and the district.

The Superintendent or designee shall quarterly inspect the grades and attendance records of students granted work permits to ensure maintenance of academic progress and any additional criteria established in Board policy.

Expiration of Work Permits

Work permits issued during the school year shall expire five days after the opening of the next succeeding school year. (Education Code 49118)

Before the work permit expires, a student may apply for a renewed work permit in accordance with the procedures specified in the section "Approval Process" above.

Revocation of Work Permits

The Superintendent or designee shall revoke a student's work permit whenever he/she determines that employment is interfering with the student's education, that any provision or condition of the permit is being violated, or that the student is performing work in violation of law. (Education Code 49116, 49164)

The Superintendent may revoke a work permit issued by a principal of a public or private school located within the district if the Superintendent becomes aware of any grounds upon which the student may be deemed ineligible for a work permit under law. (Education Code 49110)

Retention of Records

The Superintendent or designee shall retain a copy of the work permit application and the work permit until the end of the fourth year after the work permit was issued. (5 CCR 16026)

In accordance with the Adult Education Block Grant, mandated by new regulations and AB 104, school districts within the boundaries of the adult education region were required to join the Sequoias Adult Education Consortium and become members. The members of this consortium will be allocated funds received by the consortium, to run adult education programs within their districts. Adult Education funds will be dispersed accordingly only to districts that belong to a consortium. The attached MOU includes all school districts that are in the Sequoias Adult Education Consortium. The following districts will work together toward a mutual goal of educating adults within our region: Alpaugh Unified School District College of the Sequoias Corcoran Unified School District Cutler-Orosi Joint Unified School District Exeter Unified School District Farmersville Unified School District Hanford Joint Union High School District Lindsay Unified School District Tulare Joint Union School District Visalia Unified School District Woodlake Unified School District This consortium will develop a regional plan to improve the delivery of adult education in current programs and address exiting gaps in programs and services. MEMORANDUM OF UNDERSTANDING

SEQUOIAS ADULT EDUCATION CONSORTIUM

This Memorandum of Understanding shall stand as evidence that the following districts intend to work together toward the mutual goal of collaborating to form the Sequoias Adult Education Consortium, from here forward referred to as the Consortium, to improve the delivery of adult education.

• Alpaugh Unified School District • College of the Sequoias • Corcoran Joint Unified School District • Cutler-Orosi Joint Unified School District • Exeter Unified School District • Farmersville Unified School District • Hanford Joint Union High School District • Lindsay Unified School District • Tulare Joint Union School District • Visalia Unified School District • Woodlake Unified School District

The Sequoias Adult Education Consortium has been formed, in accordance with AB86, Section 76, Article 3, to develop a regional plan to improve the delivery of adult education in the following program areas and address existing gaps in programs and services:

(1) Programs in elementary and secondary basic skills, including programs leading to a high school diploma or high school equivalency certificate.

(2) Programs for immigrants eligible for educational services in citizenship, English as a second language, and workforce preparation.

(3) Programs for adults, including, but not limited to, older adults, that are primarily related to entry or reentry into the workforce.

(4) Programs for adults, including, but not limited to, older adults, that are primarily designed to develop knowledge and skills to assist elementary and secondary school children to succeed academically in school.

(5) Programs for adults with disabilities. (6) Programs in career technical education that are short term in nature and have high

employment potential. (7) Programs offering pre-apprenticeship training activities conducted in coordination

with one or more apprenticeship programs approved by the Division of Apprenticeship Standards for the occupation and geographic area.

The Consortium Board will be the governing body responsible for directing consortium staff and all actions of the allocation committee including budget recommendations and activity approval. To this end, all entities agree to the foundational principles for the Consortium governance found in Attachment A. This Memorandum of Understanding is in force from July 1, 2015 through June 30, 2018 and is subject to review and revision annually, and is renewable each year thereafter or may be terminated by either party in thirty (30) days by giving written notice of the intention to terminate the agreement. Attachment A

Principles for the Sequoias Adult Education Consortium Governance 1. Mutuality, Shared Leadership, and Collaboration The Consortium’s governance and decision-making processes are based on recognition of and respect for the interrelationships of the districts and their constituent groups. The commitment to this principle is demonstrated in the following ways:

• Members of the Consortium publicly acknowledge the importance of participatory governance and the rewards to all for collaborative participation.

• Members will vote to select co-chairs annually for the Consortium Board to ensure shared leadership between the Community College system and the K-12 Education system.

• Members agree to participate and provide input throughout the implementation process to ensure shared leadership.

2. Member Role and Participation This principle supports the use of democratic processes to ensure that the voices of all members are included. Any member of the consortium can bring items and issues the consortium as a whole. In order for this principle to be fully implemented, all members of the consortium are asked to fulfill the following responsibilities of Consortium membership:

• Each member Board of Education will designate a voting representative(s) to the Consortium Board and ensure attendance at and participation at regular Consortium meetings. Each member district with fewer than 5,000 students will be allowed one vote. Each member district with more than 5,000 students will be allowed 2 votes. A simple majority of members present constitutes a quorum. All issues to be voted on shall be decided by a simple majority of those present at the meeting in which the vote takes place.

• If a member of the Consortium Board is unable to attend a meeting, they shall designate a proxy voter who is familiar with the Sequoias Adult Education Consortium and notify the Consortium Co-Chairs who their proxy will be prior to that meeting.

• Members will vote on items concerning fiscal and implementation decisions. • Each member will provide data and information relevant to adult education as

needed for the implementation, assessment, and revision of a regional plan. • Each member will agree to participate as necessary in the implementation process

including participation as needed in sub-groups. • Members agree that in the interest of the Consortium and key stakeholders they will

function as a team member with other members of the group, follow through on tasks, report meeting outcomes back to key stakeholders within their organizations, work toward common understanding and consensus in an atmosphere of respect, support the implementation of recommendations once group consensus is reached, and welcome change and innovation.

3. Community Partnerships Partner organizations identified by the Consortium through an application process will be invited to participate in Consortium meetings and activities. They are recognized as valuable stakeholders and partners in the implementation of educational services for Adults. Partner organizations will:

• Be a funder or a provider for adult education in at least one of the 7 program areas outlined in AB86, Section 76, Article 3, and AB104, Section 84913

• Participate in data collection as required for implementation and assessment • Designate a representative to attend Consortium meetings and activities • Participate in sub-groups as needed

4. Committees The Consortium Board may create committees as needed. Leadership Committee: A temporary committee will be established for the purpose of guiding the first year of implementation of the regional plan. Consortium members will be allowed to designate representatives on this committee. Members of this committee do not need to be members of the Consortium Board. This Leadership committee will meet regularly and perform tasks as needed to implement the Regional Plan during the initial implementation period in order to provide continuity and guidance for consortium staff, make recommendations on the regional budget to the Consortium Board and other guidance as needed. This Leadership Committee will be in place as long as needed as determined by the Consortium Board. 5. Transparency The Consortium values transparency and strives to maintain an open and honest approach to decision-making, operations and communication. Everyone who will be impacted by a decision is encouraged to be involved in shaping the recommendation. The commitment to this principle is demonstrated by adherence to the Brown Act and:

• The schedules for Consortium meetings are posted on www.SequoiasAdultEd.com and the meetings are open to members and partners of the consortium, as well as the public.

• Agendas will be made public three business days prior to Consortium Board meetings.

• Anyone from the public can bring forward an item or issue during public comment. • Meeting minutes will be made public via www.SequoiasAdultEd.com. • Region-wide emails are used to keep the internal community involved and updated

on issues and decisions. • Open forums are convened at least once a year as a venue for general discussions

of emergent issues.

6. Fiscal Administration of Consortium The Consortium Board will annually select a member district to act as the Fiscal Agent. Member districts interested in the Fiscal Agent role will nominate themselves. To select the Fiscal Agent, the Consortium Board will hold a vote. The nominated member district with the simple majority of Consortium Board members present will become the Fiscal Agent. Fiscal Agent Role and Responsibilities:

The Fiscal Agent (FA) will be identified to the State as the fiscal agent on behalf of the Sequoias Adult Education Consortium for the Adult Education Block Grant. The Fiscal Agent shall be responsible for distributing funds according to an allocation schedule recommended by the Consortium Director and approved by the Consortium Board. The Fiscal Agent shall not amend an allocation schedule approved by the Consortium Board. The Fiscal Agent will be responsible for:

• Contracting with member districts to distribute allocated funds as recommended by

the Consortium Director and approved by the Consortium Board • Acting as the employer of record for all consortium staff • Fiscal reporting to the State as required by the Adult Education Block Grant • Compliance with State requirements for administration of the Adult Education Block

Grant The Fiscal Agent will be eligible to be compensated up to the allowable as designated by the Adult Education Block Grant guidance for administrative expenses related to the fiscal administration of the Adult Education Block Grant. 7. Organizational Structure and Staffing

Once the staffing plan has been established, there will need to be guidance on the staff including organization of employment. The Task Force will become the Leadership Committee upon hiring a Consortium Director.

Consortium Director: The Consortium Director is hired and supervised by the Fiscal Agent based upon the recommendation of the Consortium Board. The Director reports to Consortium Board and has day-to-day responsibilities for the organization, including carrying out the organization’s goals and policies. The Director will attend all board meetings, report on the progress of the organization, answer questions of the board members and carry out the duties described in the job description. The board can designate other duties as necessary. Adult Education Navigators: The Adult Education Navigators are hired by the Consortium Board and supervised by the Consortium Director. Each Navigator will have specialty knowledge in a Program Area. The Navigators will be well-trained and have a strong understanding of the Adult Education programs at both the SAEC Adult Schools and COS as well as the resources available at Partner organizations. These Navigators would be charged with representing the SAEC at regional locations and would be tasked with managing Program Area collaboration in all seven Program Areas as well as acting as liaisons between all agencies. 9. Consortium Budget Development The Consortium Board shall develop a recommended budget annually for Consortium activities. This recommendation will be brought to the Consortium Board for review and approval.

LEVEL 1 DEVELOPER FEE STUDY

Scope of Work 1. Developer Fee Study – Level 1:

Consultant shall prepare a Level 1 Developer Fee Study to justify the statutory fee rates for both residential and for commercial/industrial development. School Districts are authorized to collect these fees per Education Code Section 17620. The Study will include a sample Board Resolution to be adopted along with a sample Public Notice that needs to be published/posted at least fourteen (14) days prior to school Board approval.

 If SchoolWorks’ presence is requested at a School Board meeting, the district will be billed at $140 per hour plus travel time and expenses.

Payment Schedule The consulting fees cited above, will be billed upon completion of the project. The amount is due within thirty (30) days of the date of the invoice. A late fee of 5% of the invoice amount will be charged if the amount due is not paid within sixty days of the date of the invoice.

Conditions and Requirements If the District does not qualify for a Level 1 fee in excess of the statutory Level 1 fee, a fifty percent (50%) discount will be given on the cost of the study.

KINGS COUNTY, STATE OF CALIFORNIA DETERMINING SUFFICIENCY OF } INSTRUCTIONAL MATERIALS FOR 2015-2016 } Resolution No. 1170 WHEREAS, in order to receive state instructional materials funds, the Governing Board is required by Education Code 60119 to hold a public hearing and adopt a resolution by the eighth week of the school year, determining that every pupil, including English learners, has sufficient textbooks or instructional materials, or both, that are aligned to the content standards in each of the following subjects that are consistent with the content and cycles of the curriculum framework adopted by the State Board of Education: mathematics, science, history-social science, reading/language arts. WHEREAS, as part of the required hearing, the Governing Board must also make a written determination as to whether each pupil enrolled in a foreign language or health course has sufficient textbooks or instructional materials that are consistent with the content and cycles of the curriculum frameworks adopted by the state board for those subjects. WHEREAS, the Governing Board shall also determine the availability of laboratory science equipment as applicable to science laboratory courses offered in grades 9 to 12 inclusive. WHEREAS, “sufficient textbooks or instructional materials,” means that each pupil, including English learners, has a textbook or instructional materials, or both, to use in class and to take home. This does not require two sets of textbooks or instructional materials for each pupil. WHEREAS, between the 2008-09 through the 2015-2016 fiscal years, the definition of “sufficient textbooks or instructional materials: also means that all students who are enrolled in the same course within the Corcoran Unified School District, have standards-aligned textbooks or instructional materials from the same adoption cycle. THEREFORE BE IT RESOLVED, that the Governing Board hereby determines, as required by Education Code Section 60119, that the school district has sufficient instructional materials for each pupil in the following areas: Science History-Social Science Reading/language arts, including the English language development component of an adopted program Health Foreign Language Mathematics BE IT FURTHER RESOLVED, that there is available science laboratory equipment for students in science laboratory courses offered in grades 9 to 12.

THEREFORE BE IT RESOLVED, that for the 2015-2016 school year, the Corcoran Unified School District has provided each pupil with sufficient textbooks and instructional materials consistent with the cycles and content of the curriculum framework. TO: Rich Merlo, Board of Trustees FROM: Elizabeth Mendoza, Principal DATE: September 11, 2015 SUBJECT: Proposal for Additional TK/Kindergarten Combination Teacher The purpose of this proposal is to request an additional TK/Kindergarten Combination Teacher due to enrollment size impacting current class sizes and limiting space within the Kindergarten classroom. I come to you with a request to add a Kindergarten teacher to alleviate our class sizes of 24-25. Having this number of students in a Transitional Kindergarten or Kindergarten class (4-5 year olds) impacts the class size reduction reimbursement. These concerns of having 24-25 students in a class impacts the educational process by: 1) limiting time a teacher has to work with students in small group or individually and 2) limiting the space for the teacher to navigate the classroom appropriately. An immediate solution to this would be to decrease the amount of students in a classroom by increasing the number of teachers from 12 to 13. This would reduce classroom sizes to 22.6 students versus 24.6 students. Our major concern is that students are still enrolling in Transitional Kindergarten /Kindergarten and will continue to do so throughout the school year. It has been a trend that enrollment continues regularly between August and the end of October/beginning of November. The longer we wait to hire a new teacher, the more established a student becomes with his/her current teacher. I am requesting that a solution be immediate so that we can expedite the transition process of the students who will be selected to fill the additional classroom. The selection process for students who will fill the new class would be identical to the process we currently follow when forming classes:

1. Gender 2. Ability—based on Kindergarten pre-assessment 3. Language 4. Behavior 5. Class-size requirements.

As the Principal of Bret Harte Elementary, I am asking for your support and careful consideration of this request. I feel that it is in the best interest of the students and the staff to add a Transitional Kindergarten/Kindergarten combination teacher. Such a bold move would impact student achievement and experiences, while strengthening the foundational skills needed to secure a strong academic future for our youngest students. It would also keep our numbers in line with the requirements of class size reduction funding.

CORCORAN UNIFIED SCHOOL DISTRICT SUPERINTENDENT EMPLOYMENT AGREEMENT

THIS EMPLOYMENT AGREEMENT (“Agreement”) is made and entered into

by and between the Governing Board of the Corcoran Unified School District ("District"

or "Board") and Richard Merlo ("Superintendent").

Agreement

1. Term. District hereby employs Superintendent for a period of four (4) years,

beginning July 1, 2015 and terminating on June 30, 2019, unless terminated earlier or

extended as provided by the terms of this Agreement or as required by law.

2. Salary.

a. Base Salary. The Superintendent's annual salary shall be one hundred

fifty-five thousand, seven hundred and seventy-eight dollars and eighty-eight cents

($155,778.88) payable in twelve (12) equal approximately monthly payments, less all

applicable deductions and withholdings required by law or authorized by the

Superintendent. The Superintendent’s salary increase shall be retroactive to July 1, 2015.

b. Salary Increases by Mutual Agreement. The Board reserves the right to

change the Superintendent's salary or provide the Superintendent with alternate forms of

compensation for any year of this contract with the mutual written consent of the

Superintendent and the Board. A change in salary shall not constitute the creation of a

new contract nor extend the termination date of this Agreement. To receive any form of

salary or compensation increase, the Superintendent must have a satisfactory or higher

rating formal evaluation rating from the Board.

3. Superintendent's Duties.

a. General. The Superintendent is employed as District Superintendent and

shall competently and satisfactorily perform the duties of District Superintendent as

prescribed by the laws of the State of California, the Corcoran Unified School District's

board policy (See, for example BP 2120, 2122), and the District’s job description for

Superintendent, which is attached to this Agreement. The Superintendent shall have

primary responsibility for execution of board policy and responsibility for the duties

prescribed by Education Code section 35035. The Superintendent shall serve as the

Board's chief executive officer and secretary of the Board.

b. Personnel Matters. The Superintendent shall have primary responsibility

in making recommendations to the Board regarding all personnel matters, including, but

not limited to employment, assignment, transfer and dismissal of employees, subject to

the approval of the Board. Upon timely submission of recommendations by the

Superintendent, the Board shall take timely action on such recommendations. The

Superintendent shall make every effort to establish and maintain a satisfactory working

relationship with all District personnel, vigorously foster mutual respect with and among

personnel, create a harmonious working atmosphere and maximize the productivity and

efficiency of the personnel team. With prior notice to and approval by the Board, the

Superintendent may reorganize the District's administrative staff within existing financial

parameters.

c. Administrative Functions. The Superintendent, as chief executive officer

shall: (1) review all policies adopted by the Board and make appropriate

recommendations to the Board; (2) periodically evaluate or cause to be evaluated all

District employees; (3) actively seek out, perform research on, have an understanding of

and advise the Board on sources of funds that might be available to implement present or

contemplated district programs; (4) assume responsibility for those duties specified in

Education Code section 35250; (5) endeavor to maintain and improve his professional

competence by all available means, including subscriptions to and reading of appropriate

periodicals and active membership in appropriate professional associations as previously

approved by the Board and paid for by the District; (6) establish and vigorously maintain

positive community, staff and Board relations and communication; (7) serve as liaison to

the Board with respect to all matters of employer-employee relations and make

recommendations to the Board concerning those matters; (8) recommend to the Board

district goals and objectives; and (9) unless unavoidably detained, attend all regular,

special and executive session meetings of the Board. The Board shall refer all

suggestions, complaints and concerns made by the members of the public to individual

members of the Board, or the Board as a body, for review and action by the

Superintendent. The Superintendent's response to an action on certain items may be

subject to the approval of the Board.

4. Employment Fringe Benefits. As an employee, the Superintendent shall be

afforded the same benefits provided to other District certificated management staff, as

those benefits, costs, plans, providers and other terms and conditions may change from

time-to-time. Thus, the Superintendent shall be entitled to receive the same District

contribution toward health and welfare benefits and shall pay the same co-pays,

premiums, deductibles and other costs as the District’s certificated management staff, as

those costs and contributions may change from time-to-time.

5. Automobile Allowance. The Superintendent is required to have a vehicle

available at all times to perform the services and duties of the position. Therefore, the

Superintendent shall be entitled to receive a monthly automobile allowance of five

hundred dollars ($500.00) for the acquisition, use, maintenance and insurance of an

automobile while on all District business for business related travel in Kings, Fresno and

Tulare counties, irrespective of the number of miles traveled on District business. The

Superintendent shall be solely responsible for all expenses to use, maintain, operate and

insure the automobile. The Superintendent’s receipt of this automobile allowance shall

be in lieu of any entitlement to mileage reimbursement for travel within the three counties

identified. No documentation is required in order to receive this allowance and the

Superintendent shall have discretion regarding the expenditure of this allowance. This

allowance shall be treated as salary for tax purposes and shall be treated as creditable

compensation for CalSTRS purposes to the extent permitted by law and CalSTRS.

Business related travel outside of the three identified counties shall be reimbursed at the

District’s regular mileage reimbursement rate in effect at the time the expenses are

incurred.

6. Cell Phone Allowance. The Superintendent shall be entitled to receive twenty-

five ($25) per month toward expenses connected with the Superintendent’s use of his

personal cell phone and other technologies for business related purposes. No

documentation is required in order to receive this allowance and the Superintendent shall

have discretion regarding the expenditure of this allowance. This allowance shall be

treated as salary for tax purposes and shall be treated as creditable compensation for

CalSTRS purposes to the extent permitted by law and CalSTRS.

7. Sick Leave. The Superintendent shall accrue sick leave at the rate of twelve (12)

days per year. Sick leave may be accumulated without limit. In no event shall the

Superintendent be entitled to compensation for accumulated but unused sick leave.

Unused sick leave may be credited for retirement purposes as authorized by the statutes

and regulations governing STRS.

8. Retiree Health Benefits. If the Superintendent retires from the District and

immediately begins receiving a retirement allowance from STRS, then the District agrees

to provide the Superintendent and his spouse with health insurance benefits on the same

terms and conditions as provided to other active District certificated management

employees, as those terms and conditions may change from time-to-time, until the

Superintendent reaches age sixty-five (65) or dies, whichever occurs first. After reaching

age 65, the Superintendent shall have the right, at the Superintendent’s sole cost and

expense, to participate in the District’s retiree health benefit program on the same terms

and conditions as provided to other certificated management employees, as those terms

and conditions may change from time-to-time, so long as participation is permitted by

law and by the District’s benefit providers.

9. Holidays and Vacation. The Superintendent shall be required to render twelve

(12) months of full and regular service to the District during each annual period covered

by this Agreement exclusive of those days designated as holidays for certificated

management employees of the District, except that the Superintendent shall be entitled to

accrue vacation with pay at the rate of 1.66 days per month for a maximum of twenty

(20) days per year, exclusive of holidays, as defined in Education Code sections 37220

and 37221. The Superintendent shall notify the Board prior to the use of vacation days.

Vacation may be accumulated from year to year, but in no event shall be more than

twenty (20) days and be carried forward from one year to the next. In the event that the

Superintendent accumulates more than forty (40) days of earned vacation, the

Superintendent shall be required to reduce the accumulation by either taking time off in

accordance with the terms of this Agreement, taking compensation for unused vacation

days at the salary rate in effect at the time of payment, or any combination of time off and

compensation as requested by the Superintendent and approved by the Board. In all

events, no more than forty (40) days of unused vacation shall be paid at the expiration or

termination of this Agreement.

10. Work Year. The Superintendent shall be required to work 226 days during each

annual period covered by this Agreement. To determine the Superintendent’s daily rate-

of-pay, the parties agree that the Superintendent’s annual base salary shall be divided by

226. Days worked in excess of 226 are considered non-work days. The Superintendent is

not entitled to pay for non-work days.

11. Participation in Employer Provided Tax Deferred Plans. The District agrees to

provide the Superintendent with the ability to use an IRS Section 403b or similar tax

deferred plan, an IRS Section 125 Cafeteria Plan, and other plans that are made available

to other District certificated management employees. All employee contributions to such

plans shall conform to all requirements of law. The District also agrees to amend its

Section 403b Plan to permit employer contributions, if necessary.

12. Supplemental Defined Contribution Plan. If the Superintendent receives a

satisfactory annual written evaluation each year during the term of this Agreement and if

the Superintendent completes four (4) consecutive years of service to the District so that

he has continuously and satisfactorily served the District through June 30, 2017, then the

District agrees to make a contribution to its IRS Section 403b Employer Paid Plan (the

“Plan”) on behalf of the Superintendent in the amount of $50,000. The parties agree that

the Superintendent’s evaluation shall be deemed to be satisfactory solely for purposes of

this paragraph unless the Board’s overall rating on a written evaluation of the

Superintendent is unsatisfactory; thus, if the Board does not evaluate the Superintendent

during any year of this Agreement or if the evaluation is not timely, the evaluation shall

nonetheless be deemed satisfactory for purposes of the Superintendent’s entitlement to

the Plan contribution.

The Superintendent agrees to select a provider allowed by the Plan and to take all

other actions necessary to allow the District to fund the Plan. If the Superintendent

fulfills the requirements to be eligible for the contribution, then the District shall make

the contribution into the Plan during July of 2017. Plan contributions shall not exceed the

maximum allowed by law. If the District is not permitted by law to make the full

contribution in July of 2017, then the District shall pay the balance into the Plan on

behalf of the Superintendent in January of 2018.

The Superintendent shall have no right to receive any contributions in cash. All

payments and all provisions of the Plan shall be consistent with all requirements of law.

Plan contributions, once made, shall be vested.

Funds deposited into the Plan shall be invested only in investment vehicles that

are allowed by federal and state law. Following the deposit of funds, the Superintendent

shall direct the investment of the accounts. The District shall have no liability for any

investment decisions made by the Superintendent.

Plan contributions shall not exceed the maximum allowed by law. If the District is

not permitted by law to make the full contribution in July of 2017, then the District shall

pay the balance in January of 2018. Plan contributions, once made, shall be vested.

13. Goals and Objectives. The Board of Trustees shall meet with the Superintendent

to establish goals and objectives for each year of this Agreement. The agreed upon goals

and objectives shall be put in writing and shall be among the criteria by which the

Superintendent is evaluated. The Superintendent’s goals and objectives shall be

established not later than June 30th for the ensuing school year or at a time mutually

agreed upon by the Board and Superintendent.

14. Evaluation. The Board may formally evaluate, or discuss the performance of the

Superintendent, at any time and from time-to-time as deemed necessary by the Board but,

at least once per year, the Board shall formally evaluate the Superintendent. The Board

shall endeavor to complete its annual evaluation of the Superintendent on or before May

31st of each year.

After the Board's evaluation of the Superintendent is completed, the Board shall

communicate its evaluation to the Superintendent. If the evaluation rates the

Superintendent's performance as unsatisfactory or in need of improvement, the Board

may set specific goals including a reasonable time frame, deadlines and level of

performance expected for the Superintendent to satisfactorily meet those performance

goals. Failure to achieve the goals within the reasonable time frame, by the deadlines and

to the level of performance expected, shall be considered grounds for termination for

cause.

Evaluations shall be in writing on a form mutually agreed upon by the parties.

The evaluation form shall provide for a rating system such that the Board, individually or

collectively, may indicate whether the performance of the Superintendent is satisfactory

or higher, unsatisfactory, or is in need of improvement.

A copy of the final written evaluation shall be given to the Superintendent and a

copy of the evaluation shall be placed in the Superintendent's personnel file. Failure of

the Superintendent to sign the evaluation or goals shall have no legal effect upon the

Superintendent's continuing employment with the District or the Superintendent's duty to

implement the goals.

Each year, following completion of the evaluation process, the Board and the

Superintendent shall discuss whether the Superintendent’s compensation shall be

changed, whether the term of this Agreement should be extended, and whether any other

provision of this Agreement should be changed.

15. Termination of Agreement.

a. Mutual Consent. This Agreement may be terminated at any time by the

mutual consent of the Board and the Superintendent.

b. Nonrenewal of Agreement by the District. Notwithstanding any board

policy to the contrary, the Board may elect not to renew this Agreement for any reason by

providing written notice to the Superintendent in accordance with Education Code

section 35031 or other applicable provisions of law.

c. Termination for Disability. If, with or without reasonable

accommodation, the Superintendent is physically or mentally unable to effectively carry

out the essential duties of the position of Superintendent due to any physical or mental

disability established by a licensed physician or other appropriate professional designated

by the District and reported in writing by such licensed physician or other appropriate

professional ("the Physician's Report"), then this Agreement may be terminated by the

Board on six (6) months written notice or the Superintendent obtaining State Teachers

Retirement System ("STRS") disability benefits, whichever occurs first.

The Superintendent and the District shall each apply for and in good faith take all

appropriate steps to obtain STRS disability benefits for the Superintendent immediately

upon the Board's receipt of the Physician's Report.

During the pendency of the termination notice, the Superintendent shall exhaust

all accumulated sick leave, vacation entitlements and other paid leaves. Health and

welfare benefits shall remain available to the Superintendent until the Superintendent's

employment relationship with the District is terminated.

Any failure of the Superintendent to divulge the existence of a known physical or

mental disability that could diminish the effective performance of the Superintendent

shall be considered a fraudulent breach of this Agreement and grounds for termination for

cause.

d. Death. Death of the Superintendent terminates this Agreement

immediately. In such event, all salary and other monetary amounts due the

Superintendent up to the time of death, if any, shall be paid to the Superintendent's estate

unless otherwise declared in writing by the Superintendent. If the Superintendent

predeceases his spouse and his spouse is already covered by District health insurance

benefits at the time of the Superintendent’s death, the Superintendent’s spouse shall

continue to receive the same health benefits that she would have received had the

Superintendent lived, as those benefits may change from time-to-time, until the

Superintendent’s spouse dies, reaches age sixty-five (65), or obtains other health benefits,

whichever occurs first. If the Superintendent’s spouse subsequently obtains any other

source of health care coverage, she shall immediately notify the District and all District

provided contributions toward health benefits shall be immediately terminated.

e. Termination for Cause. The Superintendent's status as Superintendent and

all of the Superintendent's rights under this Agreement may be terminated by the Board at

any time for, but not limited to, breach of contract, any ground enumerated in the

Education Code, unsatisfactory performance, failure to perform the responsibilities set

forth in this Agreement, in the mutually agreed upon goals, or the job description, or any

violation of any law that puts the Superintendent's position, the District or its facilities,

personnel or students in jeopardy or danger. The Board shall not terminate this

Agreement for cause until a written statement of the grounds for termination has first

been served upon the Superintendent. The Superintendent shall then be entitled to a

conference with the Board at which time the Superintendent shall be given a reasonable

opportunity to address the Board's concerns. The Superintendent and the Board shall

each have the right to be represented by counsel at their own expense. The conference

with the Board shall be the Superintendent's exclusive right to any hearing otherwise

required by law.

f. Termination without Cause. Notwithstanding any other provision of this

Agreement, the Board may, at its sole discretion, without cause or hearing, terminate the

Superintendent by giving thirty (30) calendar days prior written notice. During this thirty

(30) calendar day period, the District shall communicate with the Superintendent about

the Superintendent’s employment and the parties shall discuss whether the

Superintendent’s employment relationship can be terminated by mutual agreement. In

consideration for the District’s exercise of its right to unilaterally terminate this

Agreement, the District shall pay to Superintendent, from the date of termination until the

expiration of this Agreement, or for a period of eighteen (18) months, whichever is less,

the Superintendent’s salary at the rate in effect during the Superintendent’s last month of

service.

For purposes of this Agreement, the term “salary” shall include only the

Superintendent’s regular monthly base salary and shall not include the value of any other

stipends, allowances, reimbursements, contributions, or any other benefits received under

this Agreement. All payments made pursuant to this termination without cause provision

shall be subject to applicable payroll deductions and shall be treated as compensation for

state and federal tax purposes. No payments made pursuant to this termination without

cause provision shall constitute creditable service or creditable compensation for

retirement purposes, but instead shall be considered as final settlement pay. Therefore,

no retirement contributions shall be paid based on any compensation paid pursuant to this

provision.

The Superintendent shall also be entitled to participate in the District’s health and

welfare benefit program and receive the same District contribution toward health

benefits, as the District’s benefit program and the District’s contribution may change

from time-to-time, for a period equal to the unexpired term of this Agreement, or

eighteen (18) months, whichever is less. Notwithstanding the foregoing, if at any time

during the preceding period, the Superintendent obtains other employment that entitles

the Superintendent to health benefits fully or partially paid by the Superintendent’s new

employer, the District shall no longer be obligated to provide the Superintendent with a

District contribution toward health benefits. The Superintendent shall immediately notify

the District, in writing, upon obtaining any subsequent employment providing health

benefits fully or partially paid by the Superintendent’s new employer. Failure to provide

such notice shall constitute a material breach of this Agreement.

The parties agree that any damages to the Superintendent that may result from the

Board’s early termination of this Agreement cannot be readily ascertained. Accordingly,

the parties agree that the payments made pursuant to this termination without cause

provision constitute reasonable liquidated damages for the Superintendent, fully

compensate the Superintendent for all torts, contract and other damages of any nature

whatsoever, and do not result in a penalty. The parties agree that the District’s

completion of its obligations under this provision constitutes the Superintendent’s sole

remedy to the fullest extent provided by law.

g. Termination for Inappropriate Fiscal Practices. Notwithstanding any other

provision of this Agreement to the contrary, if the Board believes, and subsequently

confirms through an independent audit, that the Superintendent has engaged in fraud,

misappropriation of funds, or other illegal fiscal practices, then the Board may terminate

the Superintendent and the Superintendent shall not be entitled to any salary payments,

health benefits or other non-cash benefits as set forth above. If the Superintendent elects

to contest the Board’s determination in this regard, the Superintendent may request a

hearing before an administrative law judge who shall determine the amount of the cash

settlement, if any, in accordance with the requirements of Government Code section

53260(b).

16. Physical Examination. The Superintendent shall be required to undergo a medical

examination at least once a year during the term of this Agreement or upon request by the

Board. The Board shall have the right to determine the scope of the examination as it

relates to the Superintendent’s ability to perform the essential functions of the position.

The examination may include evaluation for physical or mental disabilities that affect the

Superintendent’s job performance. The Superintendent agrees to cooperate with the

examination process, including the execution of requisite medical release forms and shall

promptly file an accurate copy of the examining physician's report with the Board of

Trustees, which the Board agrees shall remain confidential to the extent required by law.

All costs of this medical examination not covered by the Superintendent’s insurance shall

be paid by the District.

17. Early Termination/Transfer. The Board unilaterally and without cause may

terminate this Agreement and the Superintendent's status as Superintendent and reassign

the Superintendent to any available position which the Superintendent is credentialed to

perform by providing the Superintendent a minimum of thirty (30) calendar days notice

of termination and reassignment. If reassigned, the Superintendent may accept the

position to which the Superintendent has been reassigned, or the Superintendent may

resign his employment with the District and elect to receive the difference between the

Superintendent's then current monthly salary as Superintendent and the monthly salary

rate for the position to which the Superintendent has been reassigned, until the expiration

of this Agreement, or for a period of eighteen (18) months, whichever is less. If the

Superintendent elects to resign and receive the salary payments described above, the

Superintendent shall also be entitled to receive health benefits on the same terms and

conditions as set forth above.

18. Notification by Superintendent Prior to Seeking Other Employment. The

Superintendent shall notify each and every member of the Governing Board prior to

seeking any employment outside the District.

19. Notification of Absence. If the Superintendent plans to be absent from the

District for more than two (2) consecutive days, he shall notify the Board President and

shall indicate who has been assigned by the Superintendent to be in charge and

responsible during his absence. If the Board President is unavailable for direct

notification, then the Superintendent shall be responsible for notifying the responsible

person in the District office with instructions to personally bring the planned absence to

the attention of at least one member of the Board.

20. Annual Reporting Requirement. Prior to July 31st of each year, the

Superintendent shall report to the Board, in writing, the Superintendent’s use of sick

leave and vacation days in the prior fiscal year.

21. Professional Meetings. The Superintendent is expected to attend and effectively

participate in appropriate professional meetings at local, county, state and national levels.

Prior approval of the Board shall be obtained when the Superintendent plans to attend

state or national meetings. Expenses of attendance will be paid in advance by the District

or reimbursed in accordance with this Agreement.

22. General Expense Reimbursement. The District shall reimburse the

Superintendent for actual and necessary expenses incurred by the Superintendent within

the scope of his employment so long as such expenses are permitted by District policy or

incurred with prior approval of the Board and not otherwise paid by means of an

allowance. The District further agrees to pay membership dues for the Superintendent's

membership in Board-approved professional and community organizations. Each and

every month, for reimbursement, the Superintendent shall submit an itemized expense

claim to the Board in writing for the Superintendent's reimbursable expenses for the prior

month. The Superintendent's expense claim shall be supported by appropriate written

documentation, including but not limited to invoices, receipts, check copies and other

such supporting documents verifying the contents of the report prior to the Board's

authorization of reimbursement. Claims lacking sufficient, clear support may be subject

to denial of reimbursement or partial approval of reimbursement by the Board.

23. Abuse of Office Provisions. In accordance with Government Code sections

53243 et seq., and as a separate contractual obligation, if the Superintendent receives a

paid leave of absence or cash settlement and this Agreement is terminated for any reason,

such paid leave or cash settlement shall be fully reimbursed to the District by the

Superintendent if the Superintendent is convicted of a crime involving an abuse of office

or abuse of the position of Superintendent. In addition, if the District funds the criminal

defense of the Superintendent against charges involving abuse of office or position and

the Superintendent is then convicted of such charges, the Superintendent shall fully

reimburse the District all funds expended for the Superintendent’s criminal defense.

24. Tax/Retirement Liability. Notwithstanding any other provision of this

Agreement, the District shall not be liable for any retirement or state/federal tax

consequences to the Superintendent, any designated beneficiary, heirs, administrators,

executors, successors or assigns of the Superintendent. The Superintendent shall assume

sole responsibility and liability for all state and federal tax consequences of this

Agreement and all retirement consequences of this Agreement. The Superintendent

agrees to defend, indemnify and hold the District harmless from all such tax and

retirement consequences.

25. Mediation. The Superintendent and Board agree to make a good faith effort to

settle any dispute that arises under this Agreement through discussion and negotiations.

If the dispute is not resolved within thirty (30) calendar days, the dispute shall be

mediated unless the parties agree otherwise in writing. Both parties shall make a good

faith effort to select a mediator and complete the mediation process within sixty (60)

calendar days. If the parties cannot agree on a mediator, the mediator shall be appointed

by the State Conciliation and Mediation Service or other agreeable mediation service.

The mediator’s fee, if any, shall be paid by the District. Each party shall bear their own

attorney fees and costs. Any mediator selected by the parties shall have expertise in the

area of the dispute and be knowledgeable in the mediation process. No person shall serve

as mediator in any dispute in which that person has any financial or personal interest in

the outcome of the mediation. The mediator’s recommendation for settlement, if any,

shall not be binding on the parties. Mediation pursuant to this provision shall be private

and confidential. Only the parties and their representatives may attend any mediation

session. Other persons may attend only with the written permission of both parties. All

persons who attend any mediation session shall be bound by the confidentiality

requirements of California Evidence Code section 1115 et seq. and shall sign an

agreement to that effect.

26. General Provisions.

a. Governing Laws and Venue. This Agreement, and the rights and

obligations of the parties, shall be construed and enforced in accordance with the laws of

the State of California. The parties agree that, in the event of litigation, venue shall be

the appropriate state court in and for the County of Kings, State of California.

b. Severability. If any term or provision of the Agreement shall, to any

extent, be held by a court competent jurisdiction to be invalid, void, or unenforceable, the

remaining terms and provisions of this Agreement shall continue in effect.

c. Construction. This Agreement shall not be construed more strongly for or

against either party regardless of who is responsible for its preparation.

d. Entire Agreement. This Agreement, including the job description for the

Superintendent position, contains the entire agreement and understanding between the

parties. There are no oral understandings, terms or conditions and neither party has relied

upon any representation, express or implied, not contained in this Agreement. Further,

this Agreement shall supersede all prior oral or written employment contracts or

agreements between the parties executed prior to the date of this Agreement including,

but not limited to, the prior employment agreement dated June 28, 2011 and the prior

employment agreement dated June 10, 2008.

e. No Assignment. The Superintendent may not assign, delegate or transfer

any rights granted or obligations, duties or responsibilities assumed under this

Agreement.

f. Seniority. The Superintendent shall not be considered a school site

administrator for purposes of Education Code section 44956.5.

g. Amendments. This Agreement cannot be changed or supplemented orally.

It may be modified, amended or superseded only by a written legal instrument properly

executed by both parties.

h. Board Approval. The parties hereto agree that the effectiveness of this

Agreement is contingent upon approval by the District's Governing Board.

i. Binding Effect. This Agreement shall be for the benefit of and shall be

binding upon all the parties hereto and their respective successors and assigns.

j. Execution of Other Documents. All parties to this Agreement shall

cooperate fully in the execution of any other documents and in the completion of any

additional actions that may be necessary or appropriate to give full force and effect to the

terms of this Agreement.

k. Exclusivity. To the maximum extent permitted by law, the parties agree

that the employment relationship between the District and the Superintendent shall be

governed exclusively by the provisions of this Agreement and not by board policies,

administrative regulations, management handbooks or similar documents.

l. Management Hours. The parties recognize that the demands of the

position will require the Superintendent to average more than eight (8) hours a day, five

(5) days per week, and more than 40 hours per week. The parties agree that

Superintendent shall not be entitled to overtime compensation.

m. Board Approval. The effectiveness of this Agreement shall be contingent

upon approval by the District’s Board as required by law.

n. Independent Review. The parties have had the opportunity to obtain, and

have obtained, independent legal or other professional advice with regard to this

Agreement, including tax and retirement consequences. The parties acknowledge that the

terms of this Agreement have been read and fully explained and that those terms are fully

understood and voluntarily accepted.

o. Execution. This Agreement may be executed in one or more counterparts,

each of which shall be deemed an original, but all of which together shall constitute one

and the same instrument. Photographic copies of such signed counterparts may be used

in lieu of the originals for any purpose.

p. Public Record. The parties recognize that, once final, this Agreement is a

public record and shall be made available to the public upon request as required by law.

ACCEPTANCE OF OFFER

I accept the above offer of employment and the terms and conditions thereof and

will report for duty as directed above.

I have not entered into an Agreement of employment with the Governing Board

of another school district or any other employer that will in any way conflict with the

terms of this employment agreement.

I hereby certify under penalty of perjury under the laws of the State of California

that all statements contained in my application for employment and other documents I

submitted in connection with my application are true and complete. I understand that if

the District discovers false, incomplete, or misleading statements on my application or

any other documents I submitted in connection with my application or prospective

employment, such statements shall justify immediate dismissal for cause.
