I have said to Ryan that the thing about practicing family law is that she is catching most of us clients in some ofthe lousiest moments of our lives—not exactly seeing the best of any of us. And yet, she is always steady,evenhanded, and ready to smile. I’ve never seen her ruffled. I’ve managed to have lighthearted conversation withRyan even on the hardest days. We have known her for several years (sinceour retirement as university professors), primarily through club relatedactivities. Our interactions with her have been casual and recreational ratherthan formal, legal and/or commercial. On occasion we have discussedpolitical and economic issues affecting Montanans and American citizensgenerally. Our viewpoints are largely congruent.

We believe Ms. Phelan deserves serious consideration for appointment forseveral reasons, some obvious, and some perhaps not so obvious. Based onher credentials, she is unquestionably qualified in a complete professionalsense. Based on our her interactions with us and other members of ourcommunity, we are confident that she has an ideal judicial temperament.We’re also confident, given the demonstrated electoral preferences ofMontana County citizens, that she is electable.

Less obvious are two other facts. Given that approximately forty percent ofthe District Court caseload involves family law, and given Ms. Phelan’s legalpractice (including her work in court, with other attorneys, and with involvedfamilies), we believe that she would be a valuable addition to the FourthDistrict Court. We also believe that she is a member of a cohort that willbring a fresh generational perspective to the court.

I have witnessed these qualities in person for more than a decade. I first met Ryan in August of 2004 when I was hired as the receptionist for P. Mars Scott Law Offices where Ryan was an attorney with the firm. A year later, I was promoted to a paralegal; the position I retained for the next 9 years. At one point, I was even Ryan's paralegal. I have worked closely with Ryan on a variety of family law matters, including simple, collaborative divorces, parties with parenting issues, clients with sensitive needs, and cases that have been appealed to the Montana Supreme Court. We have worked long hours together, including evenings and weekends, with and without our respective children present, to prepare for cases and meet with clients. During this time, Ryan has always been extremely professional and portrayed a depth of legal knowledge and acumen. One occasion, in particular, comes time mind. I had filled in for doing the mail and running errands. When I finally got back to the office long after 5 o'clock, I overheard Ryan on the phone with a client. The client was in crisis about a parenting issue. While I finished my duties, Ryan remained on the phone with the client providing legal advice, professionalism, and a case-specific legal plan of action. When Ryan finished the call, the client was satisfied with her representation and never knew that Ryan had to rearrange her plans for the evening. Ryan has always been considerate and acted appropriately to everyone, no matter the position of the person, from runner to receptionist to senior attorney to colleagues in the community, as well as clients. She treats everyone fairly and kindly. I have witnessed this first hand during many client and colleague meetings, as well as at settlement conferences and court hearings, where Ryan either acted as second chair or took the lead or handled it directly herself. Settlement conferences require a lot of time and concentration before with preparation of settlement statements, during, and after preparing for entry of decree or trial. Not only that, they are stressful for clients. Ryan handled the stress of settlement conferences with aplomb. While at one particular settlement conference, the client was emotionally triggered by his spouse requesting certain personal

property that she knew he wanted. The client became upset and Ryan calmly asked the settlement master for time to discuss the offer with her client. After the settlement master left the room, Ryan discussed the legal and emotional pros and cons of the offer, various outcomes, and the client's ultimate goals. In the end, a settlement was reached to the client's satisfaction. This is just one of many professional interactions with Ryan, but we have also interacted on a friendly basis. When I first met Ryan, she had just started dating her now husband. I was at her wedding, subsequent baby showers, and personal parties. While I left the firm to move out of state almost 5 years ago, we have continued to grow our friendship. Through all of these personal changes in life, Ryan has continued to grow and develop and handle what life has given her with grace and professionalism. Ryan has also kept on track with her professional development. Ryan has a thirst for knowledge and developing her skills in all aspects of the legal field. She has spent many hours obtaining her CLEs and preparing for presentations that she is attending or presenting herself. She is also willing to share her knowledge, as well as being receptive to new ideas and differing opinions. There are too many qualities that Ryan possesses to be expounded in a simple letter of support. Ryan meets all of the minimum requirements for a district court judge, but, most importantly, Ryan exceeds these requirements. That is Ryan Alane Phelan. I am a certified Child Welfare Law Specialist (NACC) in private practice since 2015. My

firm specializes in foster parent representation, civil rights litigation, personal injury, and crime

victim representation. Formerly, I served as a substitute municipal court judge in Missoula City

Court 2015-2016, ran for Missoula County Justice of the Peace in 2014, and practiced as a

Deputy County Attorney from 2004-2015 after graduating from Montana Law.

Ms. Phelan possesses the qualifications Montana seeks in its judges. I have practiced

opposite Ms. Phelan professionally and known her as my next-door neighbor. She has an

incredible depth of knowledge in over 40% of all cases Montana’s judges see: family law. She

understands dispute resolution and working in the best interests of Montana’s children. She

possesses the balanced demeanor of judicial temperament required to resolve Montana cases.

Her experiences as a substitute Justice of the Peace have given her a solid foundation in

In particular, I would like to expound on the reasons why I feel the Court, as well as the Missoula and Mineral County communities, would benefit from the service of Ms Phelan in the capacity of district court judge. I have known Ms Phelan for approximately 12 years, having first met her when she and her husband, and my then fiancée and I, were participating in pre-nuptial courses at Saint Francis Xavier Catholic Church. She and her family have since become close family friends, and as such I feel qualified to state the qualities that make Ryan an excellent candidate. To begin with, I feel very comfortable commenting on Ryan's commitment to whatever endeavor she is challenged with. I know her to be one who pursues excellence in everything she applies herself to, whether it be her work, or to the responsibilities towards her family. "Diligence" is certainly a word I would use to describe her; she approaches her responsibilities with carefulness and with persistence. I feel it is her nature to not only complete a given task, but to complete it to the very best of her abilities. Ryan is also very committed to her community of Missoula. She was raised here, and as such understands what is meaningful to Missoulians. Despite her work responsibilities, she donates much of her spare time and energy to various community programs. Her daughter is involved in competitive gymnastics with my daughter at Mismo Gymnastics in Missoula, and I have seen how much time she volunteers there, not only for her daughter's benefit but for the benefit of the entire program. I know, too, that she is involved in the Missoula Children's Theater, as well as our church parish, Saint Francis Xavier Catholic Church. I truly feel that it is out of a desire to take part in community-building that Ryan chooses to dedicate so much of her spare time and energy into these programs. Lastly, in terms of Ryan's character and temperament, I know her to be intelligent, logical, compassionate, and level-headed. She always strikes me as composed, even in challenging circumstances. She always appears to be in control, regardless of what things may be taking place around her. In short, I feel Ryan has all of the qualities that make her ideally suited to serve as a District Court Judge. Her intelligence, diligence, commitment to community, and temperament all will serve her well in the capacity of District Court Judge.
