• In 2006 the Council took part in a national Cabinet Office pilot

• Strong history of social clauses• Member led Review of procurement• Engaged the Cumbrian Nuclear sector regarding

application of socio, economic and environmental clauses

• Following the Public Services (Social Value) Act 2012

- national desktop research

- producing a Social Value toolkit

- arranged local training events

• We are re-enforcing the need under Section 1(3) of the Act, where there is a duty to ‘consider’ (and therefore the Council must be able to demonstrate that such consideration has been given).

• Under Section 3(2) of the LGA 1988, there is a duty to ‘consult’ under Best Value.(Further related provisions are also highlighted under Section 17: the use of ‘non commercial matters’)

• The aforementioned also has links to the Localism Act 2011: …….the ‘Community right to challenge’.

• We must consider any expression of interest by a relevant body to run a service i.e. whether it would promote/improve the social, economic , environmental well-being of the area. ….there is a requirement for us to consider ‘promotion of well-being’.

• consider the application of social clauses, where ‘relevant… and proportionate’ to the contract. It must be linked to the subject matter. It must relate to a core requirement of the contract.

• Based on the Council’s top 100 suppliers by spend in 2012/13, 83% of spend was through Cumbrian Suppliers 

• A requirement of our Professional Services framework is for consultants to provide us with Socio-Economic Plans. 

• Social objectives delivered in 2012/13 include job creation, recruitment of a local apprentices and graduates & support local schools with 4 work experience students

• The Councils Highways Works Frameworks which were awarded in 2012, now monitor and capture data on carbon footprint, waste sent to landfill and reused/recycled waste on site as part of the KPI’s

• All CCC buildings now use green energy through our utilities contracts

Re-commissioning of our transport contracts – Social Value requirements considered…

• Use of social clauses and Qualitative scoring methods/robust contract management around vehicle base/route starts mileage. All vehicles are compliant with EURO iii Emissions limits or above. The contract will also require appropriate driver standards with qualifications of NVQ 2, BTEC or equivalent required.

Traffic Signals OJEU – Example Clauses used

• Please provide details of your company processes for proactively encouraging and employing labour and contractors, as well as for engaging with the supply chain, providing tangible examples of when you have done so. 

• Under this procurement the contractor is required to actively participate in the economic and social regeneration of the locality of and surrounding the place of delivery for the procurement. Accordingly contract performance conditions may relate in particular to social and environmental considerations.

Carlisle Office OJEU – Example Clause used

• Under this contract, the contractor and its supply chain will be required to actively participate in the achievement of social and/or environmental policy objectives relating to employment, training/skills and supply chain initiatives. Accordingly contract performance conditions will relate in particular to social and environmental considerations.

Northside Bridge – Example Clause used

• The Construction of the Northside Bridge has a significant profile at both a local and national level. The tender shall outline how they propose to manage the expectations of all stakeholders including how they propose to undertake stakeholder liaison and consultation. The tenderer shall identify specific actions and undertakings to ensure community benefits are delivered as part of the project. The tenderer shall also provide details of where they have used these proposals on previous schemes and the lessons learned and how these proposals will benefit this project

Highways Frameworks – Example clauses used

• The Contract will require the supplier to provide evidence that they have in place and actively manage formal training plans that promote access to apprenticeships work based learning and other training opportunities as appropriate and require the contractor to provide annual reports on the progress of its training plan. The Tenderer shall provide details of how it proposes to meet these requirements.

• Please outline all community benefits your organisation can offer the Council when providing this contract
