CONVENTION ON CONSENT TO MARRIAGE, MINIMUM AGE FOR MARRIAGE AND REGISTRATION OF MARRIAGES

Preamble

The Contracting States,

Desiring, in conformity with the Charter of the United Nations, to

promote universal respect for, and observance of, human rights and

fundamental freedoms for all, without distinction as to race, sex,

language or religion,

Recalling that article 16 of the Universal Declaration of Human Rights

states that:

"(I) Men and women of full age, without any limitation due to

race, nationality or religion, have the right to marry and to found

a family. They are entitled to equal rights as to marriage, during

marriage and at its dissolution.

"(2) Marriage shall be entered "into only with the free and full

consent of the intending spouses.",

Recalling further that the General Assembly of the United Nations

declared, by resolution 843 (IX) of 17 December 1954, that certain

customs, ancient laws and practices relating to marriage and the family

were inconsistent with the principles set forth in the Charter of the

United Nations and in the Universal Declaration of Human Rights,

Reaffirming that all States, including those which have or assume

responsibility for the administration of Non-Self-Governing and Trust

Territories until their achievement of independence, should take all

appropriate measures with a view to abolishing such customs, ancient laws

and practices by ensuring, inter alia, complete freedom in the choice of

a spouse, eliminating completely child marriages and the betrothal of

young girls before the age of puberty, establishing appropriate penalties

where necessary and establishing a civil or other register in which all

marriages will be recorded,

Hereby agree as hereinaf'ter provided:

Article 1

(1) No marriage shall be le~ entered into without the f'ul.l. and

free consent of both parties, such consent to be expressed by them in

person after due publicity and in the presence of the authority competent

to solemnize the marriage and of witnesses, as prescribed by law.

(2) Notwithstanding anything in paragraph 1 above, it shali not be

necessary for one of the parties to be present when the competent aut~ority

is satisfied that the circumstances are exceptional and that the party has,

before a competent authority and in such manner as ~ be prescribed by

law, expressed and not withdrawn consent.

Article 2

states parties to the present Convention shall take legislative action

to specif'y a minimum age for marriage. No marriage shall be le~ entered

into by arry person under this age 1 except where a competent authority has

granted a dispensation as to age, for serious reasons, in the interest of

the intending spouses.

Article 3

All marriages shall be registered in an appropriate official register

by the ccmpetent authority.

Article 4

(1) The present Convention shal1., unti~ }~ December ~96}, be open

for Signature on behalf of all States Members of the United Nations or

members of any of the specialized agencies, and of arry other State invited

by the General Assembly of the United Nations to became party to the

Convention.

(2) The present Convention is subject to ratification. The instruments

of ratification shall be deposited with the Secretary-General of the

United Nations.

Article 5

(1) The present Convention shall be open for accession to all States

referred to in article 4, paragraph 1-

(2) Accession shall be effected b.Y the deposit of an instrument of

accession with the Secretary-General of the United Nations.

Article 6

(1) The present Convention shall came into force on the ninetieth ~

following the date of deposit of the eighth instrument of ratification or

accession.

(2) For each State ratitying or acceding to the Convention after the

deposit of the eighth instrument of ratification or accession, the Convention

shall enter into force on the ninetieth ~ after deposit b.Y such State of

its instrument of ratification or accession.

Article 7

(1) Any Contracting State mB\Y' denounce the present Convention, b.Y written notification to the Secretary-General of the United Nations.

Denunciation shall take effect one year after the date of receipt of the

notification b.Y the Secretary-General.

(2) The present Convention shall cease to be in force as fran the

date when the denunciation which reduces the rmmber of parties to less than

eight becomes effective.

Article 8

Arry dispute which lD8\Y arise between any two or more Contracting

States concerning the interpretation or application of the present

Convention which is not settled by negotiation shall, a't the request

of all the parties to the dispute, be referred to the International.

Court of Justice for deCision, unless the parties agree to another

mode of settlement.

Article 9

The Secretary-General of the United Nations shall notify all States

Members of the United Nations and the non-member states contemplated in

article 41 paragraph 11 of the present Convention of the following:

(a) Signatures and instruments of ratification received in

accordance with article 4; (b) Instruments of accession received in accordance with

article 5;

(c) The date upon which the Convention enters into force in

accordance with article 6; (d) Notifications of denunciation received in accordance with

article 71 paragraph 1;

(e) Abrogation in accordance with article 7, paragraph 2.

Article 10

(1) The present Convention, of which the Chinese, English, French,

Russian and Spanish texts shall be equally authentic 1 shall be deposited

in the archives 01' the United Nations.

(2) The Secretary-General of the United Nations shall transmit a

certified cop,y of the Convention to all States Members 01' the United Nations

and to the non-member States contemplated in article 4, paragraph 1.

on behalf of their respective Govermnents, the present Convention which

was opened for signature at the He~arters of the United Nations, New York,

on the tenth da\Y' of December, one thousand nine hundred and sixty-two.

Preambule

Les Etats contractants,

Desirant, confonnement a la Charte des Nations Unies, favoriser Ie respect

universel et effectif des droits de l'hamme et des libertes fondamentales pour

tous, sans distinction de race, de sexe, de langue ou de religion,

Rgepelant que l'article 16 de la Declaration universelle des droits de

l'homme stipule que:

"1) A partir de liege nubile, l'homme et la femme, sans Bllcune

restriction quant a la race, la nationalite ou la religion, ont Ie droit

de se marier et de fonder une famille. lIs ont des droits egaux au regard

du mariage, durant Ie mariage et lors de sa disso:'ution,

"2) Le mariage ne peut etre conclu qui avec Ie libre et plein

consentement des futurs epoux." ,

R~pelant en outre que, dans sa resolution 843 (IX) du 17 decembre 1954,

l'Assemblee generale de l'Organisation des Nations Unies a declare que

certaines coutumes, anciennes lois et pratiques interessant Ie mariage et

la famille etaient incompatibles avec les principes enonces dans la Charte

des Nations Unies et la Declaration universelle des droits de l'homme,

Reaffinnant que tous les Etats, y compris ceux qui ont ou assument la

responsBbilite de l'administration de t~rritoires non autonames ou de

terri to ire s sous tutelle jusqu I a leur accession a. 11 independance, doi vent

prendre toutes les mesures utiles en vue d ' Bbolir ces coutumes, anciennes

lois et pratiques, en assurant notamment une enti€~re liberte dans Ie choix

du conjoint, en Bbolissant totalement Ie mariage des enfants et la pratique

des fian~ailles des jeunes filles avant liege nubile, en instituant, Ie cas

eche ant , lea. sanctions voulues et en creant un service de l'etat civil ou un

autre service qui enregistre tous les mariages,

Sont convenus des di~sitions suivantes :

Article premier

1) Aucun mariage ne pourra etre contracte legale:m.ent sans le libre et

plein consentement des deux parties, ce consentement devant etre exprbne

par elles en per sonne , en presence de l'autorite campetente pour celebrer

le mariage et de temoins, apre s une publici te suffis ante , conformement aux

dispositions de la loi.

2) Nonobstant les dispositions du paragraphe 1 ci-dessus, la presence

de l' une des parties ne sera pas exigee si 1 t autori te competente a la preuve

que les circonstances. sont exceptionnelles et que cette partie a expr~e son

consentement, devant une autorite campetente et dans les formes que peut

prescrire la 10i, et ne l'a pas retire.

Article 2

Les ~tats parties a la presente Convention prendront les mesures

legislatives necessaires pour specifier un age minbnum pour le mariage.

Ne pourront contracter legalement mariage les personnes qui n'auront pas

atteint cet age, a moins dtune dispense d'age accordee par l'autorite

campetente pour des motifs graves et dans l' interet des futurs epoux.

Article 3

Taus les mariages devront etre inscrits par l'autorite campetente sur

un registre officiel.

Article 4

1) La presente Convention sera ouverte, jusqu' au 31 decembre 1963, a la signature de tous les Etats Membres de l' Organisation des Nations Unies

ou membres de l'une quelconque des institutions specialisees et de tous

autres Etats que l'Assemblee generale de l'Organisation des Nations Unies

aura invites a devenir partie a la Convention.

2) La presente Convention est sujette a ratification et les instruments

de ratification seront deposes aupres du Secretaire general de l'Organisation

des Nations Unies.

Article 5

1) Tous les Etats vises au paragraphe 1 de I' article 4 pourront adherer

a la presente Convention.

2) L' adhesion se fera par le depOt d'un instrument d' adhesion aupres du . Secretaire general de l'Organisation des Nations Unies.

Article 6

1) La presente Convention entrera en vigueur Ie quatre-vingt-dixieme jour

qui suivra la date du depot du huitieme instrument de ratification ou d'adhesion.

2) Pour chacun des Etats qui ratifieront la Convention ou y adhereront

apres Ie depot du hUitieme instrument de ratification ou d'adhesion, la

Convention entrera en vigueur le quatre-vingt-dixieme jour qui suivra la date

du depot par cet Etat de son instrument de ratification ou d'adhesion.

Article 7

1) Tout Etat contract ant peut denoncer la presente Convention par

notification ecrite au Secretaire general de l'Organisation des Nations Unies.

La denonciation prend effet un an apres la date a laquelle Ie Secretaire general

en a requ notification.

2) La presente Convention cessera d'etre en vigueur a campter de la

date ou prendra effet la denonciation qui ramenera Ie nombre des parties a. moins de hui t.

Article 8

Tout differend entre deux ou plusieurs Etats contractants relatif a. 11 interpretation ou a. l' application de la presente Convention, qui nl ~a pas

ete regle par voie de negociations, sera soumis pour decision a la Cour

internationale de Justice a la demande de toutes les parties au differend,

sauf si lesdites parties sont convenues d'un autre mode de reglement.

Article 9

Seront notifies par 1e Secretaire general de l'Organisation des

Nations Unies a tous 1es Etats Membres de l'Organisation et aux Etats

non membres viseS' au paragraphe 1 de l' article 4 de 1a presente Convention:

a) Les signatures apposees et les instruments de ratification

re~us conformement a l'artic1e 4; b) Les instrumentsd'adhesion re~s conformement a l'article 5; c) La date a laquelle la Convention entrera en vigueur

conform6ment a l'article 6; d) Les notifications de denonciation reques confonnement aux

dispositions du paragraphe 1 de l'article 7; e) L'extinction resultant de l'app1ication du paragraphe 2 de

l'article 7.

Article 10

1) La presente Convention, dent 1es textes ang1ais, chinois,

espagno1, frangais et russe font egalement foi, sera deposee dans 1es

archives de l'Organisation des Nations Unies.

2) Le Secretaire general de l'Organisation des Nations Unies

cammuniquera une copie certifiee confonne de 1a Convention a tous 1es

Etats Membres de l'Organisation et aux Etats non membres vises au

paragraphe 1 de l'artic1e 4.

Pre&nbulo

Los Estados contratantes,

Deseando, de conformidad con la Carta de las Naciones Unidas, promover

el respeto y la observancia universales de lOB derechos humanos y las

11bertades fundamentales de todos, sin distinci6n de raza, sexo, idioma 0

religi6n,

Recordando que el articulo 16 de la Declaraci6n Universal de Derechos

Humanos dice que:

"1) Los hombres y las mujeres, a partir de la edad nubil,

tienen derecho, sin restricci6n alguna por motivos de raza, nacio­

nalidad 0 religi6n, a casarse y fundar una familia; y disfrutar'n

de iguales derechos en cuanto al matrimonio, durante el matrimonio

y en caso de disoluci6n del matrimonio.

"2) 8610 mediante libre y pleno consentimiento de los futuros

esposos podr~ contraerse e1. matrimonio.",

Recordando asimismo que 18 Asamblea General de las Naciones Unidas,

en su resoluci6n 843 (IX) de 17 de diciembre de 1.954 dec1.ar6 que ciertas

costumbres, antiguas leyes y pr'cticas referentes al matrimonio y a la

familia son incompatibles con los principios enunciados en la Carta de

1.as Naciones Unidas y en la Dec1.araci6n Universal de Derechos Humanos,

Reafirmando que todos los Estados, incluso los que hubieren contraido

o pudieren con traer la obligaci6n de administrar territorios no a~t6nomos

o en fideicomiso hasta el momento en que 'stos alcancen 18 independencia,

deben adoptar todas las disposiciones adecuadas con objeto de abolir dichas

costumbres, antiguas leyes y pr~cticas, entre otras cosas, asegurando la

libertad cornpleta en la elecci6n de c6nyuge, aboliendo totalmente el matri­

monio de los ninos y la pr~ctica de los esponsales de las j6venes antes

de la edad nubil, estableciendo con tal fin las penas que fueren del caso

y creando un registro civil 0 de otra clase para la inscripci6n de todos

los matrimonios,

Convienen p~r la presente en las disposiciones siguientes:

Art!cul.o 1

1) No podr' contraerse legalmente matrimonIo sin el pleno y libre

consent1m1ento de ambos contrayentes, expresado por ~stos en persona,

despu~s de la deb ida publicidad, ante la autoridad competente para forma­

lizar el matrimonio y testigos, de acuerdo con la ley.

2) Sin perjuicio de 10 dispuesto en e1 p~rafo 1 supra, no ser~

necesarI0 que una de las partes este presente cuando la autoridad competente

este convencida de que las circunstancias son excepcionales y de que tal

parte, ante una autoridad competente y del modo prescrito por la ley, ha

expresado su consentimiento, sin haberlo retirado posteriormente.

Art!cul.o 2

. Los Estados parte en la presente ConvencI6n adoptar~ las medidas

legislativas necesarias para determinar la edad minima para contraer

matrimonio. No podr'n contraer legalmente matrimonio las personas que

no hayan cumplido esa edad, salvo que la autoridad competente, por causas

justificadas y en interes de los contrayentes, dispense el requisito de

la edad.

Articul.o :;

Todo matrimonio deber~ ser inscrito por la autoridad competente en

un registro oficlal destlnado al efecto.

Articulo 4

1) La presente Convenci6n quedar~ abierta, hast a e1 31 de diciembre

de 1963, a la firma de todos los Estados Miembros de las Naciones Unidas 0

miembros de cualquiera de los organ1smos espec1al1zados, y de todo otro

Estado que haya sido 1nvitado por la Asamblea General de las Naciones Unidas

a participar en la Convenci6n.

2) La presente Convenci6n estar~ sujeta a ratIflcaci6n y los instru­

mentos de rat1ficaci6n ser~ depositados en poder del Secretario General de

las Naciones Un1das.

Articulo 5

1) Todos los Estados a que se ref1ere el p~rafo 1 del articulo 4 podr'n adherirse a La presente Convenci6n.

2) La adhesi6n se efectuar' depos1tando un 1nstrumento de adhesi6n

en poder del Secretario General de las Naciones Unidas.

Articulo 6

1) La presente Convenci6n entrar' en vigor noventa dias despu~s de

la fecha en que se haya depositado el octavo instrumento de ratificaci6n

o de adhes16n.

2) Para cada uno de los Estados que rat1fiquen la Convenci6n 0 se

adhieran a ella despu~s de depos1tado el octavo instrumento de ratificaci6n

o de adhes16n, la Convenci6n entrar' en vigor noventa dias despu~s de la

fecha en que ese Estado h~a depos1tado el respect1vo 1nstrumento de rati­

ficaci6n 0 de adhesi6n.

Articulo 7

1) Todo Estado contratante podr' denunciar la presente Convenci6n

mediante notif1caci6n por escrito d1rigida al Secretario General de las

Nac10nes Un1das. La denuncia surtir' efecto un ano despues de la fecha

en que el Secretario General h~a recibido la notif1caci6n.

2) La presente Convenci6n dejar' de estar en vigor a partir de la

fecha en que surta efecto la denuncia que reduzca a menos de ocho el nUmero

de los Estados partes.

Articulo 8

Toda cuesti6n que surja entre dos 0 ~s Estados contratantes sobre

la 1nterpretaci6n 0 la aplicaci6n de la presente Convenc16n, que no sea

resuelta por med10 de negociaciones, ser' somet1da a la Corte Internac10nal

de Just1cia, para que la resuelva, a petici6n de todas las partes en conflicto,

salvo que las partes interesadas convengan en otro modo de solucionarla.

Articulo 9

El Secretario General de las Naciones Unidas notificar' a todos los

Estados Mlembros de las Naciones Unidas y a los Estados no miembros a que

se refiere el p~rafo 1 del articulo 4 de la presente Convenc16n:

a) Las firmas y los 1nstrumentos de rat1ficaci6n rec1bidos en virtud

del articulo 4; b) Los 1nstrumentos de adhesi6n recib1dos en virtud del articulo 5; c) La fecha en que entre en vigor la Convenci6n en virtud del

articulo 6; d) Las not1ficac10nes de denunc1a rec1bidas en virtud del p4rrafo 1

del articulo 7; e) La extinci6n resultante de 10 previsto en el p~rafo 2 del

articulo 7.

Articulo 10

1) La presente Convenci6n, cuyos textos chino, espanol, franc~s,

ingl.~s y ruso hacen fe por igual, quedar' depos1tada en los archivos de

las Naciones Unidas.

2) El Secretario General de las Naciones Unidas enviar' copia certi­

ficada de la Convenci6n a todos los Estados Miembros de las Naciones Unidas

y a los Estados no m1embros a que se refiere el p~rafo 1 del articulo 4.

EN FE DE LO CUAL, los ini'rascr1tos, debidamente autorizados, han

firmado por cuenta de sus respect1vos Gob1ernos el presente Convenio,

el cual ha sido abierto a la f1rma en la Sede de las Nac10nes Un1das en

Nueva York el d~c1mo dia de diciembre de mil novec1entos sesenta y dos.
