1. Settlement Agreements a. In the Matter of the Contractors Licenses of Hilbers, Inc. and Kurt G.

Respondent Hilbers, Inc. and Kurt G. Hilbers (“Hilbers”) are licensed as General building contractors. Respondent’s licenses were issued on December 16, 2010; and will expire or forfeit on or about September 30, 2018. At all relevant times herein, Hilbers was the RME for Hilbers, Inc. RICO received a complaint alleging that Hilbers was not in residence in the State of Hawaii during the time period in which Hilbers, Inc. was working on a project to construct a UFC gym in the Mililani Town Center, Mililani, Hawaii. If proven at an administrative hearing, the allegations would constitute violations of the following rules:

HAR section 16-77-71(a)(4) (RME shall be in residence in Hawaii during the period a project is under construction); and

HAR section 16-77-71(a)(5) (RME shall be held responsible for any violation of HAR).

Respondents do not admit to violating any law or rule, and agree to pay an administrative fine in the amount of $20,000.00. After discussion, it was moved by Mr. Lee, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

b. In the Matter of the Contractors’ Licenses of Collins Construction, Inc.;

Corey J. Collins; CLB 2012-119-L

Respondent Collins Construction, Inc. (“Respondent CCI”) and Respondent Corey J. Collins (“Respondent Collins”) are licensed as General engineering and General building contractors. Respondent CCI’s license was issued on or about September 2, 2009; and was forfeited due to loss of insurance on or about September 28, 2014. Respondent Collins’ license was issued on or about April 8, 1999; and was forfeited due to loss of employer on or about September 28, 2014. From September 2, 2009 to September 28, 2014, Respondent Collins was the RME of Respondent CCI. RICO received a complaint alleging that Respondent exhibited poor workmanship in the construction of a residence in Wailuku, Hawaii. After RICO received the complaint, Respondents ceased business. If proven at an administrative hearing, the allegations would constitute violations of the following rule:

HAR section 16-77-97 (poor workmanship). Respondents do not admit to violating any law or rule, and agree to the voluntary surrender of Respondents’ licenses.

c. In the Matter of the Contractor’s License of Joseph M. Medeiros, dba

Tropical Innovations; CLB 2010-246-L

Respondent Joseph M. Medeiros doing business as Tropical Innovations (“Respondent”) is licensed as a C-27 Landscaping contractor. Respondent’s license was issued on or about March 11, 2003; and will expire or forfeit on or about September 30, 2016. On or about August 24, 2016, RICO filed a Petition for Disciplinary Action alleging that Respondent violated in part, the following statute(s) and/or rule(s): HRS sections 436B-17(6) (violating licensing laws) and444-25.5 (failure to provide bond and lien rights); and HAR section 16-77-80 (written contract with homeowner required; disclosures). In the Petition, RICO alleges that Respondent failed to include the requisite contractual provisions, including but not limited to bond and lien rights, in Respondent’s contract with Christopher Salem. Respondent does not admit to violating any law or rule, and agrees to pay an administrative fine in the amount of $500.00. The Board noted for the record that HRS section 436B-19(17) pertains to violating licensing laws, not 436B-17(6). After discussion, it was moved by Mr. Konishi, seconded by Mr. Lee, and unanimously carried to approve the Settlement Agreement After Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

d. In the Matter of the Contractors’ Licenses of E & H Construction Co., Inc., and Esfandiar Amirhekmat; CLB 2016-334-L

Respondent E & H Construction Co., Inc. (“E & H”) and Respondent Esfandiar Amirhekmat (“Amirhekmat”) are licensed as General building contractors. Respondent’s licenses were issued on or about June 2, 2009; and will expire or forfeit on or about September 30, 2018. At all relevant times herein, Amirhekmat was the RME for E & H. RICO received a complaint alleging that Amirhekmat was not in residence in the State of Hawaii during the period in which E& H was working on a project in the International Marketplace in Waikiki, Hawaii but was instead present in the state only during portions of the project. If proven at an administrative hearing, the allegations would constitute violations of the following rules:

Respondents do not admit to violating any law or rule, and agree to pay an administrative fine in the amount of $15,000.00. The Board noted a typographical error in the spelling of Respondent’s name which should be “Amirhekmat” in paragraph A.5. on page 2. After discussion, it was moved by Mr. Lee, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

e. In the Matter of the Contractor’s License of David C.P. Chan, doing

business as Fellows Construction; CLB 2013-446-L & CLB 2015-108-L

Respondent David C.P. Chan, doing business as Fellows Construction (“Respondent”) is licensed as a General building contractor. Respondent’s license was issued on or about April 21, 1997; and will expire or forfeit on or about September 30, 2018. RICO received a complaint alleging that Respondent exhibited poor workmanship in repair of ponding on a roof and application of white coating on the roof. Respondent alleges that he explained that the ponding could not be fixed. RICO received another complaint that Respondent failed to complete construction of the abandoned construction from a prior owner and contractor. Respondent alleges that he did not return to the project because the homeowners were withholding payment. RICO alleges that Respondent did not have a complete written contract prior to starting work on either project. If proven at an administrative hearing, the allegations would constitute violations of the following law and rule:

HRS section 444-25.5 (disclosures required in written homeowner contracts to be executed prior to start of work); and

HAR section 16-77-80 (disclosures required in homeowner contracts).

Respondent does not admit to violating any law or rule, and agrees to pay an administrative fine in the amount of $5,000.00. After discussion, it was moved by Mr. Isemoto, seconded by Mr. Lee, and unanimously carried to approve the Settlement Agreement Prior to

f. In the Matter of the Contractors Licenses of Mainland-Pacific Ltd., and

Michael K. Coates; CLB 2013-109-L

Respondent Mainland-Pacific Ltd. and Respondent Michael K. Coates are licensed as General building contractors. Respondent’s licenses were issued on or about September 4, 2008; and will expire or forfeit on or about September 30, 2016. At all relevant times herein, Respondent Coates was the RME for Respondent Mainland-Pacific Ltd. RICO alleges that on or about September 15, 2010, Respondents entered into a construction contract with the homeowner and Respondents failed to provide the oral and written disclosures required by the Board’s laws and rules. If proven at an administrative hearing, the allegations would constitute violations of the following law and rules:

HRS section 444-25.5 (failure to make oral and written disclosures);

HAR section 16-77-79 and 16-77-80 (failure to make required disclosures).

Respondents admit to the veracity of the allegations and agree to pay an administrative fine in the amount of $2,500.00. After discussion, it was moved by Mr. Lee, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

g. In the Matter of the Contractors’ Licenses of TRG Construction LLC, and

Timothy R. Guthrie; CLB 2016-343-L

Respondent TRG Construction LLC (“TRG”) and Respondent Timothy G. Guthrie (“Guthrie”) are licensed as General building contractors. Respondent’s licenses were issued on or about August 6, 2009; and will expire or forfeit on or about September 30, 2018. At all relevant times herein, Guthrie was the ME for TRG. RICO alleges that in or around April of 2016, Respondents entered into a contract to provide contracting services for an unlicensed business entity performing renovation work at the Maile Sky Court Hotel located in Honolulu, Hawaii. Respondents agreed to obtain building permits for the work and call for inspections of the work by the City and County of Honolulu, Department of Planning and Permitting.

Respondents are alleged to have entered into a contract with an unlicensed person to perform work that required a license and/or aided and abetted an unlicensed person to evade the requirements of HRS chapter 444. If proven at an administrative hearing, the allegations would constitute violations of the following laws:

HRS section 444-9.3 (Aiding or abetting an unlicensed person to evade HRS chapter 444); and/or

HRS section 444-17(17) (Entering into a contract with an unlicensed contractor involving work or activity for the performance of which licensing is required under chapter 444).

Respondents do not admit to violating any law or rule, and agree to pay an administrative fine in the amount of $25,000.00. The Board noted for the record that Respondent Guthrie’s middle initial should be “R” in the opening paragraph on page 1. After discussion, it was moved by Mr. Konishi, seconded by Mr. Isemoto, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Orders None. Following the Board’s review, deliberation and decisions in these matters,

pursuant to HRS chapter 91, Chairperson Polischeck announced that the Board was reconvening to its open meeting at 8:38 a.m.

Executive Session: At 8:39 a.m., it was moved by Mr. Kagawa, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(4) to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

Mr. Kamai arrived at 8:53 a.m. At 9:10 a.m., it was moved by Mr. Konishi, seconded by Mr. Kagawa, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Regulated Industries Complaints Office – Requests a determination on whether the definition of “homeowner” in Hawaii Revised Statutes section 444-25.5(c), includes an entity, such as a corporation or LLC, which owns the residential property (rental property).

Affordable Home AC – Requests a determination on whether a contractor’s license is required to install window air conditioning units; and requests a confirmation that Hawaii Revised Statutes section 444-2(4) (“handyman exemption”) only applies to work that requires a contractor’s license.

Daryl Hansen – Requests a determination on whether a C-60 Solar power systems contractor may (1) subcontract to a C-61 Solar energy systems contractor to install solar thermal hot water systems; and (2) subcontract a C-52 Ventilating and air conditioning contractor to install photovoltaic air conditioning systems.

Also requests a determination on whether a C-52 Ventilating and air conditioning contractor would be required to subcontract to a C-60 Solar power systems contractor to install photovoltaic air conditioning systems; and whether either a C-52 Ventilating and air conditioning contractor or a C-60 Solar power systems contractor may install photovoltaic air conditioning systems. City and County of Honolulu, Department of Budget and Fiscal Services, Purchasing Division – Requests a determination on whether Sculpted Shotcrete Finish work is “incidental and supplemental” to rockfall mitigation work performed by a C-68 RL Rockfall mitigation contractor.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(4) to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

Regulated Industries Complaints Office – Requests a determination on whether the definition of “homeowner” in Hawaii Revised Statutes section 444-25.5(c), includes an entity, such as a corporation or LLC, which owns the residential property (rental property).

Recommendation: The definition of “homeowner” in HRS section 444-25.5(c) is not limited to individuals, and includes a business entity (e.g., a corporation or LLC) which owns the residential property (rental property).

Affordable Home AC – Requests a determination on whether a contractor’s license is required to install window air conditioning units; and requests a confirmation that Hawaii Revised Statutes section 444-2(4) (“handyman exemption”) only applies to work that requires a contractor’s license.

Recommendation: A contractor’s license is not required to install window air conditioning units; provided that there is an existing window opening (i.e., the person is not constructing an opening to house the air conditioning unit), and there is no electrical hard wiring required for the installation. The Board also confirmed that HRS section 444-2(4) (i.e., the “handyman exemption”) only applies to work that requires a contractor’s license. Daryl Hansen – Requests a determination on whether a C-60 Solar power systems contractor may (1) subcontract to a C-61 Solar energy systems contractor to install solar thermal hot water systems; and (2) subcontract a C-52 Ventilating and air conditioning contractor to install photovoltaic air conditioning systems. Also requests a determination on whether a C-52 Ventilating and air conditioning contractor would be required to subcontract to a C-60 Solar power systems contractor to install photovoltaic air conditioning systems; and whether either a C-52 Ventilating and air conditioning contractor or a C-60 Solar power systems contractor may install photovoltaic air conditioning systems. Recommendation: Defer this matter pending a clarification of the inquiry and the submittal of additional information on the s of systems involved

City and County of Honolulu, Department of Budget and Fiscal Services, Purchasing Division – Requests a determination on whether Sculpted Shotcrete Finish work is “incidental and supplemental” to rockfall mitigation work performed by a C-68 RL Rockfall mitigation contractor.

Recommendation: Defer this matter for additional information on the work that is being performed; specifically the Board requests a detailed description of the project and the cost and extent of the Sculpted Shotcrete Finish work in relation to the total cost or extent of the entire project.

It was moved by Mr. Lee, seconded by Mr. Kagawa, and unanimously carried to approve the above scope recommendations.

At 9:41 a.m., it was moved by Mr. Lee, seconded by Mr. Kagawa, and unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

approve Mr. Jong S. Lee’s application for licensure in the “B” General building classification.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:52 a.m., it was moved by Mr. Lee, seconded by Mr. Mochida, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

It was moved by Mr. Mochida, seconded by Mr. Isemoto, and unanimously carried to defer Mr. Silva’s application for licensure in the C-5a Garage door and window shutters, and C-48a Steel door classifications pending the submittal of revised project lists verifying four years of supervisory experience in each classification. g.
