PART II: Mandatory for Contractors and Contract Holders

1. Introduction1.1 Purpose

PR-1171 Part II, referenced in document GU-140, C-09 HSE Requirements, is a key document designed to assist and enable Contractors, together with assistance from Company Contract Holders, to carry out PDO prescribed HSE activities in the manner and at the level required by PDO. Of particular importance is the detail given for the preparation of the Contractor’s, Contract Specific HSE Management Plan section 2.6.

It is mandatory that in any contract the HSE requirements of PR-1171 Part II are fulfilled by both Contractors and PDO Contract Holders. This entire part of PR-1171 Part II shall be given to Contractors to enable them to carry out the requirements detailed below, in addition to all other contractual requirements.

1.2 Distribution/Target AudienceThis Procedure is a mandatory requirement for Contractors and where applicable Contract Holders. However, Contract Holders must refer to PR1171 Part I.

This Procedure contains HSE instructions for Contractors. It is the obligation of Contract Holders to ensure that Part II is supplied to Contractors and that the instructions in it are followed.

Distribution of this document is controlled by the Document Custodian.

2. Contract HSE Management Procedure2.1 Scope

This Procedure applies to all contracts tendered by PDO regardless of size and value.

Throughout this document, “shall” means that an activity or requirement is mandatory. All mandatory actions and requirements are underlined.

2.2 DefinitionContractors and Contract Holders shall adhere to PR-1171 Part II in the preparation and use of documents to meet the HSE requirements of both the Tender documentation and the Post-Award HSE management requirements of a Contract. Other mandatory contractual requirements not given in this document remain obligatory on both Contractors and Contract Holders.

2.3 Deliverables2.3.1 Records

Records shall be maintained to document the implementation of this Procedure. A company Activity checklist is available in the PR1171 Part I. Other information is available in the web site stated below:

Contractor(s) shall provide the following deliverables, as stated in Contract Document C-09 HSE Requirements.

1. Contract HSE Management Plan, (refer to paragraph 2.6.2) A Draft HSE plan that details the way the company will manage HSE throughout the length of the contract.

2. As part of Tender submittal, and as part of the HSE Plan, Contractor(s) shall perform a Hazards and Effects Management Process (HEMP). The HEMP shall be used to detail how the Contractor will manage the HSE issues in the contract and the resources that will be allocated for control. Both the HEMP and the detailed information on proposed HSE management will be included in document C-09 HSE Requirements. Section 2.6 of this document provides further detail on the necessary information for Tender submission.

3. Appointment of HSE Key Personnel, including HSE Advisers (refer to paragraph 2.7.3)

4. Any further documentation required by the Contract Holder

PDO staff: Any non-compliance with PR-1171 Part II shall be notified, investigated and reported as per document CP-122, HSE Management System Manual.

Contractors: Any non-compliance with PR-1171 Part II shall be reported to the Contract Holder.

2.4 ResponsibilitiesContract Holders shall ensure that Contractors have copy of PR-1171 Part II, further ensuring that the requirements of PR-1171 Part II are adhered to within the scope of a Contract. In the event that circumstances prevent compliance with PR-1171 Part II, Contract Holders shall seek step-out approval (CP-122, HSE Management System Manual).

Contractor(s) shall be responsible for ensuring that activities undertaken within the scope of their contracts are managed in accordance with the requirements of PR-1171 Part II, and all other Contract documentation.

2.5 Performance RequirementsContractor(s) shall be responsible for managing all HSE aspects of the Work and/or Services.

Contractor(s) shall satisfy the HSE requirements of PR-1171 Part II as well as all other obligations arising from the documentation and the execution of a contract.

No contract specific activities on PDO concession area or at Site may be commenced until PDO has issued an HSE Commencement Certificate (refer Appendix 1). In the event Contract Holder permits mobilsation activities, the activity should be covered by a Commencement Certificate stating the scope of permitted work. Once the Contract Holder is satisfied that all the pre-commencement steps are complete then a Commencement Certificate for the whole scope will be issued. In the event that there is a significant change in the activity e.g. new Sub Contractor, it is advisable for the Contract Holder to direct the start of the

new scope under the checks of a Commencement Certificate for that discreet part. In this way the measure of HSE is formally monitored.

2.6 Contractor’s HSE Management Plan2.6.1 Preamble  

This entire Section 2.6 of PR-1171 Part II provides basic assistance to Contractors in the development and application of HSE Management Plans. The Contract HSE Management Plan is a mandatory document and shall be specific to each individual contract; it shall reflect the nature of the work to be performed and the specific hazards presented by the work. 

Contract Holders shall use this information when evaluating the adequacy of a Contractor’s HSE Management Plan. 

As part of the tendering process, each Contractor is obliged to conduct a Hazards and Effects Management Process (HEMP) which is used to develop the information required for document C-09 HSE Requirements: 

Contractor(s) shall detail all HSE issues discovered, including those advised by PDO in C-09, and detail how these risks will be controlled, mitigated and managed.   Details provided shall fully describe the manpower, equipment and broad details of the Contractor’s HSE policies, procedures and specifications that will be applied to the management of HSE risk for the Contract.  The Contractor will fully describe the manpower that will be applied to the HSE management of the Contract, including names, qualifications and experience.  Copies of each individual’s CV will be included in the Tender documentation for C-09. 

Contractor(s) shall, following the contract award, kick-off meeting and subsequent on-site HSE workshop, revise the HEMP as necessary to develop the HSE Management Plan, following the information in the rest of document.  

Contractor(s) shall clearly indicate the policy, procedures and standards to be adopted during each phase of the Contract. 

Contractor(s) shall cover all Contract Phases from mobilization through execution, demobilization and site restoration.

2.6.2 Contract-Specific HSE Management Plan

Contractor(s) shall, following the Contract Award, kick-off Meeting and on site HSE Workshop, revise its original HEMP and from that develop the Contract-Specific HSE Management Plan. 

Contractor(s) shall describe how the HSE Management Plan will apply its established, generic programs to manage its activities in the specific contract.

Contractor(s) shall identify the contract-specific work activities it will perform and the anticipated HSE hazards associated with the work. 

Contractor(s) shall clearly describe its plan (controls) for minimizing the potential effects of these anticipated hazards.  The plan shall identify specific deliverables, targets, performance measures, monitoring programs, etc.  When possible, responsibilities should be clearly assigned and completion dates specified.

Contractor(s) shall submit the completed HSE Management Plan to the Contract Holder for approval. 

The approved HSE Management Plan shall become part of the contract documents. Contractor(s) shall obtain formal approval from the Contract Holder for any proposed deviations from or amendments to its HSE Management Plan. 

The HSE Management Plan should contain only measurable, quantifiable, contract-specific actions that will be taken during the life of the contract.

The following outline is suggested and will be used as the template on which Contract Holders will review the content of the Contractor HSE Management Plan:2.6.3 Leadership and Commitment

Provide a list of Contractor senior management and describe their typical participation in HSE activities related to contracts (meetings, inspections, audits, etc.).

The Contractor, as part of the plan (suggest Appendix) must submit an organisation chart that clearly details the actual Contractor organisation from the top management to the site staff. The orgainsation chart must clearly identify the HSE personnel and identify the Key personnel, as stated in the contract, as well as identify the Level 1 and Level 2 HSE critical staff. The wirtten detail of HSE roles and responsibilities must then match the organisation chart. It is important that the Contractor ensures that all organisation staff are identifitied and listed in the HSE Roles and Responsibilities section of the written part of the document.

Contractor is to submit at the, end of the section, a table to detail who in the senior oganisation, when and where HSE management activities will be supported by senior management . The HSE plan will then generate an agreed monitoring plan with the Contract Holder as well as an annual calendar of HSE activities. The elements of the leadsership may be combined win the section 2.6.5 below.

2.6.4 Policy and Strategic ObjectivesProvide a written copy of the HSE Policy.  The Contractor’s HSE Policy shall be produced in an easy to read format in the working languages of staff and the workforce, endorsed and dated by the Contractor’s senior executive, and communicated to all employees and other relevant parties.

The policy should be reviewed annually to reflect any changes. The review should be recorded as part of the Contractor HSE quality system e.g. HSE Manager with CEO

2.6.5 Organization, Responsibilities, Resources, Standards and Documents

 The HSE Plan must identifity the HSE staff. It must detail the numbers of HSE staff (advisors), their positions in the organisation and their locations stated in the C4 Scope of Work.

Contractor to develop the monitoring plan, ideally with the Contract Holder. The company as well as the contractor will have specific inspections and audits planned

and it is prudent to align the plans to avoid duplication of effort. Nonetheless, it is incumbent on the Contractor to ensure tha measures stated in the HSE plan or indeed the HEMP are identified to be managed in the monitoring programme.

Contractor must be specific in the plan to detail HOW HSE activities will be organised. As an example if they are to hold ‘Gate’ meetings instead of, or as well as Tool Box meetings this should be explained. Company prefers Craft group meetings e.g. welders as this ensures smaller groups and more interaction with the workers.

The contractor must provide a sample of the agenda sheets designed to be used in particualry site meetings.

Contractor(s) shall:

Prepare a contract-specific organization chart showing personnel responsible for the implementation of HSE objectives.   

Provide the number of HSE Advisers to be employed on the Contract, describe their roles, responsibilities and deployment see section 2.7.3.  

Provide CVs for contract HSE Advisers. 

Describe a typical schedule for contract specific HSE meetings to review and communicate HSE issues to all levels of the contract-specific organization and between PDO, the Contractor and Subcontractors, including (as appropriate):

     PDO/Contractor HSE meetings (refer HSE Monitoring Program, Appendix 2);

     Contractor/Subcontractor HSE meetings;

     Craft specific HSE meetings; Preferred

     Toolbox meetings

Provide typical Terms of Reference for contract specific HSE meetings. 

Provide a statement indicating the typical involvement of HSE support functions within the Contractor organization (if applicable) in:

     preparing and monitoring departmental action plans;

The Contractor must record a sample Action Tracking Register to be approved by the Contract Holder.

     formulating HSE rules;

     Inspections and audits;

The Contractor must submit a record of the intended inspections and audits. Inspections must be detailed to cover all the aspects of the activities for example

workshops. Audits must be specified to include significant risks identified in the HEMP process. An example of this would be an audit of PR1708 and 1709 Mechanical Lifting.

     

developing promotional material;

The Contractor must state what HSE promotional material it will adopt to promote HSE in the organisation. Although the Company may provide some materials it is expected that the Contractor will drive the HSE aspects of this.

     Training;

The Contractor must submit a training programme in line with the contract requirements of C-09 and the SP1157 required training. It must include additional details of any in house training which supports the competence of any staff included in the contract organisation. See also Appendix 3

     Road Safety

The Contractor must submit Details of how they will manage the requirements of SP2000 and SP2001. Detail e.g. how will commuting be managed to assure, as far as reasonably practicable, that employees will not use private transport. Detail e.g. who in the orgnisation is competent to ensure that any loads being transported to site is secure and meets the SP2001 criteria?

Sub-contractor assessment;

The Contractor must submit a sample of the Sub Contractor HSE assessment process sheets that will be used and recorded as part of the HSE plan for the specific contract. The details of this should be available in the contract submission (T3) and Company may refer to this during audit to ensure what was committed is actually applied. Suggest that this forms a part of an appendix to support the statement on managing sub contractors.

     Health risk assessment, performance monitoring and surveillance;

The Contractor must detail how it will manage Health through the length of the contract. Company will refer to the Control Measures stated in the HEMP process and submitted as part of the HSE plan. It is expected that Contractor will detail all HRA documents as part of the HEMP controls and as appropriate to the activities. Company will apply strictly the requirements of C09 and therefore Contract must have at least knowledge of the requirements e.g., SP1230 Fitness to Work.

     Environmental monitoring;

The Contractor must detail how it will manage Environmental issues through the length of the contract. Company will refer to the Control Measures stated in the HEMP process and submitted as part of the HSE plan. It is expected that Contractor will detail all Environmental documents as part of the HEMP controls and as

appropriate to the activities. Company will apply strictly the requirements of C09 and therefore Contract must have at least knowledge of the requirements e.g., SP1009

Incident Investigation.

The Contractor must detail how it will manage Investigation issues. All investigations must be managed and led by Contractor unless otherwise directed by the Company Contract Holder. Company will apply strictly the requirements of C09 and therefore Contract must have at least knowledge of the requirements e.g., PR1418 unless otherwise stated. Ideally the Contractor should submit a typical Incident Presentation model and lesson learned model sheet as part of the HSE plan (suggest Appendix).

Contractor(s) shall allocate sufficient resources at all levels to effectively manage HSE. 

The Contractor shall submit an organisation chart as stated in 2.6.5 above. The contractor must state how it will meet the minimum requirements of C09 and at the same time manage the resources to match the stated control measures within the HSE plan (HEMP).

Contractor(s) shall ensure that all employees (including sub-contractors) are competent to perform their work tasks, that relevant HSE training is provided, and that HSE requirements are incorporated into competency assessment and assurance programs. The Contractor must identify Level 1 and Level 2 critical HSE positions in their organisation and that of their sub contractors and ensure personnel are HSE competent to deliver the activity in a safe manner.

 The Contractor shall explain in detail how the HSE Competence is managed in house for their staff as well as how they measure the competence of the sub Contractor? The Contractor is to detail how assessment of individuals and contractors are conducted. Details are also to be included who in the organisation is qualified to conduct the HSE Competence assessments for individuals and competent to assess the sub contractors. Ideally Contractor will support the detail with copy of the assessment forms used for HSE assessment. See Section 2.7

Contractor(s) shall ensure that all employees (including sub-contractors) are competently supervised. 

Contractor(s) shall provide a matrix describing required training for contract activities (including refresher training) and maintain training records of staff employed on the contract.  

In line with 2.6.5 above The Contractor must submit a training programme in line with the contract requirements of C-09 and the SP1157 required training. It must include additional details of any in house training which supports the competence of any staff included in the contract organisation.

Contractor shall submit a draft HSE training plan for approval by the Company Contract Holder.

Contract Holder shall advise Contractors of compulsory training required for contract activities.  Required training might include, but shall not be limited to:

     HSE induction;

     Job procedures (e.g. Permit to Work, fire fighting, scaffolding);

     Road safety;

     Health (e.g. first aid, use of PPE);

     Incident investigation and reporting; auditing;

     HSE meetings;

     Environmental protection/awareness;

     Supervisory training; specialized training as necessary; on the job training;

     Emergency planning.

2.6.6 Hazards and Effects Management Process Contractor(s) shall:

Provide a register of anticipated contract-specific hazards and effects identified by the detailed HEMP. The contractor is to submit the HEMP (risk assessment), and to be aligned with PDO expectations in Appendix 6 attached.

From the assessment of hazards, identify risk reduction measures to control and recover, including:

     Work methods and work site procedures

     Emergency response plans

     Exposure reduction methods

2.6.7 Planning and Procedures Contractor(s) shall:

Provide contract-specific HSE objectives and targets. 

Produce a schedule of contract-specific emergency response drills. 

Provide a list of contract-specific work procedures and other procedures to address HSE hazards identified in the HEMP. 

The Contractor must submit a list of Procedures, specifications and guidelines that it intends to use for contract management. The Contractor is mandated to follow, as a minimum, the Company C09 standards and procedures. Nonetheless, if Contractor intends to use its own standards or procedures then this must be formerly stated in the required list. The list must personify the stated documents in the HSE plan HEMP.

Provide a list identifying sub-contractors/vendors/suppliers to be employed in the execution of the contract.

Identify potential emergency scenarios that might arise during the contract and procedures typically used in such scenarios.  Examples include:

The Contractor must submit a list of the most credible scenarios relevant to the contract scope and to include full cognizance of the locations. In addition the contractor to submit a plan which states when the scenarios will be practiced which in turn must be in line with the phase of the contract or project e.g. Commissioning phase leads to H2S practice?

2.6.8 Implementation, Monitoring and Corrective Action Contractor(s) shall:

The Contractor must explain how all the contract/project equipment will be recorded for site checks, third party inspection etc. The contractor to submit, as part of the HSE plan, details of the inspection schedule for the equipment. Ideally this will be available electronically and part of a reporting system e.g. MAXIMO

     Vehicles

     Powered hand tools

     Excavation equipment

     Scaffolding

     Lifting equipment

     Hand tools

Prepare an inspection schedule for the above, indicating the frequency of inspection, responsible party and the location of the inspection. 

Using the template in Appendix 4, report monthly HSE information to the Contract Holder. 

Nominate and identify the person in the organisation chart responsible for preparing the monthly HSE report. Ensure that the responsibility is listed in the HSE plan i.e. Roles and responsibilities.

Prepare a program for monitoring contract-specific HSE data, describing what will be measured, where the measurement will occur, who will perform the measurement and the method used to take the measurement.

The Contractor must submit an example sheet to show how the HSE data will be managed by the contractor. In addition the roles and responsibilities must state who in the organisation is responsible for HSE records as well as reviewing the data.

2.6.9 Audit Contractor(s) shall provide a contract-specific matrix showing the schedule for HSE audit and inspections.  Appendix 2 might be of assistance to Contractors as well as Contract Holders.

In line with 2.6.5 above The Contractor must submit details of who will conduct audits, when and where they will be conducted. It important that the Contractor states what audits will be conducted as stated earlier in 2.6.5. The phase or activity level of the Contract or Project should drive the most appropriate audit e.g. working at height Audit scaffold SP1257.

2.6.10 Review Contractor(s) shall describe the process for management review of contract-specific HSE performance

2.7 Competence Assurance (refer 2.6.5)Contractor(s) shall provide HSE Competent personnel. Contractor staff employed (including Sub Contractor staff), particularly in positions where they have a significant influence over the safety aspects of an activity, must be HSE competent.

Contractor(s) shall have an established Competence Assurance Scheme that includes:

a specification criteria for assessment i.e. expectations in terms of knowledge and experience.

In house nominated assessors an established filing system for the recording of staff Competence Assessments. details of training requirements established to satisfy any identified gaps from the staff

assessments

2.7.2 Contractor’s HSE Key Personnel

Contractor(s) shall propose the appointment of the HSE Key Personnel given in document for Contract Holders review and approval. Individuals to fill the positions of Contractor HSE Adviser(s), Contractor Representative(s) and Contractor Site Representative(s) shall be classified as HSE Key Personnel under the contract.

HSE Advisers shall not be responsible for line management and supervision; the role of HSE Advisers shall be facilitatory/advisory in nature.

Contractor(s) shall define the role and responsibilities of the HSE Advisers in the HSE Management Plan.

2.7.3 Requirements for HSE Advisers

Contractor(s) shall provide HSE Adviser(s) as described in this section that, at a minimum, satisfy the requirements of the ‘Occupational Health & Industrial Safety Precautions’, Sultanate of Oman, Ministry of Social Affairs and Labour, Decision No. 286/2008.

PDO may consider additional HSE advisors over and above the legal requirements. The minimum number of HSE Advisors required by PDO will be as specified in the tender Requirements (C-04 and T-3). The absolute minimum will be one HSE Adviser for each geographical area in which the contract is operating (Geographical area is defined as a PDO operating area e.g. Bahja, Marmul, Lekhwair, etc.)

The total number of HSE Adviser(s) required by the Contract Holder will be stated in the tender document. The decision will be based on HSE exposures presented by the specific contract activities and the overall HSE risk.

Contractor Management shall, at all times, throughout the duration of the contract, maintain the required number of professionally qualified HSE Advisers as per the contract.

2.7.4 Minimum Competence for Professional HSE Advisers

Professional HSE Advisers shall have a minimum of five years work experience, of which at least two years shall have been as an HSE Adviser. Work experience must be related to the activities to be carried out under the terms of the contract.

HSE Advisers shall be COMPETENT in specific relevant safety techniques as required by the scope of work and have a working knowledge of the legal and contractual health, safety and environmental requirements that must be met. Contractor’s HSE Advisers shall be qualified in accordance with either of the following requirements:

2.7.5 HSE Adviser seconded from Line Management

Line Managers who are seconded to HSE might be acceptable as HSE Advisers provided that the proposed individuals have a minimum of three years experience on PDO contracts at site supervisory level and been in a HSE critical Position. Work experience must be related to the activities to be carried out under the terms of the contract. In all cases the competence level required for the post will be the overriding factor see table above.

Proposed individuals who do not satisfy the criteria of three years experience on PDO contracts at site supervisory level shall be subject to review and approval by PDO’s CFDH for HSE (MSE) to determine acceptability to PDO.

2.8 Site RestorationUpon completion of the Work or Services, the Contractor(s) shall satisfactorily restore the Site, including any areas of PDO concession area and any premises thereon, used by the Contractor to perform the Work or Services as per the requirements of SP-1012 Specification for Land Management. Upon completion of the restoration of the Site, the Contractor(s) shall apply for certification of such restoration. PDO shall certify satisfactory completion by the issuance of a Site Restoration Certificate (refer Appendix 5).A copy of the certificate must be sent to the MSE2 section in PDO for record.2.9 HSE Penalties and Defaults

PDO Contract Representative/Site Representative(s) shall apply HSE penalties and defaults on the Contractor, as allowed in the Contract, for unauthorized deviation(s) from the Contractor’s HSE Management Plan and C-09 HSE Requirements. The Contract Manager is to be advised in writing of all Penalties and Defaults being imposed.

HSE Penalties and Defaults shall be determined by the Contract Holder and may include Contract Performance Reports detailing unauthorized deviations as well as from inspections and audit findings.

2.10 Behavioral Safety and Assurance 2.10.1 Safety Training Observation Programme (STOP) DuPont

Contractor shall fully implement a safety training observation programme, or Company approved equivalent, in accordance with Company’s Specification SP-1259 STOP. Contractor(s) shall fully implement Dupont’s STOP for SupervisionTM program or approved alternative agreed with Company Contract Holder and Owner. Progress, implementation and analysis shall be reported monthly in the monthly report (refer Appendix 4). All management and supervisory staff, shall be trained in line with the requirements of SP1157 and C09 requirements.

2.10.2Life Saving RulesLife Saving Rules (LSRs) refer GU140 (C9) 7.1.2 In addition to the chosen behavioural programme the contractors shall fully implement the Company Life Saving Rules.

The Life-Saving Rules set out clear and simple “dos” and “don’ts” covering activities with the highest potential safety risk. They help to make sure that rules are followed and people are protected. We are determined to save lives. Contractors MUST adopt and ensure that the rules are embedded in their company.

There are serious consequences associated with breaking a Life-Saving Rule.

If a rule-breaker is aware of the Life-Saving Rule or required procedure through training, experience or communication, and did not comply, the maximum appropriate disciplinary action will be applied: up to and including termination of employment for employees; or removal from site and disqualification from future PDO work for employees of contractors or sub-contractors.

2.10.3Letter of Assurance The Contractor Chief Executive Officer (CEO) shall submit an HSE Letter of Assurance (LoA) every year before 1st March to Company. The LoA is a confirmation from the CEO, with or without qualifications, that the current implementation status and integrity of the Contractor HSE management system meets the Contract requirements. Only one LoA per Contractor is required covering all contracts with Company that are operational on 1 January of that year. Company will issue the format and submission details for the LoA annually.
