sample translator’s declaration[Note: This declaration is very general in nature and is not intended to cover all possible circumstances. It is in no way binding on the Society of Translators and Interpreters of British Columbia. It is offered only as an example for translators and their clients.]

I, NAME OF THE TRANSLATOR, Certifi ed SOURCE LANGUAGE to TARGET LANGUAGE Translator [or Certifi ed French or a Foreign Language/English Court Interpreter or Certifi ed Source Language to Target Language Conference Interpreter,1 Member [or Associate Member]2 in good standing3 of the Society of Translators and Interpreters of British Columbia (S.T.I.B.C.), [which is a member association of the Canadian Translators, Terminologists, Interpreters Council (CTTIC)]4, hereby attest [that I am profi cient in SOURCE LANGUAGE TO TARGET LANGUAGE translation and]5 that, to the best of my knowledge and belief, the document above [or hereto attached] is a true, correct and complete translation of a Source Language document entitled “TITLE OF THE DOCUMENT”, [a copy of] which is hereto attached.

Notes:1 The qualifi cations of the translator must be accurately represented. The translator must clearly state the source language to target language combination in which he/she has been certifi ed by S.T.I.B.C. (e.g., English to French, or French to English, but not English/French, unless he/she has been certifi ed in both directions).2 Associate Members must not claim to be “Members,” which are equivalent to “Certifi ed Members”. An Associate Members declaration may then start as I, Name of the Translator, Associate Member in good standing of...”3 The phrase “in good standing” is included to deter lapsed members from using the S.T.I.B.C. titles and seals without being bound by the S.T.I.B.C. about the societyThe Society of Translators and Interpreters of British Columbia (S.T.I.B.C.) was incorporated in 1981. It is a non-profi t professional association and an affi liate of the Canadian Translators, Terminologists and Interpreters Council (CTTIC), the umbrella organization for the associations of translators and interpreters in British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, New Brunswick, Nova Scotia, the Yukon and the Northwest Territories.

The goals of the S.T.I.B.C. are to promote the interests of translators and interpreters in British Columbia and to serve the public by providing both a Code of Ethics that members of the S.T.I.B.C. agree to observe, and a system of certifi cation for translators and interpreters.

membershipPersons who wish to join the Society must have their qualifi cations assessed by presenting evidence of their previous work and education, and/or by passing language and translation examinations that assess their potential as translators or interpreters. Please see the website or contact the S.T.I.B.C. offi ce for more information. If successful, they become Associate Members of the S.T.I.B.C. In return, they agree to abide by the Society’s Code of Ethics. These members, however, have not yet met the criteria that would entitle them to become Certifi ed Members.

certifi cationTranslators qualify for certifi cation by passing a written examination in a specifi c language combination administered and adjudicated on a national basis by CTTIC. Court interpreters are certifi ed on the basis of written and practical examinations administered by CTTIC. Conference interpreters are certifi ed on the basis of a practical examination administered by CTTIC. Also, a member may be certifi ed by passing an on-dossier portfolio review. The titles “Certifi ed Translator” (C.T.), “Certifi ed Conference Interpreter” (C.C.I.), “Certifi ed Terminologist” (C. Term.), “Certifi ed Court Interpreter” (C.Crt. I.) are legally protected under the Society Act of B.C. Only S.T.I.B.C. members in good standing who hold the appropriate certifi cation(s) may use these titles.

how to use this directoryThe Directory is intended for organizations and individuals requiring professional translation and interpretation services.

Hiring a translator

Translation involves rendering a written text from one language into another language, conveying the message as faithfully as possible. Translators who are Certifi ed Members of the S.T.I.B.C. have demonstrated their competence in one or more specifi c language combinations. Most translators work in only one direction, from their second language into their fi rst language, although some Certifi ed Members are qualifi ed in both directions. Defi nitions

71. Translation is a professional activity which has as its aim the written transposition of text from one language into another and which requires, among other things, excellent knowledge of the source language and mastery of the target language.

72. Interpretation is a professional activity, the purpose of which is to convey, in a given language and for a given audience, the content of oral messages produced in another language. Interpretation may be simultaneous or consecutive. It requires, among other things, excellent knowledge of both the source language and the target language.

73. Terminology is a sphere of professional activity, the purpose of which is the systematic study, in one or more languages, of terms used to designate concepts. It requires mastery of the working languages and a good knowledge of the fi eld under study, as well as terminological research methods and reference sources.

74. In this code, unless otherwise stated, “member” shall refer to translators, interpreters and terminologists belonging to the Society, whatever their form of membership in the Society.

Principles

75. Members shall abide by this Code of Ethics and shall be answerable to the Society for any breach thereof.

76 (1) A member is responsible for all aspects of that member’s work and shall not contract out of that responsibility by asking a client to agree to an unconditional waiver of liability.

Hiring an interpreter

Interpreting involves orally restating as accurately as possible a message expressed by a speaker using another language. Certifi ed Conference Interpreters and Certifi ed Court Interpreters are listed beginning on page 7. Language combinations for court interpreters are listed without a specifi c direction because court interpreters work in both directions (e.g. from Spanish to English and English to Spanish). Fees for court interpreting are set by the Ministry of the Attorney General of British Columbia. If an interpreter works for a private client, the fee is negotiated. Conference interpreters also negotiate fees with their clients.

82. Members shall not divulge privileged information.

83. Members shall not use their professional role to perform functions that lie beyond the scope of a language professional, such as advocacy, counselling or improper disclosure of information.

84. When interpreting in the courts of British Columbia, members shall abide any and all professional codes or standards required of court interpreters by the Ministry of Attorney General.

85 (1) In this bylaw, “Professional Seal” means an embossing seal or similar instrument that sets out the member’s affi liation with the Society by use of the registered name of the Society and includes the member’s registration number.

(2) Only a CERTIFIED TRANSLATOR may apply to the Society to obtain a Professional Seal.

(3) Only a CERTIFIED TRANSLATOR in good standing may use a Professional Seal issued by the Society to him.

(4) A member shall not use a Professional Seal unless it has been issued to him by the Society.

(2) In the event that any person makes any claims against the Society in connection with a member’s work for any damages, costs and expenses, the member responsible will fully indemnify and hold harmless the Society from any such claims and all associated legal costs.

77 (1) Members shall strive to conduct their business in accordance with the Competency Charts approved by the Directors.

(2) Members shall accept an assignment only if they are well qualifi ed with respect to knowledge of both languages involved and the skills required, and only if the subject matter is within their competence.

78 (1) Members shall refrain from making misleading statements regarding their level of competence or their certifi cation.

(2) In their advertising, members shall clearly indicate their certifi cation in terms of languages and membership class (translator, conference interpreter, terminologist, court interpreter).

79. Members shall refrain from unfair tactics in the practice of their profession.

80. Members shall act towards colleagues in a spirit of mutual cooperation, as well as assist and encourage beginners in the profession.

81. Where applicable, members shall respect all copyrights and other intellectual property rights.
