Introduction

The information provided in the answers to the questions in this proposal form will be used by underwriters to determine whether to provide the insurance requested and at what terms including premium.

Under the Consumer Insurance (Disclosure and Representations) Act 2012 you have a duty to take reasonable care (that is, the care a reasonable consumer would take) not to make misrepresentations to the insurer in answering any questions.  This applies both upon entering into a new insurance contract or on renewal or if the contract is being varied. This duty means that you must answer all questions completely and truthfully.

If the insurer relies on your answers when accepting to insure your risk and/or setting the terms and the premium, and they obtain evidence that suggests you deliberately or recklessly provided incomplete or untrue answers to questions, the insurer may avoid the policy.  This means that the insurer will not pay out on any claims and may in fact demand repayment of any claims already paid.  In some cases, the insurer may not return the premium to you.

These may include insurance carriers, third-party claims adjusters, fraud detection and prevention services, reinsurance companies and insurance regulatory authorities.
