    PART IPRELIMINARY PROVISIONS

    1.-( 1) This Act may be cited as the Constitutional ReviewAct,20II.

    Constitutional ReviewApplication 2. This Act shall apply to Mainland Tanzania and to

    Tanzania Zanzibar:Interpretation 3. In this Act, unless the context otherwise requires:

    "Commission" means the Commission established for purposesof coordination and collection of public opinions onconstitutional review;

    "consti tution" means the fundamental law, writ ten or unwritten,that establishes the character of a state by defining thebasic principles to which a society shall conform,distribution of powers and functions among pillars of thestate, by describing the organization of the executive,legislature and judiciary, their regulation, distribution,and the limitation of different state organs, and byprescribing the extent and manner of the exercise of itssovereign powers;

    "consti tutional review" means the process of collecting publicopinions and the conduct of fora for the purposes ofenactment of provisions for the new Constitution of theUnited Republic;

    "fora" means open and free public meetings, assemblies,gatherings or discussions organized by the Commissionfor purposes of collection of public opinions on the DraftConstitution Bill;

    "Minister" means the Minister in the Government of the UnitedRepublic responsible for constitutional affairs;"President" means the President of the United Republic ofTanzania;"proposed Constitution" means an enactment of the ConstituentAssembly which is the subject of the referendum;

    "public opinions" means ideas, views, information, opinions,proposals or recommendations collected from the generalpublic for purposes of the enactment of the newConstitution of the United Republic;

    "referendum" means a public vote or poll cast in accordance withthe provisions of this Act for purpose of validation of theproposed Constitution;

    "Secretary" means the Secretary referred to under section 13;Cap. 2 "the Constitution" means the Constitution of the United Republic

    of Tanzania, 1977.

    PART IIOBJECTIVES

    Objectives 4. The objectives of this Act shall be to:(a) provide for the establishment of the Commission

    for purposes of collection and coordination ofpublic opinions;(b) prescribe the oath and affirmation and provide for

    the manner under which members of theCommission and the Secretariat shall take oath oraffirmation;

    (c) make provision for terms of reference of theCommission;

    (d) provide for the establishment of the Secretariat ofthe Commission to be headed by the Secretary;

    (e) provide for a mechanism by which the public shallwidely and freely participate in expressing andtransmitting public opinions on matters relating tothe constitution;

    (f ) provide for a mechanism by which theCommission shall prepare and submit a report;(g) provide for the functions and powers of theCommission;

    (h) provide for the manner in which the Commissionshall collect information from public and privateinstitutions, civil societies and religiousorganizations;

    (i) provide for a mechanism for procuring technicalinformation by the Commission from consultants;

    (j ) generally, provide for a mechanism for consensusbuilding in national issues during constitutionalreview process;

    Constitutional Review(k) provide for a mechanism for scrutiny of a DraftConstitution Bill;(1) put in place a legal mechanism for the President toconstitute a Constituent Assembly;(m) to provide for election of the Speaker and theDeputy Speaker of the Constituent Assembly andappointment of the Clerks and Staff;(n) provide for a mechanism for the conduct of thereferendum; and(0) provide for the manner in which the newconstitution shall be promulgated.

    PART IIIESTABLISHMENT OF A COMMISSION

    5. The President shall, upon consultation and inagreement with the President of Zanzibar and, on the advice bythe Attorney General of the United Republic and the AttorneyGeneral of Zanzibar and after considering any information orprevailing social, political and economic circumstances within theUnited Republic at all times and, by order published in theGazette, establish the Commission.

    6.-( 1) The President shall, in consultation and agreementwith the President of Zanzibar, appoint members of theCommission.(2) Subject to subsection (3), the composttlon of theCommission shall have regard to the principle of equal membersfrom either part of the United Republic.(3) In appointing members of the Commission, thePresident shall have regard to:(a) experience relevant to constitutional review orprofessional qualifications on constitutionalmatters, law, publie administration, economic,finance and social science;(b) geographical and the population diversity of theUnited Republic ofTanzania;(c) the national interests;

    (d) age, gender and representation of various socialgroups; and

    (e) such other criteria as the President may considerappropriate.(4) Notwithstanding subsection (3), a person shall not

    qualify for appointment as a member of the Commission if thatperson is:(a) a Member of Parliament, a Member of the House ofRepresentatives of Zanzibar, a Councilor or anational, regional or district leader of a politicalparty;

    (b) a member of security organs;(c) a person who has been convicted of, or is the subject

    of proceedings in the court of law for an offenceinvolving dishonesty or moral turpitude; or(d) a non-citizen ofTanzania.

    7.-(1) The Commission shall consist of:(a) a Chairman;(b) a Vice-Chairman; and(c) not more than thirty other Commissioners.(2) Appointment of the Chairman and the Vice Chairman

    shall be made on the basis of the principle that where theChairman hails from one part of the United Repubiic, the ViceChairman shall be a person who hails from the other part of theUnited Republic.

    (3) Members of the Commission shall be appointedthrough an order published in the Gazette.8.-{1) The terms of reference for the Commission shall beissued by the President in agreement with the President of

    Zanzibar under the same order under which the appointment ofmembers of the Commission is made and shall specify the timewithin which the Commission is to complete and submit thereport.

    (2) The President may, where circumstances so require, inagreement with the President of Zanzibar, extend for a period ofnot exceeding three months during which the Commission shallcomplete and submit the repOlt.

    (3) The terms of reference shall be a legal instrumentupon which the performance of the functions and the exercise ofpowers by the Commission shall, subject to the provisions of thisAct, revolve.

    the existence of the United RepUblic;the existence of the Executive, Legislature and theJudiciary;the republican nature of governance;the existence of Revolutionary Government ofZanzibar;national unity, cohesion and peace;periodic democratic elections based on universalsuffrage;the promotion and protection of human rights;human dignity, equality before the law and dueprocess of law; and

    (i) the freedom of worship and religions tolerance.(3) For the purpose of subsections (I), (2), and for any

    other matter of national importance the Commission shall allowthe people to freely express their opinions with a view to furtherenrich those matters.

    9.-( 1) The functions of the Commission shall be to:(a) co-ordinate and collect public opinions;(b) examine and analyse the consistency and

    compatibility of the constitutional provisions inrelation to the sovereignty of the people, politicalsystems, democracy, rule of law and goodgovernance;(c) make recommendations on each term of reference;and(d) prepare and submit a report.

    (2) In the implementation of the provisions of subsection(1), the Commission shall adhere to national values and ethosand' shall, in that respect safeguard and promote the followingmatters:

    10. The Commission shall enjoy such independence andautonomy as may be necessary for the performance of itsfunctions and .exercise of its powers under this Act and shall notbe interfered with by any person or authority.11. Every member of the Commission and the Secretaryshall, before taking assignment, subscribe to an oath oraffirmation administered by the President as prescribed in theFirst Schedule to this Act.

    12.-(1) A person shall cease to be a member of theCommission upon the occurrence of any ofthe following events:(a) death;(b) resignation;(c) inability by reason of illness;(d) removal for breach of the Code of Conduct;(e) conviction for an offence which carries a custodialsentence of not less than one month; and(f) if that person lose qualifications of appointment.(2) For the purpose of better discharge of the functions ofthe Commission, there shall bea code ofconduct prescribed for inthe Second Schedule to this Act.(3) A member of the Commission or the Secretariat whobreaches the provisions of the Code of Conduct shall be

    disqualified fJ-omcontinuing to bea member.13.-(1) There shall be a Secretariat to the Commissionwhich shall be headed by the Secretary.(2) The Secretary shall be appointed by the Presidentup.on agreement with the President of Zanzibar.(3) A person shall qualify to be appointed as a Secretary

    i f that person is a public servant and profess law profession andhas served as such for a period of not less than ten years and is ofgood conduct and character.

    Constitutioflnl Review.(4) The Secretary shall be responsible to the Commission

    and shall perform such functions and discharge duties of theSecretariat.(5) Other members of the Secretariat shall be appointedby the Minister upon agreement with the Minister responsible forconstitutional affairs of the Rcvolut ionary Government ofZanzibar.

    (6) The Secre tariat shall have sllch number of publicofficers as may be necessary for better performance and theexercise of of the C0l11mission.

    14.-(1) The expenses of the constitutional review incurredby the Commission in accordance with this Act shall be chargedon and issucd out of the Consolidated Fund.(2) Members of the Commission and the Secretariat shallbe remunerated in such manner as the Minister may, subject to therelevant laws and regu!c:tions, determine.

    15. A member of the Commission or the Secretariat shallnot be liable pcrsonally to a civil or a cr iminal ac tion for, or inrcspect of any matter or thing done or omitt ed to be done in goodfaith as a member of the Commission or the Secretariat in theperformance of the funct ions of, and in the excrcise of powcrs ofthe Commission under this Act.

    PART IVPROCEDURE or TilE COMMISSION

    16.-(1) The Commission shall perform its funct ions inaccordance with this Act and the terms of reference.(2) For thc purposes of implementation of subsection (I),

    the Commission shall:(a) ar ticula te and conduct awareness programmes on the

    objectives and functions of the Commission;(b) hold such number of meetings or assemblies in such

    places and at such times as it shall determine;(c) examine and analyse divergent public opinions

    separately; and(d) prepare and submit a report in accordance with the

    terms of refcr?:Jce.

    (3) The may ask any person who is willingto appear before it for discussion, orally or by production ofdocument, on any constitutional matter which the Commissionconsiders relevant to the consti',utional review process.(4) In thc performance of its functions under this Act, theCommission shall examine and analyse the ideas, views,information, opinions, proposals and recommendations collectedand examined in the past, including:(a) a summary of the public opinions on areas ofconvergence ar,d divergence for both parts of theUnited Republic;(b) all documents reflecting the ideas, views andopinions of the general public under the WhitePaper No. I of 1962 on the Establishment of theRepublic of Tanganyika, the PresidentialCommission on the Establishment of DemocraticOne-Party System, the National ExecutiveCommittee of CC M Proposed Amendments to theConstitution of the United Republic of Tanzania,1977 and the Constitution of Zanzibar, 1979, thePresidential Commission on Single Party or Multi-Party System in Tanzania, 1991 and the Committeefor the colledion of views on the Constitution ( theWhite Paper, No. I of 1998);(c) the Independence Constitution of Tanganyika, 1961;

    (d) the Constitution of the Republic of Tanganyika,1962;(c) the Atticies of Union of the Republ ic of Tanganyika

    and the Peoples' Republic of Zanzibar;(f) the Interim Constitution of the United Republic ofTanzania, 1965;Cap. 2 (g) the Constitution of the United Republic of Tanzania,1977;(h) the Constitution ofZanzibar, 1979;

    (i ) the Constitution of Zanzibar 1984;(j ) the Joint Finance Commission Report and theShellukindo Report on Challenges of the Union;(k) the Wangwe Report on the Fast Tracking of the EastAfrican Federation;

    (I) analytical and academic studies undeliaken by thcCommission; and(m) any other relevant documents as the Commissionmay consider neccssary.(5) The Commission may:(a) for Mainland Tanzania, require the DistrictCommissioner, the Ward Executive Officcr or themtaa or Village Executive Officer to cause to beconvened meetings of residents of a township,ward or hamlet or village, as the case may be; and(b) for Tanzania Zanzibar, require the District

    Commissioner or a Sheha to cause to be convenedmeetings of residents of a township or variousShehias, for the purpose of collecting publicopinions on constitutional matters as spccified 111the terms of referencc.

    (6) for the purposes of this section, there shall be jurafor constitutional rcview.(7) Thc fora for constitutional review shall be formed onad hoc basis by the Commission based on geographical diversity

    of the United Republic and shall involve and bring togetherrepresentativcs of various groups of people within thecommunities.(8) The fora for constitutional review shall advise on thcDran Constitutional Bill through meetings organized by thcCommission.(9) The fora referred to in subsection (6) and in otherprovisions of this Act shall exclusively be for and attended by thecitizcns of Tanzania.(10) In order to facilitate effective discharge of itsfunctions, the Commission may form committees and may assignto any of such committees general or specific matter to deliberateupon.(1 I) The Commission may co-opt any person or engageany consultant as may be necessary for the proper performance ofits functions.(J 2) In the performance of its functions, the Commissionshall devise uniform methodologies, except where circumstances

    require otherwise, that would be applicable in each part of theUnited Republic in the collection and analysis of public opinions,the conduct of fora and writing of the report.

    17.-( 1) On the basis of the cxamination and analysisundertaken pursuant to section 16, the Commiss ion shall prcparea report containing:

    (a) a summary of public opinions on each term ofre ference;

    (b) recommendations of the Commission on each termsof rcfcrence;

    (c) reports by consultants engaged by the Commission;(d) a Draft Constitution Bill; and(e) any other relevant information.(2) The Draft Constitution Bill shall form an annex to the

    report of the Commission.18.-( I) The Commission shall, aftcr the complction of the

    assignment, "ubmit the report to the President and to the Presidentof Zanzibar.

    (2) The President shall, upon consultations and agreementwith the Presidcnt of Zanzibar and aftcr exhaustion of internalmechanism used for policy making, direct the Minister to prcsenta Constitution Bill to the Constitucnt Assembly.

    19.-( I) A person who obstructs, hinders or prevents amember of the Commission or the Secretariat from performingthe functions or exercising the powers of the Commissioncommits an offence.

    (2) A person who is convicted for contravention ofsubsection (1) shall be liable to a fine not exceeding five millionshillings or to imprisonment for a term not exceeding twelvemonths.

    20.-( 1) The President shall, upon agreement with thePresident of Zanzibar and with advice of the Attorney General of

    Constitutional Reviewthe United Republic and the Attorney General of Zanzibar, byproclamation published in the Gazette, constitute a ConstituentAssembly.(2) Without prejudice to subsection (1), the ConstituentAssembly shall have the following categories of members, that is:

    (a) all members of the National Assembly of the UnitedRepublic;(b) all members of the House of Representatives ofZanzibar;(c) Ministers responsible for constitutional affairs of theUnited Republic and the Revolutionary Governmentof Zanzibar;(d) the Attorney General of the United Republic and theAttorney General of the Revolutionary Governmentof Zanzibar;(c) one hundred and sixteen members drawn fi'om thefollowing:(i) Non-Governmental Organisations;(ii) Faith Based Organistaions;(iii) all fully registered political parties;(iv) institutions of higher learning; and(v) groups of people with special needs.

    (3) For the purpose of subsection (2), the total number ofmembers of the Constituent Assembly hailing from TanzaniaZanzibar drawn from categories (a) to (e) shall not be less thanone-third of the total number of members of the ConstituentAssembly.(4) The President shall, on the proclamation publishedpursuant to sub-section (1), publish names of persons appointed interms of subsection (1) including members referred to insubsection (2) to be members of tile Constituent Assembly.21.-( J) On the first day of its meeting, the Members ofConstituent Assembly shall elect a Speaker and a Deputy Speaker

    of the Constituent Assembly.

    (2) The Speaker and the Deputy Speaker of theConstituent Assembly shall be elected from amongst members of

    the Const ituent Assembly based on the principle that where theSpeaker hails from one part of the United Republic, then theDeputy Speaker shall be a person who hails from the other part ofthe United Republic.(3) The elect ion of the Speaker and the Deputy Speakershall be conducted by secret ballots and the winner shall beelected by simple majority of votes cast.

    (4) The Speaker and the Deputy Speaker shall, beforeassuming office, subscribe to, before the Constituent Assemblyand adminis tered by the Clerks of the Constituent Assembly, anoath or, as the case may be, affirmation as prescribed in theStanding Orders of the National Assembly.

    22.-( I) lmmediateiy after the proclamation of theConstituent Assembly by the President and subject to subsection(2), reigning Clerks of the National Assembly and the House ofRepresentatives shall, by operation of this Act, become the Clerkand the Deputy Clerk of the Constituent Assembly and vice versa.

    (2) Assumption of the Officces of the Clerk or DeputyClerk of the Constituent Assembly shall be on the basis thatwhere the Speaker of the Constituent Assembly is elected fromone part of the United Republic, the Clerk shall be a person fromthe other part of the United Republic.

    (3) The Clerk of the Constituent Assembly shalldischarge duties under the direction of the Speaker or the DeputySpeaker, as the case may bc.

    (4) The Clerk of the Assembly "hall, uponconsultation with the Deputy Clerk nominate staff from theNational Assembly and the House of Representatives of suchnumber as may be appropriate for the effective perfonning of thefunctions and the exercise of the powers of the Assembly.

    (5) The Clerk and the Deputy Clerk of the ConstituentAssembly shall, before assuming office, subscribe to an oath oraff irmation before the President as set out in the Third Scheduleto this Act.

    23.-( 1) The Constituent Assembly shall have ar.d exercisepowers to make provisions for the New Constitution of the UniteJRepublic of Tanzania and to make c:c:'!sequential and transitional

    provisions to the enactment of such Constitution and to makesuch other provisions as the Constituent Assembly may findnecessary.

    (2) The powers of the Constituent Assembly to makcprovisions for the constitution shall be excrcised by a Bil l tabledby the Minister and passed by the Constituent Assembly.

    24.-( 1) The Constituent Assembly may develop rules forthe conduct of business in the Constituent Assembly.

    (2) Without prejudice to subsect ion (I), the ConstituentAssembly may adopt with necessary modifications, the StandingOrders of the National Assembly and all other provisions relatingto the passing of Bills for Acts of Parliamcnt by the NationalAssembly.

    (3) The provisions of the Constitution Bill shall requirepassing by the Constituent Assembly on the basis of support oftwo third majority of the total number of the members hailingfrom Mainland Tanzania and two third majority of the totalnumber ofmembers hailing from Tanzania Zanzibar.

    25.-( 1) Subject to the provisions of any Act of theConstitucnt Assembly, the Interpretation of Laws Act shallapply to the interpretation of an Act of the Constituent Asscmblyand references in that or in any other law to an Act shall, exceptwhcre the context otherwisc requires, include referenc

    Constitutional Review(2) Dissolution of, and abatement of powers of the

    Constituent Assembly shall not be construed as derogatingpowers of the President to reconstitute the Constituent Assembly,with same members, to meet at any time in future beforepromulgation of the proposed Constitution for enactment of anamending provision of the proposed Constitution.

    PART VIVALiDATION OF TilE PROPOSED CONSTITUTION27.-(1) For purposes of validation of the provisions of the

    Constitution, there shall be a referendum to be organized,conducted and supervised by the National Electoral Commissionin collaboration with the Zanzibar Electoral Commission.

    (2) In t\1e implementation of subseevtion (1), theZanzibar Electoral Commission shall organise, conduct andsupervise the conduct of poll nd the referendum and shall submitto the National Electoral Commission referendum results forvotes cast in Tanzania Zanzibar for declaration.

    28.-(1) The National Electoral Commission incollaboration with the Zanzibar Electoral Commission shall,within seven "days of the publication of the Constitution, 'frameand publish in the Gazette the question to be determined by thereferendum.

    (2) The question referred to in subsection (1) shall beframed after consultation with the Attorney General of the UnitedRepublic and the Attorney General of Zanzibar.

    (3) The question to be submitted to the referendum shallrequire the voter to indicate whether the voter approves or doesnot approve the constitution and shall be so framed as to requirethe voter to answer "Yes" or "No".

    (4) The voting at a referendum shall be by secret ballot.29.-(1) The National Electoral Commission in

    collaboration with the Zanzibar Electoral Commission shall,within fourteen days after publication of the question in theGazette, specify-

    (a) the day on .which the referendum is to be held;

    Constitutional Review(b) the polling time of the referendum; and(c) the period for sensitization and public awareness

    on the referendum for the proposed Constitution.(2) For the purposes of sensitization and public awareness

    on the referendum for the proposed Constitution the Commissionshall, and the political parties and civil societies may providecivic education and advocacy.(3) The returning officer of every electoral constituencysha'll, within twenty one days of publication of the notice by theNational Electoral Commission, notify the public about theprocedure for the conduct of the referendum.

    30. A person whose name is entered in the register ofvoters established under the National Elections Act or theZanzibar Elections Act, 1984 shall, unless that person isprohibited from Yoting by any other written law, be entitled toYote at the referendum.

    31. The procedure for conducting the General Electionsunder the National Elections Act, the Zanzibar Election Act, 1984and the Local Authorities (Elections) Act shall, with necessarymodifications, apply to the conduct of a referendum under thisAct.

    32.-( I) The majority of votes given in the referendumshall determine the decision of the Yotes on such question in thereferendum and the referendum results declared by the NationalElectora! Commission shall be binding on the Government of theUnited Republic and the Revolutionary Government of Zanzibar.

    (2) The referendum results shall be decided on the basisof support by more than fifty per cent of the total number of votescast in Mainland Tanzania and more than fifty per cent of the totalnumber of votes cast in Tanzania Zanzibar.

    (3) Where the question of an equality of votes cast "YES"and "NO" on a question at a referendum, the National ElectoralCommission shall, upon agreement with the Zanzibar ElectoralCommission and by notice published in the Gazette, appoint

    33.-( 1) Upon declaration of the results of the referendumby the National Electoral Commission, the President shall, by anorder published in the Gazette, dissolve the Commission.(2) Dissolution of the Commission by the Order of thePresident shall entail abatement of powers of the Commission andthe Secretariat.34.-( 1) The prOVIsions of the New Constitution shallcome into force on the date that shall be provided for in the NewConstitution.(2) The President shall promulgate, in stich a mannerand style as the President may determine the operationalization ofthe New Constitution.(3) Consequent upon promulgation of the NewConstitution, this Act shall be spent and shall have no legal effect.(4) In the appl ication of this Act, both the Engl ish versionand the Kiswahili version are authentic.

    OBJECTS AND REASONS

    This Bill, which is divided in Six Parts, proposes the enactment ofthe Constitutional Review Act, 2011. The process of constitutionalreview, besides other matters, shall examine consistence and compatibilityof the existing constitution with regards to people's sovereignty,democracy, political systems and good governance. The legal mechanismthat is proposed in various Parts of the Bill, will enable participation of thepeople of the United Republic in the process of constitutional review.Once enacted into law, there shall be a legal framework for the Presidentto establish a Commission for reviewing constitution and to proclaim theConstituent Assembly for the purpose of enacting the New Constitution.

    Initially, this Bill was submitted to the National Assembly and wasFirst Read on the 5th April, 2011. The Bill was presented to stakeholders'meetings organized by the National Assembly and held simultaneously inDodoma, Dar es Salaam and Zanzibar between i h April, 2011 and 9thApril, 2011. The Bill is now re-published in English and Kiswahililanguages for purposes of Second Reading and Third Reading.

    Part I provide for the preliminary matters which include the title,date of commencement and application of the proposed Act. It furtherprovides for the interpretation of certain tenns, designations, words usedand authorities mentioned or sought to be established.

    Part II provide for objectives of the proposed Act. The Partspecify in details the objectives and the essence of constitutional review,including oath and affirmation by members of the Commission andmembers of the Secretariat and the procedure through which theconstitutional reviewwill be undertaken.

    Part III propose to establish a Commission that will coordinate andcollect public opinions. The Commission will be established by Presidentupon consultation and agreement with the President of Zanzibar on the

    advice of the Attorney General of the United Republic and the AttorneyGeneral of Zanzibar. Other issues provided for includes appointment ofmembers of the Commission in equal number from both parts of theUnited Republic whose names will be published in the Gazette. Likewise,this Part makes provisions for adherence of inviolability and sanctity ofcertain matters of national values and ethos as well as the provisions forimmunity of members of the Commission and the Secretariat.

    Part IV deal with the manner in which the Commission willperform its functions and discharge its duties including the mannerwhereby the Commission will prepare and submit its report to thePresident and the President ofZanzibar.Part V vest in the President, powers to proclaim the ConstituentAssembly after consultation and agreement with the President of Zanzibar

    upon advice of the Attorney General of the United Republic and theAttorney General of Zanzibar. The procedure of electing the Speaker andthe Deputy Speaker, the appointment of Clerk and the Deputy Clerk aswell as Clerk Assistants and how they will subscribe to oaths oraffirmation is provided for. Rules of procedure for the conduct of businessby the Constituent Assembly will be promulgated by the ConstituentAssembly, but the Constituent Assembly may with necessary modificationadopt the Standing Orders of the National Assembly. Other mattersprovided for in this Part, includes procedure for appointment of ClerkAssistants of the Constituent Assembly, consequential and transitionalprovisions. It also makes provisions for Acts of the Constituent Assemblyand the manner in which powers of the Constituent Assembly, shall uponcompletion of enacting the proposed Constitution, will abate.

    Part Six provide for validation of the Constitution through thereferendum that underlines the right of the people to vote for the proposedconstitution through the National Election Act, Cap. 343 and the ZanzibarElection Act, 1984. With regards the process, the public, and much so,voters will be'sensitized through public awareness programmes conductedby civil societies, political parties and the Commission. The referendumwill be conducted by the National ElectoraJ. Commission in collaborationwith the Zanzibar Electoral Commission using the Permanent Voters

    8.-( 1) Hadidu za rejea za Tume zitatolewa na Rais kwamakubaliano na Rais wa Zanzibar katika amri ilc ile ambayouteuzi wa wajumbe wa Tume utafanyika na kuainisha mudaambao Tume inatakiwa kukamilisha na kuwasilisha ripoti.

    (2) Rais kwa makubaliano na Rais wa Zanzibaranaweza, kama hali itahitaji kufanya hivyo, kuongeza mudausiozidi miezi mitatu iIi kuwczeshaTume kukamil isha nakuwasilisha ripoti.

    (3) Hadidu za rejea zitakuwa ni hati ya kisheria ambayoTume itaizingatia katika utekeIczaji wa majukumu na utumiaji wa'mamlaka yake kwa mujibu wa Sheria hii.

    Sheria ya Mabadiliko ya Katiba(c) kutokuwa na uwezo wa kutckeleza majukumu yakekwa sababu za kiafya;(d) kuondolewa kwa makosa ya kukiuka Kanuni zaMaadili;(e) kutiwa hatiani kwa kosa ambalo adhabu yake ni

    kifungo gerezani kwa muda usiopungua mwezimmoja; au(f) kllpoteza sifa ambazo kwazo aliteuliwa.(2) Kwa madhumuni ya utckelezaji bora wa majukumu yaTume, kutakuwa na kanuni za maadili kama zilivyoainishwakatika Jedwali la Pili la Sheria hii.(3) Mjumbe wa Tume au Sekretarieti ambaye atakiukamasharti ya Kanuni za Maadili atapoteza sita za kuendelca kuwamjllmbe.

    13.-(1) Kutakuwa na Sekretarieti ya Tumcitakayoongozwa na Katibu.(2) Katibu atateuliwa na Rais baada ya kukubaliana naRais wa Zanzibar.(3) Mtu atakuwa na sifa ya kuteuliwa kuwa Katibuendapo mtu huyo ni mtumishi wa Scrikali na ana taaluma yashcria na amefanya kazi hiyo kwa muda usiopungua miaka kumina ana mwencndo na tabia nzuri.(4) Katibu atawajibika kwa Tume na atafanya kazi nakutekelcza majllkumu ya Sekretarieti.(5) Watendaji wengine wa Sekretarieti watateuliwa naWaziri kwa makubaliano na Waziri mwenye dhamana ya mamboya Katiba wa Serikali ya Mapinduzi Zanzibar.(6) Sekretarieti itakuwa na idadi ya watumishi wa ummakwa kadri itakavyohitajika kwa madhumuni ya utekelezaji borawa majukumu na matumizi ya mamlaka ya Tume.

    14.-( I) Gharama za shughuli za Tume wakati wamchakato wa mapitio ya katiba kwa mujibu wa Sheria hiizitalipwa kutoka Mfuko Mkuu wa Hazina.(2) Wajumbe wa Tume na Sekretarieti watalipwa kwakadri Waziri atakavyoamua kulingana na sheria na kanuni za nehi.

    UTARATIBU WA UTENDAJI KAZI WATUME16.-(1) Tume itatekeleza majukumu yake kwa mujibu waSheria hii na hadidu za rejea.(2) Kwa madhumuni ya utekelezaji wa kifungu kidogocha (1), Tume itafanya kazi zifuatazo:(a) kuandaa. na kucndesha programu za kuelimishajuu yamadhumuni na majukumu ya Tume;(b) kuitisha na kusimamia mikutano au mabaraza katikasehemu na nyakati mbalimbali kama ambavyoitakavyoamua;(c) kutathmini na kuchambua kwa kutofautisha maoni yawananchi yanayokubaliana na yale yasiyokubaliana;na(d) kutayarisha na kuwasilisha ripoti kwa kuzingatiahadidu za rejea.(3) Tume yaweza kumtaka mtu yeyote atakaye hiarikufanya hivyo kwenda mbele ya Tume kufanya majadiliano, kwamazungumzo au kuwasilisha nyaraka, kuhusu jambo lolote lakikatiba .ambalo Tume inaona ni muhimu na Iinahusiana na

    mchakato wa mapitio ya Katiba.(4) Katika kutekeleza majukumu yakechini ya Sheriahii, Tumc itapitia ria kuchambua michango, mawazo, maoni,taarifa na mapendekezo yaliyokusanywa na kufanyiwa tathminisiku za nyu rna ikiwemo:(a) muhtasari wa maoni ya wananchi wanayokubalianana wasiyo kubaliana kwa pande zote mbili za Jamhuriya Muungano;

    (g) Katiba ya Jamhuri ya Muungano wa Tanzania yamwaka 1977;(h) Katiba ya Zanzibar ya mwaka 1979;0) Katiba ya Zanzibar ya mwaka 1984;U) Ripoti ya Pamoja ya Tume ya Fedha na Ripoti yaShellukindo Juu yll' Changamoto za Muungano;

    (k) Ripoti ya Wangwe luu Uharakishaji wa Shiriklsho JaAfrika Mashariki;(I) tafiti za kiuchambuzi na kitaalam zitakazofanywa naTume; na(m) nyaraka nyingine zozote ambazo Tume itaona nimuhimu.

    (5) Tume yaweza:(a) kwa Tanzania Bara, kumtaka Mkuu wa Wilaya, AfisaMtendaji wa Kata au Mtaa au Afisa Mtcndaji waKijiji kuitisha mkutano wa wakazi wa mji, kata, mtaaall kijiji, kwa vyovyote itakavyo kuwa; na

    (b) kwa Tanzania Zanzibar, kumtaka Mkuu wa Wilaya auSheha kuitisha mkutano wa wakazi wa mji au ShehiambaJimbali,

    Sheria ya Mabadiliko ya Katibakwa madhumuni ya kllkusanya maoni ya wananchi kuhusumasuala ya Katiba kama yalivyoainishwa kwenye hadidu za rejca.(6) Kwa madhumuni ya kifungu hiki, kutakuwa namabaraza ya mapitio ya Katiba.(7) Mabaraza ya Katiba yataundwa na Tume kwa mudamaalum kwa kuzingatia mgawanyiko wa kijiografia wa Jamhuriya Muungano na yatashirikisha na kuwakutanisha wawakilishitaka makundi mbalimbali ya watu katika jamii.(8) Mabaraza ya Katiba yatatoa ushauri juu ya Rasimu yaMuswada wa Katiba kupitia mikutana maalum itakayoandaliwana Tume.(9) Mabaraza yanayorejewa katika kifungu kidogo cha (6)na katika vifungu vingine vya Sherin hii yatakuwa maalum kwaajili ya, na yatahudhuriwa na raia wa Tanzania pekec.(10) IIi kutekcleza majukumu yake kwa ufanisi, Tumeinaweza kuunda kamati na inaweza kuipatia kamati yoyotciliyoiunda kazi zajumla au kazi tnaalutn za kufanya.

    (II) Tume inaweza kumshirikisha mtu yeyotc aukumtumia mtaalam mwelekezi yeyote kama itakavyokuwa lazimakwa ajili ya utckelezaji bora wa majukutnu yake.(12) Isipokuwa kama mazingira yatahitaji vinginevyo,katika utekelezaji wa majukutnu yake Tume itabuni utaratibuunaofanana ambao utakaotumika katika kila upandc wa Jamhuriya Muungano katika ukusanyaji na uchambuzi wa maoni yawananchi, uendeshaji wa tnabaraza na llandaaji wa ripoti.17.-(1) Kwa msingi wa mahojiano na uchambuziuliofanywa kwa kuzingatia kifungu cha 16, Tume itatayarisha

    ripati itakayokuwa na:(a) muhtasari \Va maoni ya wananchi kwa kila hadidu yareJea;(b) mapcndekezo ya Tume kwa kila hadidu ya rejea;(c) ripoti za wataalam welckezi ambao Tume iliwatumia;(d) Rasimu ya Muswada wa Katiba; na(e) taarifa nyingine yoyote muhimu.(2) Rasimu ya Muswada wa Katiba itakuwa 111kiambatisho kwenyc ripoti ya Tume.

    20.-( I) Rais, baada ya kukllbaliana na Rais wa Zanzibarna kwa ushauri wa Mwanasheria Mkull wa Serikali ya Jamhuri yaMuungano na Mwanasheria Mkuu wa Zanzibar, kwa kupitiaTangazo la Serikali, atallnda Bunge la Katiba.(2) Hila ya kuathiri masharti ya kifungu kidogo cha (1),Bunge ta Katiba litakuwa na wajumbc wa aina zifllatazo, yaani:(a) Wabunge wote wa Bunge la Jamhuri ya Muungano;(b) Wajumbe wote wa Baraza la Wawakilishi Zanzibar;(c) Mawaziri wenye dhamana ya mambo ya katiba waScrikali ya Jamhuri ya Muungano na Serikali yaMapinduzi Zanzibar;(d) Mwanasheria Mkuu wa Serikali ya Jamhuri yaMUllngano na Mwanasheria Mkuu \Va Zanzibar; na(e) Wajumbe mia Inaja na kumi na sita watakaateuliwakutoka:

    (i) asasi zisizokuwa za kiscrikali;(ii) asasi za kidini;(iii) vyama vya siasa vilivyo na usajili wakudumu;

    Naibu Katibu wa Bunge la Katiba watatcua watumishi kutokakwenye Bunge na Baraza la Wawakilishi kwa idadi watakayoonainafaa kwa ajili ya kutekeleza kwa ufanisi majukumu ya Bunge laKatiba. (5) Katibu na Naibu Katibu wa Bunge la Katiba, kabla yakushika madaraka yao wataapa au kula yamini mbele ya Rais kwanamna ilivyoainishwa kwenye Jedwali la Tatu la Sheria hii.23.-(1) Bunge la Katiba litakuwa na marnlaka nalitatumia mamlaka hayo kutunga upya Katiba ya Jamhuri yaMuungano wa Tanzania na kutunga masharti yatokanayo,masharti ya mpito na vile vile kutunga na kuweka mashartimengine kama Bunge la Katiba litakavyoona inafaa.(2) Mamlaka ya Bunge la Katiba kutunga masharti ya 'katiba yatatekelezwa kupitia Muswada utakaowasilishwa naWaziri na kupitishwa na Bunge la Katiba.24.-(1) Bunge la Katiba linaweza kuandaa kanupi kwaajili ya kllendesha shughuli katika Bunge la Katiba.(2) Bila ya kuathiri kifllngu kidogo cha (1) na kwakuzingatia marekebisho yatakayolazimu, Bunge la Katibalinaweza kutumia Kanuni za Klidumll za Bunge na masharti yoteyanayohusu upitishaji wa Miswada ya Sheria yanayotumiwa na

    Bunge. (3) IIi masharti ya Muswada wa Katiba yap atekllpitishwa katika Bunge la Katiba, yatahitaji kuungwa mkonokwa wingi wa theluthi mbili ya idadi ya wajumbe wote wa Bungela Katiba kutoka Tanzania Bara na theluthi mbili ya idadi yawajumbe wote wa Bunge la Katiba kutoka Tan71mia Zanzibar.

    25.-( 1) Kwa kuzingatia masharti ya Shcria yoyote yaBungc la Katiba, Sheria' ya Tafsiri za Shcria itatumika katikakutoa tafsiri kwa Sheria ya Bunge la Katiba na kwamba rejeakwcnye Sheria hiyo au sheria nyingine yoyotc, isipokuwa kamamuktadha utahitaji vinginevyo, itajumuisha rejca kwenye Sheriaya Bunge la Katiba.(2) Kutakuwa na uhuru wa mawazo, majadiliano nautaratibu katika Bunge la Katiba, na kwa madhumuni hayo,masharti ya Ibam 100 ya Katiba na Sheria ya Kinga, Madaraka naHaki ya Bunge, kwa kuzingatia marekcbisho yatakayolazimu,yatatumika katika Bunge Ia Katiba.

    26.-(1) Baada ya kutunga Katiba, masharti yatokanayo namasharti ya mpito, Bunge la Katiba litavunjwa na mamlaka yakutunga masharti ya katiba, masharti yatokanayo, na masharti yampito yatakoma.(2) Kuvunjwa na kukoma kwa mamlaka ya Bunge laKatiba hakutachukuliwa kuwa kunaondoa mamlaka ya Raiskuliitisha tena Bunge la Katiba lenye wajumbe wale wale sikuzijazo kwa ajili ya kutunga masharti ya katiba kabla ya kuizinduaKatiba inayopendekezwa kwa lengo la kurekebisha mashartiyaliyomo kwenye Katiba iliyopendekezwa.SEHEMU YA SITA

    28.-(1) Ndani ya siku saba baada ya kuchapishwa kwaKatiba, Tume ya Taifa ya Uchaguzi kwa kushirikiana na Tume yaUchaguzi Zanzibar itatayarisha na kuchapisha kwenyc Oazeti IiiScrikali swali litakaloamuliwa kwa kura ya maoni.(2) Swali linalorejewa katika kifungu kidogo eha (1)litatayarishwa baada ya mashauriano na Mwanasheria Mkuu waSerikali wa Jamhuri ya Muungano akishirikiana na MwanasheriaMkuu wa Zanzibar.(3) Swali litakaloulizwa katika kura ya maoni Iitamtakampiga kura kuonyesha kuwa anaridhia au kutoridhia Katiba hiyona Iitatayarishwa kwa namna ambayo litcimtaka mpiga kura kujibu"Ndiyo" au "Hapana".

    (4) Upigaji kura ya maoni utakuwa wa sirL29.-(1) Ndani ya siku kumi na nne baada yakuchapishwa kwa swali katika Gazeti la Serikalit Tume ya Taifaya Uchaguzi kwa kushirikiana na Tume ya Uehaguzi Zanzibaritaainisha:(a)(b)(c)

    siku ambayo kura ya maoni itafanyika;muda wa upigaji kura ya maoni; namuda Wa kuelimisha na kuhamasisha warianchikupiga kura ya maoni juu ya Katibainayopendekezwa.(2) Kwa madhumuni ya kuelimisha na kuhamasishawananchi kuhusu kuipigia kura ya maoni Katibainayopendckezwa, Tume italazimika, na vyama vya siasa na

    vyama vya kijamii vinaweza kutoa elimu ya uraia na kuhamasishaupigaji wa kura ya maoni.(3) Ndani ya siku ishirini na moja baada ya Tume yaTaifa ya Uchaguzi kutangaza taarifa, msimamizi wa uchaguzi wakila jimbo la uchaguzi atatoa taarifa kwa wananchi kuh\lsuutaratibu wa uendeshaji wa kura za maoni.

    31. Utaratibu wa wa Uchaguzi Mkuu chini yaSheria ya Taifa ya Uchaguzi, Sheria ya Uchaguzi ya Zanzibar yamwaka 1984 na Sheria ya Uchaguzi wa Serikali za Mitaa na kwakufanya marekebishoyatakayolazimu, utatumika katikakuendesha kura ya maoni kwa mujibu wa Sheria hii.

    32.-(1) Matokeo ya kura ya maoni yataamuliwa kutokanana wingi wa kura zote zitakazopigwa kwa swali litakalopigiwakura ya maoni na matokeo yatakayotangazwa na Tume ya Taifaya Uchaguzi yataheshimiwa na Serikali yaJamhuri yaMuunganona Serikali ya Mapinduzi ya Zanzibar.(2) Matokeo ya kura ya maoni yataamuliwa kwa msingiwa kuungwa mkono kwa asilimia inayozidi hamsini ya jumla yakura zote zilizopigwa kutoka Tanzania Bara na asilimia inayozidihamsini ya jumla ya kura zote zilizopigwa kutoka TanzaniaZanzibar.(3) Endapo patakuwa na kulingana kwa kura za"NDIYO" na "I-IAPANA" katika swali linalopigiwa kura yamaoni, basi, kwa kupitia faarifa itakayochapishwa katika Gazeti laSerikali na ndani ya siku thelathini baada ya kutangaza matokeo,Tume ya Taira ya Uchaguzi itateua siku nyingine ya kurudiwakwa upigaji kura ya maoni na utaratibu wa kura ya maoni utaanzaupya.

    (4) Endapo wingi wa kura ya maoni utakuwa ni"HAPANA", Katiba ya Jamhuri ya Muungano ya mwaka 1977,itaendelea kutumika.33.-( 1) Matokeo ya kura ya maoni kutangazwa na Tume

    ya Taifa ya Uchaguzi, Rais kwa kupitia amri iliyochapishwakwenye Gazeti la Serikali, ataivunja Tume. .(2) Kuvunjwa kwa Tume kwa amri ya Rais kutakuwa namaana ya ukomo wa mamlaka ya Tume na Sckretarieti.34.-(1) Masharti ya Katiba Mpya yataan:t..a kutumika'tarehe itakayotajwa kwenye Katiba hiyo.(2) Rais atazindua kwa namna atakayoona inafaa kuanzakutumika kwa Katiba Mpya.

    Sheria ya Mabadiliko ya Katiba(3) Baada ya kuzinduliwa kwa Katiba Mpya, Sheria hiiitakuwa imemaliza matumizi yake na itapotcza nguvu ya kisheria.(4) Katika matumizi ya Sheria hii, toleo la lugha yaKiswahili na toleo la lugha ya Kiingercza yotc ni sahihi.

    KANUNI ZA MAADILI YA WAJUMBE WA TUME NA SEKRETARIETI1. Kila mjumbe wa Tunie/Sekretarieti atapaswa kufanya kazi zake kwa uadilifu bila yaupendeleo na bila kuingiliwa na atafanya kazi za ofisi yake kwa nia njcma na bila woga, upendekeoau chuki.2. Mjumbc wa Tumc/Sckretaricti katika kipindi cha kutumikia yake, hatakuwa na sifa yakuteuliwa au kuchaguliwa kwcnye nafasi yoyotc ya kisiasa.

    3. Mjumbe wa Tume/Sekrctariati-(a) kupitia ujumbc wake, hatoshiriki, hatatoa kauli, kufanya matendo au kwa namna yoyote ilekuhatarisha uhuru wa mjumbc au kuathiri hadhi, uadilifu, uhuru au hadhi ya Tume; au(b) kutumia kwa manufaa yake au kufaidika na taarifa yoyote ya siri akiwa kama mjumbe wa Tume .

    Sheria ya Mabadiliko ya Katiba

    MADHUMUNINASABABU

    Muswada huu ambao umegawanyika katika Sehemu Sitaunapendekeza kutungwa kwa Sheria ya Mabadiliko ya Katiba ya Nchi yamwaka 2011. Mchakato wa mabadiliko ya Katiba pamoja na masualamengine utaangalia chimbuko na mahusiano ya Katiba iliyopo kwakuzingatia uhuru wa wananchi, mfumo wa siasa, demokrasia na utawalabora. Utaratibu wa kisheria unaopendekezwa utawahusishe: nakuwashirikisha wananchi wa Jamhuri ya Muungano wa Tanzania katikamchakato wa mabadiliko ya katiba ya nchi. Endapo Muswada huuutapitishwa na kuwa Sheria, kutakuwa na utaratibu wa kisheriautakaomwezesha Rais kuunda Tume ya kukusanya maoni kuhusu Katibana kuunda Bunge la Katiba kwa madhumuni ya kutunga katiba mpya.

    Awali, Muswada huu uliwasilishwa katika Bunge la Jamhuri yaMuungano na Kusomwa kwa Mara ya Kwanza tarehe 5 mwezi Aprili2011. Muswada uliwasilishwa kwenye kikao cha wadau kilichoandaliwana Bunge la Jamhuri ya Muungano na uliendeshwa kwa wakati mmojakatika miji ya Dodoma, Dar es Salaam na Zanzibar kuanzia tarehe 7 Aprili2011 hadi tarehe 9 Aprili 2011. Muswada huu sasa umetangazwa kwamara nyingine kwa kuchapishwa kwcnye Gazeti la Serikali kwa lugha zaKiingereza na lugha ya Kiswahili kwa madhumuni ya Kusomwa kwaMara ya Pili na kusomwa Mara ya Tatu.

    Sehemu ya Kwanza inaweka masharti ya utangulizi ambayoyanajumuisha jina la Sheria inayopendekezwa, tarehe ya kuanza kutumikana matumizi ya sheria inayopendekezwa. Inaendclea kutoa tafsiri yabaadhi ya misamiati na maneno yaliyotumika na mamlaka zilizotajwakatika Muswada.

    Sehemu ya Pili inaweka masharti yanayohusu madhumuni yaMuswada. Sehcmu hii inaainisha kwa undani madhumuni ya chimbuko la

    Sheria ya Mabadiliko ya Katibamchakato wa mabadiliko ya Katiba, ikijumuisha viapo na yamInl zaWajumbe wa Tume na Sekretariati na utaratibu wa kuendesha mchakatowa mabadiliko ya Katiba utakavyofanywa.

    Schemu ya Tatu inaweka masharti ya kuanzishwa kwa Tume nakuainisha utaratibu wa kukusanya maoni. Tume hii itaundwa na Raisbaada ya kushauriana na kukubaliana na Rais wa Zanzibar na kwa ushauriwa Mwanasheria Mkuu wa Serikali ya Muungano na Mwanasheria Mkuuwa Zanzibar. Masharti mcngine yaliyomo katika Sehemu hii ni kuteuliwakwa Wajumbe wa Tume ambao watatoka katika pande zote mbili zaJamhuri ya Muungano kwa idadi sawa na majina yao kutangazwa kwenyeGazeti la Serikali. Aidha, sehemu hii pia inaweka masharti kuhusumambo ambayo yanapaswa kuzingatiwa na kulindwa katika mchakato wakukusanya maoni kutokana na umuhimu na uzito wake katika Taifa letuna inaweka masharti ya utaratibu wa Tume kuwasilisha taarifa na kingakwa Wajumbe wa Tume na Sekretarieti.

    Sehemu ya Nne inaweka masharti kuhusu utaratibu wa utcndajikazi wa Tume pamoja na kuainisha kazi, wajibu na mamlaka ya Tume.Sehemu hii pia inaitaka Tume kutayarisha ripoti ambayo itaambatisharasimu ya Muswada wa Katiba na kuiwasilisha kwa Rais na Rais waZanzibar.Sehemu ya Tano inaweka masharti ya kuundwa kwa Bunge laKatiba ambapo Rais atashauriana na kukubaliana na Rais wa Zanzibarbaada ya kupata ushauri wa Mwanasheria Mkuu wa Serikali ya Muungano

    na Mwanasheria Mkuu wa Zanzibar wataunda Bunge la Katiba. Utaratibuwa kuwapata Wajumbe wa Bunge la Katiba, utaratibu wa kuwapata Spika,Naibu Spika, Katibu na Naibu Katibu wa Bunge la Katiba na jinsiwatakavyoapishwa umeainishwa. Aidha, mamlaka ya Bunge la Katiba namasharti kuhusu Bunge la Katiba pia yameelezwa kwa kina.

    Masharti mengine yaliyomo ni namna ya kuwapata MakatibuWasaidizi wa Bunge la Katiba, mamlaka ya Bunge la Katiba kutungamasharti ya Katiba, masharti yatokanayo na masharti ya mpito, Sheria naKanuni zitakazotumika katika kuongoza Bunge la Katiba na kuvunjwakwa Bunge la Katiba.

    Schemu ya Sita inahusu uha1alishaji wa Katiba inayopcndekezwakwa utaratibu wa kura ya maoni, utaratibu wa uendeshaji wa kura yamaoni itakavyotolewa, ikiwa ni pamoja na haki ya wananchi kupiga kuraya maoni kama inavyoelekezwa na Sheria ya Taifa ya Uchaguzi na Sheriaya Uchaguzi ya Zanzibar ya mwaka 1984.

    Wakati wa mchakato wa kura ya maoni, wananchiwatahamasishwa kupitia vipindi maalumu vitakavyoendeshwa na vyamavya kiraia, vyama vya siasa na Tume. Kura ya maoni itaendeshwa naTumc ya Taifa ya Uchaguzi kwa kushirikiana na Tume ya Uchaguzi yaZanzibar kwa kutumia Daftari la Kudumu la Wapiga Kura, kwa upandcwa Tanzania Bara na Daftari la Wakazi, kwa upande wa TanzaniaZanzibar.

    Katiba Mpya itabainisha tarehe ya kuanza kutumika na namna Raisatakavyoizindua na kuanza kutumika. Sheria hii inayopendekezwa,ambayo kimsingi sasa itakoma kutumika na masharti yake yatapotezanguvu ya kisheria mara tu baada ya kuzinduliwa kwa Katiba Mpya.
