3. The Grand Lodge shall meet statedly

oncea year, for the communicationof all thelodges, and may have occasionalcommunica-tions, as businessmay require, at such timesand placesas the GrandI~4aster shall appoint.

4. It shall be the duty of every lodge tobe representedat the communicationsof the

GrandLodge by its Masterand Wardens,orby a proxy, duly commissionedin writingunderthe seal of the lodge, the commissionlobe signed by the Master and attestedby theSecretary. And, that theremay be no neglectof this duty, each lodge is authorized,at itsannualeLection, to elect any Master Mason ofregular staiiding in said lodge, not holdingoffice in the Grand Lodge, a proxy to repre-

sent it there in the absenceof the MasterandWardens,and shall, at least one week beforethe annual communication,deliver the certifi-cate of proxy to the Grand Secretary.

~. No brother who is not a PastMasterofa lodge inAhis jurisdiction shall be eligible 10any office in the GrandLodge; GrandChap-

lains, Grand Organist and Grand Tyler ex-cepted. It is incompatible with the laws of

this society for any brother to hold more thanone office in the Grand Lodge at the sametime.

6. Each permanentmember of the GrandLodge shall be allowed one vote and no more,and every lodge in this jurisdiction shall beallowed three votes and no more, in all elec-tions in the GrandLodge.

W.Deputy Grand Secretaryshall be elected byballot by the membersof the Grand Lodgepresentat each statedannual communication.A majority of all the votes castshall be neces-sary to constitute a choice. If there be nochoice on the first ballot, thena secondballotshall be taken, which shall be confined to thethreecandidateswho shall receivethe highestnumber of votes. Should there be no choiceon the secondballot, then a third ballot shallbe cast,which shall be confinedto the two can-didates who, received the highestnumber oFvotes on the secondballot.

8. The GrandLodge shall havepower—

First. To constitute new lodges by war-rantsunder its seal and the signaturesof theGrand Master, Deputy Grand Master andGrand Wardens,attestedby the GrandSecre-tary.

Second. To establish a uniform mode ofworking throughout the jurisdiction, strictlyadheringto the ancientlandmarks,usagesandcustomsof Masonry,which are on no accountto be removedor violated.

Third. To require from the several lodgesunder its jurisdiction such annual dues as itshalldeemnecessaryto be appropriatedfor thebenefit of the Craft.

Fourth. To hearanddetermineall appeals,anddecidein all disputesbetweenlodgesunderits jurisdiction.

Fifth. To requiresuch a fee as it maydeemjust and reasonablefor grantinga warrant toestablisha new lodge.

Sixth. To makeall by-laws, rulesandregu-lations not inconsistentwith this constitution.

9. No alteration or addition shall be madeto this constitution unless proposedin writ-ing, and supportedby representativesof fivelodges; anda fair copy thereof, certified bythe GrandSecretary,shall be forwardedto allthe lodgesunder the jurisdiction of this GrandLodge For their consideration,until its next

annual communication, and such proposedalteration or addition shall not take effect un- bY-LAWS.less there shall appear therefor the votes oftwo-thirds of the memberspresent.

ARTICLE I.

i. The annualcommunicationof this GrandLodge shall be held at eleven o’clock A. M.,on the first Wednesdayafter the third Tues-day in April, in everyyear; subject,neverthe-less, to be changedas to time and date ofmeeting, by a majority vote of the Grand

Lodge at its annualcommunication.2. No brother, unlesshe be a member of

the Grand Lodge, shall be admitted to themeetings thereoF without permission of theGrandMasteror the GrandLodge. Nonebutmembersof the GrandLodge shallbe allowedto speakto any questionunlessby permissionof the GrandMaster.

3. Each lodge shall, within one week afterthe annual election of said lodge, deliver tothe Grand Secretaryan exact return, signedby the Master and attestedby the Secretaryunder the seal of the lodge, of the namesand

titles of the officers, and the namesof thosewho have becomememberssince the last re-turn; the datesof initiations, affiliations andrejections of candidates; the birthplace, ageandoccupationof candidatesinitiated or ad-mitted during the year; the deaths,dimissions,suspensions,expulsionsand reinstatementsofmembers, and its usual time and place ofmeeting.

4. If any lodge shalb neglect to send arepresentativefor threesuccessiveannualcom-munications,such lodge maybe strickenfromthe list andits warrantdeclaredforfeited; but,on applicationto the Grand Lodge, the war-rant may be restored.

~. The officers of the Grand Lodge shallwear their official jewels while attending itscommunications. No Past Master or repre-sentativeof a lodge shall be allowed to votein the Grand Lodge without the appropriateclothing or the jewel of his station,exceptbypermissionof the Grand Master.

6. The expensesof the Grand Officers andthe committeesof the GrandLodge,while in

attendanceat its communicationsor while en-gagedin the performanceof official duty, shallbe paidout of its treasury.

7. No warrantshall be grantedfor the for-mation of a lodge but upon the petition ofat least seven known and approv~ed MasterMasons,from whom the first MasterandWar-dens shall be nominated. The petition mustbe accompaniedby a certificatefrom the lodgenearest to the place where the new lodge isproposedto be located, which certificate shallset forth that the applicantsare duly qualifiedto become constituent members of a lodge;that the brethren chosen to be Master andWardensof the proposednew lodge haveex-emplified the standardwork to the satisfac-tion of said lodge; that eachof the petitionersis in possessionof a regular dimit or hasgivensatisfactoryevidencethat the lodge oF whichhe was last a memberis no longer in existence,and that he is not in arrearsfor dues. Saidlodgeshallalsocertify that the petitionershavesecureda suitable room in which to hold aMasonicLodge. Said lodge may or may notrecommendthe forming of the proposednewlodge andmay or maynot expressits opinion

No warrant shall become operative untileachof the petitioners shall have depositedadimit, or other proper certificate, with theGrandSecretary,which dimits and certificatesshall be deliveredto the new lodge whencon-stituted. 1921, pp. 282, 309; 1923, p. 462.

8. No dispensationor warrant for the for-mation of a new lodge shall be grantedex-cept upon the paymentof fifty dollars, andno dispensationshallbe grantedto confer oneor more degreesexcept upon the paymentoftwenty dollars, which shall be paid to theGrandLodge.

9. livery lodge under this jurisdiction shallpay annuallythe sum of fifty cents for eachand every member thereof in good standingat the time of its annualelection; andalso thesumof onedollar and fifty centsfor eachandevery person raised to the degreeof MasterMasonin said lodge during the current year,and such paymentsshall accompanysuch an-nual return. There shall also be paid at thesame time special assessmentsof five centsper capita as a contribution to the Grand

Lodge Charity Fund, and an additional sumof one dollar per capita as a contributionforthe maintenanceof the Masonic Home.

ARTICLE II.

ELECTION AND INSTALLATIO& or GRAND

OrFICERS.

i. Immediately after the opening of theGrandLodge, the Grand Secretaryshall placethe ballot-box upon his table, wherein anymemberof the GrandLodge mayplace nomi-nations for any or all of the elective GrandOfficers; which nominationsshall be readforthe information of the Grand Lodge, beforeproceedingwith the election.

2. No brother shall be eligible to any officeunlesshe be presentto signify his acceptancethereof,or hasauthorizedsomeone presenttoaccept for him.

Balloting for the electionof officers shall beconductedas follows:

Each District Deputy shall be seatedwithhis district. The District Deputiesshall collecttheballotsof iheir respectivedistricts in boxesprovided for that purpose,and shall deliver

the boxes to the tellers, who shall count thevotes.

In case oE the absenceor disability of aDistrict Deputy the Grand Master is to ap-point a brotherof that district to perform theaforesaidduties.

The ballots of the GrandLodge officers andthoseseatedon the platformareto be collectedby the SeniorGrandDeacon,who shall deliverthem to the tellers.

During the eLection of officers all visitorsshall retire, except those who remain by ex-press permission of the Grand Master.

3. The Grand Officers, when elected, shallbe immediately installed into their respectiveoffices, either in person or by proxy. Theproxy of the GrandMastermustbe either thelast or a former GrandMaster.

ARTICL.~ III.

POWERS AND DTJTI~S O1~ GRAND OI~IC~RS.

i. The Grand Master shall have power toconvenethe Grand Lodge at any time whenthereshall appearto him a sufficient occasion.He maycall on anyofficer or member for ad-vice, assistanceor instruction on any business

relative to the Craft. He is likewise investedwith powerto grantdispensationsathis discre-tion, during the recessof the Grand Lodge.But dispensationsfor the purposeof congre-gating a sufficient numberof brethrento formand open a lodge, and when openedto enterand make Freemasons,shall not be in forceanylonger than until the next annualmeetingof the Grand Lodge. Ip caseof the absenceor disability of the Grand Master, the dutiesof his office shall be dischargedby the DeputyGrand Master, and in propersequenceby theGrand Wardens respectively.

2. The Grand Treasurer shall deposit allmoneys of the Grand Lodge in. a bank ofdeposit in this State, in the name of “TheGrandLodge of the Most Ancient and Hon-orable Society of Freeand AcceptedMasonsfor the State of New Jersey,” andshall drawout the same only by the authority of theGrand Lodge, or by the Grand Master in therecess, by check or draft, countersignedbythe GrandSecretary;andall surplusfunds ofthe GrandLodge orderedto be investedshallbe investedin the nameof the Grand L4odgeas aforesaid, and shall not be assigned. lie

shall also annuallymakeout a detailed reportto the GrandLodge of all moneysreceivedandpaid out by him.

In caseof the disability of the GrandTreas-urer, from whatevercause,to perform the du-ties of his office, the Grand Master shall ap-point somememberof he GrandLodge to actas Grand Treasurerduring the incapacity ordisability of the GrandTreasurer.

The Grand Master shall be the judge of theincapacityor disability of the GrandTreasurerand as to his recovery from suchincapacity ordisability.

3. The Grand Secretaryshall havecustodyof the archives. He shall keep fair recordsofall the transactionsof the GrandLodge. Heshall keepa register for the particular purposeof entering all warrants,dispensations,and thenameof every memberof eachlodge, togetherwith the returnsfrom the severallodges. Heshall furnish the first-namedpersonon everycommittee,as soonas possible,with a copy oftheminutesandpaperswhich relateto thebusi-nessof suchcommittee, for which he shall takea receipt; and the personso first namedshallcall the committeetogether,andbe answerable

for the papers,which he shall return with thereport. No warrantor instrument of writingfrom the GrandLodge is authenticwithouthisattestationand signature, and under seal, asthe laws require. The generalcorrespondencewith the lodges and brethrenover the wholeworld is to be conductedby him, agreeablytothe voice of the GrandLodge anddirection ofthe Grand Master. He shallpromptly furnishthe C6mmittee on Foreign Correspondencewith the proceedingsof other Grand Lodgesfor review, and forward to every lodge, at theexpenseof the GrandLodge, reportsof its an-nual proceedings. He shall receiveand keepa proper accountof all moneys of the GrandLodge, and pay over the sameto the GrandTreasurerwithout delay. He shall report an-nually to the Grand Lodge the amount oImoney receivedby him, by items, and the spe~cific sourcesfrom which it was received; alsothe namesof the lodgesthathaveneglectedtC

render properannualreturns. In ca9e of th.absence,disability or deathof the Grand Sec-retary, the duties of his office shall devolveupon the Deputy GrandSecretary,who shallthen receivethe emolumentsthereof.

4. There shall be appointedat each annualcommunication~of this Grand Lodge, by theGrand Master-elect,a proper and competentmember of this Grand Body, who shall beknown as the Right Worshipful Grand In-structor, who shall be the custodianand con~servatorof the standardMasonicwork of NewJersey,and whose instructionsconcerningthesameshall be followed by the District Deputiesand the lodges of this jurisdiction.

It shallbe the duty of the Grand Instructorto impart the standardwork of this jurisdic-tion to the District Deputies,andalso to offi-cers of lodgeswho may visit him for instruc-tion therein.

~. This jurisdiction shall be divided intotwenty-four Masonic districts, each of whichshall be under the chargeof aDistrict Deputy.

6. The severaldistricts shall be designatedand District Deputies appointedand assignedby the Grand Master immediately after hisinstallation.

7. It shall be the duty of each DistrictDeputy, under the supervisionof the GrandMaster, to obtain and thoroughly commit tomemorythe standardwork, as impartedby the

Grand Instructor,as soonas practicableafterhis appointmentto oflice; and upon the occa-sion of his official visitation to each lodge as-signedto his care he shall require the exem-plification of the secretwork, by the regularofficers of the lodge, upon a substitutefor acandidate,and shall correct all inaccuracies;to make an official visit to every lodge in hisdistrictat leastoncein eachyear; to examinethe books and recordsof each lodge, and seethat they are properly kept; to ascertain thestate and condition of the lodges; to receiveandsecurethe funds andpropertyof any dor-mant or extinct lodge in his district, and im-mediatelytransmitthe sameto the Grand Sec-retary; to make report of his doings and ofthe generalcondition of Masonry in his dis-trict, with such particularsas he may deemnecessary,and transmit such report to theGrandMaster at least two weeks prior to theannual communicationof the Grand Lodge,or wheneverrequiredby him; andto performsuchotherdutiesandservicesas maybe depu-ted or intrustedto him by the Grand Master.

8. The Grand Pursuivantshall be stationedinside the door and announcethe namesand

titles of all personsreportedto him by theGrand Tyler.

9. The Grand Tyler shall guard the doorof the GrandLodge on the outside, report allbrethrenseekingadmission,and see that noneenter but such as are duly authorized andproperly clothed. He shall serve summonses

andperformall the customaryservicepertain-ing to his office.

io. The GrandTreasurer,GrandSecretary,Grand Instructor and Grand Tyler shall re-ceive such statedcompensationfor their serv-ices as the Grand Lodge shall direct.

ARTIcLE IV.

CHARGES AND APPEALs.

‘. Every chargebrought before this GrandLodge against any Master or Warden of alodge shall be made in writing, specifying—first, the charge; second, the circumstancesandacts upon which the chargeis based. TheMaster or Warden so charged shall be fur-nished with a copy thereof by the GrandSec-retaryor his Deputyat least onemonth beforethe time appointed for the trial of the same.

2. All appealsshall be in writing, and shallcontain the exceptionsof the appellantto theproceedingsand the action of the lodge ap-pealed from, andshall be filed with the GrandSecretary. The appellantshall give notice tothe lodge from whose action the appeal istaken, of his intention to appeal,at least onemonth before the next annualcommunicationof the Grand Lodge; whereuponit shall bethe duty of the Secretaryof such lodge to fileimmediately, with the Grand Secretary,dulycertified under his hand and the seal of thelodge, the chargespreferred in the case, thewhole of the evidencetaken before the lodgeor committee, and a copy of all minutes ofthe lodge which refer to the matter in contro-versy.

ARTIcLI~ V.

ORDER AND RULES OF BUSINESS.

i. The GrandLodge shall proceedto busi-nessat the hour and placeappointedas soonas a representationfrom at least fifteen lodgeson record is present.

2. The representativesof each lodgeshall beseatedtogether,lodges and Past Masters in

numerical order of districts, beginning fromthe east, the odd-numbereddistricts on thesouthside and the even-numbereddistrictsonthe north side of the GrandLodge.

3. Th~ Order of Businessshall be as fol-lows:

First. The reading of the minutes of thelast annual and emergentcommunications.

Second. Reading of the address of theGrandMasterandreportsof the GrandTreas-urer andGrand Secretary.

Third. Considerationof reports of commit-

tees previously madeand deferred.Fourth. Reportsol committees.Fifth. Petitions.Sixth. Miscellaneousbusiness.Seventh.Election of officers.Lighth. Installation of officers.Ninth. Appointmentof the following Com-

mittees:A Committee on Dispensationsand War-

rants,which shall report upon the grantingofdispensations,the propriety of granting war-rants to the recipientsof such dispensations;andalso all applicationsfor warrants,and allcasesof forfeitedwarrants.

A Committee on Printing, which shall actfor the Grand Lodge in consideringbids andawardingcontractsfor printingsuch matterasshall be orderedby the Grand Lodge.

A Committee on Foreign Correspondence,to which shall be referredall mattersinvolvingthe relations between this and other GrandLodges. This committeeshall makea reportor a review of the proceedingsof other Ma-sonicbodieswith which this GrandLodge is inzommunication,which shall be printed in theannualproceedings.

A Committeeon Finance,to which shall bereferred all recommendationsand resolutionsinvolving the appropriation of funds of theGrand Lodge.

A Committeeon Audit, which shallexamineinto and audit quarterly the severalaccountsof the GrandTreasurerand the GrandSecre-tars-, the Masonic Home and the Trusteesofthe GrandLodgeand report the result of suchaudit at each annual coinnaunication of theGrandLodge.

A Committeeon ConstitutionandBy-Laws,to which shall be referredall propositionstoalter, amendor addto the constitution,by-laws

andgeneral regulationsof the GrandLodge,the code for trial of chargesand the by-lawsof lodges.

A Committeeon MasonicJurisprudence,towhich shall be referred all decisionsof theGrandMaster,andquestionsof Masonicjuris-prudence. During recessof the GrandLodgeit maybe called upon by the GrandMaster foradvice.

A Committeeon AppealsandGrievances,towhich shallbereferredall appealsarisingfromchargespreferred. It shall be the duty of thiscommittee to determine, from the submittedrecord only, whether or not the appeal wasregularly takenandperfected; that the lodgehadjurisdiction of the persons,andthata Ma-sonicoffensewas charged;and, if so, that thespecifications stated facts which, if proven,constitutedthe particular offense charged.

The jurisdiction of the lodge, its conformityto the procedurespecified in the code fortrials being ascertained,the committee is toreport upon the question of material error,

either of law or fact, at the ttial, to the detri-ment of the appellant. The lodge being thesole tribunal for the determinationof issues

raised by or between individual members,itsconclusionson questionsof fact are not to bedisturbed, unlesscontrary to the overwhelm-ing weightof the submitted testimony;and onquestionsof law the actionof the lodgeshouldnot be disturbedunlessa denial of justice toone of the partiesis apparentfrom the recordof the trial. The committeeis not to receiveor pass upon additional evidenceor hear exparte statementsof additional testimony notcontainedin the submitted record.

A Committee on Jurisdiction of Lodges,which committeeshallhavepowerto determinethe territorial jurisdiction of each lodgewhen-ever such jurisdiction is in dispute, subject,however,to the approvalof the GrandLodge,or, in the interim, of the Grand Master.

A Committeeon Ritual, of which the GrandInstructorshallbe chairman,which shallassistin the conservationof the Ritual andpassuponmattersreferredto it regardingits proper in-terpretationand rendition.

There shall be five Trusteesof the GrandLodge, one of whom shall be elected for fiveyearsat eachannualcommunication. 1919, p.296.

Vacanciesin the office of Trusteescreatedby the death,resignationor removal from thejurisdiction of an incumbent,shall be filled adinterim by an appointmentby the GrandMas-ter until the nextannualcommunication,whenan electionshall be held for the unexpiredtermsovacated.

It shall be their specialduty to care for, in-sure,preserveandmaintainin properrepairtheproperty in their charge. They shall havethemanagementand control of the businessandproperty of the Grand Lodge, and subject tothe provisionsof the statutesof NewJersey,tothe act of incorporation,and to theseby-laws,mayexerciseall the powersof thecorporation.

They are authorized to invest the inactivefundsof the GrandLodge to anyamount lessthana remainderof threethousanddollars ofthe aggregatetotal of such funds,not presentlyrequiredto meetexisting obligations,or to de-fray immediately prospectiveexpendituresal-readyauthorized;provided, that such surplus

4. The Standing Committees on Dispensa-tions and Warrants, Constitution and By-Laws, Masonic Jurisprudence,Appeals andGrievances,andRitual, shall eachbe composed

3’of five members. All other committees,ap-pointed by the Grand Master, shall consist ofthree members,unless otherwise specified byvoteof the GrandLodge.

Recordof the proceedingsof eachcommitteeshall be kept anda full report of the samebemadeat the next annual communication.

It shall be the duty of every standingorspecial committee, to which any questionorsubject is referred for investigationor con-sideration, to embody in its report thereonaclearandconcisestatementof the subject-mat-ter before presentingan opinion or commentspertinentto the same;andwhateverrecommen-dations the committeeshall deemit proper tomake shall be submitted,with its reasonsforoffering them, in the form of specific resolu-tions appendedto the report for decisiveactionby the GrandLodge.

6. The Grand Mastershall decide all ques-tions of orderandwithout debate.

ii. When a motion is madeand seconded,it shall, before debate,be statedby the GrandMaster; or, if in writing, it shall be readaloudby the GrandSecretary.

C2. When a question is under debate,nomotion shall be received except to postpone,commit, or amend,and thesemotions shall beput in the order in which they stand.

13. A motion to amend,until decided,shallpreclude all other amendmentsof the mainquestion.

14. Any membermay call for a division ofthe quest?on where the samewill admit of it.

i. TheancientregulationrequiringtheMas-terto haveservedas a Warden,shall be strfctlyenforcedin this jurisdiction.

2. No brother shall be permitted to vouchfor anypersonapplyingto visit a lodge,unlesshe hassat in openlodgewith him as a MasterMason or has examinedhim under the direc-tion of the Master.

3. No lodgeworking underthis jurisdictionshall confer the degree of Fellow Craft orMasterMasonuponanybrotherwho hasbeeninitiatedor passed(asthe casemaybe) in anyother lodge, unlessthe brotherapplying shallproduce a recommendationor certificate ofgoodstandingfrom the lodgein which he waselected.

4. No lodge under this jurisdiction shall re-ceive any petition for initiation or affiliation,except at a stated communication thereof.Such petition shall be referredto a committee

No lodge, whose territorial jurisdictionhasnot beendefined,shall actupon a petitionol anyapplicantfor initiation whoseresidenc.emay be nearer some other lodge under thisjurisdiction,without the consentof suchlodge,except lodges located in cities and townshipswhich shall have concurrent jurisdiction insuch cities andtownshipsrespectively.

6. No lodge shall confer the three degreesof Masonry for a less sumthan thirty dollars.ten dollarsof which shall accompanythe peti-tion; and no lodge shall require the paymentof a fee for the affiliation of a brother.

9. No lodge shall make more than fiveMasons at one and the samecommunication,nor confer a degreeon more than five candi-datesat a time.

10. A. brother ~ho has dimitted from alodge, cannotagainbe madeamemberof thator any other lodge except by affiliation; andno brother shall be a member of more thanone lodge at the same time.

ii. There shall be no Masonic procession,other than funeral processions,without theconsentof the Grand Master; or, in his ab-sencefrom the jurisdiction, or incapacity, ofthe nexthighestGrandOfficer.

who reside in the immediatevicinity of suchlodge, so far as relate to the conductand be-havior of such Masonswhile so resident.

13. Every lodge has the inherent righ~ tomakeby-laws andregulationsfor its own gov-ernmentandconcerns;provided,that such lawsand regulationsare conformableto the prin-ciplesandlandmarksof the Craft, andthe lawsand regulationsof this Grand Lodge.

14. Upon the demise of any lodge withinthis jurisdiction, the last SecretaryandTreas-urer of said lodge shall, within one monththereafter,surrenderto the Grand Secretaryall the books, papers,jewels, funds and furni-ture of the lodge so demised,to be depositedin the archivesof the Grand Lodge; nor shallany former member of said demisedlodge inarrearsfor dues be affiliated with any otherlodge until he shall havepaid such arrearstothe Grand Secretary.

i~. Any memberof anyof the lodgeswithinthe jurisdiction of this Grand Lodge (exceptan officer duly elected and installed, or anofficer of .the Grand Lodge), who shall be inarrearsfor duestwelve months,andwho shallrefuseor neglectto pay the samewithin three

months after demand thereof shall have beenmadeby the Secretaryof the lodge to whomthe sameare due and payable, may be sus-pended,after dueand timely noticeof ameet-ing of the lodge at which he may be heardinregardto his proposedsuspension.

i6. The electionof officers shall be held bythe several lodges under this jurisdiction, atthe statedcommunicationto be held on or im-mediately precedingthe feastof St. JohntheEvangelist (December27th), andin casesuchcommunication shall happenon the 24th or25th of December,or on a Sunday,thensuchelectionshallbe heldat the statedcommunica-lion immediatelyprecedingsuchdate; andtheSecretaryof each lodge shall,within one weekafter such election, report in writing- to theGrandMasterandGrand Secretarythe namesof the Master,WardensandSecretaryelected,with their post-officeaddress.

17. No Master-elect shall enter upon theduties of his office previousto his havingbeenduly qualified and installed in his own lodge.

i8. In caseof the suspension,expulsionorrestoration of a member,either of the GrandLodge or a lodge, two-thirds of the votes of

19. The useof anybook,documentor paper,written or printed,or in cipher, purporting tobe the secret ritual of Freemasonry,is abso-lutely prohibited.

20. In all casesnot provided for in theseby-lawsand regulations,the Craft shalladhereto and be governedby the ancient Masonicregulations.

21. No alteration or addition shallbe madeto these by-laws and regulationsunlesspro-posedin writing. If seconded,the propositionshalllie over for theconsiderationof the GrandLodgeat its nextannualcommunication; pro-vidcd, however,that any such propositionmaybe acted upon at the samecommunicationatwhich it is made,by unanimousconsent.

When a member of a lodge, amenabletotrial in a lodge, shalibeaccusedof acrime oroffense which, if proven, would subject himto Masonic discipline, the proceedingsin thepremisesshall beconductedin accordancewiththe following:

RULES.

i. The accusationshall be reducedto writ-ing, specifying first the charge, which shallconsist of a generalstatementof the o~ensechargedagainstthe accusedbrother; second,the specifications, which shall specify sepa-rately eachact of the accusedupon which thechargeis based,each specification coveringasingle act or series of acts, constituting oneoffense,togetherwith the time andplace when

The charge and specifications shall bepresentedto the lodge having jurisdiction, ata statedcommunication, signed by a MasterMason in good standing,and if receivedbya vote of the lodgethe Mastershall forthwithand under the seal of the lodge, notify theDistrict Deputy of the Masonic district inwhich such lodge is included, that chargeshavebeen regularly preferredagainstthe ac-cused brother, and shall serveor causeto beservedupon the District Deputy,and upon theaccused,personally, if practicable, otherwiseby mail, directed to his last known place ofresidence,with the postageprepaidthereon,acopy of the chargesand specifications,attestedby the Secretaryunder the seal of the lodge,and in the samemannershall serveupon theaccusedandaccusera notice that the DistrictDeputywill be presentat astatedcommunica-tion of the lodge, to be determinedby him, tobe held, in caseof personalservice,not lessthan ten, and in caseof service by mail, notless than twenty days after service of suchnotice.

3. SuchDistrict Deputyshall attendat sucricommunicationof the lodge, upon at least tendays’ previous notice, and shall have power,upon objectionbeing madeby or on behalf ofthe accused,or by any brother of the lodgor in his discretion, to strike out any chargeor specification that he may deem frivolous,defective,insufficient or Masonicallyunlawful,either in form or substance. He shall thenpresentthe namesof fifteen MasterMasonsofthe Masonicdistrict in which the accusedre-sides,who are in good Masonicstanding,andthe accuserandaccused,or if either the accuseror accusedbe neitherpresentnor representedby counsel, or if, being present,either refusesto act, then some brother of the lo&lge, ap-pointed by the Master to representthem, oreither of them, shall eachstrike from suchlistfour names,and the seven remaining namesshall constitutethe committee to whom suchchargesandspecificationsshallbereferred,andwho shallactas a jury to hearall the evidenceoffered by the accused,accuserand witnesses,and to determinethe guilt or innocenceof theaccused.

4. The committee, all of whom must hearall the evidence,shallassemble,at a time to bedesignatedat saidcommunicationby such Dis-trict Deputy, in the room occupied by thelodge to which the accusedbelongs, or atsomeother convenientplace to be selectedby

the District Deputy. The District Deputyshall be in chargeof the hearingsat suchtrial,and shall have power to reject any irrelevantor improperevidencethatmaybe offered. Thelodge to which the accusedbelongs shall ap-point a competentbrotherto act as secretary,who shall keep a complete record of all theproceedingsbefore such committee, includingall the testimony offered in connection withthe casepandsuch lodgeshallpay thenecessarycost of the servicesof such secretary.

If the accuserbe neither presentnor repre-sented at such meeting, the District Deputyshall adjourn the hearing for one or moretimes, not exceedingeight days each, givingboth partiesat least two days’ notice of suchadjournedday. If the accuserbe neitherpres-ent nor representedat such adjournedmeetingor meetingsthe District Deputymayreport thechargesand specificationsback to the lodge

at its next stated communication; and if soreported they shall be forthwith dismissed;provided, however, that if the accused beneitherpresentnor represented,the committeemay proceedex parte.

In casesuch District Deputy shall be per-sonallyintefestedin the controversy,or physi-cally incapacitated from acting, the GrandMastershall commission,underhis privateseal,anotherDistrict Deputy to conduct the trial.Such commissionshallbe filed with the GrandSecretaryat the closeof the trial.

~. No personshall be presentduringthe in-vestigation beFore the committee without itsconsent,except the District Deputy duly em-powered,the Masterof the lodge, the accuseror accusers,the accused,their counsel,a secre-tary andthe summonedwitnesses; exceptthatthe District Deputy may, in his discretion, atany stageof the proceedings,call upon somebrotherlearned in Masoniclaw to advisehimin the properperformanceof his duties.

6. At the commencementof the trial thecharge and specificationsshall be read aloudby the secretary,and the accused,if present,shall be required to pleadguilty or not guilty

At the requestof eitherparty all witnesses,except the one under ex-amination,maybe excludedfrom the room.

7. The partiesinterestedshallhavethe bene-fit of counsel, if they desire; provided, saidcounsel shall be affiliated Master Masons ingood standing.

S. In casea witness is not a Master Masonthe testimony may be takenby the committee,the witness having been first sworn in theirpresence before some person, designatedbythe District Deputy, who is authorizedby thelaws of this State to administeroaths.

9. In taking testimony, interrogatoriesmaybe propoundedeitherby the committeeor theparties or their counsel, in the discretion ofthe District Deputy.

If either party desiresthe testimony of anypersonwho resides,or is out of this State,oris unableto attendbefore the committee,suchtestimonymay, at the discretionof the District

Deputy, be takenbefore anypersonauthorizedby the laws of this Stateto administeran oathin the placewherethe testimonyis to be takenupon such notice to the oppositeparty as theDistrict Deputymay direct; the persontakingsuch testimonyshall first take an oathor affir-i-nation, fairly andimpartially to takethe same;the testimonyof such witness,if not a MasterMason, shall be taken on oath or affirmationupon ititerrogatoriesto be thenand there putby the partiesor either of them,or anypersonauthorizedin their behalf, and such interroga-toriesandthe answerstheretoshall be reducedto writing by the officer taking such testimony,and shall be subscribedin his presenceby thewitness,and thereuponthe sameshallbe certi-fied, sealed up and mailed, or deliveredper-sonally to the District Deputy who is conduct-ing the trial, by whom the sameshall be openedandpresentedto the committee,who shall de-liver the samewith other testimony as here-inafter provided; provided,that the party ap-plying for the examinationof the witnessshallfirst pay all expensesof taking and transmit-ting such testimony.

io. The District Deputy shallhavepowertosend for personsandpaperson behalf of thepartiesinterested,and to require the Secretaryof the lodgeto issue and servesuch summons,in due form, as may be necessaryfor thatpurpose,and may adjourn the hearing fromtime to time in his discretion.

ii. At the close of the hearings,andafterthe accusedandaccuserand their counselshallhavehadan opportunity to discuss,befbrethecommittee, the guilt or innocence-of the ac-cused, the committeeshall carefully consider,in secret,the evidencetaken, andshall rendera verdict of “guilty” or “not guilty” as to eachof the specifications. Five (~) adversevotesshall be required to establishthe guilt of theaccused.

[2. The testimony shall be reducedto writ-ing anddeliveredto the Secretaryof the lodgeat the close of the examination,togetherwiththe information that the committeehas founda verdict of guilty or not guilty as to eachofthe specifications.

13. If the committeeshall find the accusednot guilty, such verdict, when communicated

to the lodge, shall terminatethe proceedings;but if the committeeshall have found the ac-cused guilty on one or more of the specifica-tions, the membersof the lodge shall be sum-monedto meetat the nextregularcommunica-tion of the lodge,or suchsubsequentcommuni-cation as the lodge shall appoint, for the pur-poseof determiningthe degreeof punishmentto be inflicted upon the accused. Neither theaccusernor the accusedshall be allowed in thelodge while such penalty is being determined.

14. When readyto proceedwith the matterof determiningthe gradeof punishmentto beinflicted, the Master of the lodge shall causethe chargeandspecificationsandthe verdict ofthe committeeto be read. 1923, pp. 380, 440,

Of LODGES.

A LODGE is a Placewhere A/Iasonsassembleand work. Hencethat Assembly,or duly or-ganizedSociety of Masons,is called a LODGE,

and every Brother ought to belongto one, andto be subjectto its By-Lawsandthe GENERAL

REGULATIONS. It is eitherparticular orgeneral,and will -be best understoodby attending it,andby theRegulationsof the Generalor GrandLodgehereuntoannexed. 6. You are cautiously to examine him, insuch a Method as Prudenceshall direct you,that you may not be imposed upon by anignorant falsePretender,whom you areto re-j~ct with Contemptand Derision, andbewareof~giving him any hints of Knowledge.

But if you discover him to be a true andgenuineBrother,you areto respecthim accord-ingly; and if he is in want, you must relievehim if you can, or else direct him how he maybe relieved. You must employhim somedays,or else recommendhim to be employed. Butyou arenot chargedto do beyondyour Ability,only to prefer a poor Brother, that is a goodMan and tri e, before anyotherpoor Peopleinthe same circumstances.
