NEW JERSEY CARES

Model Policy Prohibiting Harassment,Intimidation and Bullying on School Property,at School Sponsored Functions and on School Busses

Legislation (N.J.S.A. 18A:37-13 et seq.) enacted on September 6,2002 requires each school district to adopt, by September 1, 2003, apolicy prohibiting harassment, intimidation and bullying on schoolproperty, at school-sponsored functions and on school busses. To assisteach school district in developing these policies, the legislation also requiresthe Commissioner of Education to develop and issue a model policyapplicable to grades kindergarten through 12, by December 1, 2002.

Under N.J.S.A. 18A:37-15, each school district is granted local controlover the contents of the policy and ancillary procedures, but, at aminimum, the ten components listed in the authorizing statute must beincluded in a school district’s policy prohibiting harassment, intimidationand bullying. Some of the provisions of the authorizing statute call for theschool district to stipulate the consequences and appropriate remedialactions for the following instances: 1) personsviolating the policy; 2)persons who engage in reprisal or retaliation against someone whoreports a violation of the policy; and 3) persons who falsely reportallegations of harassment, intimidation or bullying as a means of retaliationor as a means of harassment, intimidation or bullying. Another provision ofthe statute requires the school district’s policy to articulate the range ofdifferent measures a school will take to respond to violations of the policy.

What is Cyber-bullying?

1. Why is cyber-bullying important to educators and law enforcement personnel?

Cyberbullying is important because it is the newest form of intimidationand harassment among students that is becoming increasingly evidentacross the nation.Regarded as the newest form of bullying, Cyber-Bullying is defined aswhen a student uses information and communication technologies suchas email, cell phone and pager text messaging, instant messaging,defamatory personal Web sites and defamatory online personal pollingWeb sites to harass, humiliate, intimidate and/or threaten other studentson the Internet.Across the United States, teenagers are increasingly using the Internetto deliver derogatory photographs and cruel and harmful messages,which can include racial, religious, cultural and sexual slurs.The striking difference between old-fashioned bullying and Cyber-Bullying is that Cyber-Bullying can occur both on and off schoolgrounds, making the victims extremely vulnerable and susceptive tothis new type of bullying at virtually all times of the day.Furthermore, another difference is that, with Cyber-Bullying, the bullydoes not see the immediate impact that his or her bullying has on thevictim. Bullies do not see the harm they have caused their victims,which make them less capable of actually feeling remorseful orempathetic to the victim for their actions.It is extremely important that both educators and law enforcementpersonnel are aware of the dangerous threat that Cyber-Bullyingposes to the youth of America.Most Cyber-Bullying does in fact occur off school grounds, which makeseducators and the schools limited in what they can do to prevent it.Adults are very often unaware that their children may be victims ofCyber-Bullying because it occurs away from their watchful eyes.Research shows that 50% of kids are online most of the time withoutadult supervision.As Cyber-Bullying increases, law enforcement officers are creatingnetworks that specialize in cybercrime investigation and training. Moreover,there are legal issues, such as free speech and district negligence, thatneed to be addressed in regards to Cyber-Bullying. Criminal laws and civillaw remedies also may apply to Cyber-Bullying situations.

2. What is the Division of Criminal Justice doing about the problem?In New Jersey, there is an amendment to the bullying legislation thatpassed two years ago which would include provisions and terms tocover Cyber-Bullying under the same law. This amendment is currentlyunder review in the New Jersey State Senate.The Office of Bias Crime and Community Relations is sponsoring thisCyber-Bullying conference to inform and educate law enforcementpersonnel and educators on the dangers of Cyber-Bullying. Thisstatewide conference is the first of its kind in the United States. Due tothe high responses received in relation to registration for the springconference, this conference was planned.The Office of Bias Crime and Community Relations also has a toll-freehotline service to address situations of bullying. Recently, more andmore calls about situations involving Cyber-Bullying have been comingin to this hotline.

3. Call to Action - What everyone must doEducators: Supervision and even limiting use of the internet while atschool is a key in combatting Cyber-Bullying. Discouraging the use ofinstant messenger and chat room programs while at school is a part ofthis supervision. Disallowing the use of cell phones as a general ruleprevents the use of text messaging as a form of Cyber-Bullying.Resources for educators on Cyber-Bullying include an EducatorsGuide to Cyberbullying, found on cyberbully.org, and books thatprovide educators with information and resources on the subject.Law Enforcement: One of the main resources for law enforcement atthis point in time is the network of law enforcement officers known asCyber Law Enforcement. These officers specialize in cybercrimeinvestigation and training. The issues they investigate include childpornography, cyberstalking, cyberscams and fraud online. Theirwebsite is located at www.cyberlawenforcement.org.Adults: Supervision and even limiting use of the internet while at homeis also an essential key in combatting Cyber-Bullying. Adults need torealize the threat that Cyber-Bullying poses to their children and mustbegin supervising what they do, who they talk to and what they see onthe internet. Supervising the use of cell phones is also a safe bet.Victims: Most victims of Cyber-Bullying are so impacted by the threatsand harassment that they keep quiet and never report it to theirparents, teachers or friends. It is important that victims realize that weare collectively here to fight this new form of bullying so as to protect thewelfare of our children for the future. With that, if at any time any victimexperiences any form of bullying or Cyber-Bullying, you must knowthat it is OK to report it.
