COMPLIANCE TO ENVIRONMENTAL CLEARANCE LETTER NO. SEAC-2010 / CR. 814 /TC-2 DT. 05.09.2011, AMENDMENT IN EC NO. SEIAA-2012 CR./TC2 DT. 17.01.2013 AND DT 11.06.2014 AT BLOCK C, WADALA TRUCK TERMINUS, MUMBAI.

Conditions Compliance

(i) This Environmental Clearance is issued for construction up to height of 70m, subject to the condition that the foot print of the buildings as recommended by SEAC is not exceeded. Local authority should ensure this.

The amendment in EC was obtained on 17.01.2013 and 11.06.2014 The authority has granted EC for G + 55 Floors

(ii) This environmental clearance is issued subject to land use verification. Local authority / planning authority should ensure this with request to Rules, Regulations, Notifications, and Government Resolutions, Circulars etc. issued if any .This environmental clearance issued with respect to the environmental consideration and it does not mean that State Level Impact Assessment Authority (SEIAA) approved the proposed land use.

Agreed and all the planning related permissions were obtained.

(iii) Project proponent shall ensure completion of STP. MSW disposal facility, green belt development prior to occupation of the buildings. No physical occupation or allotment will be given unless all above said environmental infrastructure is installed and made functional including water requirement in Para 2. Prior certification from appropriate authority shall be obtained.

We have provided the STP for partly completed buildings for which OC has been obtained. (iv) Local body should ensure that no occupation certificate will be issued prior to operation of STP/MSW site with due permission of MPCB. Physical possession should be given only after completion of environmental & other infrastructure for which development charges are being collected by local body.

(v) The height, Construction built up area of proposed construction shall be in accordance with the existing FSI/FAR norms of the urban local body & it should ensure the same before approving layout plan & before according commencement certificate to proposed work. ULB should also ensure the zoning permissibility for the proposed project as per the approved development plan of the area.

The construction is carried out as per the approval received from MMRDA. Building Plans are approved by MMRDA as per norms.

“Consent for Establishment” shall be obtained from Maharashtra Pollution Control Board under Air and Water Act and a copy shall be submitted to the Environment Department before start of any construction work at the site.

Consent for establishment was obtained from the State Pollution Control Board vide letter no. BO/ROHQ/EC/CAC-01//CIC-2729 Dated - 11.11.2011 and No. Format 1.0 / BO/CAC-Cell/EIC-KN-6846-15/ CE (Amend)/CAC-2013 date:- 11/02/2016. Applied for Revalidation for Consent to Establish

(vii) Wet garbage should be composted by using appropriate method and treated waste (manure) should be utilized in the existing premises for gardening. And, no wet garbage will be disposed outside the premises. Local authority should ensure this.

The solid waste generated is properly collected and Segregated. Wet garbage will be composted using mechanical composting during the operation phase.

(viii) All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase.

Temporary sanitation with separate toilets with septic tanks, soak pits for ladies and gents are provided on the site.

(ix) A First Aid Room will be provided in the project both during construction and operation of the project.

We have provided the essential medical assistance to the workers. In case of accidents during construction as well as operation phase. The room have first aid box contains: 1) Disposable syringes 2) Cotton 3) Disposable needles 4) Bandage 5) Sofframicine 6) Burnol 7) Dettol

(x) Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, crèche etc.

Pressure cooker, kerosene and other household material, mobile toilets, safe drinking water, medical health care, crèche etc. is supplied to the workers. Doctor visits site daily in Labour Camp.

Conditions Compliance

(xi) Adequate drinking water and sanitary facilities should be provided for construction workers at the site. Provision should be made for mobile toilets. The safe disposal of wastewater and solid wastes generated during the construction phase should be ensured.

The RO plant is provided at site for Treating the Drinking water site. 3 nos. 5000 litres. 2 nos. 10,000 litres. Adequate drinking water and sanitary facilities is provided to Workers. The waste generated from the labour camps is mostly household waste which is collected and disposed off in municipal bins.

(xii) Arrangement shall be made that waste water and storm water do not get mixed.

The Storm water drains and sewer lines are separately provided on site. This arrangement shall ensure that storm water and sewage will not mix.

(xiii) All the topsoil excavated during construction activities should be stored for use in horticulture/ landscape development within the project site.

Top soil generated at project site has been used for green belt development.

(xiv) Additional soil for leveling of the proposed site shall be generated within the sites (to the extent possible) so that natural drainage system of the area is protected and improved.

No additional soil is required for land leveling as land is flat.

(xv) Green Belt Development shall be carried out considering CPCB guidelines including selection of plant species and in consultation with the local DFO/ Agriculture Dpt.

Partly plantation is done. The landscape will be developed considering CPCB guidelines including selection of plant species. The tree species which planted will be of local variety.

Conditions Compliance

(xvi) Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed taking the necessary precautions for general safety and health aspects of people, only in approval sites with the approval of competent authority.

The construction waste/Muck is disposed as per MCGM’s/MMRDA guidelines at . All safety precautions have been taken on the site. The safety nets, barricading to plot boundary, water spraying at source of dust and noise pollution mitigation measures are taken.

(xvii)

Soil and ground water samples will be tested to ascertain that there is no threat to ground water quality by leaching of heavy metals and other toxic contaminants.

The soil sample from the project site is tested from NABL Accredited laboratory. As per test report there is no presence of heavy metals in the soil and ground water. This being barren plot there is no possibility of contamination of toxic and heavy metals

The Monitoring Report is attached.

(xviii) Construction spoils, including bituminous material and other hazardous materials must not be allowed to contaminant watercourses and the dumpsites for such material must be secured so that they should not leach into the ground water.

Such types of hazardous wastes are not expected to be generated in this activity. However, the disposal of the same shall be done as per CPCB /MBCB norms applicable to hazardous waste.

xix Any hazardous waste generated during construction phase should be disposed off as per applicable rules and norms with necessary approvals of the Maharashtra Pollution Control Board.

Hazardous waste is not generated as it is Residential project. However, the disposal of the same shall be done as per CPCB /MBCB norms applicable to hazardous waste.

xx The diesel generator sets to be used during construction phase should be low sulphur diesel type and should conform to Environments (Protection) Rules prescribed for air and noise emission standards.

The D. G. sets will be enclosed type and as per CPCB norms.

Conditions Compliance

(xxi) The diesel required for operating DG sets shall be stored in underground tanks and if required, clearance from concern authority shall be taken.

The diesel will be procured as and when required. No storage on site.

(xxii) Vehicles hired for bringing construction material to the site should be in good condition and should have a pollution check certificate and should conform to applicable air and noise emission standards and should be operated only during non-peak hours.

Regular maintenance of construction vehicles is carried out to keep them in good condition. The vehicles having PUC certificate is used. Adequate parking space is made available for construction vehicles inside the construction premises to lessen the impacts on traffic in surrounding areas

(xxiii) Ambient noise levels should conform to residential standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Adequate measures should be made to reduce ambient air and noise level during construction phase, so as to conform to the stipulated standards by CPCB/MPCB.

The noise levels as well as air quality was monitored from MOEF recognized laboratory. Copy of reports is attached.

(xxiv Fly ash should be used as building material in the construction as per the provisions of Fly Ash Notification of September 1999 and amended as on 27th August,2003.(The above condition is applicable only if the project site is located within the 100 km of Thermal Power Stations)

Fly ash containing Ready mix concrete is used for building construction.

(xxvi) The approval of competent authority shall be obtained for structural safety of the buildings due to any possible earthquake, adequacy of fire fighting equipments etc. as per National Building Code including measures from lighting.

We are carrying construction as per the Planning Authorities approval which considers the structural safety, firefighting measures etc while granting the approval. Latest being Commencement Certificate No. T&C/WTT/Block-C/CC/Vol-XII/ 131/2016 dated 20.04.2016.

Conditions Compliance

(xxvii) Storm water control and its re-use as per CGWB and BIS standards for various applications.

The provision of Roof top rain water harvesting through collection tank is made. The overflow of the tank is connected to the Municipal Storm Water drains. Also ring wells are provided to Recharge the ground water. The Storm water drains are constructed as per MMRDA’s/MCGM’s approval.

(xxviii) Water demand during construction should be reduced by use of pre-mixed concrete, curing agents and other best practices referred.

Complying the same by use of pre-mixed concrete, curing agents and other best practices in NBC.

(xxix) The ground water level and its quality should be monitored regularly in consultation with Ground Water Authority.

The ground water quality is

As regards to ground water level

(xxx) The installation of the Sewage Treatment Plant (STP) should be certified by an independent expert and a report in this regard should be submitted to the Ministry before the project is commissioned for operation. Treated effluent emanating from STP shall be recycled / reused to the maximum extent possible. Treatment of 100% gray water by decentralized treatment should be done. Discharge of unused treated effluent shall conform to the norms and standards of the Maharashtra Pollution Control Board. Necessary measures should be made to mitigate the odour problem from STP.

We have provided the STP for partly completed buildings for which OC has been obtained. STP will be certified by an independent expert and a report in this regard will be submitted to the Ministry before the project is commissioned for operation. A treated water quality confirms the MPCB/CPCB/MoEF&CC norms. Sewage will be treated up to tertiary level. The treated sewage will be reused for gardening and flushing purpose.

(xxxi) Project proponent shall ensure completion of STP, MSW disposal facility prior to occupation of the buildings and should obtain completion certificate for these systems/aspects from MPCB.

We have provided the STP for partly completed buildings for which OC has been obtained. Yes we will ensure to complete STP, MSW and green belt development prior to occupation of ongoing buildings We will also obtain completion certificate of STP, MSW disposal facility prior to occupation from MPCB

(xxxii) Local body should ensure that no occupation certification is issued prior to operation of STP/MSW site etc. with due permission of MPCB.

(xxxiii) Permission to draw ground water shall be obtained from the competent Authority prior to construction/ operation of the project.

We are not using ground water for construction purpose. We will obtain the CGWA NOC

(xxxiv) Separation of gray and black water should be done by the use of dual plumbing line for separation of gray and black water.

We have provided the dual plumbing system for separation of gray and black water.

(xxxv) Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control.

(xxxvi) The solid waste generated should be properly collected and segregated. Wet garbage should be composted and dry/ inert solid waste should be disposed off to the approved sites for land filling after recovering recyclable material

The solid waste will be segregated at source. The biodegradable waste will be treated by Mechanical Composting Method. The recyclable waste will be given to Authorized vendor. The inert/non-biodegradable waste will be disposed in Municipal Solid waste Management facility The treated waste shall be utilized in premises for gardening and landscaping.

(xxxvii) Use of glass may be reduced up to 40% to reduce the electricity consumption and load on air conditioning. If necessary, use high quality double glass with special reflective coating in windows.

(xxxviii) Roof should meet prescriptive requirement as per Energy Conservation Building Code by using appropriate thermal insulation material to fulfill requirement.

(xxxix) Energy conservation measures like installation of CFLs/TFLs for lighting the areas outside the building should be integral part of the project design and should be in place before project commissioning. Use CFLs and TFLs should be properly collected and disposed off/sent for recycling as per the prevailing guidelines/ rules of the regulatory authority to avoid mercury contamination. Use of solar panels may be done to the extent possible like installing solar street lights, common solar water heaters systems. Project proponent should install, after checking feasibility, solar plus hybrid non conventional energy source as source of energy.

Solar hot water in each tower will be provided. Solar PV panel unit in Commercial Tower is proposed.

Conditions Compliance

(xl) Diesel power generating sets proposed as source of backup power for elevators and common area illumination during operation phase should be of enclosed type and conform to rules made under the Environment (Protection) Act, 1986. The height of stack of DG sets should be equal to the height needed for the combined capacity of all proposed DG sets. Use low sulphur diesel. The location of DG sets may be decided with in consultation with Maharashtra Pollution Control Board.

The D. G. set is enclosed type and as per CPCB norms. DG sets Provided: 2 x 600, 2 x 400, 2x 500 kVA for completed buildings

During operation phase the provision of DG Sets shall be as per EPA-1986 as well as, guidelines for DG Set installation shall be followed. All DG Sets shall be with acoustic enclosures and will be using low Sulphur diesel. The stack heights shall be as per MPCB prescribed norms

(xli) Noise should be controlled to ensure that it does not exceed the prescribed standards. During night time the noise levels measured at the boundary of the building shall be restricted to the permissible levels to comply with the prevalent regulations.

The barricading has been provided at site. The noise levels are monitored from MOEF recognized laboratory.

Noise Monitoring report is attached.

(xlii) Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

Entry & exit to the proposed project are located in such way that it won’t affect traffic on the adjoining roads. Also sufficient parking is provided.

(xliii) Opaque wall should meet prescriptive requirement as per Energy Conservation Building Code, which is proposed to be mandatory for all air-conditioned spaces while it is aspirational for non-air-conditioned spaces by use of appropriate thermal insulation material to fulfill requirement.

The buildings are not air-conditioned, these are Residential buildings hence ECBC code is not applicable in the instant case. However, we are achieving U value of 0.56 w/m2˚k for wall for the effective insulation against the Heat gain.

(xliv) The building should have adequate distance between them to allow movement of fresh air and passage of natural light, air and ventilation.

(xlv) Regular supervision of the above and other measures for monitoring should be in place all through the construction phase, so as to avoid disturbance to the surroundings.

The regular supervision is carried out by the project in-charge and supervisors are trained in Environmental Management measures.

(xlvi) Under the provisions of Environment (Protection) Act, 1986, legal action shall be initiated against the project proponent if it was found that construction of the project has been started without obtaining environmental clearance.

We have obtained environmental clearance vide letter No. SEAC-2010 / CR. 814 /TC-2 dt. 05.09.2011, EC amendment letter no. dt. SEIAA-2012 /CR./TC2 dt. 17.01.2013 and dt 11.06.2014

(xlvii) Six monthly monitoring reports should be submitted to the Department and MPCB.

(l) No land development/ construction work preliminary or otherwise relating to the project shall be taken up without obtaining due clearance from respective authorities.

At present project head himself is managing environment issues. However, the Cell shall be formed and it shall be responsible for necessary environmental safeguards.

(lii) Separate funds shall be allocated for implementation of environmental protection measures/EMP along with item-wise breaks-up. These cost shall be included as part of the project cost. The funds earmarked for the environment protection measures shall not be diverted for other purposes and year-wise expenditure should reported to the MPCB & this department.

The funds for implementation of environmental protection measures/EMP are provided as per planned requirement. Expenditure on EMP is being done as planned. However, year-wise expenditure was not submitted to MPCB & Env. Dept. as the project is still under progress. All the environmental infrastructure like STP, Rainwater harvesting and Solar system will be installed for the constructed buildings

(liii) The project management shall advertise at least in two local newspapers widely circulated in the region around the project, one of which shall be in the Marathi language of the local concerned within seven days of issue of this letter, informing that the project has been accorded environmental clearance and copies of clearance letter are available with the Maharashtra Pollution Control Board and may also be seen at Website at http://envis.maharashtra.gov.in

(liv) Project management should submit half yearly compliance reports in respect of the stipulated prior environment clearance terms and conditions in hard & soft copies to the MPCB & this department, on 1st June & 1st December of each calendar year.

We have submitted all six monthly compliance reports to Environment Department and MPCB

(lv) A copy of the clearance letter shall be sent by proponent to the concerned Municipal Corporation and the local NGO, if any, from whom suggestions/representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

(lvi) The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levels namely; SPM, RSPM, SO2 , NOx (Ambient level as well as stack emissions) or critical sectorai parameters, indicated for the project shall be monitored and displayed at a convenient location near the main gate of the company in the public domain.

(lvii) The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by e-mail) to the respective Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.

(lviii) The environmental statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of EC conditions and shall also be sent to the respective Regional Officers of MoEF by e-mail.

The environmental statement is submitted. The six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data are submitted along with Compliance reports to Regional office of MOEF, Environment Department and MPCB.

(lix) The environmental clearance is being issued without prejudice to the court case pending in the court of law and it does not mean that project proponent has not violated any environmental laws in the past and whatever decision of the Hon’ble court will be binding on the project proponent. Hence this clearance does not give immunity to the project proponent in the case filed against him.

4. This environmental clearance is issued as per EIA Notification; 2006.If any part of the plot is affected by CRZ then project proponent should obtain NOC from MCZMA as per FSI applicability. If there is change in building plan accordingly, project proponent to submit the same building plans otherwise liable to initiate due action under E P Act.

We have amended the environmental clearance vide letter No SEIAA-2012 CR./TC2 dt. 17.01.2013 and Amendment dt.11.06.2014 for minor amendment in the project.

5. Project proponent should submit exactly same document for approval of building plans to the concern authority as per the documents submitted to the SEIAA for prior Environmental Clearance.

6. If there is any change in local town planning rules including FSI, parking area, RG area etc, which changes building plans, then project Proponent should approach SEIAA again. It is the sole responsibility of the project Proponent to submit the same building plans otherwise liable to initiate due action under E P Act.

8. In case of submission of false document and non compliance of stipulated conditions, Authority/ Environment department will revoke or suspend the environmental clearance without any intimation and initiate appropriate legal action under Environmental Protection Act, 1986.
