Turn their thoughts to You and open their hearts to Your Holy Spirit that they might have the wisdom and understand- ing to accomplish Your will. Draw near unto them as they labor to promote the interests and concerns of their constitu- ents.

Let them not think, when this prayer is over, that their dependence upon You is over and forget Your counsels for the remainder of the day. But, Lord, cause us to do what is pleasing in Your sight both now and forevermore, we pray. Amen.

A0808:

Amend Sec. 5, page 11, line 10, by inserting after "service." The money collected from the contribution rate is a county fee collected by the telephone company; the money is not subject to taxes or charges levied on or by the telephone company. The money collected from the contribution rate shall not be consid- ered revenue of the telephone company for any purpose.

The SPEAKER. On that question, the gentleman from Lehigh, Mr. McHale, is recognized.

Mr. McHALE. Thank you, Mr. Speaker. Mr. Speaker, to the best of my knowledge, this is the only

amendment which will be offered to the bill. It is a technical amendment. It clarifies the original intent of the legislation, which is to say that we want to make it clear that the money collected by the telephone company, in order to maintain the existing 91 1 system, not be used as a basis for further taxation upon either the municipality or that phone company.

That was our intent originally. We are simply clarifying that. I would seek an affirmative vote.

County have in place the 91 1. How will this particular legisla- tion impact on our system?

Mr. McHALE. Mr. Speaker, I am having difficulty hearing you, but as I understand your question, it is that your constit- uency in Indiana County already has a 91 1 system; how would HB 54 impact upon your community. Is that the question, sir?

Mr. WASS. Yes, sir. Mr. McHALE. What this would do is it would provide two

major forms of assistance to Indiana County and to all other counties similarly situated which have already instituted 911 service.

The two benefits to Indiana County would be these: First of all, if you have a basic 91 1 system as opposed to an enhanced 911 system, you would be able to use the no-interest loan money provided in this legislation to upgrade your existing system to a more technically and technologically proficient system. Over the last decade, 91 1 systems have developed, and there have been steady improvements in the technical quality of those systems. Money would be available at the present time, and hopefully into the future, for Indiana County to stay abreast of that changing technology by using no-interest loans to upgrade the current equipment.

Secondly, you now maintain your system, I, assume, through tax revenues.

Mr. WASS. Right. Mr. McHALE. This would provide an alternative funding

mechanism that could, at the option of your county, be adopted to pay for the recurring costs, and that would be a contribution rate that would appear monthly on the phone bill. 'A very small amount-pennies is what we are talking about-could be imposed on the phone bill in order to provide a stable funding mechanism as an alternative to taxes in order to guarantee the recurring costs of the system.

So in summary, you would be able to improve your system using no-interest loans. You would be able to maintain your system through the contribution rate.

Mr. McNALLY. Mr. Speaker, does this bill provide for some statewide system of assuring certain standards of profi- ciency in a 91 1 system established under this bill?

Mr. McHALE. Yes, it does, Mr. Speaker. It does it in two ways, and let me mention them briefly.

Under the language of my bill, the Pennsylvania Emergency Management Agency, PEMA, would be required to establish technical standards that must be met on a statewide basis, so

that as a community develops a 91 1 plan, that plan would sub- sequently be reviewed by PEMA to make sure that it was tech- nically proficient, that in fact when someone dialed 911, access would be provided to a local emergency operator. So the technical standards would be established and supervised by PEMA. Now, that has to do with hardware.

I think a second aspect of your question has to do with the proficiency of operators who would answer the calls. The bill does not mandate that proficiency, but I certainly would encourage PEMA to establish a program providing assistance to individual counties in the training of their operators. Most of the difficulties, indeed virtually all of the difficulties, that have ever occurred concerning 911 service have been related not to the hardware but to the human errors that have been made in answering the calls.

The technical problems are directly addressed in this bill. Indirectly I think we should encourage PEMA to provide pro- fessional training to operators throughout the State so that they are able to take full advantage of the technical irnprove- ments in the quality of communication.

The SPEAKER. The gentleman is in order to remark. Mr. McNALLY. Thank you, Mr. Speaker. I appreciate the gentleman's comments on this particular

issue. It would be of great concern to my constituents who live in the city of Pittsburgh where they have a 91 1 system oper- ated by the Department of Public Safety, which has had a history of inefficiency and incompetence, and we would welcome a statewide system that would assure that every 91 1 operator and every 911 system in the Commonwealth of Pennsylvania has attained a certain status and certain profi- ciency to serve the community.

Thank you very much. The SPEAKER. The Chair recognizes the gentleman from

Lehigh, Mr. McHale, on the question of final passage. Mr. McHALE. Thank you, Mr. Speaker. Mr. Speaker, as we take up consideration of HB 54 on final

passage, let me briefly provide a summary of where we stand in providing 91 1 service statewide.

At the present time, roughly one-third of the citizens of the Commonwealth of Pennsylvania live within jurisdictions that have previously adopted 91 1 emergency telephone communi- cation. That means that two-thirds of our constituents live in jurisdictions throughout the Commonwealth not currently served by 911. The legislation that I bring before the House today is intended to provide a framework and significant financial incentives in order to guarantee that within the next 5 or 6 years, we have adopted a truly comprehensive statewide 91 1 system of emergency telecommunications.

Now, let me just briefly explain the elements of this bill. I understand that both caucuses have considered the bill, and I do not think that lengthy debate is necessary on this subject.

Essentially what would happen is this: If a community wants to adopt 91 1 service following the enactment of HB 54, that community-and the community would normally be a county-would in fact appoint a system coordinator. That system coordinator would be a local official who would in

effect serve as a liaison to the Department of Community Affairs. DCA would accept loan applications, which would be processed, and money would be distributed to establish 91 1 communication in that county. Once the plan was developed and initially reviewed by DCA, it would also be reviewed by the Public Utility Commission to make sure that the cost was fair and reasonable. Further, it would be reviewed by PEMA to make sure that the system would work technologically.

I Then the plan would be referred to DCA for final approval and ultimately would be submitted to the voters of that juris- diction for approval at a referendum occurring either at a primary or a general election.

A great deal of thought has gone into this legislation over the last 5 years, and I sense today that we have finally reached a consensus as to what we can possibly afford and what will truly be a major step forward in a lifesaving effort.

I simply want to close by saying that I thank a number of people for participating in the negotiations that led to this bill. The Governor's Office has been extremely helpful. Secretary Hershock has been very supportive. Representative Pievsky has put in many long hours on this. Representative O'Donnell and his staff were very helpful. I believe what we have is a consensus that truly will save human lives. I urge an affirma- tive vote.

Mr. REBER. Thank you, Mr. Speaker. Mr. Speaker, I would want to say initially for the record

that I have discussed this amendment with the prime sponsor of the legislation, and for purposes of legislative intent, I just do want to clarify one aspect of the amendment as drafted.

This particular amendment, Mr. Speaker, will in essence increase the areas or the vicinities, if you will, on which the offense in question can be perpetrated and appropriate sen- tences can be imposed. In essence, Mr. Speaker, what the amendment does is add the language to the school areas as well as the child-care-facility areas for the imposition of drug- free zones to additionally encompass playgrounds, video arcades, and community recreational centers. Obviously, Mr. Speaker, these are three areas that are highly and prominently frequented by minors, are areas that are notoriously used for the selling of drugs, and I think goes a long way to strengthen the intent of the General Assembly which was carried out last May when this particular concept was enacted into law.

Mr. Speaker, I think for clarification purposes the words "video arcade" should be specifically noted to mean just that - a particular establishment whose primary purpose, its occu- pancy purpose, is for the operation of video games. Normally there are a multitude of various forms of video games appear- ing on a premises which has an occupancy-and-use permit for

that particular concept and that particular concept alone. Obviously, Mr. Speaker, we are not concerned about a restau- rant or some other establishment that may have one type of amusement game in the waiting-room-type concept. This is really that particular area which holds itself out solely for the purposes of playing video games and caters and panders, if you will, to the frequency of minors on the premises to carry out the playing of video games.

I would urge all members to join in an affirmative vote on this bill. Thank you.

Mr. LLOYD. Thank you, Mr. Speaker. Mr. Speaker, this amendment makes two technical correc-

tions. First, it makes clear that licenses must be renewed every 2 years; and second, it ties the balanced budget requirements of the Cosmetology Board to the electrologists, so that rather than the electroiogists having to be seii-supporting, they are required to participate in supporting the Cosmetology Board.

The SPEAKER. The Chief Clerk has asked me to announce to the members that the members' and employees' blood drive is being conducted today and tomorrow. Those of you who are able and willing to give blood can give such this afternoon after 1 o'clock. A mobile unit has been set up on the plaza in front of the Capitol Annex, not the new building but the old Capitol Annex. That blood can be given by members and staff this afternoon at 1 o'clock and tomorrow.
