    EXCERPTS FROM THE BRITISH COLUMBIA STRATA PROPERTY ACT,JULY 16,2002

    Rules Section 125

    (1) The Strata Corporation may make Rules governing the use, safety and condition of thecommon property and common assets.

    (2) A Rule is not enforceable to the same extent that a Bylaw is not enforceable under Section121 (1).

    (3) All Rules, including those posted on signs, must be set out in a written document that iscapable of being photocopied.

    (4) The Strata Corporation must inform Owners and tenants of any new Rules as soon asfeasible.

    (5) If a Rule conflicts with a Bylaw of the Strata Corporation, the Bylaw prevails.(6) A Rule ceases to have effect at the first Annual General Meeting held after it is made, unless

    the Rule is ratified by a resolution passed by a majority votea. at that Annual General Meeting, or

    b. at a Special General Meeting held before that Annual General Meeting.(7) Once a Rule has been ratified under subsection (6), it is effective until it is repealed, replacedor altered, without the need for further ratification.

    Enforcement Options Section 129

    (1) To enforce a Bylaw or Rule the Strata Corporation may do one or more of the following:a. impose a fine under section 130;b. remedy a contravention under section 133;c. deny access to a recreational facility under section 134.

    (2) Before enforcing a Bylaw or a Rule the Strata Corporation may give a person a warning ormay give the person time to comply with the Bylaw or Rule.

    Fines Section 130

    (1) The Strata Corporation may fine an Owner if a Bylaw or Rule is contravened bya. the Owner,b. a person who is visiting the Owner or was admitted to the premises by the Owner for

    social, business or family reasons or any other reason, orc. an occupant, if the strata lot is not rented by the Owner to a tenant.

    (2) The Strata Corporation may fine a tenant if a Bylaw or Rule is contravened bya. the tenant,b. a person who is visiting the tenant or was admitted to the premises by the tenant for

    social, business or family reasons or any other reason, orc. an occupant, if the strata lot is not sublet by the tenant to a subtenant.

    Maximum Fines Section 132

    (1) The Strata Corporation must set out in its Bylaws the maximum amount it may fine an Owneror tenant for each contravention of a Bylaw or Rule.

    (2) The strata corporation may set out in its Bylawsa. different maximum amounts of fines for different Bylaws and Rules, andb. the frequency at which fines may be imposed for a continuing contravention of a

    Bylaw or Rule.(3) The maximum amount of a fine and the maximum frequency of imposition of fines must not

    exceed the maximums set out in the Regulations.

    104.4 Followers must not be allowed access to a common asset or common property dooror gate unless they are known to the Owner.

    104.5 Door wedges or similar devices must not be stored near any common asset orcommon property doors. Door wedges or a similar device may be used to temporarilyprop open a common asset or property door (e.g.: bringing in shopping bags) andmust be taken away after.

    105 Other (Common and Limited Common Property / Assets)105.1 No items other than those designated as acceptable in the Strata Corporations

    Bylaws may be kept in common assets or common property (e.g.: storage lockers).105.2 Unauthorized members of the Strata Corporation, occupants or visitors are not

    permitted in any part of the restricted common property of the building such as:a. Roof(s);b. Electrical rooms;c. Mechanical rooms; andd. Locked rooms other than those of an Owner, or occupant without the express

    permission of the Strata Council.105.3 Owners or occupants must not leave shopping carts or similar devices in any common

    property or common asset by order of the City of Surrey Fire Marshall.

    105.4 No Owners or occupants;a. Shall do anything or permit anything that will increase the risk of fire or the rate offire insurance on the building or any part thereof, or that is contrary to any of theprovisions, Rules or ordinances of any statute or municipal law;

    b. Obstruct entry or exit from the building other than for moving.105.5 Owners, occupants and visitors should avoid cutting through flower beds and walk

    only on designated pathways.105.6 Owners shall not do anything on common property to damage the landscaping.105.7 No personal items are allowed on the common area landscaping areas.105.8 Owners and occupants are entitled to quiet enjoyment of our property. A quiet time

    will be in effect from 11: 00 PM through 7:00 AM nightly. Owners are responsible toensure that no excessive noise levels from their units occur during this quiet timewhich may be disturbing to fellow Owners and occupants. Loud talking on patios,dog(s) barking and / or loud music are examples of conduct which may be ofannoyance to fellow Owners.

    105.9 The conveyance of food and / or beverages or other materials on common property(e.g.: lobby, elevators, storage areas, parking areas, corridors, stair wells) shall be inclosed containers and packaging. Any spillage or debris from such conveyances shallbe cleaned by the Owners, occupants or visitor causing the spill.

    106 Pests106.1 Owners and occupants must be vigilant against attracting rodents and other pests by:

    a. Not installing bird feeders or other feeders that attract rats and mice on commonor limited common property;

    b. Not storing food(s) on balconies or patios.

    107 Gardening107.1 There will be no planting or moving of trees or shrubs without the permission of Strata

    Council of the Gardening committee. Any plant planted outside the perimeter of theindividual strata lot patio will immediately become the property of St. Andrews.

    CLUBHOUSE /AMENITIES BUILDING

    To ensure a congenial living atmosphere and fairness to all, common courtesy and enforcement of house Rules arenecessary. The cooperation of all Owners and guests is expected. Living in a planned community such as ST.ANDREWS provides residents with many benefits, however there are also restrictions. Please refer to the Bylaws and

    Rules created to ensure we maintain the high level of standards at ST.ANDREWS.

    200 General Rules for St. Andrews Amenities building (Clubhouse)200.1 Persons using this facility do so at their own risk and release and indemnify Strata

    Corporation BCS 2562 and their managing agents from any and all claims arisingfrom the use of the facilities.

    200.2 Damage to common property, and equipment, whether intentional or not, may becharged to the Owner/Resident responsible at Councils discretion. Report anydamage to the Property Manager and/or the Caretaker

    200.3 Smoking is prohibited in the St. Andrews Amenities building (Clubhouse) and poolarea.

    200.4 Unacceptable or unsafe behavior is not permitted.200.5 Pets are not permitted in the St. Andrews Amenities building (Clubhouse) rooms

    including the pool area, exercise room, Dukes Room and Fireside Lounge, (exceptcertified assistance dogs).

    200.6 Adult Owners/Residents must accompany their visitors at all times in the Amenitiesbuilding (Clubhouse) and pool area. Children (under 16 years) including bothOwner/Resident and Visitor, must be accompanied by an adult Owner/Resident.

    200.7 Proper attire and foot wear must be worn in the dukes Room, Fireside Lounge, library,crafts room and meeting room. Wet bathing suits, other wet attire, along with wettowels and gear are not permitted. Sandals, slippers or other foot wear must be wornwhen walking from the pool area to any common area in the residential buildings ofSt. Andrews. Clean and proper foot attire must be worn in the exercise room.

    200.8 Owners/Residents are responsible for themselves and their Visitors in ensuring thatall areas are kept clean and tidy throughout the Amenities building (Clubhouse),including the pool area, when using the St. Andrews Amenities building (Clubhouse.

    Owners/Residents violating any Rules concerning the St. Andrews Amenities building (clubhouse),including the pool area are subject to being fined and/or lose privileges to the Amenities building(clubhouse) including the pool area.

    201 Alcohol201.1 The sale of alcohol on Clubhouse premises will be governed by the B.C. Liquor

    Control Board. Permits must be in place and strictly adhered to. A photocopy of anypermit/license granted must accompany the corresponding rental agreement(s)between the Clubhouse Committee and the Owner/Resident. Liquor permit and therental agreement must be in the same name.

    201.2 Minors under the age of 19 years found to be consuming alcohol in or on BCS 2562

    common property are prohibited. Offenders and/or the Owner/Resident will be finedand/or lose Amenities building (clubhouse) privileges.201.3 Alcohol consumption is confined to the Dukes Room and the Fireside Lounge areas.

    At all times, B.C. Provincial Liquor laws apply. BCS 2562 will not be held liable fornon-compliance or issue of any license requirements. Owners/Residents are toobtain and to be aware of the regulations for your function.

    202 Amenities building (Clubhouse) Booking Policies

    The St. Andrews Amenities building (Clubhouse is designated for the use and enjoyment of all Owners/Residents ofBCS 2562. To ensure Owners/Residents access to all facilities, exclusive bookings will be limited as outlined below.

    202.1 Designated rooms may be used for private parties for St. Andrews Owners and/orResidents only if approved in writing by the St. Andrews Amenities building(Clubhouse) Committee and/or Council.

    202.2 Rooms eligible for rentals are: the Fireside Lounge (including kitchen and BBQarea), Theatre room, and the two guest suites.

    202.3 The library, meeting room, exercise room, pool, hot tub, spa (steam room), sauna,crafts room, and the Dukes (billiards) room will be open during operation hours andwill not be available for private bookings.

    202.4 All bookings are on a first come first served basis. An up to date booking calendar willbe posted on the bulletin board for Owners convenience.

    202.5 No Commercial activities are permitted.202.6 Room rental bookings will not be accepted more than one month in advance.202.7 Booking a private function does not entitle guests unbridled use of the Clubhouse

    building.202.8 Opening and closing times can vary depending on the room and function and will be

    determined by the Clubhouse Committee or Council at the time of the booking.202.9 Rooms are not to be sub-leased. If an Owner/Resident wants to cancel a booking

    and another Owner/Resident wants to take advantage of the vacancy, a cancellationof the facility is necessary and a new booking is completed.

    203 Booking Procedures203.1 Rooms should be booked a minimum of one week in advance whenever possible.

    Bookings requested with less than a one week notice will be considered and granted ifpossible.

    203.2 All bookings are made through the Caretaker. A form accepting responsibilities andunderstanding of Rules must be signed at the time of booking.

    203.3 Deposit(s) are required to be paid in full at the time of booking. An accepted depositis a confirmed booking.

    204 Booking Fees204.1 All rental cheques are made out to BCS 2562 at the time of the booking.204.2 All damage deposits are to be paid in cash and will be returned within 48 hours of

    cleanup and damage inspection. If it is determined by the Caretaker that additionalcleaning or repairs are needed the balance of the costs will be taken out of thedamage deposit. If the damage deposit is insufficient, additional funds required will bebilled to the Owners strata lot.

    204.3 A rental fee, by cheque, will be charged for each private booking as follows :a. No rental fee for the Theater. Damage & cleanup check to be completed after

    each booking and before the next booking can commence. Bookings commenceat 10:00 AM and each four hours thereafter (one hour is reserved for cleanupcheck and equipment test for damage).

    b. $50.00 for the Fireside Lounge - Evening (6PM to 11PM)c. $50.00 for the Fireside Lounge - Daytime (10AM to 6PM)d. $100 full day for the Fireside Lounge Full Day (10AM to 11PM)e. An additional fee of $50 for half day and $100 for full day to secure (lock off) the

    Fireside Lounge prior to an event.f. $50.00 for the BBQ Area (Any Time)g. $50 for the first night and $35 per any subsequent night for Guest Suite rental.

    204.4 Damage deposits, in cash, are required for the following venues, in the amount of:a. $250.00 for the Theatreb. $100.00 for the BBQ areac. $200.00 for the Fireside Lounged. $200.00 for a Guest Unit.

    204.5 Booking times include cleanup requirements (see Rule 214). Please leave yourselftime to complete the booking.

    205 Guest Suite Booking205.1 Guest suites must be booked 48 hours in advance and no more than 30 days in

    advance.205.2 There are two guest suites. Rental is per Rule 204.03 (f) and 204.4(d).205.3 Cancellation:

    a. Refunds are at the complete discretion of Council.b. Refund, in full, if cancelled with (7) seven days notice.c. Refund, less 50%, if notice given within 48 hours of booking.d. No refund if less than 48 hours notice is given.e. Full damage deposit is returned within 48 hours of cancellation.

    205.4 Maximum rental is for (7) seven consecutive nights.

    205.5 Extensions may be granted on a per night basis if a suite is available.205.6 Reasonable access by the Caretaker must be granted when Rules or Bylaws arebroken.

    205.7 Refundable damage deposit(s) will be returned within 48 hours of any booking, if andwhen, a satisfactory inspection by the Caretaker is completed.

    205.8 Cooking is not allowed per the Surrey Fire Marshall. Our insurance does not covercooking.

    205.9 Children (under the age of 16 years) must not be left unattended in the suites at anytime.

    205.10 Suites must be kept locked at all times.205.11 BCS 2562 is not liable, and does not take any responsibility, for the loss of any

    personal articles left in the suites or the facility.205.12 No more than (4) four persons may sleep in any one of these suites.

    206 Fireside Lounge Open 8AM ~ 11PM Daily206.1 Capacity Maximum is 55 people.206.2 Clean up is the sole responsibility of the owner.206.3 Damage or additional clean up, if required as a result of a booking, will be deducted

    from the deposit.206.4 Excess costs over the deposit rate, will be charged back to the owners strata lot.206.5 The BBQ area is for rental use only, not for owner/visitors at large.206.6 Ensure that the BBQ and the gas line are turned to the OFF position after use.206.7 The BBQ grill must be scraped clean of burned food and other debris before leaving.206.8 The Lounge will not be available December 24, 25, 26, 31 and January 1.

    207 Theater (Media Room) Rental Only Access Available 10AM ~ 11PM Daily

    207.1 Maximum capacity is 15 people.207.2 No Alcohol is allowed in the Theatre room.207.3 The renter must go through a short operating training procedure for the equipment.

    Please do not attempt to operate the equipment if you are not clear on its operations.207.4 After your event, all equipment must be turned off and remote controls returned to

    their designated area.207.5 This facility is for private and Clubhouse Committee bookings only and is not open to

    owners at large

    208 Dukes Room (Games and Bar area) Open 10AM ~ 11PM Daily208.1 Owners are not permitted to hold any semi-private or private functions, post any signs

    advising or implying of a gathering that would discourage an owner from entering theroom.

    208.2 Pool table and darts board are for the use of all owners and their guests. Access tothese games is provided by name rotation on a first come, first served basis.

    208.3 Ensure that the pool table and dart board covers are put on and that the accessoriesare retuned to their designated storage areas when they are not in use.

    208.4 Use of the billiards (pool) table is confined to adults. Those under 19 years of agemust be accompanied by an adult owner at all times.

    209 Crafts Room Open 10AM ~ 11PM Daily209.1 Unrestricted use. Please keep the area clean and tidy.209.2 The Clubhouse Committee is not responsible for unattended projects. We suggest

    placing your name on any projects left in the area.209.3 This is a quiet area. Loud noise and/or music through speaker systems is not

    tolerated. If music is desired, personal music through the use of headphones is

    encouraged.

    210 Exercise Room Open 6AM ~ 11PM Daily

    BCS 2562 and/or their Managing agents will not be responsible or liable for any injuries whileusing the exercise room and equipment. It is strongly recommended that all Owners/Residentsand Visitors read the exercise equipment instructions explicitly.

    210.1 The exercise room is restricted to ADULTS ONLY (19 years or older). NO childrenpermitted

    210.2 Appropriate gym clothing and foot wear must be worn. (e.g.: running shoes, gymshorts, sweat pants, and T-shirt etc.). No street shoes and boots are permitted.

    210.3 Owners/Residents are restricted to one (1) Visitor using the exercise room. The

    Visitor must be accompanied by the Owner/Resident while using the exercise room.210.4 Time on any one (1) machine is limited to 30 minutes if others are waiting.

    211 Library Open 10AM ~ 11PM Daily 211.01 The Library is a quiet area, as the name Library indicates. Please refrain from making

    noise that may disturb others211.2 No alcohol or food is permitted.211.3 Book donations are welcome.211.4 Dress code in these rooms is; you must be dry and fully clothed (i.e.: top, pants,

    shoes). No wet attire.

    212 Meeting Room Open 10AM ~ 11PM Daily

    212.1 No alcohol is allowed in this area.

    213 Showers and Washrooms Open 6AM ~ 11PM Daily

    Use at your own risk. BCS 2562 will not be held responsible or liable for accidents or injuries.213.1 Non-slip foot wear must be worn.213.2 Kindly keep area clean and tidy.

    214 Cleanup Standards214.1 Areas throughout the Clubhouse should be kept neat and tidy as they are being used.214.2 Before leaving any area, please ensure;

    a. furniture is returned to its original position;b. floors are swept/vacuumed and clean;c. all food/drink containers are removed;

    d. spills are wiped up and furniture is clean for use by the next person214.3 All personal property should be removed or labeled and put away for a return visit

    (i.e.: crafts etc.).

    Storage rooms and Service areas in the Clubhouse as well as all Residential buildingsare not open to Members. (Rule101.3) and are restricted to those agents acting onbehalf of BCS 2562. Do not attempt to enter these areas.

    There is no lifeguard at St. Andrews Amenities Clubhouse. Use the

    pool area and facility at your own risk.The swimming pool, hot tub, steam room and sauna are inclusive and may be

    referred to as the pool area.

    POOL AREA HOURS ARE 10:00AM~8:00PM

    300 Rules and Hours for the Pool Area300.1 The pool area is restricted to the use of the Owners and Tenants (referred herein after

    as Owners/Residents) who reside at St. Andrews BCS 2562 and their Visitors.300.2 Adult Owners/Residents and Visitors (only) 8:00 AM to 10:00 AM and 8:00 PM to

    10:30 PM.300.3 Children under 16 years of age; swimming pool only from 12:00 NOON to 4:00 PM300.4 Children must be accompanied by an adult Owner/Resident at all times. Young

    children and babies must wear diapers specifically designed for swimming when usingthe swimming pool.

    300.5 Children under 19 years of age are NOT PERMITTED in the hot tub, steam room andsauna.

    300.6 Respecting that the St. Andrews swimming pool is not a public swimming pool, and isfor the primary use of St. Andrews residents, your consideration for a reasonablenumber of guests is greatly appreciated. Adult Owners/Residents must accompanytheir Visitors at all times. Owners/Residents are responsible for themselves and theirVisitors.

    300.7 Showering with soap is required before entering the pool area.300.8 Proper bathing attire is required in the pool area. Nudity is prohibited.300.9 No food, glass containers, or alcohol is permitted in or around the pool area.300.10 Diving or jumping in swimming pool or hot tub is prohibited. Anyone causing a

    disturbance or acting in an unsafe manner in the pool area is prohibited and is subjectto removal.

    300.11 Owners/Tenants will be fined and/or lose Clubhouse amenities and Pool areaprivileges if they, or their visitors, are found to be in violation of any Rule governingthe Pool area.

    The swimming pool will be closed(weather depending) from approximately

    November 1stthrough to May 1st

    All other pool areas, including the hot tub, steam room and sauna will remain open.

    SAFETY RULESfrom theFRASER HEALTH BOARD

    Health and Safety Rules

    (1) All persons with open sores, bandages, head colds, discharging ears ornoses, or infected eyes are forbidden to enter the pool area.

    (2) A cleansing shower using warm water and soap is mandatory before enteringthe pool area.

    (3) Running, fighting, or any form of conduct likely to cause an accident in thepool is forbidden.

    (4) All accidents must be reported to the Property Manager at once.

    WARNING: NO LIFEGUARD ON DUTY

    Safety Rules for the Pool area

    (1) Keep long hair out of the water, away from all underwater fittings, especiallysuction fittings.

    (2) Always have someone with you when you are in the hot tub.(3) Children must be constantly supervised. Unsupervised use by children is

    prohibited.(4) Keep your children, especially infants, out of hot tubs and spas (their small

    bodies overheat too fast).(5) Water temperatures must not be hotter than 40C (104F).(6) Elderly people, people with heart disease, diabetes, or high or low blood

    pressure and people taking medication for cardiovascular or nerve disordersshould not use the spa or hot tub without consulting their doctor.

    (7) Dont stay any longer than 10 minutes. Then shower, cool down. Then, ifyou wish, return for another brief stay. Long exposure may result in nausea,dizziness or fainting.

    (8) Always enter and leave slowly and cautiously.(9) Dont use when you are under the influence of alcohol.(10) If you are pregnant, talk to your doctor before using.(11) Do not totally immerse your body.

    By signing below, I agree to the rules governing the use The St. Andrews Club. I agree to hold harmless the St.Andrews Club from any liability that may arise from my function. I further agree that it is understood anymisrepresentation as to the nature of the function, or that a breach or non-compliance of any of the terms andconditions of this contract, or any Bylaw and/or Rule or Regulation of St. Andrews and BCS 2562, shall result inrecovery of costs and / or financial penalties being assessed against me by the BCS 2562 Strata Committee.
