AN ACT DIVIDING BARANGAY PAMPANGA IN THE CITY </!' DAVAO IKrO THREE (3) DISTINCT AND INDEPENDENT BARANGAYS TO BE KNOWN AS BARANGAY PAMPANGA, BARANGAY ALFONSO ANGLIONGTO, SR^ AND BARANGAY V.IIIZON

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

1 Section 1. Division of Barangay Panipanga. — Duran gay Pampanga

2 in ihc City of Davao is hereby divided into tlircc (3) distinct and independent

3 barangays to be knowTi as: (1) Darangay Pampanga; (2) Barangay Alfonso

4 Angliongto, Sr.; and (3) Barangay V. Hi/on.

3 Sec. 2. Territorial BuuruLtries. - The territorial boundaries of ea.'l,

6 barangay created in tlie immediately preceding section shall be as follows:

7 (I) Barangay Pampanga

7 Sfc. 3. Conduct and Supenision of Plebiscite. - The plebiscite

8 conducted and supervised by the Commission on Elections (COMELEC) in

9 Barangay Pampanga pursuant to City Ordinance No. 00161-03 of thi.*

10 Sangguniang Panlung.sod of the City of Davao, which ratified the creation of

11 Barangay Alfon.so .Angliongto, Sr. and of Barangay V. Hizon as prvKlaimcd by

12 the Plebiscite Board of Canvas.sers on July 25, 2004, shall serve as substantial

13 compliance with the plcbi.scite requirement under Section 10 of Republic <Vct

14 No. 7160. as amended, otherwise known as the “Local Government Code of

15 1991”

16 Sue. 4. Incumbent Barangay Officials. - The incumbent barangay

17 oflkials of barangays Pampanga, Alfonso Angliongto, Sr., and V. Hizon.

18 City of Davao shall continue to hold office until such time that their successo-s

19 have been duly elected and qualified.

20 Sec. 5. Public Infriistructure and Facilities. - All public

21 infra.structurc and facilities for public use existing tlicrcin at the time of the

22 approval of this Act are hereby transferred without cost or compensation t*>

23 and shall be admini.stcrcd by the new barangay s.

24 SbC. 6. Internal Revenue Allotment Shares. - Barangays PaInpang^^

25 Alfonso Angliongto, Sr. and V. Hizon shall be entitled to Internal Rcventic

26 Allotment (IRA) shares pursuant to Section 285 of Republic Act No. 7160, as

27 amended, otherwise know n as the ”lx>cal Government Code of 1991".

1 • Sec. 7. Separability Clause. - If, for any reason, any part or

2 provision of this Act is declared unconstitutional or invalid, other parts or

3 provisions which arc not affected thereby shall continue to be in full force and

4 effect

5 Sec. 8. EJfectivity. — This Act shall take effect fifteen (15) days after

6 its publication in the Official Gazette or in a newspaper of general circulation.
