The LEA requested USFWS identify and submit property ownership information for the parcel with the exposed waste and include a proposed plan to evaluate/define the extent of the waste and whether it is limited to the surface. Only a minor amount of vegetation has grown in the area providing for limited erosion control (Photo #1). As of this inspection, the LEA had not received an update on the requested information. The 2011 brush fire also exposed approximately 10 cubic yards of treated wood waste which is subject to Hazardous waste/Alternative Management Standards pursuant to California Code of Regulations 67386.1-.12. Additional piling/pieces of TWW are also scattered along the rail line. This waste appears to be related to the past Arizona Eastern Rail Road activities. The TWW continues to remain on the ground surface. As of this inspection, the LEA has not received proposed corrective actions from Arizona Eastern Rail Road/Metropolitan Transit System (MTS) to manage the treated wood waste. Corrective Actions: By January 1, 2014, USFWS is requested to submit the requested information to evaluate/define the extent of exposed waste and property ownership. By January 1, 2014, MTS is requested to provide corrective actions for the proper management of the treated wood waste debris scattered along the railroad tracks. X 20530 - Site Security Comments: No additional signs have been posted along the northwest entrance to the site to minimize unauthorized entry (Photo #3 of the northwest entrance indicating recent unauthorized entry (Photo #4). No additional signs have been posted along the southern access points where unauthorized entry had been observed during previous LEA inspections (Photo #5). Just inside of the southern open area was a pile of solid waste lying on the ground. The waste was starting to migrate due to weather conditions (Photo #6). Corrective Actions: By January 1, 2014, USFWS is requested to post additional Closed Area signs at the northern and southern access points on USFWS property to discourage unauthorized entry onto areas of the burnsite for public health and safety. Immediately manage the electronic waste per state requirements and remove the solid waste debris to prevent windblown dispersion into the marsh. No additional signs have been posted along the southern access points where unauthorized entry had been observed during previous LEA inspections (Photo #5). Just inside of the southern open area was a pile of solid waste lying on the ground. The waste was starting to migrate due to weather conditions (Photo #6).

Inspection Report Comments:

Corrective Actions taken since the previous LEA inspection: 27 CCR 21180 – Post Closure Maintenance: On July 29, 2013, Marina Gateway Development Company (MGDC) provided the LEA with the 2012 annual maintenance and monitoring report required under the 2007 Post Closure Maintenance Monitoring Plan (PCMMP). Ensure all future annual reports outline the results of quarterly inspections, including the condition of the pavement, soil cap, any problems noted or repairs or maintenance performed including special occurrences and the timelines for completion of ongoing repair if required. Submit the annual report for the prior year to the LEA by February 1st of each subsequent year.

27 CCR 21190 – Post Closure Land Use: On August 15, 2013, the Department of Transportation (Caltrans) provided the LEA with a written response for construction activities related to the irrigation cross-over that exposed burnash materials. Documentation included a chronology of site activities, photos, email correspondence, laboratory analysis and a manifest for burnash disposal. Air monitoring using direct reading instruments was determined to be not required by John Sacco, Certified Industrial Hygienist. Ensure all future proposed post closure land use changes are submitted to the LEA for review and approval prior to construction.

General Comments: The ice plant installed along the southern side slope along Bay Marina Drive is taking growth and beginning to cover the side slope for erosion control. The down drain at the top of the eastern side slope contained dirt and vegetative debris. A significant amount of litter has also accumulated along the eastern and western side slopes on-ramp (Photo #2). Caltrans shall ensure these areas are addressed as part of site maintenance.

The pedestrian barrier/litter fence along the southern side slope was damaged at a few locations near the Native Plants sign. MGDC shall ensure the fence is inspected and repaired during scheduled PCMMP quarterly site inspection as part of site maintenance.
