Curriculum Vitae -‐ Overview
Clare Carnell graduated from Canberra Girls Grammar School in 2001, commencing an Arts/Law degree in 2002 at the Australian National University. Although linguistics, languages and acting held initial attraction, coincindentally realising she was not, in fact, a doppelganger for Sandra Bullock, Clare realised her future lay in the ‘legal arena’, graduating with a Bachelor of Laws, followed by a Graduate Diploma (Legal Practice, with Merit). Admitted to the ACT Supreme Court as a solicitor and barrister in 2008, Clare went on to complete her Masters in Legal Practice – also at ANU -‐ in 2014.
Despite common practice, Clare chose to realise her longstanding aim of becoming a Barrister-‐at-‐Law immediately following the completion of her Graduate Diploma in Legal Practice.
Thus in 2010, Clare sat and passed the NSW Bar Association examinations and was admitted to practice at the NSW Bar as a Barrister-‐at-‐law across Australia. Clare is also currently on or provides consulting to a number of organisations on a volunteer basis. Apart from legal advice, this is primarily in roles promoting fundraising and education initiatives in the areas of security and policing, health law reform and patient rights, and civil liberties.
In her practice, Clare is particularly interested in the areas of mediation; family law; laws around children and child protection; Evidence law generally (though particularly DNA/scientific/medical data and digital media); defamation; human rights law; privacy; and crime. She also sees her strong interest and research and writing in contract, constitutional and administrative law as a strength which crops up across all of these fields.
Clare is currently researching the scope and potential ramifications of (national and international laws on) digital communication technology, especially the Internet, Social Media and online services – namely the emerging areas of cyber-‐crime; cyber-‐fraud; ‘internet law’; and other arenas of data collection and use. In particular, the clash between social norms and legal ramifications. Another of Clare’s publications in the pipeline include co-‐authoring a ‘practice and procedure’ handbook – aimed at both those studying for the Bar exams, and legal practitioners who use this material regularly. Fundamentally, it is cross-‐referenced and annotated law, practice notes, precedent and other sources which underpin and fill any advocate’s ‘litigation tool-‐box’ – some of the so-‐called-‐basics which are sadly often misunderstood and/or misapplied in litigation. This handbook includes the NSW Court Procedure Rules (and ACT equivalent(s)), and Evidence Act(s)), along with other relevant legislation. Her co-‐author, Tatiana Stack, Principal of ShoreStack solicitors, also worked with Clare in co-‐authoring a chapter in the recent edition of the Your Practical Guide to the Law in NSW, 14th edition: [Chapter 41] -‐ Security For Costs. Clare is passionate about education – even as an undergraduate student she helped script, act and produce training films for ANU, in both Criminal Law and Evidence Law. Clare continues to tutor final year or post-‐graduate students at the ANU (since 2012), primarily in Litigation & Dispute Management. She has regularly volunteered to judge university moot competitions, and continues to enjoy doing so. She also regularly provides motivational speeches to various groups of young people. In 2014, Clare spent the year in the United Kingdom, studying with the prestigious London School of Mediation (‘LSM’). She qualified as a mediator -‐ further study led to the award of advanced mediator

-‐ at which point Clare was invited on to the Faculty of the LSM. Also in this year, Clare completed her Masters of Law via distance at ANU, awarded at the end of 2014, specializing in Legal Practice, in particular Advanced Contract Law. After her inaugurating years at the Bar in the nation’s capital, on returning to Australia, Clare found more of her matters being heard in Sydney, and, with the bright lights beckoning, she and her husband created a Sydney base in early 2015. Clare was invited to join chambers at 15Wardell Chambers in Martin Place – an exclusive and delightfully quirky floor of extremely talented barristers. Being much younger than many (strictly speaking, all) of her colleagues, and among the very few females, life at the Bar was and indeed is undoubtedly challenging. But, it’s a fantastic challenge – she’s loving life, the job -‐ and she spent a satisfying time in 2015-‐2016 building a stable of Sydney solicitors to compliment her Canberra based work; receiving numerous commendations; ‘thank you’ notes and gifts from both clients and their families, and their solicitors (available on request and/or see for example ‘Recommendations’ on LinkedIn Profile).
However, as the NSW Government has decided that the building which houses 15 Wardell Chambers is to be demolished to enable light rail, Clare is currently practicing primarily in both the ACT and NSW, with a view to geographically settling back into her old stamping ground in Canberra, while continuing her successful relationship with Sydney solicitors.
