3 - 4 P.M. Pursuant to Texas Government Code §551.072, the City Council will meet in
closed executive session to discuss a possible abandonment of alley right of-way to the
abutting property owner of 6517 Hillcrest Ave.; Pursuant to TGC§551.071(2) to receive
confidential legal advice from the City Attorney with regard to a potential use agreement
for City facilities, and; to receive confidential legal advice from the City Attorney with
regard to the City’s legal obligation to the Firefighters’ Relief and Retirement Fund
(FRRF). No action will be taken. Executive Conference Room, 1st Floor, City Hall.

SUBJECT: Purchase of City Hall Dispatch Computer Equipment Replacement BACKGROUND: In early 2009, the City purchased equipment to support a permanent dispatch center in the newly remodeled City Hall. This dispatch center is essentially comprised of three consoles containing five computers each and an additional display computer for security cameras, mapping, or other situational awareness material. The items being proposed for replacement have a five-year lifespan and now need to be replaced. The items being recommended for replacement are sixteen desktop computers with their supporting monitors and equipment and NICE Recording System Hardware and Software. All items proposed for replacement are defined in the Capital Projects budget as project number 14600. The cost and intended purchasing vehicle for each item is outlined below: 1. 16 Desktop Computers and Monitors - $21,633.56 - Dell Computers - TXDIR Contract Number DIR SDD-1951 2. MATROX Video Cards (Required for CAD Software) - $882.84 – CDW – TCPN Contract Number R5106 3. NICE Logger Appliance and Software - $58,601.00 - TXDIR Contract Number DIR SDD-1736 RECOMMENDATION: Replacing these items will allow us to continue providing excellent service to the community by providing a stable computing environment in the City Hall Dispatch Center. AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, DECLARING UNOPPOSED CANDIDATES FOR MAYOR AND COUNCILMEMBER ELECTED TO OFFICE; CANCELLING THE ELECTION; REQUIRING ISSUANCE OF A CERTIFICATE OF ELECTION TO EACH CANDIDATE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, an election was called for May 10, 2014, to elect a Mayor and four members of the City Council; and WHEREAS, no proposition or opposed at-large race appears on the ballot and the City Secretary has certified that there is only one candidate for Mayor and four candidates for Councilmember and that, therefore, each candidate is unopposed for office; and WHEREAS, no candidate’s name has been placed on a list of write-in candidates for any office under applicable law; and WHEREAS, the City Secretary has delivered such certification to the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. Chief Planning Official Harry Persaud addressed the City Council. He reviewed the
request from Southern Methodist University for a Specific Use Permit to construct
private lighted tennis courts on the SMU campus. Mr. Persaud said the plans called
for nine (9) light poles of twenty-two feet in height. Mr. Persaud reviewed staff's
report which showed there would be no negative impact to adjacent properties from
the lighted courts. Mr. Persaud also stated the SUP request was unanimously
recommended for approval by the Planning and Zoning Commission.
Mayor Davis opened the public hearing. There were no requests to speak and Mayor
Davis closed the public hearing.
14-017B. Consider and act on an ordinance approving a Specific Use Permit to

SUBJECT: Continue a public hearing on an amended detailed site plan for Planned Development District “PD-27" for St. Christopher's Episcopal Church to provide for a children's playground. BACKGROUND: The subject tract is zoned Planned Development District PD-27 for St. Christopher's Episcopal Church. Existing development and uses on the site include the church, a Montessori School and a children's playground located on the south portion of the site facing Westminster. The Church is requesting an amendment to the detailed site plan to enclose an existing courtyard located north of the Parish Hall to be used for another children's playground. The attached detailed site plan shows the proposed playground to be enclosed with an 8 feet wrought iron fence with masonry columns and recreation equipment to be installed. Council held a public hearing on July 16, 2013 and expressed concerns about a wooden fence at that specific location. Council again discussed the item on September 17, 2013 and tabled the item to allow Taylor Armstrong, a representative of the City to work with the Church to design an appropriate fence for that location. It was moved that the public hearing would remain open at that meeting. Staff met with representatives of the Church on December 4, 2013 regarding the proposed design of a wrought iron fence. The final design was submitted to staff on Thursday February 20, 2014. Notices for the proposed amendment were mailed to 10 property owners located within 200 feet of the subject site and a public notice was posted in the Park Cities News on June 27, 2013. Two responses were received, with both opposed to the proposed amendment. RECOMMENDATION: The Planning and Zoning Commission considered this item at its regular meeting on May 14, 2013 and voted 4 - 1 to recommend approval.

SECTION 2. That the amended detailed site plan depicting the above-described
improvements is attached hereto as Exhibit “A” and made part hereof for all purposes the same as if
fully copied herein. That such site plan contains the data required by the Comprehensive Zoning
Ordinance.
SECTION 3. That this Planned Development District is granted subject to the following
special conditions:
(a) That the property will be developed only in conformance with the requirements of this ordinance, the Comprehensive Zoning Ordinance as amended hereby and the approved amended detailed site plan;
(b) That except as amended hereby, the detailed site plan approved by the granting of PD-27, as heretofore amended, shall remain in full force and effect; and, (c) That the property will be used only for the purposes authorized by the Comprehensive Zoning Ordinance and PD-27, as amended.
SECTION 4. That all ordinances of the City of University Park in conflict with the
provisions of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, are
repealed.
SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, be adjudged or held
to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance or
the Comprehensive Zoning Ordinance as a whole, or any part or provision thereof, other than the
part decided to be invalid, illegal or unconstitutional.
SECTION 6. That any person, firm or corporation violating any of the provisions or terms
of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be subject to
the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of University
Park, Texas, and upon conviction in the municipal court of the City of University Park, Texas, shall

be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense,
and each and every day such violation is continued shall be deemed to constitute a separate offense.

WHEREAS, the Planning and Zoning Commission of the City of University Park and the City Council of the City of University Park, in compliance with the laws of the State of Texas with reference to the granting of zoning classifications and changes, have given the requisite notices by publication and otherwise, and have held due hearings and afforded a full and fair hearing to all property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof, and the City Council of the City of University Park is of the opinion and finds that a zoning change should be granted and that the Comprehensive Zoning Ordinance and Map should be amended; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of
University Park, Texas, be, and the same are hereby, amended so as to grant an amendment to
Planned Development District No. 27 (PD-27) so as to approve an amended detailed site plan to
provide for construction of a children’s playground north of the parish hall by enclosing an existing
court yard of the St. Christopher Episcopal Church, on the property described as a tract of 183.5 feet
by 177 feet and 172.8 feet by 171 feet in the Jefferson Tilley Survey, Abstract No. 1480, City of
University Park, Dallas County, Texas, and more commonly known as 2600 Westminster,
University Park, Texas.

SECTION 2. That the amended detailed site plan depicting the above-described
improvements is attached hereto as Exhibit “A” and made part hereof for all purposes the same as if
fully copied herein. That such site plan contains the data required by the Comprehensive Zoning
Ordinance.
SECTION 3. That this Planned Development District is granted subject to the following
special conditions:
(a) That the property will be developed only in conformance with the requirements of this ordinance, the Comprehensive Zoning Ordinance as amended hereby and the approved amended detailed site plan;
(b) That except as amended hereby, the detailed site plan approved by the granting of PD-27, as heretofore amended, shall remain in full force and effect; and, (c) That the property will be used only for the purposes authorized by the Comprehensive Zoning Ordinance and PD-27, as amended.
SECTION 4. That all ordinances of the City of University Park in conflict with the
provisions of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, are
repealed.
SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, be adjudged or held
to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance or
the Comprehensive Zoning Ordinance as a whole, or any part or provision thereof, other than the
part decided to be invalid, illegal or unconstitutional.
SECTION 6. That any person, firm or corporation violating any of the provisions or terms
of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be subject to
the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of University
Park, Texas, and upon conviction in the municipal court of the City of University Park, Texas, shall

be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense,
and each and every day such violation is continued shall be deemed to constitute a separate offense.
SECTION 7. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

SUBJECT: Consider an ordinance creating a Special Sign District for the Highland Park High School to provide for advertising signage and new scoreboard located at Highlander Stadium.
BACKGROUND: HPISD has requested approval to increase the size of the existing scoreboard at the Football Field. The subject site is located south of Grassmere Street, east of Douglas and west of Westchester and situated on Lots 1-9, Block 9, of the Methodist University Addition and known as Highlander Stadium. Existing signage includes 34 advertising signs all mounted on the east and west sides, facing the football field with a typical dimension of 12 feet 2 inches wide and 9 feet 2 inches in height measured from grade. The existing scoreboard measures 36 feet in width and 19 feet 3 inches in height and mounted 13 feet 4 inches above grade. The new scoreboard is 36 feet in width by 25 feet in height and mounted 13 feet 4 inches above grade. The draft ordinance attached provides for the number, location, size and dimension of the new scoreboard and advertising signage. RECOMMENDATION: UDADAC considered this request at its meeting on January 29, 2014 and unanimously recommended approval subject to a special condition that the number of advertising signs shall not exceed forty (40), all of which must be oriented internally facing the field.

WHEREAS, the Urban Design and Development Advisory Committee of the City has
considered a request for a special sign district for Highlander Stadium of Highland Park High School and has recommended to the City Council the adoption of a special sign district with conditions; and
WHEREAS, the provisions of the sign ordinance have been complied with and the City
Council has provided notice and a public hearing with regard to such request and recommendation and is of the opinion and finds that such special sign district should be granted; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
UNIVERSITY PARK, TEXAS:
SECTION 1. That the Urban Design and Development Advisory Committee has considered a special exception to Chapter 3 of the Code of Ordinances, submitted by Highland Park Independent School District to provide signage for Highlander Stadium at the high school as part of an overall graphics program. That such request was accompanied by a plan which provided such details and specifications as were required by the Committee and in the opinion of the Committee, such graphics program will result in the signage appearance of the area being beneficial to the public health, safety and general welfare and in the interest of the City of University Park. That the Committee has recommended to the City Council that a special sign district be established for such area, permitting signs and other graphics in accordance with the plan.
SECTION 2. That after notice and public hearing, the City Council has determined
that such special sign district is in the best interest of the public health, safety and general welfare of the city and should be granted subject to certain conditions. As part of improvements to Highlander Stadium, the school district intends to erect a new scoreboard and advertising signs ("signs") as permitted by this ordinance. That the school district shall be permitted by this

ordinance to place or permit the placement of a scoreboard and advertising signs on or within the perimeter of and facing the playing field of Highlander Stadium, subject to the following special conditions:
SIGNS
1. The number of advertising signs shall be limited to forty (40);
2. The signs may be placed as shown in Exhibit “A” attached hereto and made part hereof;
3. The size of the advertising signs shall be limited to not more than
twelve feet two inches (12'2") in width by nine feet two inches (9'2") in height, measured from grade to the top of the sign, in area each. See Exhibit “B” attached hereto and made part hereof;
SCOREBOARD
1. The new scoreboard shall not exceed thirty-six feet (36') in width
or twenty-five feet (25 ') in height, and when installed, the overall height shall not exceed thirty-eight feet four inches (38'4") measured from grade to the top of the scoreboard. See Exhibit “C” attached hereto and made part hereof;
2. The approved specifications for the scoreboard ar e

SECTION 3. That all ordinances of the City in conflict with the provisions of this
ordinance are hereby repealed.

1. Call to Order Bud Smallwood opened the meeting at 12:03pm.
2. Discuss a Proposed Amendment to the Special Sign District for HPISD Bud Smallwood introduced the agenda item and reviewed the definition of “Special Sign District”. He then turned over the meeting to Harry Persaud. Harry Persaud addressed the committee welcoming them to the first UDADAC meeting of the new year and introduced the guests in attendance as representatives of the Highland Park School District. Guests in attendance were Noble Nash, Johnny Ringgold, Mike Nolen, and Tim Turner. Mr. Persaud noted the school district approached the City about increasing the size of the scoreboard at the football stadium. Mr. Persaud suggested to HPISD the advertising signs on the fence around the football field were not included in the special sign district and would need to be addressed in the amendment as well. Mr. Persaud continued by providing the committee a history of the HPISD special sign district and then moved on to the specifics of the amendment.
The proposed scoreboard would be 36’ wide by 25’ tall; the existing scoreboard is 36’ wide and 19’ 3/4” tall. The new score board would be topped with a Bank of Texas logo and the area under the logo would be a digital video screen. The advertising signs on the fence around the interior of the football field currently number 34. It was determined those will be covered under the amendment and as well as up to six (6) additional signs for no more than 40 signs total. Discussion ensued regarding the proposal and its potential impact on the neighborhood. The HPISD representatives answered questions. Chairman Culwell moved to approve the amendment to the special sign district for Highland Park Independent School District which would provide for the larger scoreboard and up to 40 advertising signs along the interior fence of the football stadium. Doug Smellage seconded the motion and all members present voted in favor. Mr. Persaud informed the committee the amendment would go to Council at the March, 4, 2014 meeting.
3. Review and Approve Minutes of the June 11, 2013 meeting
Mr. Smellage moved to approve the minutes, and Cindy Kipp seconded the motion. All members present voted in favor.
4. Adjournment The meeting was adjourned at 12:30pm.

SUBJECT: Discuss short-term rental of single-family homes and provide direction to staff
BACKGROUND: City Council received a report from staff on November 19, 2013 regarding short-term leasing of single-family homes in the City. The Council forwarded the item to the Zoning Ordinance Advisory Committee (ZOAC) for review and consideration. ZOAC held an initial meeting on December 12, 2013 and received reports from residents of the 3300 block of Westminster regarding a single-family home in that neighborhood which was advertised online and leased on a short-term basis. ZOAC convened a second meeting on February 19, 2014 after reviewing ordinances and other information related to short-term rental of single-family homes in other cities. Staff provided a summary of on-going online advertising for single-family homes for a period of nine weeks prior to February 19, 2014 and police records for all complaints received for those specific properties for the past year. ZOAC discussed the issues and determined that there was no compelling reason or widespread problem at this time to establish regulations for short-term rental of single-family homes. ZOAC requested that staff continue to monitor online advertising of short-term rentals and refer complaints to the Police Dept. RECOMMENDATION: ZOAC considered this item and recommended no further action at this time; however, the committee requested that the City continue to monitor short-term rental websites, especially during events that might attract visitors to the metroplex. Staff will continue to monitor web advertising of single-family homes in the community.

Chairman Spies then opened the floor for presentation. Ms. Susan Wilson, who resides at 3312 Westminster, addressed the committee first. She explained that the neighbor at 3320 Westminster regularly lists her home for rent on various short term rental websites, such as VRBO.com. The home is advertised for rent at $850 per night, with no minimum stay. She added that the neighbor lives in the home full-time with her daughter, and then vacates the property while it is being rented. Ms. Wilson distributed handouts with information from other cities in the United States that regulate short term rentals. She explained that the short term renters create extra traffic and noise. She added that her biggest concern is safety because she does not know the renters. Mr. Rob Dillard asked if this area had resident-only parking, and Ms. Wilson replied no. Ms. Kim Daugherty, who resides at 3324 Westminster, then addressed the Committee. She read aloud a letter that she had written to the Committee. The letter highlighted her concerns with the short term rentals including safety issues, as she has two daughters ages 7 and 10. The letter also described that Ms. Daugherty had tried to confront her neighbor about the issue, but the neighbor has continued to deny that the property is being rented out. Ms. Wilson and Ms. Daugherty then added additional detail about the type of complaints they
have had with the renters including damage to property. Ms. Wilson described an incident in which some of the renters broke another neighbors Christmas lights. Ms. Daugherty then described an incident in which a large trailer was parked in front of her house overnight, facing the wrong direction. She explained that the police were called and the renters were ticketed. A discussion ensued regarding parking and the possibility of petitioning for resident-only parking in the neighborhood. Mr. Rob Dillard stated that at this time the city does not regulate rentals of any length of time, and added that it is a property right to rent out your home. He further explained that most cities that regulate short term rentals are vacation destinations. He stated that it needs to be determined if this is really a problem for the city. In his opinion, it would be possible to regulate only if a definite impact on the community could be determined as a result of short term rentals. He added that some of the complaints could be resolved by calling the police, and the main concern of the neighbors seems to be the conduct of the renters. Mr. Bob Clark then stated that short term rentals are not compatible with single family zoning. A discussion ensued regarding zoning and current ordinances in place. Mr. Harry Persaud presented a brief PowerPoint presentation on the item as it relates to zoning. He added that the current ordinances, such as a violation of the family definition, would be difficult to enforce. He then presented several options to the committee including monitoring short term rentals and potentially requiring registration for STRs. Ms. Gretchen Henry asked how many other homes in the city are being rented short term. Mr. Corder stated that he has only seen 3 to 4 homes for rent at any time. Mr. Dillard recommended that the committee hear from the property owner at 3320 Westminster, and also review police data for other complaints. Mr. Clark stated that the property owner is running a business from his home. A discussion then ensued regarding home occupation. Chairman Spies stated that he does not feel that the Committee has enough information or enough members present to make a decision at this time. He recommended that city staff monitor the available rentals and also review complaint data from the police department. All Committee members were in agreement. The Zoning Ordinance Advisory Committee of the City of University Park met on Wednesday, February 19, 2014 at 12:00 Noon in the South Conference Room, Peek Service Center, 4420 Worcola, Dallas, Texas. ZOAC - 13-002: Discuss short term rental in single family homes and provide direction to staff.
Chairman Spies then opened the floor for a briefing from city staff. Mr. Harry Persaud addressed the committee to explain a handout that was distributed prior to the meeting. The handout summarized nine weeks of tracking short term rental advertisements on the following websites: Air Bnb, Homeaway, and VRBO. Attached is copy of this documentation. Mr. Persaud then circulated copies of police reports for each of the addresses that were found to be advertising short term rentals, including 2932 Dyer, 3201 Northwest Pkwy, 3537 Marquette, and 3320 Westminster. Ms. Gretchen Henry asked if the reports were directly related to the rental of the properties. Mr. Persaud explained that it appeared that all of the complaints involved the owners of the properties, and not renters. A discussion ensued regarding the relevancy of the reports, as it could not be determined if the complaints were linked to the rental of the property. Mr. Terry Skartsiaris asked if there were any current ordinances prohibiting short term rentals. Mr. Rob Dillard replied that there is an ordinance prohibiting the rental of garage apartments, but there is currently nothing prohibiting specifically short term rentals. Mr. Robbie Corder added that it is difficult for city staff to enforce the ordinance for garage apartment rentals, but there are some areas around SMU that are monitored by code enforcement. Mr. Corbin Crews asked why short term rentals are happening now in the city of University Park. Mr. Rob Dillard replied that initially the Super Bowl may have attracted short term renters
to the area. Mr. Robert Rhoads added that SMU football games likely attract renters as well. A discussion then ensued regarding the initial complaint at 3320 Westminster. Mr. Robbie Corder explained that surrounding neighbors initially approached City Council, asking for them to regulate this activity. City Council then sent the issue to ZOAC to research further. Mr. Corder added that there has not been an increase in emergency calls to these properties. Chairman Spies stated that it appears no major issues have arisen as a result of the short term rental properties, and he does not feel that the city should punish all homeowners as a result of one bad example. Mr. Syd Carter asked if Ms. Susan Wilson had called the police regarding the renters on Westminster, prior to bringing the issue to City Council. Mr. Corder replied that she had not. A discussion then ensued regarding short term rentals in other areas. Mr. Rob Dillard explained that the city of Austin began losing hotel/motel tax income due to the popularity of short term rentals. For this reason, the city began licensing the rentals so that this income could be recouped. Chairman Spies explained that he believes city staff should continue to monitor the short term rentals being advertised, especially through upcoming football season. He added that it would be helpful for the neighbors to call in complaints to the police so that the city could more easily track them. Chairman Spies asked for input from other Committee members. All expressed agreement with this sentiment. Mr. Robbie Corder added that the Community Development Department could work with the Police Department to make them aware of short term rentals, so that officers could ask appropriate questions when responding to calls that may be related to this activity. Mr. Rob Dillard advised that in order to regulate a lawful activity such as renting property, there would need to be evidence that there is a negative impact to a substantial part of the community. Chairman Spies stated that the Committee has not found enough evidence to warrant regulating short term rentals at this time. He then made a motion for city staff to continue to monitor the short term rental advertisements, including throughout the upcoming SMU football season. The motion passed with a unanimous vote. Chairman Spies then made a motion to approve Minutes from the February 26, 2013 and December 12, 2013 meetings. The Minutes were approved with a unanimous vote.
