REQUEST FOR PROPOSALS

The City of Malibu, California (“City”) is inviting proposals for an update of the City’s General Plan Housing Element for the 5th planning cycle (October 15, 2013 to October 15, 2021). The City is seeking the services of an experienced consultant firm (Consultant) to prepare the Housing Element Update for submission to the California Department of Housing and Community Development (HCD) in accordance with all applicable laws, regulations and statues. The Consultant shall also be responsible for undertaking all steps necessary to prepare and process the document in conformance with HCD guidelines, requirements and timelines. BACKGROUND The City of Malibu, which was incorporated in 1991, lies entirely within the State designated Coastal Zone. The City extends approximately 21 miles from the Ventura County line on the west to Topanga Canyon Boulevard on the east. Inland, the City’s Coastal Zone boundary extends approximately two miles and includes portions of the coastal terrace and slopes of the Santa Monica Mountains. The City is a beachfront community famous for its warm, sandy beaches. As of the 2010 U.S. Census, the City’s estimated population is 12,645. The City’s General Plan was initially adopted in 1995 and the Housing Element has been amended twice, in 1997 and 2001. A comprehensive update of the Housing Element for the 4th planning cycle is nearing completion. An Environmental Impact Report (EIR) was prepared for this Housing Element Update. It is anticipated that the updated Housing Element and related EIR for the 4th planning cycle will be approved by the City Council in September 2013. The City received a Preliminary Certification Letter from HCD in July 2012. SCOPE OF WORK

The City desires that the Housing Element Update should be developed through a consensus building process that is fully responsive to comments and concerns of the public and affected/interested agencies. The range of work under proposals submitted shall include the necessary efforts of research, and to prepare and present all materials necessary to affect the submission of an updated Housing Element that is acceptable to the Malibu City Council and that will be certified by HCD. This is envisioned as, but is not limited to, the items listed in the “Proposal Content” section below. PROJECT COMPONENTS Prior to initiating work on the Housing Element, the Consultant shall carefully review the City’s existing housing-related documents to develop a focused list of data needs. The Consultant shall meet with City staff to collect available data, and pursue outside data as necessary. The Consultant’s work shall include updates of the following sections of the Housing Element:

Introduction The introductory chapter to the Housing Element sets the stage by describing the purpose of the Housing Element in lay terms and establishes the community’s housing context. The Introduction also typically includes a summary of key housing issues; establishes the Housing Element’s relationship with the balance of the General Plan; and describes the public participation process. 2. Housing Needs Assessment Malibu’s current Housing Element is primarily based on the 2000 U.S. Census; therefore, the Housing Needs Assessment will require a comprehensive update using 2010 Census data and other current market information. Updated information shall be provided pertaining to 1) population and household characteristics; 2) housing stock characteristics; 3) assisted housing at-risk of conversion to market rate; and 4) the Regional Housing Needs Assessment (RHNA) for the City as adopted by the Southern California Association of Governments (SCAG). 3. Site Availability This section of the Housing Element should provide an inventory of vacant and underutilized parcels within the City available for residential development during the 2014-2021 planning period. In addition to vacant residential sites, the Consultant will evaluate growth potential on underutilized sites, including opportunities for mixed use, underdeveloped residential properties, second residential units, surplus public properties, and other potential sites based on discussion with City staff. The Consultant will evaluate the adequacy of this site inventory in fulfilling the City’s housing needs allocation for the 5th planning cycle. 4. Potential Housing Constraints and Resources The Consultant shall prepare an updated analysis of potential constraints upon the maintenance, improvement or development of housing in Malibu to include market conditions (construction costs, land costs, availability of financing) and an additional public policy discussion of zoning, residential development standards, codes and enforcement, on- and off-site improvements, fees and taxes, and processing and permit procedures. This section shall also include a discussion of incentives offered by the City for provision of affordable housing, such as the density bonus program, modified development standards, fee reductions, etc. The resources analysis shall evaluate financial resources available for program implementation, including Federal, State, local and private funding sources. In addition, this section shall include a summary of administrative resources available to assist in achieving the City’s housing goals. 5. Review of Existing Housing Element In order to develop appropriate programs to address the housing needs identified in the prior tasks, the Consultant shall work with City staff to determine the achievements under adopted housing programs in the Housing Element anticipated to be certified during late 2013, and evaluate the effectiveness of these programs in delivering housing services. This evaluation shall include a description of the City’s track record in producing new affordable housing during the planning period, and a comparison of housing production with the City’s identified regional housing growth needs.

Draft Housing Element Based on the evaluation conducted in the prior phases, combined with input from HCD, City decision-makers, and the public, the Housing Element will be updated. To implement changes to the document, the Consultant shall develop and submit to City staff a redline version (track changes) of the Administrative Draft Housing Element to delineate all proposed revisions. For any new programs proposed, a summary chart shall be prepared which specifies the following for each program: program objective, funding source, responsible agency and implementation time frame. This chart will be used to track program implementation, and can serve as the basis for the City’s annual report to HCD. Based on direction received from City staff, the Consultant shall make any appropriate revisions to the Draft Housing Element, and provide an electronic Screencheck version to City staff for final review prior to finalizing the Draft Housing Element for public review and submittal to HCD. 7. Environmental Documentation It is anticipated that the Environmental Impact Report (EIR) prepared for the Housing Element Update currently underway will be utilized for the 5th Cycle Housing Element. This EIR is scheduled for certification in September. If, however; significant land use changes are ultimately proposed as part of the Housing Element, a Mitigated Negative Declaration, or a Supplemental EIR may be necessary. For purposes of budgeting, assume use of the EIR prepared for the current Housing Element Update. Deliverable: Initial Study / Negative Declaration

8. Public Review and Finalization Upon receipt of comments from HCD on the Public Review Draft Housing Element, the Consultant shall draft a memo identifying any recommended changes to the Housing Element necessary to achieve HCD compliance. The Consultant shall assist City staff in conducting the Planning Commission and City Council public hearings on the Draft Housing Element. All comments and changes arising from these meetings will be prepared for incorporation into the final documents. Deliverables: Memo identifying recommended changes to Draft Housing Element

PROPOSAL CONTENT The Proposal shall consist of two parts: the (A) technical component and the (B) cost component. The Proposal shall be transmitted with a cover letter that must be signed by an official authorized to bind the Consultant contractually, and shall contain a statement that the proposals are firm offers for a 90-day period. The letter shall also provide the name, title, address, telephone number and email address of individuals with the authority to negotiate and contractually bind the Consultant. The cover letter constitutes certification by Consultant, under penalty of perjury, that the Consultant complies with nondiscrimination requirements of the State and the Federal government. An unsigned proposal or one signed by an individual unauthorized to bind the Consultant may be rejected. A. TECHNICAL COMPONENT The technical component shall include the following information: Introduction - The introduction shall contain a project proposal, including a statement of the understanding of the project, discussion of how the objectives of the scope of work will be accomplished, and identification of the Consultant, including the address, telephone number, email address, and a designated contact person if further information is needed. Any participating Consultants and proposed sub-consultants shall be identified and included in the proposal (all sub-consultants must be approved by the City).

Qualifications - a. A description of the Consultant's capabilities and experience in preparing a quality

Housing Element Update.

b. An Organization Chart showing the proposed relationships between all key personnel, identification of staff's capabilities, identification of the Project Manager and the support staff, the proposed responsibilities of each person on the chart, and brief resumes which highlight special qualifications relevant to the required tasks.

c. A description of the present activities of the Consultant's key personnel and their availability to accomplish the required services.

address of the sub-consultant, resumes of the key staff proposed for the project and the tasks to be carried out.

Scope of Work - A summary of the scope of work as you envision it and a description of the approach and methodology to be used to provide the required services. Identify any supplemental tasks deemed necessary or alternatives which may enhance the project, reduce costs, or expedite delivery. The Consultant should also identify any tasks not identified and/or mentioned in this document that would otherwise affect the successful realization of this project. Identify the specific end products which will be submitted. B. COST COMPONENT The cost component shall include the following information: a. Rate Schedule for the duration of the contract;

b. Total cost to perform the work in its entirety, including a breakdown of the costs for each individual work task;

c. Listing of any other costs charged by Consultant in providing services; and

d. A schedule for the proposed work showing the tasks to be performed, corresponding dates when each task and/or subtask will begin and end.

C. REFERENCES Provide at least three professional references for the project manager and the firm. For each of these, please identify the individuals in the firm who worked on or are working on the project and their role or responsibility. D. CONFLICT OF INTEREST The Consultant shall disclose any financial, business or other relationships with the City that may have an impact on the outcome of this contract or any resulting construction project. Furthermore, a list of individuals and firms associated with the project applicant is included on page 12 of this RFP. The Consultant shall disclose any financial, business or other relationships with these individuals or firms. The City reserves the right to cancel the award of contract if any interest disclosed from any source could either give the appearance of a conflict or cause speculation as to the objectivity of the program. The City determination regarding any questions of conflict of interest shall be final. E. LIMITS OF GENERAL AND PROFESSIONAL LIABILITY INSURANCE The Consultant shall provide detailed information pertaining to the limits of the general and professional liability insurance.

The Consultant rated as most qualified to provide the requested services will be invited to negotiate a final contract. If an agreement is not reached, negotiations may be terminated and commenced with the next qualified Consultant. The City reserves the right to reject any and all proposals. The Proposal will be evaluated by City staff based in the following manner:

• Demonstration of a clear understanding of the project; • Professional qualifications and capability of the Consultant team; • Experience with similar types of projects; • Examples of recent projects that were successfully completed; • Reasonable cost and on-time performance; and • Approach to performing this type of service and demonstrated adherence to schedules.
