AGENDA TITLE: Consider appointment for the currently
vacant District 4 Council Member seat MEETING DATE: February 2, 2017 PREPARED BY DEPARTMENT HEAD: Jason Lindgren, City Clerk RECOMMENDED ACTION: Consider appointment for the currently vacant District 4 Council Member seat, and/or provide direction as deemed appropriate.
If a nominee is selected by the City Council, staff recommends the City Council adopt a resolution appointing the selected nominee as the District 4 Council Member and direct the City Clerk to administer the Oath of Office to the appointed Council Member.
BACKGROUND INFORMATION: The District 4 Council Member seat was vacated after Steve Ly assumed the office Mayor on December 14, 2016. Government Code Section 36512 provides regulation for the process of filling a council vacancy of a general law city. Government Code Section 36512(b) addresses vacancies of elected officers of a general law city. A vacancy must be filled by the City Council, and can be done in the following ways: 1) appointment by the council within 60 days of the commencement of the vacancy, or 2) calling a special election within 60 days of the vacancy. Any person appointed or elected to fill the vacancy would hold the office for the unexpired term of the council member whose seat is vacated.

Recruitment for the vacancy was authorized by the City Council December 14, 2016. The application deadline was January 18, 2017, and twenty qualified applications were received listed as follows:

During the regular meeting of January 11, 2017, Mayor Ly received City Council consensus to schedule a special meeting for the consideration of the vacancy appointment for Council Member District 4. On the consent calendar of the regular meeting of January 25, 2017 the special meeting date of Thursday, February 2, 2017 was selected. The Elk Grove City Council Norms & Procedures Manual prescribes an outline of the agenda and meeting structure to consider an appointment, providing that each candidate has the opportunity to give an opening statement of five minutes, and answer questions posed by the City Council.

Past practice at meetings that considered vacancy appointments received the candidates in alphabetical order by last name. After all candidates had the opportunity to provide their opening statements, and answer questions of the City Council, the Mayor opened the public comment opportunity. After public comment, the City Council deliberated on the matter and took action or provided direction as deemed appropriate. ANALYSIS: For consideration of an appointment, the last day of the 60 day timeframe from the date of the vacancy is February12, 2017. A resolution has been prepared to appoint a nominee and, if approved, would direct the City Clerk to administer the Oath of Office to the appointed Council Member. The appointee would hold the office through the unexpired term until December 12, 2018 – the date an elected District 4 Council Member is expected to take office following the November 2018 election. FISCAL IMPACT: The recruitment and application solicitation process is accounted for in the Office of the City Clerk Fiscal Year 2016-17 Budget. ATTACHMENTS:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE APPOINTING _________ AS THE CITY OF ELK GROVE
DISTRICT 4 COUNCIL MEMBER
WHEREAS, on December 14, 2016 the City of Elk Grove District 4 Council Member seat became vacant; and WHEREAS, Government Code Section 36512(b) addresses vacancies of elected officers of a general law city and provides that a vacancy must be filled by the city council either by 1) appointment by the council within 60 days of the commencement of the vacancy, or 2) calling a special election within 60 days of the vacancy to fill the vacancy; and WHEREAS, the City Council authorized recruitment for the vacancy on December 14, 2016, for consideration to make an appointment scheduled for the special meeting of February 2, 2017.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk Grove hereby appoints ______ as the City of Elk Grove District 4 Council Member; and BE IT FURTHER RESOLVED that the City Council of the City of Elk Grove hereby directs the City Clerk to administer the Oath of Office for ________, who will then assume the duties and responsibilities of office from that point, continuing for the remaining term of the District 4 Council Member office expected to expire in December 2018. It is an honor to be included in the selection process for the City Council position in Elk Grove, CA. As your Councilmember I believe in the governing Philosophy of Capacity building by seeking to solve problems at the local level without expanding the role of government or by creating new, expensive government-run or government- financed programs. Instead, local, state, and federal politicians can play a role in solving local problems by using their leadership skills to mobilize community resources. I will inspire and mobilize people in our district to enhance economic development and improve the quality of our communities, while providing leadership in a manner that honors and respects everyone. I will support programs and projects that seek to build capacity over programs and projects that foster dependence. Furthermore, I plan to serve as a vital link between career technical education programs in the Elk Grove Unified School District and local businesses. This partnership with EGUSD will provide Elk Grove employers highly trained employees while making education more relevant and rigorous for high school students.
During 2003-2005 we had the opportunity to sponsor, train and hire the “Lost Boys” from Sudan. After sponsoring the 18 of 29 young men that came to San Jose, it became well known via the local media. We were able to assist with training, financing and licensing thru the CA Consumer Affairs BSIS. After licensing, we hired and trained them with special attention toward building their future. This process was the beginning of our internal Career Technical Education, whereby we reached out to local high schools and Colleges to offer skills to the next generation. Over the past 25 years’ we have worked to promote employees for a long-term career, one example; a former employee now works for the U.S. Secret Service.
My business experience spans over 30 years as the owner of a Funeral Home, Insurance Company, Security Companies, and serve on the Board of Directors with other companies. Over the past 20 years I have created new jobs by originating security services to numerous Fortune 500 companies like Symantec and Novellus Systems. 2016 Candidate for State Assembly, District 9 California
As a Candidate, I was recognized by the CA Secretary of State as the Nominee for the office State Assembly in the 9th District. I have obtained endorsements from the Howard Jarvis Taxpayers’ Association, California Republican Party, California Republican Assembly, Sacramento Republican Party, and California Pro-Life Council, Republican Party of San Joaquin, and numerous elected officials in California. My campaign gave me the opportunity to meet with thousands of Elk Grove residents, and hear their life experiences as a resident. However, my experience with the Republican Party does not preclude me from working with leaders from other parties. There are no party interests that supersede the interests of the people of Elk Grove!

As Corporate President, and CEO I served numerous CA corporations to include hospitals, high-tech companies and other corporate facilities and maintained over 150 employees. As the owner of the company I elected to provide armed/unarmed security, private investigations, armed off-duty Police Officers, access control and video systems. The services were provided to Novellus Systems, Inc., Federal Aviation Administration, Monterrey County, The Tech Museum, Good Samaritan Hospital, Tenet Hospitals, Sutter Hospitals, O’Connor Hospital, Regional Medical Center, San Jose Medical Center and numerous other hospitals and high-tech facilities within the State of California.
