RECOMMENDATION:

The Engineer’s estimate was $1,219,202.70. A total of three responsive bids were received. The lowest bid was submitted by Pavement Coatings Co. in the amount of $1,123,123.00. Pavement Coatings Co. holds a valid Class A and C32 General Contractor’s license in the State of California with no enforcement actions listed and has good references; therefore, Pavement Coatings Co. qualifies as the lowest responsible bidder as required under state law.

Schedule:

The project allows for a total of 55 working days. The anticipated schedule is as follows:

Award Contract: September 13, 2017 Notice to Proceed: October 2, 2017 Project Completion: December 15, 2017 In accordance with the California Environmental Quality Act, the proposed project is exempt from future review. A Notice of Exemption (NOE) was filed for the project. On April 28, 2017 the Governor signed Senate Bill (SB) 1, which is known as the Road Repair and Accountability Act of 2017, to address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local streets and road system. In order to receive an apportionment of the funds, cities are required to submit a list of project(s) proposed to be funded by SB1, and the project(s) must be included in a city budget that is adopted by the city council at a regular public meeting. The revenue amount for FY 17/18 for Eastvale is estimated to be $368,238. The apportionment is estimated to begin in mid-January, 2018.

This fund is eligible to be used on projects that include, but are not limited to, the following:

• Road Maintenance and Rehabilitation • Safety Projects • Railroad Grade Separations • Complete Streets Components • Traffic Control Devices

Slurry seal operation is considered as road maintenance therefore is eligible to be funded by SB1. The City Council is recommended to approve budget amendment to appropriate $368,238 of SB1 funds to the 2017 Residential Slurry Seal Project. FISCAL IMPACT The 2017 Residential Slurry Seal project is part of the 2017/18 Capital Improvement Program Budget. There is currently $500,000 budgeted in FY 2017/18 budget under Measure A and $1,125,000 of Continuing Appropriations are available for the project in Measure A. If the budget amendment recommendation is approved, $368,238 of SB1 funds will be used for the project, and current available budget in amount of $1,625,000.00 in Measure A will be decreased to $1,260,762.00. There are sufficient amount of funds budgeted to complete the project, and any remaining funds within Measure A will be appropriated to future Slurry Seal projects. RESOLUTION NO. 17-XX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EASTVALE, CALIFORNIA, AFFIRMING THE FISCAL YEAR 2017- 2018 BUDGET FOR THE USE OF FUNDS PROVIDED BY THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 (SB 1)

WHEREAS, the Governor of California on April 28, 2017 signed Senate Bill 1, the Road Repair and Accountability Act of 2017, also known as the Road Maintenance and Rehabilitation Account (RMRA), to address basic road maintenance, rehabilitation and critical safety needs on highways and local streets, which is funded through a per gallon fuel tax and vehicle registration fees; and

WHEREAS, pursuant to Street and Highways Code (SHC) Section 2034, each

eligible city or county prior to receiving an apportionment of RMRA funds is required to have identifiable capital projects in a budget adopted or amended by the governing body that monies provided by RMRA will fund; and

WHEREAS, pursuant to SHC Section 2030, RMRA funds are to be prioritized for

expenditure on basic road maintenance and rehabilitation projects, and on critical safety projects, railroad grade separations, complete streets components including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and storm water recapture projects in conjunction with any other allowable project, and traffic control devices; and

WHEREAS, pursuant to SHC Section 2037, a city or county may spend its

apportionment of RMRA funds on transportation priorities other than those outlined in SHC Section 2030, if the city or county’s average Pavement Condition Index (PCI) meets or exceeds 80; and

WHEREAS, pursuant to SHC Section 2036, a city or county may spend its

apportionment of RMRA funds for general fund transportation expenses in excess of the maintenance of effort as calculated in the Street Report as the average general fund expenditures for street, road and highway purposes in Fiscal Years 2009-2010, 2010- 2011 and 2011-2012; and

WHEREAS, the City of Eastvale is projected to receive $364,238 in RMRA funds

in Fiscal Year 2017-2018.

NOW, THEREFORE, the City Council of the City of Eastvale does hereby resolve, determine, and order as follows:

SECTION 1. The City of Eastvale has identified the following RMRA capital

project to the adopted budget for Fiscal Year 2017-2018: 2017 Residential Slurry Seal Project

SECTION 2. The City of Eastvale will submit to the California Transportation Commission for their review a list of proposed projects to be funded by RMRA by October 16, 2017, in the format prescribed.

SECTION 3. The Director of Engineering is hereby authorized to undertake such acts as necessary to carry out this Resolution.

SECTION 4. The City Clerk is directed to certify to the adoption of this Resolution.
