Background

• Indian Creek Nature Center requests the removal of a rezoning ordinance condition requiring a conservation easement for the subject property.

• Ordinance 068-12 approved in 2012 rezoned the property from R1 to C3 (now S-MC)

• Condition 8 of this rezone required that 6.5 acres of the property known as Lot 2 be placed in a conservation easement

• Request recommended for approval by City Planning Commission on June 24 (6-0).

• Owner’s reasons for the removal:

• Electric easement and overhead power runs through the lot

• Restrictive covenants already exist on the lot

• Low development potential as lot is irregularly shaped and difficult to access.

• The requested ordinance amendment does not conflict with the intent of the original ordinance because the lot continues to be a buffer between commercial development to the north and residences to the south based on the circumstances stated previously.
