SUBJECT: Item 7: Remote Participation in Council Meetings
Councilmembers Lee and Robinson have requested to participate remotely during items 1 1 a andb of tonight's City Council meeting. Additionally, Councilmember Robinson has asked toparticipate in next week's Extended Study Session.
According to Section 6E of the City Council Rules ofProcedure, remote participation must beapproved in advance at an earlier Council meeting, or before joining a current meeting.Additional provisions include:
~ A Councilmember may participate remotely no more than four times per year (unlessrequired for medical reasons);
~ Only two Councilmembers may participate remotely during any one Council meeting;
~ Remote participation will be considered attendance at the meeting and shall be countedtoward determination of a quorum.
Council is being asked to consider the following requests to approve remote participation:

I have been asked to comment on whether the City of Bellevue's proposed Ordinance No.6313 represents reasonable and appropriate zoning of marijuana land uses. In that review,one particular issue stands out to me. The 100 foot buffer between some high densityresidential uses and marijuana retail uses is inconsistent with the existing code. Westrongly encourage you to make a minor amendment to the proposed ordinance beforeadopting it as mentioned below.
Section 5 amending LUC 20.20.535.F, includes a prohibition on any retailer being locatedwithin 100 feet of any single family or multi-family districts (excluding Downtown and Bel-
Red residential uses and multi-use districts). While separation from single family uses maybe appropriate, the prohibition seems incompatible with the purpose of the R-20 and R-30multi-family districts. While "R-10 and R-15 District are more restrictive and may be utilizedas a buffer between Suburban Residential Districts and moderate density residential orcommercial districts," the "R-20 and R-30 Districts are intended to be convenient to centersof employment and have primary access to arterial streets." LUC 20.10.220. The intent ofthe R-20 and R-30, both in writing and in practice is to place the higher density residentialzones adjacent to business and higher traffic areas, which may serve to buffer lower densityzones. The R-20 and R-30 Districts can be found throughout Bellevue immediately adjacentto a wide variety of uses, including industrial uses that are typically incompatible withresidential uses. Furthermore, the proposal seems inconsistent when there is not a similarbuffer required around Downtown and Bel-Red Residential Districts (DNTN-R, BR-R) andmulti-use zones. Rather, R-20 and R-30 should be treated in a similar fashion whereretailers are not allowed to be located in the residential districts (see Section 5, Paragraph6), but not require an additional buffer.

Additionally, it is worth noting that requiring a 100 foot buffer around R-20 and R-30properties may have unintended consequences. For example, it appears that there is onlyone suitable parcel in the Crossroads subarea that complies with LCB distance restrictions,which would be eliminated by the proposed R-20 and R-30 buffer. As a result, there may besome unintended concentration of stores in other subareas.
Requiring a buffer between a commercial use and R-20 and R-30 Districts is inconsistentwith the purpose and application of the higher density residential uses and, therefore, wouldbe an arbitrary and capricious decision. Bellevue should carve out R-20 and R-30 from theproposed ordinance and revise the language of Section 5, paragraph 2 as follows:
2. A marijuana retailer shall not be located within 100 feet of the following land use
