The Mayor reported that Mr. Sullivan was hospitalized, but was ex­pected to ' be horre by Wednelday~ '

Motion by LaVaque to approve the minutes of January 13, 1964 as ( 1 presented. Seconded by Rustad. 4 Ayes.

Mr. Eliason approved as requested by the Council at the previous meeting and .explained why he requested an extension of time for parking of mobile homes.

Motion by Hodges to re.new 'permit for above use for 60 days. allowing Mr. Eliason to live in mobile home at 8323 Eastwood Road. Seconded by Rustad. 4 Ayes.

Mr. C. Larson requested approval of the remainder of the building permits on the Montgomery Trailer Park Site. Motion by Rustad to authorize the building inspector to issue building 'permits for a total of 21 four-plexes at thiS location. Seconded by Hodges. 4 Ayes.

Mayor Hodges informed the residents and papers of the mailing of an advisory-type notice to the land owners and residents regarding sewer.

(Copy of said notice attached to the official minutes.)

A complaint from a resident regarding the unsanitary conditions in a rental unit was referred to Mr. LaVaque for action.

Mr. Rustad read a letter from the Police Chief regarding needed stop signs in the village. Letter on file. Motion by Rustad to concur with the Police Ch ieE' s ~co.l1mendation and order stop signs at the intersection of Red Oak Drive and County Road H-2, and at Red '')ak Drive and Woodcrest Drive. Seconded by LaVaque. 4 Ayes.

The Attorney presented a resolution to request the County to change the name of Spring Lake Park Road to Spring Lake Road. Motion by Blanchard to adopt Resolution #145. Seconded by Rustad. 4 Ayes.

A resolution referring to change of :~!~ssments for project 1960-1 and 1960·2 was presented~ Motion by Hodges to adopt Resolution #146. Seconded by Rustad. 4 Ayes.

A resolution referring to change of assessments for project 1961-1 was presented. Motion by Rustad to adopt Resolution #147. Seconded by LaVaque. 4 Ayes.

A resolution regarding certain assessments w~s " presented. Motion by LaVaque to adopt Resolution #148. Seconded by Rustad. 4 Ayes. Resolution #148 covers the following divisions: #32738(MA '3~Z6~3), 32987 (MA 34&35), 32478,321'73 ' (1v1A 35;37), 32848 (MA 34 & 37).

A resolution abating assessment of 11.36 was presented. Motion by Hodges to adopt Resolution #149. Seconded by Blanchard. 4 Ayes.

Copies of letters from the Attorney to the Board of Health, New Brighton Council, Chies B~s., regarding the condition and operation of the Chies . dump were placed on file.

Motion by Hodges to adopt Ordinance #109, entitled: · (Snowbird) AN ORDINANCE REQUIRING REM0VAL OF MOTCR VEHICLES FROM PUBLIC PARKING AREAS AFTER PROPER WARNING. AND PROVIDING A PENALTY FOR FAILURE TO OBSERVE WARNING.

The Mayor opened the public hearing for the hous~ moving called for this date at 9:00 P.M. The Clerk read the published notice and stated that all forms were in order and that requested mailed notices had been sent. Several citizens questioned th petjtioner about the home in an informal manner and the Mayor then called 3 times fo~ objectors to the proposal. There were floNe. ..

The Mayor closed the hearing. Motion by Blanchard to approve the request and

The petitioner presented preliminary plans for the duplexes he wanted to con~truet and answered several questions from the audience.

Motion by Rustad to approve minutes of the regular meeting held on January 27, 1963 ,as presented. Seconded by LaVaque. 4 Ayes. Sullivan abstained.

Motion by LaVaque to approve minutes of the special meeting held on February 3, 1964 as presented. Seconded by Sullivan. 5 Ayes.

A petition opposing the construction of sanitary sewers in the Hill­view area was presented. The Clerk was instructed to file the petition

\ with · the others received on the same subject. ) The Mayor announced that the problem of the sewer proposal would be

discussed at the next agerda.meeting, Monday, February 17, 1964.

Motion by Hodges to direct the Police Department to release an air rifle they had impounded to Mr. Swenson, 5462 Jackson Drive. Seconded by Rustad. 5 Ayes.

The matter of storm drainage through the east ~ of Lot 9 on Gloria Circle was referred to the Engineer for recommendation.

Al~tter from the Minne sota Water Polution Control Commission approving plans for the N.S.S.S.D.'s interceptor system was read and filed.

A letter from the Ramsey County Auditor requesting the Village to use permanent voter registration was read and filed.

The Clerk's office was instructed to investigate the water hook-up, without penalty, of a house at 8345 Red 0ak Drive.

The Police report for January, 1964 was read and filed.

The B. & E. Patrol report for January, 1964 was read and filed.

Mr. LaVaque reported that the unsanitary conditions at a rental unit t ~ reported at the last meeting were cleaned up.

ice for period of time that meter was inoperat~ve due to broken gears. Bill in the amount of $154.77. Seconded by Blanchard. 5 Ayes.

The Clerk's cMice was direc 'ted to issue water permits only after payment of the late hook-up fees.

The minutes of the Civil Defense meeting of January 31,1964 were read and discussed.

Motion by Rustad to adopt recommendations of the Civil Defense Commiss-ion as follows:

1. The key for the Civil Defense truck shall remain in the possession of the Civil Defense organization only.

2. The truck shall be used only if an authorized C.D. man is in charge. .

3. When the truck i~ called out by any department, a charge of $2.50 per hb~r shall be charged.

A. $1.50 per hour to the man on the truck. B. $1.00 p~r hour to be credited t o the Civil Defense

budget for expense on the truck.

4. A price up to a certain Hamount be agreed upon for a build­ing to house the Civil Defense truck and Civil Defense equipment. A figure of approximately $500.00

5. Permission be granted to the Civil Defense to install the antenna for communications on top of the water tower when the building for Civil Defense is completed. The height of the water tower is within F.C.C. regulations.

Seconded by LaVaque. 5 Ayes.

Mr. Anthony Donatelle requested permiseion ',to move the Pinewood Club from it's present location to his property at County Road H-2 and High­way #10.

He was referred to the Clerk's office to fill out proper forms and to comply with ordinances.

Motion by Blanchard to set ' a public hGaring ' on :': the above matter for February 24, 1964 at 9:30 P.M. Seconded by Rustad. . 5 Ayes.

The Attorney presented a formal .contract proposal for Engineering servires for study.

The matter of County liability for property damage done by their equipment was referred to the Attorney for a memo.

The Attorney reported that the Karl Dedolph Construction Co. case was postponed again and no new date had been set.

Motion by Blanchard to pay bills submitte by LaVaque.

Motion by LaVaque to approve the minutes of the regular meeting held on February 10, 1964 as presented. Seconded by Rustad. 5 Ayes.

Two petitions against installation of sanitary sewer in the village were received and filed.

( The Mayor stated that at the second meeting in March the Council would g1ve their decision on the sanitary sewer proposal.

Mr. G.E.Christian appeared requesting a sub-division and variance at his property. Motion by Rustad to approve the sub-division and grant variance requested for Mr. Christian at 7917 Eastwood Road. Sa1d var­iance will allow a 6 foot side yard set back for garage on the north side of the N.! of lot 58 and a 2i foot side yard set back for garage on the N. side of the So. half of lot 58. Seconded by Sullivan. 5 Ayes.

Mr. Eigenheer presented the final plot plans for his proposed sub­division across the street from Edgewood Junior High School. Motion by Blanchard to approve the final plot plan for the Eigenheer addition and to authorize the Mayor and Clerk to sign and to affix the village seal. Seconded by Hodges. 5 Ayes.

The Mayor announced that the Recreation Department had closed the warming houses at the skating rinks due to the warm weather and con­dition of the ice.

A meeting and reorganization of the Mounds View Industrial Develop­\ ment Committee will be held at the village hall on February 24, 1964.

Motion by Sullivan to increase the salary of Superintendent Walter Skiba from $474.96 to $500.00 per month plus payment' of health in­surance and to increase the salary of Walter Johnson from $2.12 per hour to $2.40 per hour plus payment of health insurance, effective March 1, 1964. Seconded by Rustad. 5 Ayes.

Motion by Sullivan to sign application and pay premium to Trav­elers Insurance Company for Health and Accident and Life Insurance for a total of six employees, effective March 1, 1964. Seconded by Blanchard. 5 Ayes.

A letter regarding the legality of this motion was requested from the insurer, and the Attorney was directed to furnish this.

Motion by Blanchard to authorize the Mayor to appoint one rep­resentative to attend the University of Minnesota short course on turf and sodding on March 17, 1964. Village to pay expenses in-curred. Seconded by Rustad. 5 Ayes.

Mr. Rustad read the minutes of the Police Commission meeting of February 20, 1964. Copy on file.

Motion by Rustad to concur with the recommendation of the Police Commission and raise the pay of part time Police officers $10.00 per month. Seconded by LaVaque. 5 Ayes.

The matter of the vacating of liquor establishments after closing hours was referred to the Attorney for recommendation.

The Mayor presented a certificate of appreciation to Mr. Perry Malvin from the Council for his years of active interest in the Village.

The minutes of the Planning Commission meeting of February 18, 1964 were read and filed. r~~-'-

The Public Hearing for the Rezoning of the property on County Road I from R2 to R3 was opened at 9:00 P.M. The Clerk read the legal notice and stated that all forms and procedures had been completed and followed. The Mayor explained the reason for the re • . quest and asked if anyone wished to speak on the subject. There were no objectors to the proposal. The Mayor closed the hearing at 9:05 P.M. Motion by LaVaque to rezone:

. The Attorney presented a resolution regarding apportionment of assessments dUe to lot splits.

Motion by Rustad to adopt resolution #153. Seconded by LaVaque. 5 Ayes.

Divisions included in the resolution are: 33089 - Area and Lateral, 33067 - Area and Lateral, and 33068 - Area,Lateral, and Service.

A memo and resolut1on regarding designation of Silver Lake Road was presented by Mr. Meyers.

Motion by Blanchard to adopt resolution #152. Seconded by Rustad. 5 Ayes.

The contract for Engineering services by Comstock and Davis was presented by the Attorney. Motion by Rustad to approve the contract and authorize the Mayor and Clerk to execute. Seconded by Hodges. 4 Ayes. Sullivan naye.

A memo regarding liability for damage caused by County equip­ment doing village work was presented for study.

A letter from the Department of Health regarding the Ch1es Dump was read and filed.

The Mayor opened the Public Hearing on the relocation of a building within the village.

Mr. Donatelle stated that he wished to move the Pinewood Club now at County Road I and Highway #8 to his property at County Road H-2 and Highway #10 for use as a supper club. The Mayor called 3 times for objectors to the proposal. There were none. The Mayor" closed the hearing at 9:40 P.M. Motion by Rustad to concur with the Planning Commission's . recommendation and allow the relocation of the Pinewood Club from it's present location to:

Motion by Blanchard to pay bills submitted, totaling Seconded by Hodges.

$8,217.65. 5 Ayes.

Motion by Blanchard to approve applications for licenses. (List attached) Seconded by Sullivan. 5 Ayes.

Motion by Blanchard to raise pay of Administrative Clerk, Paul Boog, from $550.00 to $575.00 ($25.00 per month).Seconded by La-Vaque. 5 Ayes.

The Clerk was instructed to request Ramsey County to post load limits on village roads when county roads are posted.

Motion by Blanchard to direct Attorney to prepare a resolution adopting the N.S.S.S.D. contract. Seconded by Hodges. 5 Ayes.

The matter of whether or not to remove the stop signs at Quincy and Pinewood intersection was referred to the Police CommiSSion for recommendation.

Mr. Rustad was directed to request a letter box to be placed at or near the B. and R. Grocery Store on County Road I.

The Attorney was directed to prepare a resolution to change the name of Spring Lake Park Road to Spring Lake Road.

Motion by Blanchard to adjourn. Seconded by Sullivan. 5 Ayes.

Motion by Sullivan to approve the minutes of February 24, 1964 as presented. Seconded by LaVaque. 5 Ayes.

Five residents from Fairchild Ave., north of Highway #10, requested the Council to reconsider any previous action and not deSignate Fairchild Ave . north of Highway #10 as a county road continuation of Silver Lake Road. After considerable discussion by council members, the Attorney and the Engineer, with questions and answers from the residents present, the following action was taken: Motion by Hodges to direct the Attorney to inform the County Engineer to disregard previous correspondence re­garding this matter and to request the County to deSignate Red Oak Drive, north of Highway #10, as the continuation of Silver Lake Road County Highway. Seconded by Rustad. 5 Ayes •

A representative of the Mounds View Sportsmen's Club requested the use of the village hall for meetings. This was referred to the Clerk's office for proper application.

. A resident requested village action on a house at 2091 Pinewood Drive that is in an extremely unsanitary condition. This was referred to the Attorney and Building Inspector for immediate action.

Mayor Hodges reported that the Industrial Development Committee was in need of a chairman as John Bell, the present chairman, was moving from the village.

Mr. LaVaque reported that a steel building is now being contemplated for the Sanitary Sewer service building inst.ead of' the brick building previously planned, because of lower cost.

Mr. Rustad read the Police report for February, 1964. Copy on file.
