The State of Illinois is divided into 22 judicialcircuits. Each circuit is a unified court systemin which all trial courts are consolidated undera chief judge. The chief judge has centralizedadministrative authority to coordinate andsupervise the functions of the court.

The Circuit Court of Cook County is notonly the largest of the 22 circuits in Illinois, itis also one of the largest unified court systemsin the world. It was created by a 1964amendment to the Illinois Constitution whichreorganized the courts of our state. Theamendment effectively merged the often con-fusing and overlapping jurisdictions of CookCounty's 161 courts into one uniform andcohesive court of general jurisdiction.

Today, Chief Judge Timothy C. Evans andmore than 400 judges serve the 5.1 millionresidents of Cook County within the City ofChicago and its 126 surrounding suburbs.

More than 2.4 million cases are filed everyyear. To accommodate its vast caseload, theCircuit Court of Cook County is organizedinto three functional departments: County,Municipal and Juvenile Justice and ChildProtection.

The JUVENILE JUSTICE AND CHILDPROTECTION DEPARTMENT is theCircuit Court of Cook County's newestdepartment. Prior to its creation as a full-status department by then Chief JudgeDonald P. O'Connell in January 1995, theJuvenile Justice and Child ProtectionDepartment was originally known as theJuvenile Justice Division and functioned as apart of the County Department. The estab-lishment of the Juvenile Justice and ChildProtection Department marked the firstrestructuring of the Circuit Court of CookCounty in its thirty-year history.

The department is divided into two divisions:Juvenile Justice and Child Protection. Eachdivision is headed by a presiding judge.

The Juvenile Justice Division hears cases involvingdelinquent minors under 17 years of age. The JuvenileJustice Division also orders programs and services torehabilitate these minors and monitors their progressthrough probation officers. Cases heard include:

those beyond the control of a parent, guardian orcustodian)

The Child Protection Division hears cases involving:

The Juvenile Justice and Child ProtectionResource Section serves as liaison to theacademic, business and religious communities toidentify and develop services and resources thatwill augment programs vital to juvenile justice. Thesection is supervised by an administrative presidingjudge and is located in the Richard J. Daley Center.

ESNON-JUDICIAL OFFICESThe Circuit Court's fourteen non-judicial offices provide anumber of important court-related services. Informationfor contacting each office is provided in the directory.

Adult Probation DepartmentThe Adult Probation Department supervises adults sentenced toprobation who have been convicted of felonies, includingdrug-related offenses, domestic battery, criminal sexual assault,retail theft and criminal damage to property, as well as somemisdemeanor offenses. The average length of a probationsentence is 18 months. Basic conditions of probation includereporting to a probation officer, refraining from further criminalactivity and not leaving the state without permission from thecourt. A probationer may also be required to participate incounseling, drug treatment or other specialized programs. Thedepartment also administers pretrial services which providesupervision of accused persons released on bond and awaitingtrial, as well as victim assistance, intensive probationsupervision, home confinement, sex offender supervision andin the future, electronic monitoring.

Expedited Child Support CenterThe Expedited Child Support Center administers the ExpeditedHearing Process. The goal of the hearing process is to ensureall children receive prompt and regular child support payments.Specially trained hearing officers make recommendations tojudges on establishing, enforcing or modifying child supportorders and also make recommendations on parentage andmedical support orders. The Expedited Child Support Centerworks in coordination with the Illinois Department of Public Aid.

Forensic Clinical ServicesForensic Clinical Services provides comprehensive anddiagnostic clinical services to the court and related agenciesunder the court's jurisdiction. The agency employs psychiatric,psychological and social service methods in the deliveryof clinical services and submits clinical opinions andrecommendations to the court. Forensic Clinical Services alsoprovides expert witness testimony where mandated.

ESHearing Officer SectionThe Hearing Officer Section is comprised of attorneys appointed bythe Chief Judge to conduct court hearings in the Child ProtectionDivision. These hearings ensure that children who are in foster carefind permanent homes. The officers listen to evidence to determineif progress has been made in achieving a permanency goal, whichmay include return to the home, adoption, private guardianship,preparation for independent living or residential care. The hearingofficer then submits a recommended order to the judge.

Office of Interpreter ServicesThe Circuit Court provides persons having limited English proficiencyor speech or hearing impairments with court interpreters to helpfacilitate court proceedings. Interpreters help ensure that all personsenjoy equal access to justice and that court proceedings functionefficiently and effectively. The most common languages interpretedare Spanish, Polish, Korean, Arabic and Russian. Sign languageinterpreters are also requested frequently.

Office of Jury AdministrationThe Office of Jury Administration is responsible for providing thepool of qualified jurors for the Circuit Court. It accomplishes thisgoal by mailing out jury summonses to prospective jurors. TheCircuit Court does recognize, however, that jurors may besummoned at times which may not be convenient. To addressproblems based on hardship, the Circuit Court makes every effortto honor requests to be rescheduled to another date or to betransferred to another courthouse. Prospective jurors should makesuch requests in writing and submit them to the Office of JuryAdministration for review. Additionally, the Circuit Court givesprospective jurors age 70 or older the option of not participating injury service under the court's Opt-Out Program. Those wishing toopt-out must call jury administration at 312.603.JURY before theirscheduled date of service. Opting-out does not permanently removethe juror's name from the juror list. The juror may be summonedagain at a later date, at which time he or she may choose to serveor may opt-out again. Under the Opt-Out Program, prospectivejurors age 70 or older can opt-out without limitation. In addition toscheduling juror service, the Office of Jury Administration acquaintsprospective jurors with their responsibilities through the use of ajuror orientation video.

Juvenile Court ClinicThe Juvenile Court Clinic is responsible for providing a variety of serv-ices to judges and court personnel regarding clinical information injuvenile court proceedings. These services include consultation regard-ing requests for clinical information, forensic clinical assessments inresponse to court ordered requests, information regarding communitybased mental health resources, and education programs on issuesrelating to mental health information and court proceedings. JuvenileCourt Clinic staff comprise lawyers and mental health professionals whouse a multi-disciplinary approach to provide high quality mental healthassessments that are relevant, timely, culturally sensitive, and in a formthat bridges the legal and mental health fields. Forensic clinical assess-ments can only be initiated by court order. Forensic clinical informationis defined as mental health information that is to be used for a legaldecision. After a family has been ordered to undergo a clinical evalua-tion, a clinical coordinator facilitates the process, which includes evalu-ating the information request, documenting the request, and arrangingan intake interview. The assessment is written by a clinician, who is usu-ally a psychologist or psychiatrist, and is delivered to court before thefamily’s next court date. The information contained in the assessment isused by judges, lawyers, and probation officers to help them makeinformed decisions that promote better outcomes for minors and theirfamilies.

Juvenile Probation and Court Services DepartmentThe Juvenile Probation and Court Services Department provides a myr-iad of supervision and intervention programs for minors under theage of 17 who have been found delinquent by the court. In each casewhere a child is found delinquent, the court carefully considers how itcan best meet the needs of the child and at the same time ensure theprotection of the public. A judge allows a juvenile to remain at homeunder supervision as long as the special conditions established by thecourt and the terms set by the probation officer are followed. The pri-mary objectives of the Juvenile Probation and Court ServicesDepartment are threefold: 1) to respond with a plan of action thatbuilds the competence of the minor 2) to redirect negative behaviorwhile promoting accountability 3) to restore the victim and the com-munity.

Marriage and Family Counseling ServiceA part of the Domestic Relations Division, the Marriage and FamilyCounseling Service mediates custody and visitation disputes. Thecounseling service operates under court order and offers emergencyintervention and referral services when necessary. Through its Familyin Focus program, the service assists with court facilitation of custody

ESdisputes and provides supervised visitation for parents who meet the pro-gram's qualifications. The services are provided free of charge.

Mandatory ArbitrationThe Mandatory Arbitration program is an alternative dispute resolutionprocess for civil suits seeking money damages of $30,000 or less. Theprocess is less formal and less time consuming than a jury trial and isconducted by a three-member panel of arbitrators. The arbitrators arelicensed attorneys who have at least three years of experience and arecertified by the Administrative Office of the Illinois Courts as having suc-cessfully completed a course in dispute resolution.

Parenting Education ProgramThe Parenting Education Program, known as Focus on Children, provideshalf-day parenting education class sessions. The classes address par-enting in divorce situations, post-decree situations and never-been-mar-ried situations where the parents do not live together. The classes are ini-tiated by court order. A fee is charged for attending the class, however,it may be reduced or waived by the judge.

Office of the Public GuardianThe Office of the Public Guardian represents minors in juvenile courtcases involving abuse, dependency and neglect, as well as in contestedchild custody cases heard in the Domestic Relations Division. The Officeof the Public Guardian also acts as guardian of disabled adult wards ofthe court. The Chief Judge of the Circuit Court is responsible for appoint-ing the Cook County Public Guardian.

Office of Official Court ReportersThe Office of Official Court Reporters employs court reporters who arelicensed by the State of Illinois. An official court reporter uses a steno-graphic machine to record verbatim each and every word spoken in acourt proceeding.

Social Service DepartmentThe Social Service Department provides casework services to primarilymisdemeanor offenders. Some misdemeanor offenses include theft,indecent exposure, unlawful use of a weapon, assault and battery. Thedepartment develops and implements an individualized supervision planfor each offender and monitors the offender while he or she remainsunder the court's supervision. Some of the services include the DomesticViolence Program and the DUI (Driving Under the Influence) InterventionProgram.

THE TRIAL PROCESSWhen attending a criminal or civil trial, who or what canyou expect to see?

The Participants

Judge: acts as a legal referee to ensure that propertrial procedure is followed and issues rulings on pointsof law. In a bench trial, the judge gives the verdict inplace of a jury.

Jury: present if demanded in a civil case and presentin a criminal case unless waived by the defendant.Their names are chosen at random from the lists ofregistered voters and licensed drivers in Cook County.

Once a juror appears for jury duty, the juror is assigneda panel number. Panels are divided randomly intogroups of 6 or 18. The juror then takes part in anorientation program explaining the trial process whichincludes watching an orientation videotape.

When a trial is ready to begin, the judge sends thedeputy sheriff to the jury room to request potentialjurors. The judge generally requests a group of 6, 12,18 or 36 jurors. Jurors, chosen by panel number, aresent to the courtroom to be questioned by the judge andthe attorneys to determine the juror's ability to keep anopen mind and be fair. Eventually a jury panel of 12 isselected. In some instances, two alternate jurors arealso chosen. They are present throughout the trial butdo not deliberate unless taking the place of an absentjury member. Any jurors not selected to sit on thecourtroom panel return to the jury room and may besent to a new courtroom to be questioned for anothertrial.

CESS

The Circuit Court operates on a one day or one trialsystem. This means that if a juror is not selected to serveon a jury by the end of the day, the juror is not requiredto return the next day. Jury service is considered fulfilledand the juror will not be called for at least another year.However, jurors chosen to sit on a panel in a particularcourtroom for a particular trial are required to serve forthe duration of that trial.

While the trial judge determines the evidence andinstructs the jury as to the law, the jurors are responsiblefor deciding the facts, following the law and rendering afinal decision.

Plaintiff: in a civil case, the person who files thecomplaint.

Defendant: person against whom a civil or criminalcomplaint is filed.

Prosecutor: in a criminal case, the Cook County State'sAttorney’s Office acts as the legal representative of thepeople of the State of Illinois in prosecuting the accuseddefendant. Certain cases may be prosecuted bymunicipal prosecutors.

Witness: gives testimony during the trial relating to thecase.

Court Reporter: records every word spoken duringthe trial on a stenograph machine or a recording device.

Deputy Sheriff: keeps order in the court, guardsdefendants in criminal cases and maintains custody ofthe jury.

Clerk: swears in witnesses and maintains court ordersand exhibits in a trial.

Jury SelectionThe judge and attorneys question the jurors sent to thecourtroom until a panel of twelve is agreed upon by allsides. The questioning is designed to excuse jurorswho might have difficulty in rendering a fair andimpartial verdict in that particular case.

Opening StatementsThese are brief statements made by the attorneys to thejury in which the attorneys outline the facts as they seethem and what they hope to prove. The attorneys arenot considered witnesses and their statements are notevidence. The plaintiff's attorney in a civil case or theprosecutor in a criminal case gives the first statementand the defense attorney follows.

Presentation of EvidenceWitnesses for the plaintiff in a civil case or for theprosecution in a criminal case testify first, witnessesfor the defense testify next and any rebuttal witnessestestify last. Each witness is sworn to tell the truth. Theattorney who calls the witness asks questions in directexamination. The attorney for the opposing side thenquestions the witness in cross-examination. Thepurpose of this questioning is to elicit evidence. Exhibitsand physical objects such as photographs and x-raysmay also be presented at this time as evidence.

Closing ArgumentsThis is the final opportunity for the attorneys toaddress the jury. The plaintiff's attorney in a civilcase or the prosecutor in a criminal case proceedsfirst. The attorney analyzes the evidence andattempts to convince the jury to decide in favor of hisor her side of the case. The defense attorney followswith his or her argument, attempting to do thesame. Finally, the plaintiff's attorney or prosecutorhas the opportunity to present a rebuttal to thedefense attorney's argument.

Jury DeliberationsThe judge instructs the jury on the law they mustapply in the particular case. Jurors then retire fromthe courtroom to deliberate in secret. When thejurors reach a verdict, the jury foreman who iselected by fellow jurors informs the deputy sheriffthat a decision has been reached. The jury returnsto the courtroom and the verdict is read aloud to theparties.
