Achmea appears to have marked the entry into a new era, where classical investment arbitraon is no longer a privileged route to protect intra-EU investments. In light of the flow of investments and related disputes between Western Europe and Central and Eastern European pares, how will there be legal security in the future in that field? Will we see a new dynamic emerge, for beer or for worse?

Arbitraon and jusce, on one hand, and governments and polics, on the other, have always entertained complex relaonships. It seems this is even truer today where the rule of law is being restricted and somemes quesoned at the highest levels and where tensions among European naons are increasing. Will arbitraon suffer from this polical context or does it present a new opportunity?

9:30 - 10:30 AM Arbitraon as a “luxury” only Accessible to Wealthy Elists and Experts: Time to Change the Percepon?

Moderator: Phillip Landolt Partner – Landolt & Koch (Switzerland)

Arbitraon is somemes, especially in Europe, cricized for being an Ivory Tower, accessible to only a privileged few, such that it is too burdensome, too complicated, and too expensive. It this cricism sll jusfied? Has it been remedied? How can the percepon of arbitra-on as a privileged form of jusce be improved?

While arbitraon is supposed to reflect the will of equal pares and thus their diversity, it seems the goal of a more diverse, gender-equal and ethical arbitraon community has not yet been reached. How far are we from this ideal world? What can we expect in the future?

CIArb EUROPEAN BRANCH 2019

Dear CIArb European members and friends,Dear Parcipants, Guests and Speakers,

We would like to welcome you all very warmly to what is probably one of the most colorful cies in Europe: Prague. This is one of the few mes our European Branch (EB) looks towards the Central Connent, and the first me that we look towards Prague, which is an injusce we needed to repair. And it won't be the last me.

Why Prague? Of course, as you will see, a warm beauty surrounds us everywhere, with the genuinely welcoming atude of our Czech CIArb members, but also of the Czech Bar Associaon. And, precisely, we are also here to debate on the future of arbitraon in Europe, what we all believe is a truly beauful and welcoming form of jusce. It is undeniable that the arbitraon community is in a state of ferment in the Czech Repub-lic. Despite some old cricism, arbitraon is indeed on the rise, with figures showing Prague as an increasingly aracve venue to arbitrate, while a new arbitraon law in the process of being enacted, many centers are emerging, and investment arbitraon is a field that is gaining local experse… With that in mind, it was natural to conclude that, aer Rome where the EB organized one of its prior events, all roads were leading to… Prague!

In contrast, these signs of warmness and readiness, not just to host events, but also to welcome new people and fresh ideas, with a view toward the future rather than back to the past, are becoming elements of scarcity in a connent increasingly tempted to draw back and close in on itself, both in mindset and in naonal froners. If this is more than an impression and perhaps a growing reality, let us also not forget that Europe remains a source of hope and ambion for people willing to come together by consent (like in arbitraon) and to channel this opmism into a project that is constantly being develo-ped, requiring the efforts of everyone and at all mes. Isn't this precisely what jusce also demands? Isn't it a process that takes me, requiring relentless work and adapta-on in order to achieve a fair and peaceful outcome? Union is not uniformity: it is about unity and convergence. The only queson is towards which goal(s)?

FOREWORD

Page 10: CIArb European Branch Conference & AGM · 8:45 AM Conference Registra on 9:20 - 9:30 AM Welcome Address by: - the President of the CIArb European Branch - Mar n Maisner Independent

Despite recent challenges posed by countries wishing to depart from this long-term process of convergence, despite the rise of naonalism and other polical hurdles Europe has had to cope with for some years now, our Branch has wished to debate at its very center, here in Prague, how vivid the European idea remains and whether it is sll a powerful source of inspiraon within our arbitraon community. We will discuss how these polical changes may affect the world of arbitraon and how, reversely, arbitra-on can adapt to meet the growing, at mes contradicng, demands that come from people, sociees and governments.

Like Europe, can arbitraon renew itself to face mounng challenges? To answer the queson, we will have five unique panels on Brexit, on the quesoning of investment arbitraon that arose in Achmea, on naonalism and populism, on the need for more diversity and legimacy, and on the eternal queson of whether arbitraon is an elist form of jusce. Finally, CIArb will have the opportunity to dialogue with Czech arbitra-on instuons. In that appealing menu, one should menon the starter: we will also be privileged to have a Keynote Speech, this me not from an academic, but from an actual arbitraon user, the general counsel of a company that does business and builds bridges all across Europe and beyond.

Hence, where beer than in Prague to foster this passionate debate, the city of a hundred spires, combining beauty (the form) and democrac aspiraons (the substan-ce), a strong identy with a genuine culture for openness? May this gathering allow us to find, humbly, some answers to this eternal debate: how can necessary change be incorporated into a process without forgeng the end goal and leaving anyone behind?

Wishing everyone a happy spring in Prague and beyond.
