I respectfully request Legislative Council approval of an interim committee to study the potential for consolidating the state's automobile theft prevention and apprehension programs and the automobile salvage inspection program (title branding law), by transferring motor vehicle inspectors from the Department of Transportation to the State Patrol Division of the Department of Public Safety. Such a consolidation might eliminate duplication of effort and provide for better coordination in the administration and operation of these programs.

This proposal was discussed toward the end of the 1989 session, but due to a number of unresolved questions, no legislative action was taken.

This letter is being written to request an interim committee to study perceived personnel problems with the vehicle salvage and theft inspection law.

Currently, both non-sworn employees of the Department of Transportation and sworn members of the Iowa Highway Patrol are jnvolved in conducting these inspections. There have been discussions concerning transferring all DOT inspection personnel to the Department of Public Safety but this will cause additional problems; i.e. peace officers vs. non-peace officers do~ng the same work, two different retirement systems, etc.

Since various changes are being discussed, I believe it advisable to have an interim study of the n1atter so all aspects of the inspection program can be considered before any legislative changes are made.

I understand that Senator Vande Hoef has requested an interim study on the role of the State Citizens' Aide office. The Iowa State Association of Counties supports Senator Vande Hoef's request because we are uncertain of the Citizens' ~ide's office authority.

Our concern arises out of an incident where the citizens' Aide off ice investigated a county official. The matter was turned over the grand jury which ultimately found insufficient evidence to indite. Although the legal system made a judgement the Citizens' Aide office. continues to investigate. The question we have concerns defin­ing the point at which the Citizens' Aide office should remove itself from a case and let the legal system carry out its function. !SAC does not believe it is fair or proper for the office to operate totally independent of the legal system.

Because of our concern we hope you will take posi­tive action on Senator Vande Hoef's request.

I had a letter drafted to request a study on who would fund · additional Bill of Rights services, and what to expect in required services as a result of the federal nursing home reform and future expansion of Iowa's Bill of Rights Legislation.

I notica that a study has been approved on "f·~ental Illness Cost Assessment," which may address part of that. I'd like to suggest that it be expanded to include the Mental~vRetarded and Develop­mentally Disabled, since those populations will be as costly as the Mentally Ill. New services and facilities will be required as a result of the nursing home reform act.

I'd also like to recommend that a representative of th~ counties be included on the committee, or at least be one of the presenters. The :i?30 l-1 in property tax relief, which is the subject of another interim, could disappear in a hurry if increased services/facilities for ~rn, MH & DD mean increased property t~xes.

WHEREAS, the state of Iowa currently has certain land surveying and platting statutes 3nd practices

which are outdated and in need of revision; and WHEREAS, in 1988 various groups including, but not

limited to, the Iowa State Bar Association, the Iowa State Association of Counties, the Society of Land Surveyors of Iowa, the League of Iowa Municipalities, and the Iowa Land Title Association addressed issues relating to land surveying and platting and submitted their respective proposals; and

WHEREAS, an interim committee was appointed by the Legislative Council and held its one authorized meeting on December 19, 1988; and

WHEREAS, in the 1989 Session of the Seventy-third General Assembly surveying and platting bills have been filed in both houses; however, disagreement

remains among the interested groups; and WHEREAS, additional time is necessary to resolve

this disagreement, and the establishment of an interim study committee to analyze and review these practices is advisable; NOW THEREFORE,

BE IT RESOLVED BY THE SENATE, That the Legislative

Council is requested to establish an interim study

committee, and appoint its members from the Judiciary

3 A Resolution proposing the establishment of an interim 4 study committee for the purpose of studying child 5 abuse, juvenile delinquency, and 6 termination of parental rights issues. 7 WHEREAS, in the first session of the Seventy-third 8 General Assembly several bills have been introduced 9 relating to juvenile justice, and particularly child

10 in need of assistance proceedings, termination of 11 parental rights proceedings, and juvenile delinquency 12 proceedings; and 13 WHEREAS, the issues involved in comprehensive 14 legislation relating to juvenile justice require that 15 the General Assembly devote the necessary time and 16 resources to adequately resolve the issues; and 17 WHEREAS, under current law, the provisions and 18 disposition of various juvenile justice proceedings 19 are inconsistent and in need of analysis with a view 20 toward revision; NOW THEREFORE, 21 BE IT RESOLVED BY THE SENATE, That the Legislative 22 Council is requested to establish an interim study 23 committee, and appoint its members from the Judiciary 24 and Human Resources Committees of the Senate and the 25 Judiciary and Law Enforcement and Human Resources 26 Committees of the Bouse of Representatives, to study 27 the adjudication, disposition, and enforcement of 28 child in need of assistance proceedings, family in

29 need of assistance proceedings, juvenile delinquency 30 proceedings, and termination of parental rights

3 A Resolution requesting the Legislative Council to provide

4 funds for a study of medical malpractice and tort

5 liability claims. 6 WHEREAS, in 1986 the National Center for State

7 Courts collected data in all Iowa counties and 8 prepared an analysis of tort cases in Iowa courts; and 9 WHEREAS, that study involved cases filed in 1981,

10 1983, and 1985, and the dollar value of tort trial 11 awards from January 1, 1980, through the first half of 12 1986; and 13 WHEREAS, this information is of great importance 14 to, and has been used by, the insurance commissioner 15 in determining the impact of tort case awards on 16 insurance claims and the effects of these cases on

17 insurance rates; and 18 WHEREAS, a number of modifications of Iowa's tort

19 law have been made in recent years, and this study 20 would provide an indication of the impact of those 21 changes; and 22 WHEREAS, this information is of vital importance to

23 the Iowa General Assembly when legislating in the area 24 of tort law; NOW THEREFORE,

25 BE IT RESOLVED BY THE SENATE, That the Legislative 26 Council expend the necessary funds to allow the

27 Judicial Department to update the National Center for 28 State Courts' study, including settlements where

29 feasible, and that the findings of that update be 30 filed with the Legislative Council, the chairpersons,

marriage law in Iowa concerning property rights between spouses in comparison with the Uniform Marital Property Act, rights of spouses after a dissolution of marriage, and other related issues.

WHEREAS, this state recognizes that the parties to a marriage have certain rights and expectations regarding property, family responsibilities, and other aspects of the marriage: and

WHEREAS, the law of this state should recognize the respective contributions of both spouses during a marriage relating to the property accumulated during a marriage; and

WHEREAS, marriage is a partnership between two people with each making a different, yet important and valuable contribution to the relationship; and

WHEREAS, marriages have beginnings and endings, yet 21 the property rights upon the ending of a marriage are 22 undefined under current law: and 23 WHEREAS, each spouse has a right to a legally 24 defined and enforceable property right at the time of

25 contribution which should be recognized in the event 26 of the termination of the marriage; and

27 WHEREAS, the Uniform Marital Property Act was 28 approved by the National Conference of Commissioners 29 on Uniform State Laws in 1983 and was drafted taking 30 into account the above mentioned considerations; and

1 WHEREAS, this state recognizes that, while the ~ 2 family as a unit is an integral part of our society,

3 conflicts do arise within the family which can result 4 in the breakup of a marriage and hardship on all 5 members of that family; and 6 WHEREAS, this state has a vital interest in 7 maintaining the strength of the family structure, and a in the event of an irreparable situation resulting in 9 the breakdown of that structure, easing the stress and

10 potentially harmful effects on all family members; and 11 WHEREAS, dispute resolution mechanisms are being 12 tried in other states in an effort to reduce the 13 number of family breakdowns and reduce the harmful 14 impacts of the breakup of a family; NOW THEREFORE, 15 BE IT RESOLVED BY THE SENATE, THE HOUSE CONCURRING, 16 That the Legislative Council create an interim study 17 committee to study the Uniform Marital Property Act in 18 comparison with current Iowa law, family and marriage
