    Members of the public are invited to put questions to the Chair of the Area Committee onany matters within the powers and duties of the Area Committee, subject to theexclusions set out in the Code of Practice. (Questions must be submitted prior to thecommencement of the meeting on the cards provided. These are available at themeeting and at local libraries and Information and Advice Centres)

    The Area Conditions Officer and Highways Officer will attend the meeting to providean update on matters raised at the last Area Committee meeting. Councillors and

    Third Greater Manchester Transport Plan Consultation on the Draft Long TermHigh-Level Strategy

    The report details a draft long-term high-level Strategy for Transport in GreaterManchester up to 2026 has been published for consultation.

    The Area Committee is requested to suggest amendments to the draft strategythat will increase its benefits to Stockport.

    The report requests the Area Committee to consider introducing Traffic RegulationOrders on Hall Street, Ernest Street and Crescent Road, Cheadle and introduce NoWaiting at Any Time and revocation of restriction of waiting at the junction of Hall Streetand Brook Road.

    PRESENT

    1. MINUTES

    The Minutes (copies of which had been circulated) of the meeting held on 12 October2010 were approved as a correct record and signed by the Chair.

    2. DECLARATIONS OF INTEREST

    No interests were declared.

    3. PROGRESS ON AREA COMMITTEE DECISIONS

    The Head of Area Governance submitted a report (copies of which had beencirculated) updating the Area Committee on progress since the last meeting ondecisions taken by the Area Committee, the current position on Ward FlexibilityFunding and the Highway Maintenance and Traffic Management delegated budgets.

    RESOLVED That the report be noted.

    4. URGENT DECISIONS

    No urgent decisions were reported.

    5. COMMUNITY ENGAGEMENT

    (i) Chairs Announcements

    No announcements were made.

    (ii) Neighbourhood Policing

    Inspector Gilbertson, Greater Manchester Police attended the meeting to answerquestions from Councillors and members of the public in relation to NeighbourhoodPolicing issues within the Cheadle Area Committee area.

    The following issues were raised/comments made:-

    Operation Treacle. Operation Gotham. Work with Trading Standards and a recent arrest for fraud.

    RESOLVED That Inspector Gilbertson be thanked for his attendance.

    (iii) Public Question Time

    No questions were submitted.

    (iv) Environmental and Highway Services

    (a) Environmental Services

    Julie Henshall, Area Conditions Officer attended the meeting to answer questionsfrom Councillors and members of the public in relation to environmental issues in thearea represented by the Cheadle Area Committee.

    The following issues were raised/comments made:-

    The roll out of the new black bins across the Borough. A recent meeting with the site owners of the former Tatton Cinema.

    RESOLVED That Julie Henshall be thanked for her attendance.

    (b) Highway Maintenance and Local Initiatives

    A representative of the Service Director (Environment) submitted a report (copies ofwhich had been circulated) requesting the Area Committee to consider proposals toresurface the footways and repair the kerbs at Brooklyn Crescent, Cheadle.

    RESOLVED That the following be approved at an approximate cost of 19,000 tobe funded from the Area Committees Highway Maintenance and TrafficManagement delegated budget:-

    Brooklyn Crescent, Cheadle Resurface footways (full length) and repair kerbs asnecessary.

    (c) Problems Associated with Flooding in the Cheadle Area Committee Area

    Representatives of the Service Director (Environment) attended the meeting andgave an update on the current position and answered questions on the issues offlooding in the area represented by the Cheadle Area Committee.

    The representatives of the Service Director (Environment) informed the AreaCommittee and members of the public that they held regular meetings with UnitedUtilities and that work with them was ongoing to resolve issues.

    The following comments were made/issues raised:-

    Improvement works had been carried out at Ladybridge Road, including the

    drains at the car park at the junction with Station Road. Work with UnitedUtilities was underway to determine who had responsibility for drainage in thatarea.

    Land ownership issues and responsibilities for drainage.

    Flooding at Outwood Road and Cross Road where there were several landowners.

    Flooding at Wilmslow Road at its junction with Chapel Street and at its junctionwith Gatley Road.

    An obstruction had been removed from the culvert near Ladybridge Road andthat area would continue to be monitored.

    The Service Director (Environment) would continue to monitor forecasts. The Service Director (Environment) would develop a risk register and a

    maintenance regime.

    RESOLVED (1) That the Service Director (Environment) be requested to providean update at the January 2011 meeting of the Area Committee.

    (2) That the Service Director (Environment) be requested to invite representatives ofUnited Utilities to attend the January 2011 meeting of the Area Committee.

    (3) That the Service Director (Environment) be requested to provide information toCouncillors with regard to flooding on land ownership issues, new legislation and itsimplications.

    (v) Petitions

    The Head of Area Governance reported the receipt of a petition from residents ofMeadows Road requesting road resurfacing and new road markings.

    Councillor Peter Burns reported that the Service Director (Environment) was

    currentlyinvestigating the provision of junction protection markings at MeadowsRoad.

    RESOLVED That the petition and report be noted and the Service Director(Environment) be requested to report to a future meeting when the investigationswere complete.

    (vi) Open Forum

    (a) Archaeological Society Cheadle Green Dig

    Representatives of the South Manchester Archaeological Research Team, theArchaeological Society, Salford University and the Service Director (Environment)attended the meeting and gave a presentation on the Cheadle Green Dig. Thepresentation detailed the history and archaeology of Cheadle Green, communityinvolvement and the success of the dig.

    RESOLVED That the representatives of the South Manchester ArchaeologicalResearch Team, the Archaeological Society and the Service Director (Environment)be thanked for their attendance and presentation.

    (b) Census 2011

    With the consent of the Area Committee this item was withdrawn.

    (vii) Ward Flexibility Funding

    The Head of Area Governance submitted an application on behalf of the TogetherTrust (copies of which had been circulated) requesting funding towards Cheadle

    Festival 2011.

    RESOLVED That consideration of the application from the Together Trust bedeferred to the next meeting to allow representatives of the Trust to attend.

    6. DEVELOPMENT APPLICATIONS

    Development applications were submitted.

    (NOTE: Full details of the decisions including conditions and reasons for granting orrefusing planning permission and imposing conditions are given in the schedule of

    plans. The Corporate Director, Communities, Regeneration & Environment isauthorised to determine conditions and reasons and they are not therefore referred toin committee minutes unless the committee makes a specific decision on a conditionor reason. In order to reduce printing costs and preserve natural resources, theschedule of plans is not reproduced within these minutes. A copy of the schedule ofplans is available on the councils website atwww.stockport.gov.uk/planningdecisions. Copies of the schedule of plans, or anypart thereof, may be obtained from the Communities, Regeneration & EnvironmentDirectorate upon payment of the Councils reasonable charges).

    The Head of Area Governance outlined the procedure approved by the Council for

    public speaking on planning applications.

    In respect of plan no. 45256 for change of use from offices on first and second floorsabove lock up shops to eight no. one bedroom flats at 14-20 Old Rectory Gardens,Cheadle, it was

    RESOLVED That planning permission be granted subject to conditions specified inthe schedule of plans, including a requirement that the flats be sound level testedprior to occupation with the noise level not exceeding 35 dba.

    In respect of plan no. 45260 for single storey rear extension at 8 Nansen Road,Gatley.

    A member of the public spoke against the application, and the application respondedto questions from the Area Committee.

    RESOLVED That the Planning and Highways Regulation Committee be requestedto undertake a site visit to assess the impact of the proposal on neighbouringproperties, the distance to adjacent properties and the proposed percentage increase

    in size of the property.

    7. APPEAL DECISIONS, CURRENT PLANNING APPEALS AND

    ENFORCEMENTS

    The Head of Area Governance submitted a report of the Service Director (Legal &

    Property) (copies of which had been circulated) listing any outstanding or recentlydetermined planning appeals and enforcements within the area represented byCheadle Area Committee.

    RESOLVED That the report be noted.

    8. PROPOSED GATING OF BROOKHEAD ARCADE, CHEADLE

    A representative of the Service Director (Communities) submitted a report (copies ofwhich had been circulated) providing an update on the informal and formal processescarried out in respect to the proposal to introduce a gating order for Brookhead

    Arcade.

    RESOLVED (1) That no further action be taken in respect to the introduction of agating order at Brookhead Arcade as it would fail to address the problems that hadbeen encountered in the area.

    (2) That the Service Director (Communities) be requested to monitor the anti-socialbehaviour at Brookhead Arcade.

    9. LAND OFF OAK ROAD, CHEADLE HULME

    The Head of Area Governance submitted a report of the Managing Director, NPS(copies of which had been circulated) requesting the Area Committee to consider thelease of land off Oak Road, as identified in the report, to the Cheadle Hulme Branchof the Royal British Legion.

    RESOLVED That, without prejudice to any future planning application, theManaging Director, NPS be recommended to give approval to the granting of a leaseto the Royal British Legion for the purposes as detailed in the report, subject toappropriate planning permission being granted.

    10. NOMINATION OF AUTHORITY GOVERNORS

    The Head of Area Governance submitted a report of the Service Director(Learning & Achievement) (copies of which had been circulated) requestingthe Area Committee to provide nominations for an Authority Governorvacancies at Etchells Primary School.

    RESOLVED That the report be noted.

    (NOTE: The Area Committee was of the opinion that this item, although not includedon the agenda, should be considered as a matter of urgency in accordance withSection 100B (4) (b) of the Local Government Act 1972 in order that the objectioncould be considered promptly).

    Report of the Service Director (Environment)

    1. Matter for Consideration

    1.1. A draft long-term high-level Strategy for Transport in GreaterManchester up to 2026 has been published for consultation. Theviews of all Area Committees will be included in the formulation ofthe Councils response by the closing date of December 24.

    1.2. The Committee is asked to suggest amendments to the draft

    strategy that will increase its benefits to Stockport.

    2. Information

    2.1. Greater Manchester Passenger Transport Executive (GMPTE) ispreparing a Third Local Transport Plan for Greater Manchester(GMLTP3) and with the Association of Greater ManchesterAuthorities (AGMA) has published a draft high-level TransportStrategy for consultation. Local Transport Plans are statutorydocuments. The first LTP covered the period 2001-2006, and thesecond, 2006-2011. The GMLTP3 covers the period 2011-2026.

    2.2. The GMLTP3 has two main elements:

    A high-level Strategy for transport in GM, up to 2026, and

    10 Local Implementation Plans (LIP), one for each District, for2011-2015.

    2.3. A draft Strategy has been prepared by GMPTE. The LIPs are beingprepared by Districts. The Stockport LIP will set out our plans todeliver the Greater Manchester long-term Strategy over the next fouryears, and will be aligned to anticipated funding allocations. Our LIP

    will be published in March 2011.

    2.4. The following are appended to this report:

    Appendix A: Section 5 of the full Draft Strategy that sets out asummary of the key proposals for the long-term strategy, and

    Appendix B: a copy of the Summary consultation brochure preparedby AGMA / GMPTE.

    2.5. GM Transport Strategy to 2026 and Context: The draft Strategy has

    been prepared on the assumption that the Greater ManchesterStrategy (GMS) provides the framework of policy objectives, and that

    a Combined Authority (CA) will take over responsibility for transportin Greater Manchester and will work closely with a Local EnterprisePartnership (LEP).

    2.6. The GMS identifies the priorities for transport interventions and

    funding as:a) major transport interventions; b) access from specified residentialareas; c) surface access to Airport; d) transport networks; e) safety;f) integrated transport.

    2.7. The draft Strategy proposes five Core Objectives for LTP3 thatwould apply across all of Greater Manchester, and lists priorities:

    (1) Economy - Transport networks that support the GM economy:Major road and PT interventions; Access from residential areas;Access for freight; Surface access to Airport; Efficient and effective

    rail and road networks

    (2) Carbon/climate change - Reduced carbon emissions:Integrated land use and transport planning; Smarter travel choices;Low carbon travel; Improve transports env performance; Managetravel demand; Decarbonising procurement; Resilience to peak oiland climate change

    (3) Public Health and wellbeing - Minimise adverse impacts oftransport on public health and community safety:More walking; a GM cycle route network; reduction in casualties;better safety; reduced emissions; better access to health facilities.

    (4) Sustainable neighbourhoods and public spaces - Supportsustainable neighbourhoods:Access from priority neighbourhoods to areas of opportunity; accessfor people with disabilities; reduced impact of traffic on areas ofdeprivation; improved public realm; reduced impact on biodiversity,natural sites.

    (5) Value for money:

    Efficient networks; prioritise spending to maximise contribution toeconomic growth and gain third party funding; procurement;improved satisfaction levels

    2.8. The majority of schemes and actions proposed are not specific toany Borough, and all are subject to availability of funding, having anadequate Business Case, and competing priorities within GreaterManchester.

    2.9. Specific references to Stockport within the full Draft Strategy include:

    A scheme for implementation - a Quality Bus Partnership scheme

    on the Manchester-Hazel Grove corridor

    Road.

    2.10. The final Strategy will set out a list of schemes and actions that willhave first call on funding in Greater Manchester for the foreseeablefuture.

    2.11. It is desirable that the final Strategy reflects Stockports aspirationsfor transport development that will benefit the Borough, and thatStockports Local Implementation Plan (LIP) contains the prioritiesthat can be developed into full schemes for bidding for funding.

    3. Financial Information

    3.1. The amount of transport funding1 for Authorities may be announcedby Government in mid December. Stockport Council is anticipatinghaving smaller transport allocations than in previous years. It is alsoanticipated that payment will be made to GMITA / CombinedAuthority which will then allocate funding to Districts. GreaterManchester can also bid annually for schemes to be funded from twoother national transport funds: a Local Sustainable Transport Fund(guidance is awaited, but it is thought that Government favours smallscale schemes to change traveller behaviour and improve localsustainable modes of transport), and a Regional Growth Fund(whichrequires participation with the private sector).

    4. Recommendation

    4.1. Members are requested to note the contents of this report andcomment on the following matters:

    1. Do the proposals set out in Appendix A help to meet GreaterManchesters Core Objectives?

    2. Do these proposals meet the needs of Stockport?3. What do you consider to be the most important major schemes tobenefit Stockport?

    4. Assuming that funding for transport will be constrained over thenext 4 years, what are the priorities for spending Stockportstransport funds?

    5 Summary of our Key Proposals (Short, Medium & Long Term)5.1 Introduction

    5.1.1 Through the development of the Greater Manchester Transport Fund,the Greater Manchester authorities are delivering the first elements of a 1.5billion package of investment in major transport schemes covering Metrolink,road, rail and bus networks. In developing our strategy for the next fifteenyears we are, however, aware that public funding will be limited, at least in theearly years, and that the delivery of individual schemes will be subject to theoutcome of the Comprehensive Spending Review.However, this is a long term strategy aimed at delivering the GMS, hence it isimportant to set out our aspirations in full so that individual schemes can bedelivered as funding allows. This will allow us to exploit any opportunities forfuture funding, particularly working with other sectors where schemes would

    deliver wider, non-transport, benefits such as regeneration.

    5.2 Better buses for Greater Manchester

    Delivering key investment schemes that will enhance the role and image ofbus services in Greater Manchester, including:

    o Cross City Bus Packageo Leigh-Salford-Manchester Buswayo Altrincham Interchangeo Bolton Interchangeo Rochdale Interchangeo Wythenshawe Bus Stationo Subject to funding, a future scheme for a new Stockport Interchangeand associated town centre access improvements

    DESCRIPTION OF DEVELOPMENT

    Application for a two storey side extension, rear extension, single storey rearextension, modification of front porch and installation of solar panels. The proposedtwo storey side extension will be 4.25 metres wide, set back 1.4 metres from thefront of the house. To the rear a flat roof single storey extension with roof lantern isproposed.

    The access and driveway to the front will remain unchanged, the garage to the side /rear of the property will be relocated 2.5 metres rearwards.

    The extension will provide internally two extra bedrooms and a bathroom at first floorand a study / guest room (with en suite), lounge, dining room and extended kitchen.

    The attached plans illustrate the proposal.

    SITE AND SURROUNDINGS

    The application site is a two storey detached dwelling house on the western side ofStyal Rd. The site is within the Greater Manchester green belt, forming part of aribbon development. The property is served by a large garden approximately 35

    metres in length. Beyond is open land which separates the built up areas ofStockport and South Manchester to the west.

    All the properties on the western side of Styal Rd are within the green belt, theproperties opposite on the eastern side of Styal Rd are within the predominantlyresidential area (as defined on the proposals map of the UDP Review).

    The properties on this side of Styal Rd are a mixture of sizes and styles, with many

    extensions evident. To the north, number 100 is a large two storey detacheddwelling that has been extended to the rear in the past. The properties immediatelyto the south are large bungalows with extended two storey dwellings found furthersouth at 112 and 114 Styal Rd.

    SITE HISTORY

    No relevant history

    NEIGHBOUR REPLIES

    The occupiers of five surrounding properties were notified in writing of thedevelopment. The occupier of number 100 has commented on the applicationstating:

    No major objections, development should enhance our stretch of Styal Rd. Tworeservations:Ground floor side window will overlook property, could it be opaque glass.Relocation of mature trees. Concerns regarding relocation and shadowing ofgarden.

    POLICY BACKGROUND

    The following policies of the Stockport Unitary Development Plan Review are ofrelevance to these applications:

    ANALYSIS

    In assessment of the application it is considered that the main issues of assessmentare the impact of the proposed development upon the character and appearance ofthe green belt and the impact to residential amenity.

    Green Belt

    The applicant has submitted that the volume of the extensions upon that of theoriginal dwelling will be 80%. However these are based on footprint only. The actual

    volume for the additions and estimates that the volume upon the original dwelling willbe increased by 103%.

    In relation to the impact on the Green Belt, it is acknowledged that due to the volumeof the extension at approximately 103% this would be over the one-third guideline inpolicy GBA 1.5 and as such the proposal would comprise inappropriatedevelopment, contrary to Policy GBA1.2 and GBA1.5 and government guidance in

    PPG2. It therefore follows that if the proposal comprises inappropriate developmentin the Green Belt, consideration should be given to whether there are other factorswhich would amount to very special circumstances sufficient to clearly outweigh theharm to the Green Belt. Members are aware that the onus is for the applicant todemonstrate very special circumstances. To demonstrate this case, the applicanthas submitted a design and access statement which outlines the case for veryspecial circumstances. The applicant states that the size is in line with other housesalong Styal Rd and provides photographic evidence in this respect.

    It is considered that the applicant is correct in his assertion and that the character ofthe area is such that the scale of the extension would not be a detrimental addition to

    the streetscene or cause harm to the openness of the green belt. Styal Road is atypical ribbon development with many extended properties. The footprint of theexisting property is relatively small in relation to the width of the plot, as such therewould still be generous space around the dwelling post development. Along thewestern side of Styal Rd, many properties have extended with development up to theproperty boundaries. As stated in policy GBA 1.5, the interpretation of significantchange will vary according to the character of the property. It is acknowledged thatthe volume of this extension is large and possibly in excess of other extensions onthe street however the plot in this instance is capable of providing such an extensionwith minimal harm. Additionally the extension has been designed to appearsubservient in appearance with materials and detailing appropriate to the originaldwelling. In light of this context it is considered that it would be difficult to argue andsustain a reason of inappropriate development within the green belt. The applicationis considered to be in accordance with green belt policies GBA 1.2 and GBA 1.5 ofthe Stockport Unitary Development Plan Review.

    Residential Amenity

    To the south of the application site is number 104 Styal Road, this property hasoutbuildings on the boundary which obscure any views of the application site, thisproperty will not be materially affected by the proposed development.

    To the north of the site is number 100 Styal Rd, this property has extended to therear in the past, the side facing windows are not considered to be original principalhabitable windows and as such little weight is afforded to their protection. The sidefacing windows (ground floor and first floor) on the proposed two storey sideextension should be obscure glazed to avoid a loss of privacy occurring. Theproposal will not adversely affect neighbouring amenity in accordance with CDH 1.8of the Stockport Unitary Development Plan Review.

    Other issues

    There are no protected trees on the site and as such the removal / replanting of treeswould not require permission, it is therefore not necessary to exert any control in this

    respect.

    The proposal is considered to be in accordance with the adopted policies of theStockport Unitary Development Review and is recommended for approval.

    SUMMARY

    The application is a departure from the Stockport Unitary Development Plan Review.It does not, however, require referral to the Government Office for the North Westunder the Town and Country Planning (Consultation) (England) Direction 2009 asthe floorspace involved is less than 1000m2 and would not have a significant impacton the openness of the Green Belt. Under the Councils scheme of delegationhowever, the application must be determined by P&HRC and Cheadle AreaCommittee are only therefore requested to make a recommendation.

    1. MATTER FOR CONSIDERATION

    1.1 Proposed changes to the Councils Application Validation Checklist (AVC) for thevalidation of planning applications.

    2. INFORMATION

    2.1 The purpose of this report is to seek agreement to changes to the CouncilsApplication Validation Checklist (AVC). In accordance with Government guidancean eight week consultation period on the AVC is also being undertaken with thelocal community, including applicants and agents. Should this consultation periodculminate in any significant amendments being proposed to the AVC it will bebrought back to Committee for further consideration. However, in view of the urgentneed to update the AVC it is considered necessary to seek Committee approval atthe earliest opportunity.

    2.2 BACKGROUND

    2.3 The aim of the AVC is to provide users of the Development Management Servicewith clear and up to date guidance on the form and content of information required

    for the validation of planning applications. Through the use of the AVC applicantshave greater certainty of their responsibilities, and the public are informed of thenature of development proposals, leading to a more open, accessible and efficientservice. Where applicants do not submit the required information with anapplication it will remain invalid and will not be processed until such time as theinformation has been received. At all times the Local Planning Authority will makeproportionate requests for information, and will not use invalidation to prevent thestart of the determination period where an applicant has taken reasonable steps tofulfil the information requirements set out on the local list.

    2.4 The current AVC was adopted by the Council in 2008, and has since become

    outdated following changing planning and legislative requirements. Through theregular use of the Checklist it has also become apparent that there are gaps in thecurrent validation information requirements. Failure to obtain this information at thevalidation stage is impacting negatively on application processing times. Inreviewing the AVC all Local Planning Authorities are required to review national,regional and local planning policy to ensure that they have not missed any recentpolicies. The information requirements on the revised Local List are driven bystatutory requirements, national, regional or local plan policies, or publishedguidance that explains how adopted policy should be implemented.

    2.5 The updated AVC is attached to this report with the proposed changes highlighted

    1 INTRODUCTIONThe purpose of Application Validation Checklists [AVC] is to provide users of theDevelopment Management Service with clear guidance on the form and content ofinformation required for the submission of planning applications. By providing AVCsfor the scope and extent of the information required applicants should have greatercertainty of their responsibilities, and the public will be informed of the nature ofdevelopment proposals leading to a more open, accessible and efficient service.

    Appendix 1 contains relevant contact details for the sources of advice and guidancereferred to in the Checklist. Links to the Stockport UDP Review and information onthe emerging Local Development Framework (LDF), including the Core Strategy,are provided.

    2 LEGISLATION BACKGROUNDThe form and content of planning applications are prescribed by law and inparticular the The Town & Country Planning (Development Management Procedure)Order 2010 (DMPO).

    Local Planning Authorities are encouraged to consult and adopt their own lists ofinformation requirements that are drawn from a recommended and nationallydefined list that is set out in government guidance. Once a Local Planning Authorityhas undertaken consultation and adoption of their local list in accordance with thegovernment guidelines, it can be used as the local requirement of the AVCs whenvalidating applications.

    The Council has prepared this guidance for users of the Development ManagementService in this context. The guidance takes account of existing legislation, existingGovernment guidance, the relevant provisions of the First Review of the Unitary

    Development Plan [UDP Review], emerging policies of the Local DevelopmentFramework [LDF]and the implementation of the e-government planning agenda.

    3 PRE-APPLICATION DISCUSSIONFor all but the most straightforward developments it is strongly recommended thatcontact is made with the Development Management Service before submitting anapplication. In the first instance this should be with the Planning Case Officer whodeals with the area where the site is located. Contact details can be found inAppendix 1. Pre-application discussion will enable the informationrequirements of individual development applications to be assessed,identified and agreed. This would enable an individual Validation Checklist to

    be completed and submitted with the formal application.

    In order to fully assess the proposal as much information as possible should beprovided with the request for advice. Where appropriate the Case Officer will consultwith internal and external bodies for specialist advice on any issues raised beforefinally responding. The reply will refer to material planning considerations includingrelevant policies of the UDP Review and the emerging policies of the LocalDevelopment Framework [LDF] and outline the information requirements of thepotential application.

    For particularly complex proposals it may be appropriate to set up a Development

    Team of relevant officers to co-ordinate a Council response. A meeting with thepotential developer may be necessary in some cases to clarify aspects of theproposed development.

    Prospective developers and their agents are also able to contact relevant externalbodies for advice as part of a pre-application discussion [e.g. United Utilities,Environment Agency, English Heritage etc]. The results of any consultation shouldbe shared with all parties.

    4 VALIDATION OF APPLICATIONS

    Applications will need to provide all the information needs required nationally. Theseneeds have been detailed in government guidance and vary depending on theapplication type. The national information requirements are set out below at pages 4to 8. Applications must also include relevant local information. The local informationneeds are listed on the individual AVCs that are found later in this report.

    An application will be considered invalid if it does not include any relevantinformation requirement contained in the National and Local lists.

    It is recommended that potential applicants undertake pre-applicationdiscussion to identify the information needs for all but the most

    straightforward of proposals. The Development Management Servicerecognises that the validation of planning applications has become morecomplicated in recent years. It can now provide a more proactive or fast trackvalidation service for those applicants or agents who need to determinewhether their application is complete for validation purposes with theminimum of delay. The service is optional and would attract a fee based onthe size and nature of the development proposed. Details are available on theCouncil website.

    Where an application does not include relevant information requirements considerednecessary for its determination, the applicant will be informed accordingly in writingand an explanation given as to what is required to ensure validation. In thesecircumstances applicants may submit to the Council a written justification why therequested local information requirements are not considered to be appropriate in aparticular case. The Council will take account of any written justification and onlyinvalidate applications where it is satisfied that the additional information isnecessary to determine the application.

    When an application has been validated, the processing of the application mayresult in further information requirements, without which it may be necessary torefuse permission.

    5 NATIONAL REQUIREMENTS FOR INFORMATIONThe following list of information needs is outlined at the beginning of each individualAVC and is mandatory for the validation of new applications.

    5.1 The standard application formPlanning applications will be submitted on a standard application form that will beavailable electronically. The government encourages applicants to submitapplications electronically since it can reduce delay and costs. However applicantswill retain the right of submitting paper versions of the form and in doing so will needto provide three additional copies of the form.

    5.2 The location plan

    All applications should include copies of a location plan based on an up to date mappreferably to 1:1250 or 1:2500 scale. If the application is not submitted electronicallythen three copies of the location plan will be required. Wherever possible the planshould show at least two roads and surrounding buildings. The properties should benumbered or named to ensure the exact location of the application site is clear.

    The application site should be edged clearly with a red line and include all land

    necessary to carry out the proposed development. Land for example should beincluded that is required for the site access from a public highway, visibility splays,landscaping, car parking and areas of open space around buildings. A blue lineshould be drawn round any other land owned by the applicant that is close to oradjoins the application site.

    5.3 Site Plan3 copies to be supplied unless the application is submitted electronically drawn to ascale of 1:500 or 1:200 and accurately showing:

    The direction North;

    The proposed development in relation to the site boundaries and other buildings

    on the site with written dimensions including those to the boundaries; All the buildings, roads and footpaths on land adjoining the site including the

    access arrangements;

    The position of all trees on the site, and those on adjacent land that couldinfluence or be affected by the development;

    The extent and type of any hard surfacing

    Boundary treatment including walls or fencing where this is proposed

    5.4 Other PlansIn addition other plans should be submitted dependent on the type of application

    (see the individual AVCs for further information) and may include: Block plan of the site at a scale of 1:100 or 1:200 showing any site boundaries,

    the type and height of boundary treatment (e.g. Fences, walls etc), the positionof any building or structure on the other side of such boundariesExisting and proposed elevations for example to a scale of 1:50 or 1:100. Theelevations should show clearly the proposed works in relation to what is alreadythere. All sides of the proposal must be shown and these should indicate wherepossible the proposed building materials and the style, materials and finish ofwindows and doors. Blank elevations must also be included; if only to show thatthis is in fact the case.Where a proposed elevation adjoins another building or is in close proximity, the

    drawings should clearly show the relationship between the buildings, and detailthe positions of the openings on each property.

    Existing and proposed floor plans to a scale of 1:50 or 1:100. The plansshould explain the proposal in detail. Where existing buildings or walls are to bedemolished these should be clearly shown. The drawings submitted should showdetails of the existing building(s) as well as those for the proposed development.New buildings should also be shown in context with adjacent buildings includingproperty numbers where applicable.

    Existing and proposed site sections and finished floor and site levels to ascale of 1:50 or 1:100. The plans should show a cross section through theproposed building(s). In all cases where a proposal involves a change in ground

    levels, illustrative drawings should be submitted to show both existing andfinished levels to include details of foundations and eaves and howencroachment onto adjoining land is to be avoided.

    Full information should also be submitted to demonstrate how proposed buildingsrelate to existing site levels and neighbouring development. Such plans should showexisting site levels and finished floor levels (with levels related to a fixed datum pointoff site) and also show the proposals in relation to adjoining buildings. This will berequired for all applications involving new buildings.

    In the case of householder development, the levels may be evident from floor plansand elevations, but particularly in the case of sloping sites it will be necessary toshow how proposals relate to ground levels or where ground levels outside theextension would be modified. Levels should also be taken into account in theformulation of design and access statements.

    5.5 Roof PlansRoof plans to a scale of 1:50 or 1:100 are used to show the shape of the roof and istypically drawn at a scale smaller than the scale used for the floor plans. Detailssuch as the roofing material, vents, and their location are typically specified on theroof plan.

    5.6 Ownership CertificatesThe provisions of Section 65(5) of the Town and Country Planning Act 1990 andArticle12 of the Development Management Procedure Order 2010 (DMP0) requirethat an application for planning permission cannot be entertained without therelevant certificates concerning the ownership of the application site having beencompleted. All applications for planning permission except for approval of reservedmatters must include the appropriate certificate of ownership. An ownershipcertificate A, B, C or D must be completed stating the ownership of the property.

    For this purpose an owner is anyone with a freehold interest, or leasehold interest

    the unexpired term of which is not less than 7 years.

    5.7 Notice(s)A Notice(s) to owners of the application site must be completed and served inaccordance with Article 11 of the DMPO.

    5.8 Agricultural Holdings CertificateThis certificate is required whether or not the site includes an agricultural holding. Allagricultural tenants must be notified prior to the submission of the application. Thiscertificate is not required if the applicant is making an application for reservedmatters, renewal of temporary planning permission, discharge or variation ofconditions, tree preservation orders, or express consent to display anadvertisement.

    5.9 The Correct Planning Fee where one is necessary.

    5.10 Design and Access StatementsA Design and Access Statement [DAS] must accompany all applications for bothoutline and full planning permission, other than in the circumstances set out byArticle 10 of the DMPO. A DAS is a short report accompanying and supporting aplanning application that should seek to explain and justify the proposal in a

    structured way. The level of detail required will depend on the scale and complexityof the proposal. The DAS should cover both the design principles and concepts thathave been applied to the proposed development and how issues relating to access

    to the development have been dealt with. In summary, a DAS is not statutorilyrequired for:

    Engineering or mining operations;

    development of an existing dwellinghouse, or development within the curtilage of adwellinghouse for any purpose incidental to the enjoyment of the dwellinghouse,where no part of that dwellinghouse or curtilage is within a designated area;

    a material change in the use of land or buildings, unless it also involves operationaldevelopment;

    extensions to the time limits for implementing existing planning permissions;

    development of an existing flat for any purpose incidental to the enjoyment of the flatas such, where no part of the flat is within a designated area;

    the extension of an existing building used for non domestic purposes where thefloorspace created by the development does not exceed 100 square metres andwhere no part of the building or the development is within a designated area;

    the erection, construction, improvement or alteration of a gate, fence, wall or othermeans of enclosure, up to 2m high or the height of the existing means of enclosure,whichever is the higher, where no part of the building or the development is within adesignated area or the curtilage of a listed building;

    development on operational land consisting of the erection of a building or structureup to 100 cubic metres in volume and 15m in height and where no part of thedevelopment is within a designated area;

    the alteration of an existing building where the alteration does not increase the sizeof the building and where no part of the building or the development is within adesignated area;

    the erection, alteration or replacement of plant or machinery where, as a result ofthe development, the height of the plant or machinery would not exceed the greaterof 15 metres above ground level, or the height of the original plant or machinery,

    and where no part of the development is within a designated area; or development of land pursuant to section 73 (determination of applications to develop

    land without conditions previously attached) of the Town and Country Planning Act1990.

    In this context, designated area means a World Heritage Site or a conservationarea.

    Design and access statements are not required for applications relating toadvertisement control, tree preservation orders or storage of hazardous substances.Neither are they required for applications for prior approval for proposed

    development, or non-material amendments to existing planning permissions.

    Applications for Listed Building Consent should be accompanied by a DAS andshould address:

    The special architectural or historic interest of the building;

    The particular physical features of the building that justify its designation as a listedbuilding; and

    The buildings setting.

    Under Policy HE6 of PPS5 Planning for the Historic Environment, all applicationsfor consent affecting heritage assets must also provide a level of information that isproportionate to the significance of the asset and the potential impact upon that

    significance of the proposals. Where an application requires the submission of aDesign and Access Statement, the assessment of the significance of the asset andimpact should be set out in the DAS as part of the explanation and justification forthe design approach.

    The relevant Council Policy context can be found in the UDP Review in particularpolicies DCD1 [Design And Character], DCD1.1 [Design Principles], DCD1.2

    [Design Appraisals] and DCD1.3 [Access for People with Access Difficulties].Government guidance on design issues and planning can be found in PlanningPolicy Statement1 Delivering Sustainable Development.

    5.11 Reserved Matters ApplicationsA reserved matters application deals with some or all of the outstanding details ofthe outline application proposal, including:

    Layout: the way in which buildings, routes and open spaces within the developmentare provided, situated and orientated in relation to each other and to buildings andspaces outside the development.

    Scale: the height, width and length of each building proposed within thedevelopment in relation to its surroundings.

    Appearance: the aspects of a building or place within the development whichdetermine the visual impression the building or place makes, including the externalbuilt form of the development, its architecture, materials, decoration, lighting, colourand texture.

    Access: this covers the accessibility to and within the site for vehicles, cycles andpedestrians in terms of the positioning and treatment of access and circulationroutes and how these fit into the surrounding access network.

    Landscaping: this is the treatment of land [other than buildings] for the purpose of

    enhancing or protecting the amenities of the site and the area in which it is situatedand includes screening by fences, walls or other means, the planting of trees,hedges, shrubs or grass, the formation of banks, terraces or other earthworks, thelaying out or provision of gardens, courts, or squares, water features, sculpture, orpublic art, and the provision of other amenity features.

    5.12 Outline applicationsAs a minimum all outline applications shall include information on

    Use: the use or uses proposed for the development and any distinct developmentzones within the site identified.

    Amount of development: The amount of development proposed for each use. For

    example for residential development the number of proposed units and for otherforms of development the proposed floor-space for each use.

    Indicative layout: an indicative layout with separate development zones proposedwithin the site boundary where appropriate.

    Scale parameters: an indication of the upper and lower limits for height, width andlength of each building within the site boundary.

    Indicative access points: an area or areas in which the access point or points tothe site will be situated.

    6 LOCAL REQUIREMENTS FOR INFORMATIONThe Government encourages Local Planning Authorities to prepare their own list ofinformation requirements in connection with applications for planning permission, andthis is referred to in their guidance [The Validation of Planning Applications]. Howeverthe Government also advises that before the local information requirements canbecome mandatory consultation is undertaken on the contents of a draft list and

    account taken of the responses received. The final list should then be adopted by theCouncil for the purposes of the validation of planning applications.

    The following list of local information requirements is the list prepared byStockport Council in accordance with Government guidance. The consultationperiod commenced on ** and lasted for a period of 8 weeks. The responsesreceived have been taken into account and the AVC revised as appropriate.Details of the consultation responses received are available on request and willalso be made available on the Development Management website.
