63.3. Fencing of machinery :encing of machinery :

position while the part of machinery requiredposition while the part of machinery required

(2)(2) Without prejudice to any other provisionWithout prejudice to any other provision

machinery, every set screw, bolt and keymachinery, every set screw, bolt and key

on any revolving shaft, spindle wheel oron any revolving shaft, spindle wheel or

68.8. Cranes and other l ift ing machineryranes and other l ift ing machinery

(b)(b) no such machineryno such machinery shallshall be loadedbe loaded

beyond the safe working loadbeyond the safe working load whichwhich shallshall

(c)(c) while any person is employed or workingwhile any person is employed or working

on or near the wheel-tract of traveling of on or near the wheel-tract of traveling of a traveling crane in any place where hea traveling crane in any place where he

would be liable to be struck by the cranewould be liable to be struck by the crane

69.9. Hoists and lift :oists and lift :

competent person at leastcompetent person at least once in everyonce in every period of six monthsperiod of six months, and a register shall, and a register shall

be kept containing the prescribedbe kept containing the prescribed

particulars of every such examination;particulars of every such examination;



(2)(2) everyevery hoist wayhoist way andand lift waylift way shall beshall besufficiently protected by an enclosuresufficiently protected by an enclosure

fitted with gates and the hoist or lift andfitted with gates and the hoist or lift andevery suchevery such enclosure shall be soenclosure shall be soconstructed as to prevent any personconstructed as to prevent any person ororthing from being trapped between anything from being trapped between any

part of the hoist or lift and any fixedpart of the hoist or lift and any fixedstructure or moving part;structure or moving part;

(3)(3) thethe maximum safe working loadmaximum safe working load shall beshall be

plainly markedplainly marked on every hoist or lift andon every hoist or lift andno load greater than such load shall beno load greater than such load shall becarried thereon ;carried thereon ;



(4)(4) the cage of every hoist or lift used forthe cage of every hoist or lift used for

carrying persons shall be fitted with acarrying persons shall be fitted with a

(5)(5) every gate referred to in subsection (2)every gate referred to in subsection (2)

the commencement of this Act, namely-the commencement of this Act, namely-

(a)(a) where the cage is supported bywhere the cage is supported by ropeope ororchainhain there shall bethere shall be at least two ropes orat least two ropes or

chains separately connectedchains separately connected with thewith the

cage and balance weight, and each ropecage and balance weight, and each ropeor chain with its attachments shall beor chain with its attachments shall be

capable of carrying the whole weight of capable of carrying the whole weight of

the cage together with its maximumthe cage together with its maximuml



(b)(b) efficient devicesefficient devices shall be provided andshall be provided and

maintained capable of supporting themaintained capable of supporting the

cage together with its maximum loadcage together with its maximum load ininthe event of breakage of the ropes,the event of breakage of the ropes,

chains or attachments ;chains or attachments ;

(c)(c) an efficientan efficient automatic deviceautomatic device shall beshall be

provided and maintained to prevent theprovided and maintained to prevent the

cage from over-running.cage from over-running.



(7)(7) The Chief InspectorThe Chief Inspector maymay permitpermit thethe

continued use of a hoist or lift installed incontinued use of a hoist or lift installed in

an establishmentan establishment before thebefore thecommencement of this Actcommencement of this Act which does notwhich does not

fully comply with the provisions of sub-fully comply with the provisions of sub-

section (1), (2), (3), (4) and (5) uponsection (1), (2), (3), (4) and (5) uponsuch conditions for ensuring safety as hesuch conditions for ensuring safety as he

71.1. Pressure plant :ressure plant :

If in any establishment any part of theIf in any establishment any part of theplant or machinery used inplant or machinery used in

manufacturing process is operated at amanufacturing process is operated at a

pressure above atmospheric pressure,pressure above atmospheric pressure,

effective measures shall be taken toeffective measures shall be taken to

ensure that theensure that the safe working pressuresafe working pressure of of

such partsuch part is not exceededis not exceeded..



72.2. Floors, stairs and means of accessloors, stairs and means of access

: In every establishment –In every establishment –

(a)(a) all floors, stairs, passages and gangwaysall floors, stairs, passages and gangways

shall be of shall be of sound constructionsound construction andand

properly maintainedproperly maintained and where it isand where it is

necessary to ensure safety steps, stairsnecessary to ensure safety steps, stairs

passages and gangways shall bepassages and gangways shall be

provided with substantial handrails ;provided with substantial handrails ;



(b)(b) there shall, so far as is reasonablethere shall, so far as is reasonable

practicable, be provided and maintainedpracticable, be provided and maintained

safe means of access to every placesafe means of access to every place atatwhich any person is, at any time,which any person is, at any time,

required to work; andrequired to work; and

(c)(c) allall floors, ways and stairwaysfloors, ways and stairways shall beshall be

clean,clean, wideide and clear of all obstructionsand clear of all obstructions..



74.4. Excessive weights :xcessive weights :

No person shall be employed in anyNo person shall be employed in anyestablishment to lift, carry or move anyestablishment to lift, carry or move any

load so heavy as to be likely toload so heavy as to be likely to causecause

him injury.him injury.



75.5. Protection of eyes :rotection of eyes :

establishment, by rules, require thatestablishment, by rules, require that

effective screens of suitable goggleseffective screens of suitable goggles shall be provided for the protection of shall be provided for the protection of

persons employed on, or in thepersons employed on, or in the

immediate vicinity of a process involves-immediate vicinity of a process involves-



(a)(a) risk of injury to the eyesrisk of injury to the eyes from particlesfrom particlesor fragmentsor fragments thrown off in the course of thrown off in the course of

the process, orthe process, or

(b)(b) risk to the eyesrisk to the eyes by reason of exposure toby reason of exposure to

excessive light or heatexcessive light or heat..



77.7. Precautions against dangerousrecautions against dangerous

fumes :umes :

(1) In any establishment no person shall(1) In any establishment no person shall

enter or be permitted to enter anyenter or be permitted to enter any

chamberchamber,, tank tank ,, vat pitvat pit,, pipepipe,, flueflue oror otherother

confined spaceconfined space in whichin which dangerous fumesdangerous fumes areare likely to be presentlikely to be present to such an extentto such an extent

as to involve risks of persons beingas to involve risks of persons being

overcome thereby,overcome thereby, unlessnless it is providedit is providedwith a manhole of such size, as may bewith a manhole of such size, as may be

prescribed or other effective means of prescribed or other effective means of

egress.egress.



(2)(2) No portable electric light of voltageNo portable electric light of voltage

exceeding twenty-four volts shall beexceeding twenty-four volts shall be

permitted in any establishmentpermitted in any establishment for usefor useinside any confined spaceinside any confined space such as issuch as is

referred to in sub-section (1) and wherereferred to in sub-section (1) and where

the fumes present are likely to bethe fumes present are likely to beinflammable, lamp or light other than of inflammable, lamp or light other than of

flame proof construction shall beflame proof construction shall be

permitted to be used such confined space.permitted to be used such confined space.



(3)(3) No personNo person in any establishmentin any establishment shall entershall enter or beor be

permitted to enter any suchpermitted to enter any such confined spaceconfined space untiluntil

all practicable means have been taken to removeall practicable means have been taken to removeany fumesany fumes which may be present and to preventwhich may be present and to prevent

any ingress of fume andany ingress of fume and unless either-unless either-

(a)(a) a certificate in writinga certificate in writing has been given by ahas been given by a

competent person, based on a test carried outcompetent person, based on a test carried outby himself that the space is from dangerousby himself that the space is from dangerous

fumes and fit for persons to enter, orfumes and fit for persons to enter, or

(b)(b) the worker is wearing suitable breathingthe worker is wearing suitable breathingapparatus and a belt securely attachedapparatus and a belt securely attached to a rope,to a rope,

the free end of which is held by a personthe free end of which is held by a person

standing outside the confined space.standing outside the confined space.



(4)(4) Suitable breathing apparatusSuitable breathing apparatus, reviving, revivingapparatus and belts and ropes shall, inapparatus and belts and ropes shall, in

every establishment, be kept ready forevery establishment, be kept ready forinstant use beside any such confinedinstant use beside any such confinedspacespace, as aforesaid which any person as, as aforesaid which any person asentered and all such apparatus shall beentered and all such apparatus shall be

periodically examined and certified by aperiodically examined and certified by acompetent person to be fit for use; andcompetent person to be fit for use; anda sufficient number of persons employeda sufficient number of persons employed

(5)(5) No personNo person shall be permittedshall be permitted to enterto enter

in any establishment, any boiler furnance,in any establishment, any boiler furnance,boiler, flue chamber, tank boiler, flue chamber, tank , at, piper or, at, piper or

other confined spaceother confined space for the purpose of for the purpose of

working or making any examinationworking or making any examinationthereintherein until it has been sufficiently cooleduntil it has been sufficiently cooled

by ventilationby ventilation or otherwise to be safe foror otherwise to be safe for

persons to enter.persons to enter.



78.8. Explosive or inflammable dust, gas,xplosive or inflammable dust, gas,

etc. :tc. :

(1)(1) Where in any establishment anyWhere in any establishment any

manufacturing processmanufacturing process produces dust, gas,produces dust, gas,

fume or vaporfume or vapor of such character and to suchof such character and to suchextent as to be likely to explode on ignition,extent as to be likely to explode on ignition,

allall practicable measurespracticable measures shall be taken toshall be taken to

prevent any such explosion by–prevent any such explosion by–



(a)(a) effective enclosureeffective enclosure of the plant orof the plant or

machinery used in the process ;machinery used in the process ;(b)(b) removal or preventionremoval or prevention of theof the

accumulation of such dust, gas, fume oraccumulation of such dust, gas, fume or

vapour;vapour;(c)(c) exclusion or effective enclosureexclusion or effective enclosure of allof all

possible sources of ignition.possible sources of ignition.



(2)(2) Where in any establishment the plant orWhere in any establishment the plant or

machinery used in a process is not somachinery used in a process is not so

constructed as to withstand the probableconstructed as to withstand the probablepressure which such anpressure which such an explosionexplosion asas

aforesaidaforesaid would producewould produce,, all practicableall practicable

shallshall not be opened exceptnot be opened except in accordance within accordance with
