Why choose CGU’s Multimedia Liability Policy? CGU’s Multimedia Liability Policy aims to protect organisations in the media, marketing and advertising industries with respect to civil liability claims arising from the provision of Multimedia Services. Such civil liability claims can include breaches of duty, defamation, breach of copyright, false attribution of authorship (and other infringements of intellectual property), invasion of privacy or improper disclosure of sensitive private facts, false or wrongful arrest, detention or imprisonment. See the CGU Multimedia Liability Policy wording for a full list of the civil liability claims covered by the Policy. Litigation against organisations in the media, marketing and advertising industries can arise from the provision of any of the following types of Multimedia Services: a) publishing, broadcasting, communication, distribution and/or dissemination of content; b) researching, investigating, acquiring, preparing, compiling, producing and/or editing of content; c) licensing, syndication, serialisation, distribution, sale or lease of content, by or with the written permission of a multimedia organisation. A key component of cover in the CGU’s Multimedia Liability Policy is cover for defamation actions. Such actions in particular can be extremely costly, complicated and difficult to defend with substantial damages being awarded against organisations in the media and advertising industries. The litigation involved in defamation actions is often lengthy and disruptive to the operation of a business and can potentially put at risk the assets and reputation of organisations, and individuals (e.g. partners, directors and/ or employees) within those organisations. This is where CGU’s Multimedia Liability Policy is designed to step in to cover a media or multimedia organisation and its staff against the incurring of such legal and financial liabilities. CGU’s Multimedia Liability Policy also includes covering the legal and other costs and expenses incurred in the preparation, investigating, defending and or settling of any matter covered by the Policy.
