NOTICE INVITING QUOTATIONS

Sealed Quotations are invited from interested and reputed Service Providers

experienced in providing Electronic Data Interchange (EDI) Services to Container

Freight Station (CFS) or Inland Container Depot (ICD) or any other Logistics Service

Providers including private firms, preferably in Customs Notified environment, for

providing EDI Services at Container Freight Station, Kukatpally, Hyderabad,

subject to the “Terms and Conditions” (Annexure-A) and the “Scope of EDI

Systems and Services” (Annexure-B) in conformity with “CBEC Partner

Connectivity Protocol – Solution for CBEC field formations managed by

Custodians (under the “HCCAR, 2009” – Annexure-E) requiring IT

infrastructure and connectivity with CBEC Data Centre” (Annexure-F).

1. The Service Provider shall quote a lumpsum rare per month inclusive of all

expenses, except GST in “Price Bid” (Annexure-C).The rate of GST shall be

mentioned separately.

2. The cost of Notice Inviting Quotation (NIQ) / Tender document shall be Rs.100/-

plus GST @ 18%. The intending Quotationers / Tenderers shall deposit an

amount of Rs.118/- (Rupees one hundred and eighteen only) either in cash at

Container Freight Station, Kukatpally, Hyderabad or in the form of Demand Draft

from Nationalized Bank Regional Manager, Central Warehousing Corporation,

Hyderabad, payable at Hyderabad.

3. The quotation must be accompanied with Earnest Money Deposit (EMD) of

Rs.15,000/- (Rupees fifteen thousand only) in the form of Demand Draft from

Nationalized Bank, in favour of Regional Manager, Central Warehousing

Corporation, Hyderabad, payable at Hyderabad. Quotations not accompanied

with requisite EMD shall be summarily rejected.

4. The bidder registered with NSIC / MSME is exempted from depositing EMD, on

furnishing a copy of the valid Registration Certificate issued by NSIC / MSME.

5. The EMD of unsuccessful bidders is refundable and carries no interest. The

EMD of successful bidder shall be converted into Security Deposit (SD)

equivalent to 10% of annual contract value. The balance amount falling short of

Security Deposit shall be deposited in the form of DD at the time of executing

agreement as per Annexure-D. SD will be refunded on successful and

satisfactory completion of contract period or extended period of contract, if any.

6. Schedule of quotation is given below:

a) Date and time of receipt / acceptance of Quotation: 22-10-2019 at 15:00 hrs.

b) Date and time of opening of Quotation: 22-10-2019 at 15:30 hrs. (if 22-10-

2019 happens to be a holiday for any reason, the quotation shall be received /

accepted upto 15:00 hrs and opened at 15:30 hrs on the next working day)

8. The intending quotationer / Service Provider shall drop the quotation in the drop

box provided at CFS, Kukatpally in person send the same by Registered /

Speed Post. The rate must be quoted only in the Price Bid (Annexure-C),

enclosing Annexures – A and B containing “Terms and Conditions” and

“Scope of Work” respectively duly signed by the bidder or the authorized

signatory, and attested documents in support of eligibility criteria, GST

Registration, PAN card, NSIC / MSME registration, etc. in a sealed cover duly

super-scribed as “Quotation for providing EDI Services as per NIQ

No.CWC/CFS/KKP/EDI/2019-20, dt.07-10-2019” so as to reach Container

Freight Station, Kukatpally, IDPL Road, Hyderabad – 500 037 (Telangana), on or

before 22-10-2019 15:00 hrs. Quotations received after due date and time will

not be considered / opened.

The details of NIQ can be seen and downloaded at our website

www.cewacor.nic.in and on www.tenderhome.com. The same can also be

obtained from Container Freight Station, Kukatpally, Hyderabad from to from 11:00

hrs on 07-10-2019 to 16:00 hrs on 21-10-2019 on remittance of Rs.118/- in cash or

DD as mentioned at point (2) above.

Annexure-A

Terms and Conditions

1. The minimum qualification requirements for a resource provisioned as a Resident

Engineers (R.E.) as a part of Project SAKSHAM are as under:

a) The proposed candidate should be a graduate Science/ IT

b) The candidate should have diploma in Networking from an ISO certified

institutes

c) Read/Speak/Write in English and Hindi/ Regional Language

d) Should have at least 1 years’ experience of providing IT support, preferably as

site IT Engineer

e) Shall be trained by the SI on support, maintenance, troubleshooting of key

component supplied by CBEC in the locations.

f) Shall be trained on using the Ticketing System being proposed.

The Service Provider shall submit attested copies Certificates of the personnel

proposed to be deployed as Resident Engineers, in support of minimum

qualification requirements.

2. The intending Service Provider shall submit an attested copy of GST Registration

Certificate.

3. The intending Service Provider shall submit an attested copy of Income Tax PAN

Card held in the name of the owner / proprietor / authorized signatory.

4. The intending Service Provider shall submit an attested copy of valid NSIC /

MSME Certificate, in case of claiming exemption of EMD.

5. The Service Provider shall position a minimum of one Resident Engineer (RE)

as per the working hours of CFS, Kukatpally. The Resident Engineer shall be

responsible for day to day support and maintenance of the Local Infrastructure.

6. An alternate RE shall be arranged by the firm as and when the RE originally

deployed at CFS proceeds on leave and shall continue to render the services till

the originally deployed RE reports for service.

7. The RE deployed shall intimate in writing in advance, as and when he / she

desires to proceed on leave, duly making the alternate arrangement.

8. For any inconvenience or dislocation of work arising out of non-availability of RE,

the Service Provider shall be solely responsible and shall be liable for appropriate

amount of recovery from the monthly bill.

9. In the event of unauthorized absence of the RE and non-provision of alternate

arrangement by the Service Provider in the event of absence of regular RE, CWC

shall at its entire discretion without terminating the contract be at liberty to

engage the tendered services at the risk and cost of the Service Provider, who

shall be liable to make good all the additional charges, expenses, cost or losses

that may incur or suffer thereby.

10. The Annual Maintenance Contract (AMC) shall be valid upto one year and

extendable upto another year in the spells of 6 months each at the discretion of

Competent Authority at the same rates, terms and conditions.

11. The monthly bill as per the approved / awarded rate shall be submitted positively

before 5th of every month for the service provided during the preceding month.

12. The payment shall be processed for release on receipt of pre-receipted bill (in

duplicate) supported by the Work Done Certificate duly signed by Manager, CFS,

Kukatpally.

13. The Scope of EDI Services shall be as mentioned in Annexure-B in conformity

with “CBEC Partner Connectivity Protocol – Solution for CBEC field formations

managed by Custodians (under the “HCCAR, 2009” – Annexure-E) requiring IT

infrastructure and connectivity with CBEC Data Centre” (Annexure-F).

14. The Corporation does not bind itself to accept the lowest quotation and reserves

to itself the right to accept or reject any or all quotations received without

assigning any reason thereof.

15. Successful quotationer has to execute an agreement as per proforma mentioned

at Annexure-D.

16. Conditional Quotation shall not be accepted.

Annexure-B

Scope of EDI Systems and Services at CFS, Kukatpally

1. To conduct status review of EDI Equipment from time to time as per CBEC Partner Connectivity

Protocol (Version 2.0, March, 2017) – Solution for CBEC field formations managed by Custodians

(under the HCCAR, 2009 – Annexure-E) requiring IT infrastructure and connectivity with CBEC Data

Centre (Annexure-F) and submit a report and action plan to CWC, for providing new / higher end

infrastructure;

2. To implement the above said CBEC Partner Connectivity Protocol (Version 2.0, March, 2017) on

behalf of the Custodian, i.e., CWC, CFS, Kukatpally.

3. To provide EDI Service and Maintenance of all EDI equipments on daily basis for a period of one year

from the date of award of AMC, which is extendable upto six months on the same rates, terms and

conditions;

4. To act as interface between Customs and Custodian (CWC) in the matters relating to EDI;

5. To ensure uninterrupted functioning of Virtual Private Network (VPN) of BSNL exclusively provided for

Customs use by CWC;

6. To ensure uninterrupted functioning of internet provided to Customs, by the Custodian;

7. To initiate immediate trouble-shooting measures in the event of any interruption in the functioning of

VPN or Internet, and maintain a log book of action taken, duly signed by the Manager – CFS;

8. To print the Shipping Bills in Export released by Customs;

9. To print the Out Of Charge (OOC) documents in Import, released by Customs;

10. To attend work relating to Closure of Export General Manifest (EGM) in Export, by feeding details of:

Vehicle Number, Let Export Order (LEO) Date, Mode of Transport, Shipping Bill Number, Date of

Shipping Bill, Container / CBT Number, Wagon Number in case of train movement (mainly from

ICDs), House Code (of Custodian), Gross Weight, ISO Code of Country, Liner Name, Port of

Discharge, Country of Origin, etc (provided by CHAs / Custodian) on day-to-day basis, after

completion of Stuffing Report by Customs

11. To attend work relating to Closure of Import General Manifest (IGM), by feeding details of: 1) BL

Number; 2) SFTP (TSA) Number; 3) SFTP (TSA) Date; 4) Train Number / Vehicle Number; 5) Train /

Vehicle Arrival Date; 6) Container Number; 7) Weight; 8) Port of Origin; Gateway Port Name, etc. on

day to day basis.

12. Any other work / service, which falls under the purview of EDI Services, irrespective of whether

expressly stated hereinabove or not.

Annexure-E

Handling of Cargo in Customs Areas Regulations, 2009

[Notification No. 26/2009- Cus (NT), Dated 17-03-2009, amended by Corrigendum F. No. 450/55/2008-Cus-IV, dt.2.04.2009, Notification No. 96/2010- Cus. (N.T.), dated 12-11-2010, 43/2012-Cus. (N.T.), dated 16-05-2012, 104/2012-Cus. (N.T.), dated 16/11/2012]

In exercise of powers conferred by sub-section (2) of section 141 read with section 157 of the Customs Act, 1962 (52 of 1962),

the Central Board of Excise and Customs hereby makes the following regulations, namely:-

1. Short title and commencement.-

(1) These regulations may be called the Handling of Cargo in Customs Areas Regulations, 2009.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.-

(1) In these regulations, unless the context otherwise requires, -

(a) "Act" means the Customs Act, 1962 (52 of 1962);

(b) "Customs Cargo Services provider" means any person responsible for receipt, storage, delivery, dispatch or otherwise

handling of imported goods and export goods and includes a custodian as referred to in section 45 of the Act and persons as

referred to in sub-section (2) of section 141 of the said Act;

(c) "specified" means specified by a notification or an order issued under the provisions of the Act;

(2) the words and expressions used herein and not defined but defined in the Act shall have the same meanings respectively

assigned to them in the Act.

3. Application.-

These regulations shall be applicable to the handling of imported and export goods in ports, airports, inland container depots,

land customs stations and in customs areas approved or specified under section 8.

4. Retrospective Application.-

Any action taken or anything done in respect of appointment of Customs Cargo Service providers, immediately preceding the

coming into force of these regulations, shall be deemed to have been done under the corresponding provisions of these

regulations. Customs Cargo Service providers already approved on or before the date of coming into force of these regulations

shall comply with the conditions of these regulations within a period of three months or such period not exceeding a period of one

year as the Commissioner of Customs may allow from the date of coming into force of these Regulations.

5. Conditions to be fulfilled by CustomsCargo Service provider

The Customs Cargo Service provider for custody of imported goods or export goods and for handling of such goods in a customs

area shall fulfill the following conditions, namely:-

(1) Provide the following to the satisfaction of the Commissioner of Customs, namely:

(i) Infrastructure, equipment and adequate manpower for loading, unloading, stacking, handling, stuffing and de-stuffing of

containers, storage, dispatch and delivery of containers and cargo etc., including:-

(a) standard pavement for heavy duty equipment for use in the operational and stacking area;

(b) free of cost or rent fully furnished office accommodation for Customs, Customs Electronic Data Interchange (EDI) Service

Centre, with required amenities and facilities and residential accommodation and transportation facilities for customs staff;

(c) premises for user agencies with basic amenities and facilities;

(d) storage facility, separately for imported, export and transshipment goods;

(e) gate complex with separate entry and exit;

(f) adequate parking space for vehicles;

(g) boundary wall;

(h) internal service roads;

(i) electronic weigh-bridge and other weighing and measuring devices;

(j) computerized system for location and accountal of goods, and processing of documents;

(k) adequate air-conditioned space and power back up, hardware, networking and other equipment for secure connectivity with

the Customs Automated system; and for exchange of information between Customs Community partners;

(l) facilities for auction, including by e-auction, for disposal of uncleared, unclaimed or abandoned cargo;

(m) facilities for installation of scanning equipment;

(n) security and access control to prohibit unauthorized access into the premises, and

(o) such other facilities as the Commissioner of Customs may specify having regard to the custody and handling of imported or

export goods in a customs area;

(ii) safe, secure and spacious premises for loading, unloading, handling and storing of the cargo for the projected capacity and for

the examination and other operations as may be required in compliance with any law for the time being in force;

(iii) insurance for an amount equal to the average value of goods likely to be stored in the customs area based on the projected

capacity, and for an amount as the Commissioner of Customs may specify having regard to the goods which have already been

insured by the importers or exporters.

(2) Undertake to bear the cost of the Customs officers posted, at such customs area, on cost recovery basis, by the

Commissioner and shall make payments at such rates and in the manner prescribed, unless specifically exempted by an order of

the Government of India in the Ministry of Finance;

(3) Execute a bond equal to the average amount of duty involved on the imported goods and ten per cent of value of export

goods likely to be stored in the customs area during a period of thirty days and furnish a bank guarantee or cash deposit

equivalent to ten per cent of such duty:

Provided that the condition of furnishing of Bank guarantee or cash deposit shall not be applicable to ports notified under

the Major Ports Act, 1962 (38 of 1963) or to the Central Government or State Governments or their undertakings or to the

Customs Cargo Service provider authorised under Authorised Economic Operator Programme.

(4) Execute a separate bond for an amount equal to ten percent of value of export goods with a bank guarantee for an amount

equal to ten percent of the value of the bond, towards the export goods transported from the customs area to any other customs

area for export or transshipment, as the case may be;

(5) Undertake to comply with the provisions and abide by all the provisions of the Act and the rules, regulations, notifications and

orders issued thereunder.

(6) Undertake to indemnify the Commissioner of Customs from any liability arising on account of damages caused or loss

suffered on imported or export goods, due to accident, damage, deterioration, destruction or any other unnatural cause during

their receipt, storage, delivery, dispatch or otherwise handling.

6. Responsibilities of Customs Cargo Service provider:

(1) The Customs Cargo Service provider shall -

(a) keep a record of imported goods, goods brought for export or transshipment, as the case may be, and produce the same to

the Inspector of Customs or Preventive Officer or Examining Officer as and when required;

(b) keep a record of each activity or action taken in relation to the movement or handling of imported or export goods and goods

brought for transhipment;

(c) display or make available in any other manner, information of process or movement or handling of imported or export goods

and goods brought for transhipment;

(d) demarcate separate areas for unloading of imported goods for their storage with respect to the category of importers, nature

of goods, place of destination, mode of transportation or any other criterion as the Commissioner of Customs may specify having

regard to the custody and handling of imported goods in a customs area;

(e) demarcate separate areas for loading of export goods for their storage with respect to categories of exporters, nature of

goods, examined and sealed containers or other criterion as the Commissioner of Customs may specify having regard to the

custody and handling of export goods in a customs area;

(f) not permit goods to be removed from the customs area, or otherwise dealt with, except under and in accordance with the

permission in writing of the Superintendent of Customs or Appraiser;

(g) not permit any export cargo to enter the customs area without a shipping bill or a bill of export having been filed with the

Deputy Commissioner or Assistant Commissioner of Customs;

(h) not permit any import cargo to enter the customs area or be unloaded therein without the import report or the import manifest

having been filed with the Deputy Commissioner or Assistant Commissioner of Customs;

(i) be responsible for the safety and security of imported and export goods under its custody;

(j) be liable to pay duty on goods pilfered after entry thereof in the customs area;

(k) be responsible for the secure transit of the goods from the said customs area to any other customs area at the same or any

other customs station in accordance with the permission granted by the Deputy Commissioner or Assistant Commissioner of

Customs;

(l) subject to any other law for the time being in force, shall not charge any rent or demurrage on the goods seized or detained or

confiscated by the Superintendent of Customs or Appraiser or Inspector of Customs or Preventive officer or examining officer, as

the case may be;

(m) dispose off in the manner specified and within a time limit of ninety days, the imported or export goods lying unclaimed,

uncleared or abandoned:

Provided that the period of ninety days may be extended by the Commissioner of Customs by such further period as may be

allowed, on sufficient cause being shown for delay in the disposal;

(n) not make any alteration in the entry or exit points or boundary wall without the permission of the Commissioner of Customs;

(o) shall bear the cost of the customs officers posted by the Commissioner of Customs on cost recovery basis and shall make

payments at such rates and in the manner specified by the Government of India in the Ministry of Finance unless specifically

exempted by an order of the said Ministry;

(p) shall observe the Central Government holidays as followed by the jurisdictional Customs formations and in case of any

variation in the working days, intimate the same to Commissioner of Customs and the trade, at least seven days in advance, and

(q) abide by all the provisions of the Act and the rules, regulations, notifications and orders issued thereunder.

(2) The Customs Cargo Service provider approved for custody of imported or export goods and for handling of such goods shall

not lease, gift, sell or sublet or in any other manner transfer any of the premises in a customs area; or sub contract or outsource

functions permitted or required to be carried out by him in terms of these regulations to any other person, without the written

permission of the Commissioner of Customs.

(3) The Customs Cargo Service provider shall publish and display at prominent places including website or webpage of the

Customs Cargo Service provider the schedule of charges for the various services provided by him in relation to the imported

goods or export goods in the customs area.

7. Power to relax and regulate:

(1) if the Commissioner of Customs is satisfied that in relation to the custody and handling of imported or export goods in a

customs area, the Customs Cargo Service provider, for reasons beyond his control, is unable to comply with any of the conditions

of regulation 5, he may for reasons to be recorded in writing, exempt such Customs Cargo Service provider from any of the

conditions of regulation 5.

Provided that no exemption shall be granted in respect of any of the conditions referred to in regulation 5,

where the overall safety and security of the premises are likely to be affected thereby.

(2) The Commissioner of Customs may regulate the entry of goods in a customs area for efficient handling of such goods.

8. Commencement of operations:

The Customs Cargo Service provider approved for custody of imported or export goods and for handling of such goods shall

not commence any operations in a customs area for the first time unless the Commissioner of Customs is satisfied that all the

requirements of the Act have been fulfilled and grants permission to commence the operations by an order in writing.

9. Application for approval of Customs Cargo Service provider:

(1) An application to act as a Customs Cargo Service provider for custody of imported or export goods and for handling of

such goods in a customs area shall be made in the form of a letter to the jurisdictional Commissioner of Customs containing

details as prescribed inForm A'.

(2) The Commissioner of Customs shall dispose of the application within forty five days of the receipt of the application.

10. Approval of appointment of a Customs Cargo Service provider and review thereof:

(1) Where the Commissioner of Customs is satisfied that the applicant has fulfilled the conditions prescribed in regulation 5,

he may approve such an applicant as a Customs Cargo Service provider, for a period of two years from the date of issue of such

approval.

Provided that a Customs Cargo Service provider already approved on or before the date of coming into force of these

regulations, shall be deemed to be approved as a Customs Cargo Service provider under these regulations for a period of five

years from the date of compliance with the conditions of these regulations as stipulated in regulation 4.

(2) The Commissioner of Customs shall review the approval granted under sub regulation (1) before the expiry of the initial

period of approval of two years or five years, as the case may be, and may extend such approval to a further period of five years

at a time.

Provided that the Commissioner of Customs, for reasons to be recorded in writing, may order for review of the approval

granted to any Customs Cargo Service provider before the completion of the period of approval.

Provided further that in case of Customs Cargo Service provider authorised under Authorised Economic Operator

Programme', the approval granted under sub-regulation (1) may be extended for a further period of ten years at a time.

11. Suspension or revocation of approval for appointment of a Customs Cargo Service provider:

(1) The Commissioner of Customs may, subject to the provisions of these regulations, suspend or revoke the approval

granted to the Customs Cargo Service provider subject to the observance of procedure prescribed under regulation 12 and also

order for forfeiture of security, if any, for failure to comply with any of the provisions of the Act and the rules, regulations,

notifications and orders made thereunder;

(2) Notwithstanding anything contained in sub-regulation (1), the Commissioner of Customs may, in appropriate cases where

immediate action is necessary, suspend the approval granted to a Customs Cargo Service provider where an enquiry against

such Customs Cargo Service provider is pending or contemplated.

12. Procedure for suspension or revocation of approval and imposition of penalty:-

(1) The Commissioner of Customs shall issue a notice in writing to the Customs Cargo Service provider stating the grounds on

which it is proposed to suspend or revoke the approval and requiring the said Customs Cargo Service provider to submit within

such time as may be specified in the notice not being less than thirty days, to the Assistant Commissioner or Deputy

Commissioner of Customs nominated by him, a written statement of defence and also to specify in the said statement whether

the Customs Cargo Service provider desires to be heard in person by the said Assistant Commissioner or Deputy

Commissioner of Customs.

(2) On receipt of the written statement from the Customs Cargo Service provider, or where no such statement has been received

within the time-limit specified in the notice referred to in sub-regulation (1), the Assistant Commissioner or Deputy Commissioner

of Customs may inquire into such of the grounds as are not admitted by the Customs Cargo Service provider.

(3) The Assistant Commissioner or Deputy Commissioner of Customs shall, in the course of inquiry, consider such documentary

evidence and take such oral evidence as may be relevant or material to the inquiry in regard to the grounds forming the basis of

the proceedings and he may also put any question to any person tendering evidence, for or against the Customs Cargo Service

provider, for the purpose of ascertaining the correct position.

(4) The Customs Cargo Service provider shall be entitled to cross-examine the persons examined in support of the grounds

forming the basis of the proceedings and where the Assistant Commissioner of Customs or Deputy Commissioner of Customs

declines to examine any person on the grounds that his evidence is not relevant or material, he shall record his reasons in writing

for so doing.

(5) At the conclusion of the aforesaid inquiry, the Assistant Commissioner of Customs or Deputy Commissioner of Customs shall

prepare a report of the inquiry recording his findings.

(6) The Commissioner of Customs shall furnish to the Customs Cargo Service provider a copy of the report of the Assistant

Commissioner or Deputy Commissioner of Customs and shall require the Customs Cargo Service provider to submit within the

specified period not being less than thirty days any representation that he may wish to make against the findings of the Assistant

Commissioner of Customs or Deputy Commissioner of Customs.

(7) The Commissioner shall, after considering the report of the inquiry, and the representation thereon, if any, made by the

Customs Cargo Service provider, pass such orders as he deems fit.

(8) If any Customs Cargo Service provider contravenes any of the provisions of these regulations, or abets such contravention or

who fails to comply with any provision of the regulation with which it was his duty to comply, then, he shall be liable to a penalty

which may extend to fifty thousand rupees.

(9) Any Customs Cargo Service provider aggrieved by any decision or order passed under this regulation, may appeal under

section 129A of the Act to the Customs Central Excise and Service Tax Appellate Tribunal established under sub-section 1 of

section 129 of the Act.

13. Renewal of approval for appointment of Customs Cargo Service provider:

The Commissioner of Customs may on application made by the Customs Cargo Service provider before the expiry of the validity

of the appointment under regulation 10, renew the approval for a further period of five years from the date of expiration of the

original approval granted under regulation 10 or of the last renewal of such approval, as the case may be, if the performance of

the approved Customs Cargo Service provider is found to be satisfactory with reference to his obligations under any of the

provisions of the Act and the rules, regulations, notifications and orders made thereunder.

EXPLANATORY MEMORANDUM

Handling of Cargo in Customs Area Regulations, 2009 provide for a comprehensive mechanism for handling of goods in a

customs area and set out the terms and conditions for all facilities where customs cargo is handled. It also provides for the

conditions and responsibilities of the persons handling import or export cargo in Inland Container Depot (ICD) or Container

Freight Station (CFS) or seaport or airport or Land Customs Stations (LCS) and provide adequate control over the cargo handling

entities to ensure that the adequate infrastructure is set up at such facilities for efficient handling of import or export goods. This

also fulfills the recommendation made by the Public Accounts Committee (2005-2006) for the Government to formulate

appropriate provisions in this regard.

Reference: Reference is invited to CBEC Notification No. 26/2009-Customs(N.T.)

dated 17th March 2009 bringing into effect the “Handling of Cargo in Customs

Areas Regulations 2009” (referred in short as ‘Regulations’) and Circulars Nos.

13/2009-Customs dated 23rd March 2009 and No. 21/2009-Customs dated 4th

August 2009. Reference is also invited to CBEC’s Circular No.4/2011-Customs

dated 10th January 2011

The above Regulations/Circular issued by CBEC prescribe, inter-alia, that the

networking, communication equipments, Uninterrupted Power Supply System,

desktops, servers, printers other computer peripherals and secure connectivity to

the CBEC Data Centres as specified by the Directorate General of Systems shall also

be provided by the custodians. It has further been provided that these instructions

apply to all the Custodians of ports, airports, Inland Container Depots (ICDs),

Container Freight Stations (CFSs), Integrated Check posts (ICPs), Land Customs

Stations (LCSs), the major ports notified under the Major Ports Act 1963 and the

airports notified under the Airports Authority of India Act, 1994.

Overview: This Document provides the current revised technical details for

network connectivity and IT infrastructure at ICDs/CFSs/ICPs etc. which are covered

under HCCAR 2009, requiring access to CBEC’s Data Centres for accessing CBEC’s

Customs applications. This document/specifications herein may be revised from time

to time in terms of the above cited Regulations.

Requirements:

a) The Custodian would be required to provide MPLS connectivity for access to the

Data Centre. M/s BSNL and M/s TCL are the authorized service providers of CBEC for primary connectivity and alternate connectivity respectively and therefore already have presence at the Data Centres. However, connectivity can also be taken from any other MPLS Service provider who has presence at CBEC’s Data Centres.

b) It is mandatory for the Custodian to take MPLS connectivity to the Data Centre-Delhi as well Data Centre – Chennai to ensure business continuity in the event of a contingency as well as disaster recovery. This would help the location to be connected to the services at the time of non-availability of Primary Data Centre at New Delhi.

c) The bandwidth provided should be of either 4, 8, or 16 Mbps through Optical Fiber Cable depending on the number of users. A bandwidth estimate of about 150 kbps per user should be used while calculating the bandwidth requirement.

d) The Custodian shall ensure that the last mile connectivity to the Custodian site and to Data Centres would be on Optical Fiber Cable. The Custodian shall ensure that the underground fiber laid should have proper ducting and the routes taken by the fiber shall avoid digging prone areas thereby ensuring minimum or no disruption to CBEC services. Refer to Annexure 1 for various options of Connectivity to the Data Center.

e) The Custodian would be required to provide all requisite infrastructure including office space and furniture, Local Area Network (LAN) Infrastructure including Desktops, File & Print servers, Printers (including Line Printers as may be required), Routers, LAN Switches, air- conditioning, backup power and UPS. Specifications of equipment (as deployed by CBEC) are detailed at Annexure 2. The infrastructure supplied must conform to these specifications or higher. The annual maintenance and proper upkeep of these equipments would also be the responsibility of the Custodian.

f) The WAN and LAN equipment provided by Custodians shall conform to CBEC’s IT Infrastructure Design and secure access policy. The local infrastructure would have to integrate with CBEC’s Central End Point Protection (Anti-Virus & HIDS) gateway, Network Access Control (NAC), Active Directory, CBEC’s Content Filtering Solution, Data Leakage Prevention (DLP) and Centralized Patch Management systems etc. This is important since any violation would impact the connectivity to the data centre. List of all software agents required to be installed on Desktops are provided in Annexure 3. The agents which are required to be mandatorily integrated with CBEC’s centralized security controls are marked as Mandatory and will be provided to the Custodian by CBEC.

g) The Custodian would be required to provision Resident Engineers (R.E.) as per their working hours who would be responsible for day to day support and maintenance of the Local IT Infrastructure. Minimum qualification of R.E.s (as deployed by CBEC) is provided in Annexure 4.

h) The Custodian should ensure that CBEC LAN is segregated for security and not connected to the CFS/ICD own LAN. The LAN/WAN implementation would be required to conform to the Information Security Policy of CBEC, which will be shared by CBEC with the Custodian after they have executed the required Non-Disclosure Agreement.

i) Custodian would be required to sign a “Non Disclosure Agreement” on a stamp paper with the Jurisdictional Commissioner of Customs. The format of this agreement is enclosed at Annexure 5. Once the infrastructure is ready, the custodian is required to fill up the Infrastructure checklist enclosed at Annexure 6, and have it verified by the Customs officer located at the site. The Non Disclosure Agreement and Infrastructure checklist in original is required to be submitted to the Jurisdictional Commissioner of Customs.

Annexure 1 – Connectivity Protocols

A. Connectivity Options for ICES system to the CBEC Data Centres

A. Access through the MPLS Cloud:

The Custodian can connect to CBEC Data Centre - Delhi and CBEC Data Centre – Chennai with the partner MPLS Cloud of either M/s BSNL or M/s TCL or any other service provider who has presence in CBEC’s Data Centre. VPN Client is not required in case of MPLS connectivity. All the Network Switches and Routers at the location accessing CBEC’s Data Centres must support 802.1x to enable integration with CBEC’s Network Access Control (NAC).

B. VPN over BroadBand/Fibre through specified Internet Service Provider

(ISP) :

In case MPLS network is not available at the site, CBEC users can connect to Data Centre using VPN access over Broadband/Fibre through M/s BSNL or M/s TCL as CBEC has taken connectivity from these service providers. VPN Credentials (userid & password) in this case is to be provided by the ISP. All the Network Switches and Routers at the location accessing CBEC’s Data Centres must support 802.1x to enable integration with CBEC’s Network Access Control (NAC).

C. VPN over Internet through other ISPs:

VPN over internet can also be taken from any other ISP but since those ISPs do not have presence in CBEC’s Data Centres, the VPN IDs will be provided to officer concerned by SAKSHAM Seva Helpdesk. The VPN ID will be bound to the device (Desktop) and in the event that device/device credentials change, the VPN access will get impacted. In such an event, the user will again have to contact SAKSHAM Seva Helpdesk for access.

All the Network Switches and Routers at the location accessing CBEC’s Data Centres must support 802.1x to enable integration with CBEC’s Network Access Control (NAC).

B. Connectivity of stakeholders authorized by CBEC for Message Exchange

Stakeholders having voluminous and time-sensitive message exchange has an option to build point to point links between the Stakeholder’s Data Centre and Data Centres of CBEC at New Delhi and Chennai. In this case partner locations will be connected to both Data Centre-Delhi & Data Centre-Chennai of CBEC on separate Point to Point Links. CBEC will only work as a facilitator and the responsibility for arranging the actual connectivity remains with the partner agency. CBEC is only suggesting various options, which have different techno-commercial implications. The custodians may choose any option based on their business requirements.

Annexure 5

NON DISCLOSURE AGREEMENT

To

The Commissioner of Customs,

WHEREAS, we the undersigned , having our

principal place of business/ registered office at

, hereinafter referred to as the Custodian of ICD/ CFS/

ACU/ Port , are desirous of establishing connectivity with the Central Board of

Excise & Customs (CBEC) data center for the purposes of electronic data interchange (hereinafter

called the said 'Connectivity') and,

WHEREAS, the Custodian is aware and confirms that the information, software, hardware,

business data, architecture schematics, designs, storage media and other documents made available

by DG (Systems), CBEC during the process of establishing connectivity and thereafter, or otherwise

(confidential information for short) is privileged and strictly confidential and/or proprietary to DG

(Systems), CBEC.

NOW THEREFORE, in consideration of the foregoing, the Custodian agrees to all of the

following conditions, in order to enable DG (Systems) to grant the Custodian specific access to DG

(Systems)’s confidential information, property, information systems, network, databases and other

data as may be required in the process of establishing connectivity.

IT IS HEREBY AGREED AS UNDER:

a) The CUSTODIAN agrees to hold in confidence any confidential information received by the CUSTODIAN, as part of the connectivity process or otherwise, and the CUSTODIAN shall maintain strictest of confidence in respect of such confidential information. The CUSTODIAN also agrees:

(i) to maintain and use the confidential information only for the purposes of establishing connectivity and only as permitted by DG (Systems),CBEC;

(ii) to only make copies as specifically authorized by the prior written consent of DG (Systems), CBEC and with the same confidential or proprietary notices as may be printed or displayed on the original;

(iii) to restrict access and disclosure of confidential information to such of their employees, agents, consultants and representatives (hereinafter ‘Authorized Personnel’) who strictly have a "need to know", and who agree in writing to maintain confidentiality of the confidential information disclosed to them in accordance with this Agreement;

(iv) to treat confidential information as confidential unless and until DG (Systems), CBEC notifies the Custodian of release of its obligations in relation to the said confidential

information;

(v) that CUSTODIAN will not and shall use reasonable endeavors to ensure that its Authorized Personnel do not modify, reverse engineer, de-compile or disassemble any software programs contained in the Confidential Information unless otherwise specified in writing by DG (S), CBEC; and

(vi) to put in place such reasonable methods of control as CUSTODIAN deems necessary to ensure that no person in its employment, except the Authorized Personnel, is able to copy, transfer, or take away Confidential Information at any time unless otherwise agreed in writing by DG (S) CBEC. If such person leaves the CUSTODIAN’s employment at any time or for any reason before the expiry of confidentiality obligations mentioned in this Agreement, CUSTODIAN shall ensure that such person is debriefed appropriately.

b) Confidential information does not include information which:

(i) the CUSTODIAN knew or had in its possession, prior to disclosure, without limitation on its confidentiality;

(ii) is independently developed by the CUSTODIAN without breach of conditions under this agreement;

(iii) information in the public domain as a matter of law;

(iv) is received from a third party not subject to the obligation of confidentiality with respect to such information provided the third party has not disclosed the information for or on behalf of CBEC or as a third party vendor of CBEC;

(v) is released from confidentiality with the written consent of DG (Systems), CBEC.

The CUSTODIAN shall have the burden of proving hereinabove are applicable to the information in

the possession of the CUSTODIAN.

c) Notwithstanding the foregoing, the CUSTODIAN acknowledges that the nature of activities to be performed as part of the Connectivity process may require the CUSTODIAN’s personnel to be present on premises of DG (Systems) or may require the CUSTODIAN’s personnel to have access to software, hardware, computer networks, databases and storage media of DG (Systems) while on or off premises of DG (Systems). It is understood that it would be impractical for DG (Systems) to monitor all information made available to the CUSTODIAN’s personnel under such circumstances and to provide notice to the CUSTODIAN of the confidentiality of all such information. Therefore, the CUSTODIAN agrees that any technical or business or other information of DG (Systems) that the CUSTODIAN’s personnel, representatives or agents acquire while on DG (Systems) premises, or through access to DG (Systems) computer systems or databases while on or off DG (Systems) premises, shall be deemed confidential information.

d) Confidential information and any derivatives thereof shall at all times remain the sole and exclusive property of DG (Systems). All confidential information and derivatives thereof shall be returned to DG (Systems) promptly after receipt of request by CUSTODIAN from the DG (systems) in this regard, together with any available copies with CUSTODIAN thereof and CUSTODIAN shall not retain any copy of the Confidential Information of DG (systems) with itself except as may be required by law.

e) In the event that the CUSTODIAN hereto becomes legally compelled to disclose any confidential information, the CUSTODIAN shall give sufficient notice to DG (Systems) to enable DG (Systems) to prevent or minimize to the extent possible, such disclosure. CUSTODIAN shall not disclose to a third party any confidential information or the contents of this Tender without the prior written consent of DG

(Systems). The obligations of this Clause shall be satisfied by handling Confidential

confidential information but in no event less than reasonable care.

f) The obligations herein shall survive the completion or cancellation of the Connectivity process.

g) CUSTODIAN shall not assign or transfer any rights or obligations under this Agreement without the prior written consent of DG (systems). No waiver or amendment of any term or condition of this Agreement will be effective unless made in writing and signed by both parties.

h) CUSTODIAN acknowledges that any unauthorized disclosure or unauthorized use of the Confidential Information by the CUSTODIAN may cause immediate and irreparable harm to DG (systems) for which damages or injury sustained by DG (systems) may be impossible to measure accurately or remedy fully. Therefore, CUSTODAIN acknowledges that in the event of such a breach, DG (Systems) shall have the right to seek injunctive relief without prejudice to its all other legal rights.

i) If any provision of this Agreement is determined to be invalid in whole or in part, the remaining provisions shall continue in full force and effect as if this Agreement had been executed without the invalid provision.

j) This Agreement shall be governed by and construed in accordance with the laws of India, without giving effect to conflict of law rules. The competent courts of New Delhi shall have jurisdiction in connection with any dispute arising under this Agreement.

k) This Agreement shall come into force and effect on .
